Vice Chair Elston read the rules and regulations of the Zoning Board of Adjustment. She stated alternate Board Member Thomas Clemmons is acting in place of an absent member and would be voting on the item. Vice Chair Elston opened the public hearing, and called for Principal Planner Clayton Husband to introduce the request. Mr. Husband introduced the request. Vice Chair Elston called for the applicant to be sworn in and present the request. Chris Trent, 7301 Smithfield Road, North Richland Hills, Texas 76180, was sworn in by Vice Chair Elston and presented the request. Board member Kemp and Mr. Trent discussed the drainage easement on the property. Board member Gibbs and Mr. Trent discussed the square footage of the house being built on the property. Vice Chair Elston stated the public hearing was open and called for anyone wishing to speak for or against the request to come forward. Doug Terry, 444 East Dallas Road, Grapevine, Texas, 76501 spoke in favor of the request. PRESENTER: Clayton Comstock, Planning Director SUMMARY On behalf of Convergence Capital LLC, Rhonda Berry is requesting approval of a variance to the screening wall and fence criteria to allow a waiver of the masonry screening wall requirement adjacent to the Hawk's Ridge subdivision. The 8.443-acre property is located at 8800 Mid-Cities Boulevard. BACKGROUND INFORMATION The property is located on the north side of Mid-Cities Boulevard across from Birdville High School. The overall site extends from just east of Hawk Avenue to The Home Depot property. A preliminary plat of the property was approved by Planning and Zoning Commission in June 2019, and the plat includes twelve lots for office and retail development. A final plat of the four westernmost lots was approved by City Council in October 2019, and Lot 4 in the final plat is the subject of the variance request (see exhibit at right). The lot abuts three single-family residential lots to the - -- - ---- .. north. The applicant has submitted an application for a variance to waive the masonry screening wall requirement as it applies to the three lots on the north side. - Lu Y F The variance application and supporting 1 9W I LF F ) ikc es materials are attached. The materials include a copy of the application explaining the reasoning for the variance request, the final plat, a buffer yard exhibit, and photos. An analysis of the request and relevant codes is below. "K NOKTH KICHLAND HILLS ANALYSIS The lot in question is 44,943 square feet in area and 233.94 feet wide at the rear property line. The property is zoned C-1 (Commercial). The lot is part of a proposed 8.4-acre office and retail development called Berry Creek Village. The variance request is related to the masonry screening standards contained in Sc ct.J.2 D. q Y g �" ro ,,1,11,E , ; ,11 of the zoning ordinance. This section requires that a minimum six-foot tall masonry screening wall be constructed along the entire length of the common property line between commercial and residential property as part of new building construction on a commercial lot. The developer of the commercial property is required to construct the wall. The owner is requesting a variance to waive the masonry screening wall requirement as it applies to the three residential lots on the north side of the property. The three lots are located on Michelle Lane in the Hawk's Ridge subdivision. There is an existing retaining wall on the rear property lines that was constructed as part of the subdivision development. The retaining wall is approximately 230 feet long and averages four feet in height. A six-foot tall wood fence is constructed on top of the retaining wall. The exhibits below show photos of the property and the extent of proposed variance request relative to the entire property. The regulations require a 15-foot 1 wide buffer yard that includes one large tree for each 30 linear feet. In the subject area, eight (8)trees are required. In exercising it powers to grant a variance, the board of adjustment must make specific findings and show in its minutes that- a. Literal enforcement of the controls will create an unnecessary hardship or practical difficulty in the development of the affected property. b. The situation causing the hardship or difficulty is neither self-imposed nor generally affecting all or most properties in the same zoning district. c. The relief sought will not injure the permitted use of adjacent conforming property. d. The granting of the variance will be in harmony with the spirit and purposes of these regulations. OPTIONS FOR BOARD CONSIDERATION The Zoning Board of Adjustment has the following options on this application. 1. Approve the variance as presented. This action would waive the requirement for a minimum 6-foot masonry screening wall as proposed. 2. Approve the variance with conditions. This action would waive the requirement to construct a minimum 6-foot masonry screening wall subject to conditions as directed by the Board, such as landscaping or other applicable conditions. 3. Deny the variance. This action would require the commercial property owner to construct the masonry screening wall. List the pertinent section(s)of the zoning ordinance and indicate the specific variances being requested. If necessary, use a separate sheet. Ordinance: A minimum 6-foot tall masonry screening wall is required by Sec. 118-872 of the City of North Richland Hills Code of Ordinances to be installed by a commercial development when adjacent to residential. Variance: Request to waive installing the required screening wall for the approximately 230 feet along the current stone retaining wall that lines the Hawkes Ridge Addition-lots 6, 7 and 8 due to hardship. 2. State the grounds for the request and describe any special conditions that cause hardships that, in your opinion,justify the variance(s) being requested. Examples of special conditions are:topography, creeks, utility lines, irregular lot or tract shapes, etc. The Zoning Board of Adjustment must determine that special conditions exist before making a motion to approve a request. If it is determined that special conditions do not exist,the motion must be to deny the request. If necessary, use a separate sheet. Convergence Capital is asking for a variance to waive the install of a commercial screen wall between Hawkes Ridge Development lots 6, 7 and 8 due to an existing stone retaining wall with a 6 foot wood privacy fence that exists for this portion of the north property line of Berry Creek Development. Hawkes Ridge stone retaining wall stands approximately 41/2 feet to 3 feet tall with a 6 foot wood privacy fence on top and is approximately 230 feet long. In my opinion,the retaining wall is not structurally designed to hold the weight of a commercial screen wall. The retaining wall is also compromised and has many visible cracks. In addition, placing the commercial screen wall in front of the existing retaining wall does not make sense and does not fall in line with the general character of the development nor does it provide the intent of the code since the Hawkes Ridge Property is elevated. 3. Explain any special circumstances, if applicable, not considered by the zoning ordinance. Examples: (1) if the subdivision plat was approved prior to the current zoning ordinance requirements; or (2) the zoning ordinance was amended or a policy change was adopted after submitting an application for a building permit or other phase of the development process. If necessary,use a separate sheet. Convergence Capital has been working with the homeowners of the Lots 6,7 and 8 in Hawkes Ridge. PRESENTER: Clayton Comstock, Planning Director SUMMARY On behalf of Rufsnow NRH Investments Inc., Erick Canas is requesting approval of a variance to refuse container setback requirements to allow a refuse container to be placed in front of the building on the property. The site is located at 3732 Rufe Snow Drive. BACKGROUND INFORMATION The property is located on the east side of Rufe Snow Drive between Onyx Drive North and Harmonson Road, immediately north of Cable Electric. The site is approximately 20,000 square feet in area with 100 feet of frontage on Rufe Snow Drive. The property is developed with an existing commercial building initially constructed in 1973. In 2019, the previous owner renovated the building and constructed site improvements such as a parking lot, landscaping, and signage. A site plan for the property was approved in 2018, and a copy is attached. Due to the existing location of the building and layout of the site, the previous owner indicated there were no plans to place a refuse container on the site. The building is located at the extreme rear of the property, with parking and landscaped areas between the building and street. Potential tenants would be expected to use curbside solid waste service or other alternative services. The property was sold in November 2019, and the new owner intends to operate a commercial bakery on the site. The proposed use of the property would require a container to be placed on the property. However, the layout of the site does not provide an appropriate location for the container and enclosure on the property. The container and enclosure are proposed to be located in an area adjacent to existing parking spaces on the north side of the lot. The owner is seeking a variance from the setback standards to accommodate the location. The owner is requesting a variance to allow the enclosure to be placed at the location shown below. The proposed location for the enclosure would result in the functional loss of two of the parking spaces due to the swing path of the gates on the enclosure. The proposed use requires six (6) parking spaces, and there are 15 spaces provided on the property. The loss of the two parking spaces would not reduce the number of spaces below the minimum requirements.
