A. CALL TO ORDER
Mayor Trevino stated in accordance with the Texas Governor's March 13, 2020
Disaster Declaration and subsequent suspension of certain Texas Open Meetings Act
Provisions, this May 4, 2020 meeting of the North Richland Hills City Council is
hereby called to order at 6:00 p.m.
Mayor Trevino stated that tonight's meeting will be conducted using Webex video
conference in order to observe physical distancing to mitigate the spread of COVID-19.
Mayor Trevino conducted a roll call of City Council members to confirm the presence of
a quorum.

A.2 PLEDGE
Council member Orr led the Pledge of Allegiance to the United States and Texas flags.
A.3 CITIZENS PRESENTATION
There were no requests to speak from the public.
A.4 PUBLIC COMMENTS
Mr. Landon lilies, Mountasia General Manager, 8851 Boulevard 26, reviewed Mountasia's
tiered approach for reopening to the public. Their plan is to begin with miniature golf that
will include a limited number of guests at each hole. They will provide signage for social
distancing. The tiered roll-out will be followed by the batting cage, go karts and kid rides.
The arcade room will be the last to open. Mr. lilies mentioned that they would keep their
capacity to 125 guests. They have floor markings inside the building and signage at the
front entrance/counter. They had a soft opening earlier this week. asked council to
oconsider that they can open up at a tiered approach.
Mayor Trevino asked City Attorney Maleshia McGinnis how Mountasia's business is
identified in the county and state orders.
Ms. McGinnis informed City Council the governor's order separates businesses into two
categories--essential business or reopened business. The reopened businesses as they
are defined, do not include amusement parks or similar types of facilities. Ms. McGinnis
informed City Council that Mr. lilies will need to contact Texas Department of Emergency
Management to receive a recommendation or designation for Mountasia's type of
business to be reopened.
B. GENERAL ITEMS
B.1 CONSIDER ORDINANCE NO. 3644, RELATING TO THE DECLARATION OF
LOCAL DISASTER FOR PUBLIC HEALTH EMERGENCY DUE TO THE
COVID-19 PANDEMIC.
APPROVED
Director of Public Safety Jimmy Perdue informed City Council that Governor Abbott, on
April 27, 2020, issued two Executive Orders--GA-18 and GA-19. Executive Order GA-18
supersedes any conflicting order issued by local officials in response to the COVID-19
disaster and prohibits local officials from imposing restrictions inconsistent with GA-18.
Mr. Perdue informed City Council that staff is recommending approval of Ordinance No.
3644. The proposed ordinance supersedes all North Richland Hills Declarations of Local

Disaster due to Public Health Emergency; is coterminous with the State of Disaster
issued by Governor Abbott on March 13 2020, as may be subsequently extended,
amended or renewed; and creates a class C misdemeanor for any person, firm,
corporation, agent or employee who violates any provision of the ordinance.
A MOTION WAS MADE BY MAYOR PRO TEM WRIGHT OUJESKY, SECONDED BY
ASSOCIATE MAYOR PRO TEM RODRIGUEZ TO APPROVE ORDINANCE NO. 3644.
MOTION TO APPROVE CARRIED 6-0.
B.2 CONSIDER ORDINANCE NO. 3645, ESTABLISHING A TEMPORARY
MORATORIUM ON ALL DOOR-TO-DOOR SOLICITATION ACTIVITIES AND
DISTRIBUTION OF HANDBILLS AUTHORIZED BY THE CITY CODE OF
ORDINANCES, CHAPTER 18, ARTICLE VII, SOLICITORS AND HANDBILLS.
APPROVED
City Secretary Alicia Richardson informed City Council with the previous action to
approve Ordinance No. 3644, a separate ordinance is required to establish a temporary
moratorium on all door-to-door solicitation activities and distribution of handbills. If the
ordinance is approved, no new permits shall be issued for door-to-door solicitation or for
the distribution of handbills. Upon expiration or termination of the moratorium, all current
solicitor's and handbill permits shall be extended by the time period equal to the length of
the time the moratorium is in effect, except that no handbill permit shall be extended for
longer than thirty (30) days. The time period for extension shall be calculated beginning
April 10, 2020.
A MOTION WAS MADE BY COUNCIL MEMBER COMPTON, SECONDED BY MAYOR
PRO TEM WRIGHT OUJESKY TO APPROVE ORDINANCE NO. 3645, WITH THE
MORATORIUM ENDING JUNE 8,2020.
MOTION TO APPROVE CARRIED 6-0.
