In compliance with the Texas Open Meetings Act and in accordance with
Section 418.016 of the Texas Government Code and such action issued by
the Governor of Texas on March 16, 2020, the North Richland Hills City
Council will conduct its regular meeting via video conference in order to
advance the public health goal of limiting face-to-face meetings (also called
"social distancing") to slow the spread of the Coronavirus (COVID-19). There
will be no public access to the City Hall location described above, unless
otherwise noted.

General Description:
Mr. Roger Price made a presentation on July 27, 2020 regarding the ability for him to
open up a sweepstakes business in North Richland Hills. He requested the City Council
look into the matter and assist him with getting this business open. Staff will address the
issue during work session and inform the City Council on what action has been taken.

The City Secretary's Office prepares action minutes for each City Council meeting. The
minutes for the previous meeting are placed on the consent agenda for review and
approval by the City Council, which contributes to a time efficient meeting. Upon
approval of the minutes, an electronic copy will be uploaded to the City's website.

Mayor Trevino stated that tonight's meeting will be conducted using Webex video
conference in order to observe physical distancing to mitigate the spread of COVID-19.

made aware that the zoning does not allow sweepstake businesses. Mr. Price
commented that he would love to do business in North Richland Hills and to assist the
police department via his sweepstake business.

C. PUBLIC HEARINGS
CA PUBLIC HEARING AND DISCUSSION ON UPDATING IMPACT FEES FOR
WATER AND WASTEWATER AND AMENDING IMPACT FEE REGULATIONS,
PURSUANT TO CHAPTER 395 OF THE LOCAL GOVERNMENT CODE.
Mayor Trevino opened the public hearing for item C.1 and called on Director of Public
Works Caroline Waggoner to introduce items C.1 and E.1.
Ms. Waggoner informed City Council a correction to the service unit equivalent for
wastewater is required in the Impact Fee Study based on a technical memorandum
provided by the study consultant, Freese & Nichols. The study document indicated the
service unit equivalent for wastewater was lower than water. The meter unit equivalents
should be identical for both water and wastewater. Item E.1 , Ordinance No. 3656,
amends the service unit equivalent and updates the City's fee schedule. The proposed
ordinance will not alter the impact fee rates identified in the Impact Fee Study approved
by City Council. The ordinance amends Table 4 - North Richland Hills Meter/Service Unit
Equivalency. State law requires the governing body to conduct a public hearing prior to
revisions to the Impact Fee Study.
Mayor Trevino asked Assistant City Secretary Traci Henderson to call on those who
completed a public meeting appearance form to speak during the public hearing. There
being no one wishing to speak, Mayor Trevino closed the public hearing.

AGREEMENT WITH BISD.

Director of Public Works Caroline Waggoner informed City Council the request is to
abandon a water line easement, instrument number D216158176 as recorded with the
deed records of Tarrant County. The easement was granted in May 2016 for placement
of a fire hydrant. The construction of a new campus required the relocation of the water
main and fire hydrant and the easement is no longer necessary. Ms. Waggoner
informed City Council that Birdville Independent School District has executed a release
agreement and a quitclaim deed will be required from the City.

Director of Public Works Caroline Waggoner informed City Council the Glenview Drive
East project consists of engineering and construction of approximately 2,700linear feet
of Glenview Drive from Boulevard 26 to Flory Street. The improvements include the
reconstruction of the existing roadway with concrete and addition of sidewalks where
possible. The reconstruction will not expand the roadway. Staff recommends City
Council approve the professional service agreement for engineering design services with
Baird, Hampton & Brown, Inc.

OBLIGATION IN AN AMOUNT NOT TO EXCEED $2,075,000.

Director of Finance Mark Mills informed City Council the amended budget for Fiscal Year
2019/2020 includes two projects--Iron Horse Boulevard reconstruction and Hightower /
Davis Boulevard signal ization--that will be financed with Certificates of Obligation. State
law requires specific notification prior to the issuance of Certificates of Obligation. The
resolution, if approved, authorizes and directs staff to publish the notice of intent to issue
Certificates of Obligation in the amount not to exceed $2,310,000. Mr. Mills informed City
Council the caption on the agenda and the resolution had an incorrect amount of
$2,075,000. The memorandum in the agenda packet had the correct number in the
amount not to exceed $2,310.000. Mr. Mills informed City Council the notice, if approved,
will publish on Wednesday, July 29 and the following Wednesday, August 5, 2020. The
anticipated sale date is September 14, 2020.

VOTER-APPROVAL TAX RATE, AND PERFORMING ALL OTHER DUTIES
AND OBLIGATIONS NECESSARY TO EFFECT SUBMISSION OF THE TAX
RATE TO THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS IN

Director of Budget and Research Robert Myers informed City Council state law requires
the City Council designate an officer to be responsible for the calculation of the
no-new-revenue tax rate, voter-approval tax rate and to perform other duties and
obligations related to submission of the tax rate to the City Council. Resolution No.
2020-030, designates the Director of Finance as the primary and Director of Budget and
Research as the secondary officer or employee responsible for the City in the
calculation of the no-new revenue tax rate, voter-approval tax rate, and other obligations
required by Chapter 26 of the Texas Tax Code.

F.3 CONSIDER RESOLUTION NO. 2020-031, DIRECTING THE DESIGNATED
OFFICER TO CALCULATE THE VOTER-APPROVAL TAX RATE FOR THE
CITY OF NORTH RICHLAND HILLS IN ACCORDANCE WITH TEXAS TAX
CODE 26.04 (C-1).
Director of Budget and Research Robert Myers informed City Council the item for their
consideration is to direct the designated officer to calculate the voter-approval tax rate for
the City of North Richland Hills in accordance with the Texas Tax Code Section
26.04(c-1). The section allows any City to calculate the voter-approval tax rate in a
manner provided for a special taxing unit if any part of the taxing unit is located in an

area that is declared a disaster area during the current tax year by the governor of the
state or by the President of the United States. The change provides for a taxing unit to
calculate the voter-approval tax rate from a 3.5% increase over the no-new revenue tax
rate to an 8% increase over the no-new revenue tax rate. Based on staff's additional
research, staff is recommending no action from City Council.

Director of Budget and Research Robert Myers informed City Council this item sets the
date of Thursday August 13, 2020 for public hearings on the Revised Fiscal Year
2019/2020 budgets for the Park and Recreation Facilities Development Corporation,
Crime Control and Prevention District, and City Council. The public hearing for the Park
and Recreation Facilities Development Corporation is scheduled for 6.30 p.m., Crime
Control and Prevention District is scheduled for 6.40 p.m. and City Council scheduled for
7.00 p.m.
Mr. Myers also presented item F.5, which sets the date of Thursday August 13, 2020 for
public hearings on the Proposed Fiscal Year 2020/2021 budgets for the Park and

be compensated by the Presiding Judge to serve during his absence.

citizen emailed praise for the management staff at NRH2O. She stated that both Frank
and Stephanie go above and beyond in providing extraordinary customer service. They

integrity, respect, diversity, safety, and inclusion. In an era where one-to-one customer
service is a rarity, Mr. Perez and Ms. Hee are a great example for all to follow.

between North Richland Hills and the City of Irving for reimbursement
of overtime salary costs associated with the North Texas Anti-Gang
Center Task Force.

SUMMARY:
City Council is being asked to authorize the City Manager to execute a memorandum of
agreement (MOA) between North Richland Hills (NRH) and the City of Irving (Irving) for
reimbursement of overtime salary costs directly related to work performed by their officer(s)
assigned to the North Texas Anti-Gang Center Task Force (TAG).
GENERAL DESCRIPTION:
The North Richland Hills Police Department, in cooperation with law enforcement agencies
across the area, supports the TAG in its mission to reduce violent crime and related activities
that are perpetrated by gangs. Local municipal and county agencies that have officer(s)
assigned to TAG investigations are responsible for making payments of overtime to the
officer(s) during the period of assignment to TAG. Subject to availability of funds and to the
extent they are included in TAG's approved fiscal year budget, NRH, as the fiduciary agent
for the grant funding the TAG, will reimburse Irving for overtime payments made to the
officer(s) participating in the TAG, up to a maximum sum equivalent to 25 percent of the
salary of a GS-12, Step 1-RUS Employee. The term of this MOA shall be for TAG budget
year 2019-2020 and be effective from September 1, 2019 until August 31, 2020. NRH will
be responsible only for obligations incurred by the agencies during the term of this MOA.
RECOMMENDATION:

This Memorandum of Agreement, hereinafter referred to as "MOA," is effective as of the 11t day of September, 2019
between the City ofNorth Richland Hills, hereinafter referred to as "NRH," and the City ofIrving, hereinafter referred
to as "Irving" each parties to that certain Local Administrative Agreement between the Constituent Agencies of the
Texas Anti-Gang Center ("ILA"), for the purpose of reimbursement of overtime salary costs directly related to work
performed by the Irving officer(s) in providing resources to assist the North Texas Anti-Gang Center Task Force,
hereinafter referred to as "TAG."
U, CONDITIONS AND PROCEDURES
A, Irving will be responsiblefor making payments of overtimeto its officer(s) cluringthe period of assignment to TAG.
Subject to availability of funds and to the extent they are included inTA5's approved fiscal year budget, NRH will

On behalf of Wildcat Reserve LLC, Douglas Orr is requesting approval of a final plat of
Lot 22, Block 1, Parkridge Estates. This 1.61-acre property is located at 4801 Rufe Snow

GENERAL DESCRIPTION:
The property is located on the west side of Rufe Snow Drive between Carston Court and
Parkridge Drive. The property is currently an unplatted tract of land with a single-family
residence. The proposed final plat is intended to create one single-family residential lot
for the purpose of constructing a new permanent accessory building.

SUMMARY:
Consideration of a contract for assessment and collection services by the Tarrant County
Tax Assessor/Collector and Tarrant County for the City Point PID Improvement Zone A
(642).
GENERAL DESCRIPTION:
The area surrounding City Hall, known as City Point, is the former location of North Hills
Mall. At the request of the property owner, City Council approved the creation of the City
Point Public Improvement District (PID) to facilitate the construction of authorized public
improvements to expedite the timing and enhance the quality of development. A PID is a
designated area where property owners pay a special assessment for improvements and
services within that area.
Pursuant to the provisions of Chapter 372 of the Texas Local Government Code (PID
Act), on December 9, 2019, the City Council passed Ordinance No. 3625, which approved
the Service and Assessment Plan for the PID and levied assessments against the
assessable properties within Improvement Zone A.
This City currently outsources the ad valorem tax assessment and collection function to
Tarrant County. Attached to this item is a proposed two-year agreement between the
City, Tarrant County Tax Assessor/Collector and Tarrant County to include City Point PID
Improvement Zone A (642) for assessment and collection services through the 2021 tax
year.
The compensation for Tarrant Tax Assessor services rendered is $.98 per account, with
Linebarger Goggan Blair & Sampson, LLP servicing delinquent accounts.
RECOMMENDATION:
Authorize the City Manager to enter into a contract with Tarrant County Tax
Assessor/Collector and Tarrant County for the assessment and collection services of
special assessments levied for the City Point PID Improvement Zone A (642).
§ Agreement for the Collection of Special Assessments
COUNTY OF TARRANT §
Agreement made this day of 2020, by and between the Tarrant County Tax
Assessor/Collector,hereinafter referred to as"ASSESSOR/COLLECTOR,"and Tarrant County,hereinafter referred to
as the"COUNTY,"both of whom are addressed at 100 East Weatherford Street,Fort Worth,Texas 76196-0301,and the
City Point PID Improvement Zone A(642),hereinafter referred to as"City Point PID A"whose address is 4301 City
Point Drive,North Richland Hills,Texas 76180.
PURPOSE OF AGREEMENT
The purpose of this Agreement is to state the terms and conditions under which the ASSESSOR/COLLECTOR will
provide assessment and collection services of special assessments levied by the City Point PID A, in accordance with
Chapter 372 of the Texas Local Government Code(the"Assessments").
NOW THEREFORE,in consideration of the mutual promises herein contained,the parties hereto agree as follows:
I.
SERVICES TO BE PERFORMED
The ASSESSOR/COLLECTOR agrees to bill and collect the assessments due and owing on property upon which the City
Point PID A has imposed said assessments. The ASSESSOR/COLLECTOR shall perform the said services in the same
manner and fashion as Tarrant County collects its own taxes due and owing on taxable property. The services performed
are as follows: receiving the Certified Appraisal Roll from the appropriate Appraisal District and monthly changes thereto;
providing mortgage companies,property owners and tax representatives assessment roll and payment data;providing all
necessary Assessments and Truth in Taxation calculations as required; the transmittal of assessment statements via the
U.S.Mail or electronic transfer of data;and payment processing. All City Point PID A disbursements,made by check or
by electronic transfer(ACH), for collected tax accounts will be made to the City Point PID A on the day the COUNTY
Depository Bank indicates the mandatory assigned "float" period has elapsed and the funds are posted to the collected
balance.If any daily collection total is less than one hundred dollars($100.00),the disbursement may be withheld until the
cumulative total of taxes collected for the City Point PID A equals at least one hundred dollars($100.00),or at the close
of the month.
II.

The ASSESSOR/COLLECTOR will provide the City Point PID A the following reports via internet access:

III.
COMPENSATION
Inconsideration of the services to be performed by the ASSESSOR/COLLECTOR,compensation for the services rendered
is a rate of ninety-eight cents ($0.98)per account located within Tarrant County, and two-dollars ($2.00)per account
located outside Tarrant County. The number of accounts will be based on the ending number of accounts on the certified
roll as of September 30'for the previous year as provided by the Appraisal District The ASSESSOR/COLLECTOR will
invoice for all these accounts by January 31 of each contract year with payment to be received from the City Point PID
A by February 28 of each contract year.
The scope of services identified in this contract does not include the administration of a rollback election. In the event of
a successful rollback election,these costs incurred by the Tarrant County Tax Office will be separately identified,billed,
and paid by the entity.
IV.
A UDITS
The ASSESSOR/COLLECTOR will provide to the City Point PID A auditor necessary explanations of all reports and
access to ASSESSOR/COLLECTOR in-house tax system computer terminals to assist the City Point PID A auditor in
verifying audit samples of the financial data previously provided by the ASSESSOR/COLLECTOR during the past audit
period. Additional support for entity verification or entity auditor verification is not a part of this contract. Each request
for support will be reviewed individually. Costs for providing audit support will be determined by the
ASSESSOR/COLLECTOR and will be charged to and must be paid by the City Point PID A.
V.
TAX RATE REQUIREMENT
The City Point PID A will provide the ASSESSOR/COLLECTOR copies of the resolution, ordinance, or order
signed by the governing body adopting the City Point PID A's current assessment rates and exemption schedules
to be applied for assessing purposes along with a copy of the rate calculation worksheets,if applicable,by the third
Wednesday in September of each contract year. Under authority of Section 31.01 (h)of the Property Tax Code,any
additional cost of printing and mailing tax statements because of late reporting of the assessment rates or the exemption
schedules will be charged to and must be paid by the City Point PID A. Any additional cost or expense requiring
recalculation or rebilling due to an inaccurate or erroneous tax rate provided by City Point PID A will be paid by City Point
PID A.
The assessment rates and the exemption schedules,if any, for each of the last five (5)years in which an assessment was
levied, or all prior years where there remain delinquent assessments, must be furnished in writing to the
ASSESSOR/COLLECTOR at the time of the initial contract.
VI.
COMPLIANCE WITHAPPLICABLE
STATUTES,ORDINANCES,AND REGULATIONS
In performing the services required under this Agreement,the ASSESSOR/COLLECTOR shall comply with all applicable
federal and state statutes, final Court orders and Comptroller regulations. If such compliance is impossible for reasons
beyond its control, the ASSESSOR/COLLECTOR shall immediately notify the City Point PID A of that fact and the
reasons therefore.
VIL
DEPOSIT OF FUNDS
All funds collected by the ASSESSOR/COLLECTOR in the performance of the services stated herein for the City Point
PID A shall be promptly transferred to the account of the City Point PID A at the City's depository bank. All payments to
entities will be made electronically either by the automated clearing house(ACH)or wire transfer. Wire transferred funds
will incur an additional fee,which will be charged back to the City Point PID A and deducted from those collected funds.
The transfer fees charged will be the same fees charged to the COUNTY by its bank depository. If the City Point PID A
desires its tax disbursements to be made by wire transfer the ASSESSOR/COLLECTOR has no liability for the funds after

initiation of the wire transfer of the City Point PID A's funds from the COUNTY Depository to the City Point PID A's
designated depository. ASSESSOR/COLLECTOR has the authority to temporarily suspend payments to City Point PID
A due to unforeseen or unanticipated circumstances.
VIIL
INVESTMENT OF FUNDS
The City Point PID A hereby agrees that the COUNTY, acting through the County Auditor, may invest collected
assessment funds of the City Point PID A during the period between collection and payment. The COUNTY agrees that
it will invest such funds in compliance with the Public Funds Investment Act. The COUNTY further agrees that it will
pay to the City Point PID A all interest or other earnings attributable to taxes owed to the City Point PID A. All parties
agree that this Agreement will not be construed to lengthen the time period during which the COUNTY or the
ASSESSOR/COLLECTOR may hold such funds before payment to the City Point PID A.
IX.
REFUNDS
Refunds will be made by the ASSESSOR/COLLECTOR except as set forth herein. The ASSESSOR/COLLECTOR will
advise the City Point PID A of changes in the assessment rolls which were mandated by the appropriate Appraisal District
The ASSESSOR/COLLECTOR will not make refunds on prior year paid accounts unless the prior year paid accounts for
the past five(5)years are provided to the ASSESSOR/COLLECTOR.
If the amount of refunds processed for City Point PID A exceeds collections for City Point PID A,City Point PID A will
be placed in a negative status and no distributions made to City Point PID A until collections exceed the negative balance.
All refunds of overpayments or erroneous payments due,but not requested,and as described in Section 31.11 of the Texas
Property Tax Code, will after three (3) years from the date of payment, be proportionately disbursed to those entities
contracting with the ASSESSOR/COLLECTOR. The contract must have been in force,actual assessment and collection
functions begun and the tax account was at the time of the over or erroneous payment within the City Point PID A's
jurisdiction. The proportional share is based upon the City Point PID A's percent of the tax account's total levy assessed
at the time of receipt of the over or erroneous payment.
In the event any lawsuit regarding the collection of assessments provided for in this agreement to which the City Point PID
A is a party, is settled or a final judgment rendered, and which final judgment is not appealed, and the terms of such
settlement agreement or final judgment require that a refund be issued by the City Point PID A to the taxpayer,such refund
shall be made by ASSESSOR/COLLECTOR by debiting funds collected by the ASSESSOR/COLLECTOR on behalf of
the City Point PID and remitting such refund to the taxpayer in conformity with the terms of the settlement agreement or
final judgment.
X.
DELINQUENT COLLECTIONS
The ASSESSOR/COLLECTOR will assess and collect the collection fee pursuant to Sections, 33.07,33.08,33.11 and
33.48 of the Property Tax Code, when allowed. The ASSESSOR/COLLECTOR will collect attorney fees that are
specified by the City Point PID A through written agreement with a delinquent collection Attorney. The
ASSESSOR/COLLECTOR will disburse the amount directly to the City Point PID A for compensation to a firm under
contract to the City.
If the delinquent collection Attorney contracted by the City Point PID A requires attendance of ASSESSOR/COLLECTOR
personnel at a court other than the District Courts in downtown Fort Worth,and the COUNTY is not a party,the employee's
expenses and proportionate salary will be the responsibility of the City Point PID A and will be added to the collection
expenses and charged to the City Point PID A.
The ASSESSOR/COLLECTOR will not be responsible for the collection of prior year delinquent accounts unless all

XF
TERM OF AGREEMENT
This Agreement shall become effective as of the date hereinabove set out and shall continue in effect through the 2021 tax
year,unless sooner terminated by providing sixty(60)day written notice,as outlined in paragraph XII.
XIL
NOTICES
Any notices to be given hereunder by either party to the other may be affected by e-mail,or in writing,either by personal
delivery or by mail,registered or certified,postage prepaid with return receipt requested. Mailed notices shall be addressed
to the address of the parties as they appear in the introductory paragraph of this Agreement,but each party may change
this address by notice in accordance with this paragraph.
XIIL
MISCELLANEOUS PROVISIONS
This instrument hereto contains the entire Agreement between the parties relating to the rights herein granted and
obligations herein assumed. Any oral representations or modifications concerning this instrument shall be of no force or
effect.
This Agreement shall be construed under and in accordance with the laws of the State of Texas,and all obligations of the
parties created hereunder are performable in Tarrant County,Texas.
This Agreement shall be binding upon and inure to the benefit of the parties hereto and their respective legal representatives
and successors.
In case any one or more of the provisions contained in this Agreement shall for any reason be held to be invalid,illegal,or
unenforceable in any respect, such invalidity,illegality,or enforceability shall not affect any other provision hereof and
this Agreement shall be construed as if such invalid,illegal,or unenforceable provisions had never been contained.
This Agreement and the attachments hereto constitutes the sole and only agreement of the parties hereto and supersedes
any prior understandings or written or oral agreements between the parties respecting the within subject matter.

Any notices to be given hereunder by either party to the other may be affected by e-mail,or in writing,either by personal

this address by notice in accordance with this paragraph.
XIIL
MISCELLANEOUS PROVISIONS
This instrument hereto contains the entire Agreement between the parties relating to the rights herein granted and
obligations herein assumed. Any oral representations or modifications concerning this instrument shall be of no force or
effect.
This Agreement shall be construed under and in accordance with the laws of the State of Texas,and all obligations of the
parties created hereunder are performable in Tarrant County,Texas.
This Agreement shall be binding upon and inure to the benefit of the parties hereto and their respective legal representatives
and successors.
In case any one or more of the provisions contained in this Agreement shall for any reason be held to be invalid,illegal,or
unenforceable in any respect, such invalidity,illegality,or enforceability shall not affect any other provision hereof and
this Agreement shall be construed as if such invalid,illegal,or unenforceable provisions had never been contained.
This Agreement and the attachments hereto constitutes the sole and only agreement of the parties hereto and supersedes
any prior understandings or written or oral agreements between the parties respecting the within subject matter.

SUBJECT: Consider Resolution No. 2020-033, an amended and restated
resolution calling a special election to be held on November 3, 2020
for the design, construction, reconstruction and rehabilitation of
streets, roads, sidewalks, trails and related utility and drainage
improvements in an amount not to exceed $49,875,000.00.

GENERAL DESCRIPTION:
The City Council, at its February 10, 2020 meeting, approved Resolution No. 2020-006.
The resolution called a special election for the purpose of authorizing the issuance of
General Obligation Bonds, in the aggregate principal amount of not more than
$49,875,000, to be held on May 2, 2020.
In less than one month following City Council approval of Resolution No. 2020-006,
calling the special election, the World Health Organization, on March 11, 2020, declared
Coronavirus Disease (COVID-19) a worldwide pandemic. Symptoms of COVID-19
include fever, cough, and shortness of breath, and outcomes have ranged from mild to
severe illness and in some cases death. Subsequently, on March 13, 2020, Texas
Governor Greg Abbott, Tarrant County Judge Glen Whitley, and President Donald
Trump declared state, county and national emergencies due to COVID-19. Texas
Government Code Section 418.108 authorizes the Mayor to declare a state of local
emergency in the event a disaster has occurred or is imminent. On March 13, 2020, the
Mayor of North Richland Hills declared a local disaster to prevent and alleviate the
suffering of the citizens of North Richland Hills and to protect the public health and
safety.
On March 18, 2020, Governor Abbott issued a proclamation (Attachment A) suspending
Sections 41.0052(a) and (b) of the Texas Election Code to the extent necessary to allow
political subdivisions to move their general or special elections to be held on May 2,
2020 to the next uniform election date—November 3, 2020. The proclamation further
provides to the extent necessary a requirement that all county election officers, if
requested by an affected political subdivision, enter into a contract to furnish election
services with any political subdivision who postponed its election to November 3, 2020.

On March 23, 2020, City Council approved Resolution No. 2020-015 to move the
special election to November 3, 2020. This resolution included mandatory information
outlined by the Secretary of State.
o Reference to Governor Abbott's proclamation that authorizes the entity to
postpone its election date, and the fact that the political subdivision is
exercising the authority.
o Confirmation that candidate filings for the election will remain valid for the
election held on the November date and that the filing period will not be re-
opened for the November election date. (not applicable, North Richland
Hills canceled the general election for officers)
o Confirmation that all applications for ballot by mail (ABBMs) for voters that
are voting by mail due to being over the age of 65 or due to a disability will
still be valid for the postponed election, and that ABBMs for voters who
submitted based on expected absence from the county are not valid for
the postponed election.
o Include relevant dates for the November election, to include voter
registration deadline (October 5, 2020), deadline to submit an ABBM
(October 23, 2020), and the dates for early voting (October 19, 2020 —
October 30, 2020).
Most recently, Governor Abbott issued a proclamation (Attachment B), dated July 27,
2020, suspending Sections 85.001(a) and 86.006(a-1) of the Texas Election Code.
• Section 85.001(a) provides for the period for early voting by personal appearance
to begin on the 17t" day before election day and continue through the fourth day
before election day.
o Governor Abbott's proclamation provides for six (6) additional days
of early voting. The proclamation states that the first day of early
voting by personal appearance shall begin on October 13, 2020 and
continue through October 30, 2020.
• Section 86.006(a-1) provides for the method in returning a marked ballot by mail,
carrier or in person.
o Governor Abbott's proclamation provides a voter to deliver a marked
ballot in person to the early voting clerk's office prior to and
including on election day.
Staff has worked with bond counsel to bring forward one resolution that codifies
previous City Council action regarding the November 3, 2020 Special Election. Staff
recommends City Council approve Resolution No. 2020-033.

RESOLUTION NO. 2020-033
AN AMENDED AND RESTATED RESOLUTION CALLING A SPECIAL
ELECTION FOR THE PURPOSE OF AUTHORIZING THE ISSUANCE OF
GENERAL OBLIGATION BONDS, TO BE HELD IN THE CITY OF
NORTH RICHLAND HILLS, TEXAS ON NOVEMBER 3, 2020; MAKING
PROVISION FOR THE CONDUCT OF A BOND ELECTION; AND
RESOLVING OTHER MATTERS INCIDENT AND RELATED TO SUCH
ELECTION.
WHEREAS, the City Council (the "City Council') of the CITY OF NORTH RICHLAND
HILLS, TEXAS (the "City"), located in Tarrant County, Texas (the "County"),
previously adopted Resolution No. 2020-006 calling an election to be held in the
City on May 2, 2020, to determine whether the City Council should be authorized
to issue general obligation bonds of the City; and
WHEREAS, due to the novel coronavirus (COVID-19), the Governor of the State of Texas (the
"State")issued a proclamation(the"Proclamation")allowing political subdivisions
of the State to move their general and special elections to be held on May 2, 2020,
to the next uniform election date, November 3, 2020; and
WHEREAS, on March 23,2020,the City Council adopted Resolution No. 2020-015,postponing
the May 2, 2020, election to November 3, 2020, in accordance with the
Proclamation; and
WHEREAS, the City Council hereby finds and determines that an election (the "Election")
should be held on November 3, 2020, to determine whether the City Council shall
be authorized to issue general obligation bonds of the City in the amount and for
the purposes hereinafter identified;
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
NORTH RICHLAND HILLS, TEXAS THAT:
SECTION 1. This Resolution hereby amends and restates Resolution No. 2020-006 in its
entirety as follows.
SECTION 2. The Election shall be held in the CITY OF NORTH RICHLAND HILLS,
TEXAS on November 3, 2020 ("Election Day"), which is a uniform election date under the Texas
Election Code, and is not less than 78 days nor more than 90 days from the date of the adoption of
this resolution (the "Resolution"), for the purpose of submitting the following proposition to the
qualified voters of the City:
PROPOSITION A
"Shall the City Council of the City of North Richland Hills, Texas be authorized to
issue and sell one or more series of general obligation bonds of the City in the
aggregate principal amount of not more than $49,875,000 for the purpose of

designing, acquiring, constructing, renovating, improving, upgrading, updating,
and equipping City streets, roads, and intersections, and related curb, gutter,
sidewalk,trail,drainage and utility infrastructure improvements,demolition,repair,
and rebuilding of existing streets, completing necessary or incidental utility
relocation and drainage in connection with the foregoing and the acquisition of
land, easements, rights-of-way, and other real property interests necessary therefor
or incidental thereto, such bonds to mature serially or otherwise (not more than 40
years from their date) in accordance with law; and any issue or series of such bonds
to bear interest at such rate or rates (fixed, floating, variable or otherwise) as may
be determined within the discretion of the City Council, provided that such rate of
interest shall not exceed the maximum rate per annum authorized by law at the time
of the issuance of any issue or series of such bonds; and shall the City Council of
the City be authorized to levy and pledge, and cause to be assessed and collected,
annual ad valorem taxes, within the limitations prescribed by law, on all taxable
property in the City sufficient to pay the annual interest and provide a sinking fund
to pay the bonds at maturity and the cost of any credit agreements executed in
connection with the bonds?"
SECTION 3. The City Council authorizes the Mayor, the City Manager, the City
Secretary, or their respective designees, to negotiate and enter into one or more joint election
agreements and/or similar contracts or agreements (collectively, the"Contract")with the County,
acting by and through the County Elections Administrator (the "Administrator"). The Mayor, or
his designee, is hereby authorized to execute the Contract and any other necessary contract(s) and
agreements,joint or otherwise, with the Administrator, or any other public entity, for the purpose
of having the County furnish all or any portion of the election services and equipment needed by
the City to conduct the Election. The contract document and election services provided therein
shall conform to Chapter 31, Subchapter D, of the Texas Election Code and all other applicable
statutes and laws.
A. The City shall be divided into election precincts for this Election and the polling
places designated for each election precinct are shown in Exhibit A, which is attached hereto and
incorporated herein by reference as a part of this Resolution for all purposes. Exhibit A may be
modified to include any changes to polling places designated by the Administrator and to conform
to the County's polling locations, and the City Secretary is authorized to make any conforming
corrections or revisions to Exhibit A. The election officers and maximum number of clerks for
such polling places shall be determined and appointed in accordance with the provisions of the
Contract.
B. On Election Day, the polls shall be open from 7:00 a.m. to 7:00 p.m.
C. The main location, dates and times for early voting for this Election shall be as
shown in Exhibit B,which is attached hereto and incorporated herein by reference as a part hereof
for all purposes. In addition,temporary branch polling places may be authorized and used for early
voting as established by the Administrator. Exhibit B may be modified to include any changes to
early voting designated by the Administrator and to conform to the Contract and the City Secretary
is authorized to make any conforming corrections or revisions to Exhibit B. Additional early
voting locations may be designated by the Administrator. Heider Garcia, Administrator, is hereby

appointed early voting clerk and shall appoint and designate deputy clerks for early voting in
accordance with the Contract. For purposes of processing ballots cast in early voting, the election
officers for the early voting ballot board for this Election shall be appointed and designated in
accordance with the provisions of the Contract.
The Central Counting Station for the tabulation and counting of ballots for this election
shall be located at the Tarrant County Elections Center, 2700 Premier Street, Fort Worth, Texas
76111, and the Manager, Tabulation Supervisor, Programmer, Presiding Judge and Alternate
Presiding Judge at the Central Counting Station shall be appointed and designated in accordance
with the provisions of the Contract.
The Manager and Presiding Judge of the Central Counting Station may appoint clerks to
serve at such Station, as provided by Section 127.006 of the Election Code.
SECTION 4. A voting system or systems meeting the standards and requirements of the
Texas Election Code, as amended, is hereby adopted and approved for early voting by personal
appearance and by mail and for Election Day voting.
SECTION 5: The official ballot shall be prepared in accordance with the Texas Election
Code, as amended, so as to permit voters to vote "FOR" or "AGAINST" the aforesaid measure
which shall appear on the ballot substantially as follows:

"THE ISSUANCE OF $49,875,000 OF CITY OF NORTH RICHLAND HILLS,
TEXAS GENERAL OBLIGATION BONDS FOR STREETS, ROADS,
SIDEWALKS, TRAILS AND RELATED UTILITY AND DRAINAGE
IMPROVEMENTS, THE ACQUISITION OF REAL PROPERTY NECESSARY
OR INCIDENTAL FOR SUCH PURPOSES AND THE LEVYING OF TAXES
SUFFICIENT TO PAY THE PRINCIPAL OF AND INTEREST ON THE BONDS
WILL BE IMPOSED"
SECTION 6. All resident qualified voters of the City shall be permitted to vote at the
Election, and on Election Day, such voters shall vote at the designated polling places. The Election
shall be held and conducted in accordance with the provisions of the Texas Election Code,
Chapters 1251 and 1331 of the Texas Government Code, and as may be required by other
applicable law. To the extent required by law,all materials and proceedings relating to the Election
shall be printed in English, Spanish, and Vietnamese.
SECTION 7. Notice of election, including a Spanish and Vietnamese translation thereof,
shall be published on the same day in each of two successive weeks in a newspaper of general
circulation in the City, the first of these publications to appear in such newspaper not more than
30 days, and not less than 14 days, prior to Election Day. A substantial copy of this Resolution,
including a Spanish translation thereof, shall be posted (i) at City Hall not less than 21 days prior
to Election Day; (ii) at three additional public places within the City not less than 21 days prior to
Election Day, (iii) in a prominent location at each polling place on Election Day and during early

voting, and (iv) in a prominent location on the City's internet website not less than 21 days prior
to Election Day. A sample ballot shall be posted on the City's internet website not less than 21
days prior to Election Day.
SECTION 8. As required by and in accordance with Section 3.009(b)(5) and (7)through
(9) of the Texas Election Code, the City, as of the date of this Resolution, had outstanding an
aggregate principal amount of debt equal to $117,830,000; the aggregate amount of the interest
owed on such City debt obligations, through respective maturity, totaled $28,927,213.92; and the
City levied an ad valorem debt service tax rate for its outstanding debt obligations of$0.237062
per $100 of taxable assessed valuation. The City estimates an ad valorem debt service tax rate of
$0.232089 per $100 of taxable assessed valuation if the bonds that are subject of the Election are
approved and are issued(taking into account the outstanding City bonds, the assumed issuance of
previously authorized but unissued voted bonds and the bonds that are the subject of this Election,
but no other future bond authorizations of the City). The bonds that are the subject of this Election
shall mature serially or otherwise over a specified number of years (not more than 40 years from
their date), in accordance with applicable Texas law, though the City estimates that, based on
current bond market conditions, such bonds will amortize over a 20-year period from their
respective date of issue. The foregoing estimated tax rate and amortization period are only
estimates, provided for Texas statutory compliance, and do not serve as a cap on any City ad
valorem tax rate or the amortization period for bonds that are the subject of this Election.
SECTION 9. The City Council authorizes the Mayor, the City Manager, the City
Attorney,the City Secretary, or their respective designees to make such corrections, modifications
or changes to this Resolution or the Exhibits hereto that are necessary for compliance with
applicable Texas or federal law or to carry out the intent of the City Council, as evidenced herein.
To the extent that any duty or obligation of the City, in general, or any City official, in particular,
is properly delegated to the County pursuant to the Contract, then the County's carrying out those
duties and obligations on the City's behalf pursuant to the terms of such Contract shall be binding
upon the City and are hereby determined by the City Council to be evidence of the City's
compliance with the provisions of applicable Texas law concerning the Election relative to the
same, unless such delegation of duties or obligations is otherwise prohibited by law. By
incorporating all essential terms necessary for a joint election agreement, this Resolution is
intended to satisfy Section 271.002(d) of the Texas Election Code, as amended, without further
action of the City Council. To the extent needed or desirable,the Administrator is hereby appointed
joint custodian of voted ballots for the purposes of Section 31.096, as amended, Texas Election
Code.
SECTION 10. It is officially found, determined, and declared that the meeting at which
this Resolution is adopted was open to the public and public notice of the time,place, and subject
matter of the public business to be considered at such meeting, including this Resolution, was
given, all as required by Chapter 551, as amended, Texas Government Code.
SECTION 11. If any provision of this Resolution or the application thereof to any person
or circumstance shall be held to be invalid,the remainder of this Resolution and the application of
such provision to other persons and circumstances shall nevertheless be valid, and this City
Council hereby declares that this Resolution would have been enacted without such invalid
provision.

vested in the Governor by Section 418.014 of the Texas Government Code,declared a
state of disaster for all counties in Texas;and
WHEREAS,pursuant to Section 418.016 of the Texas Government Code,the Governor
has the express authority to suspend the provisions of any regulatory statute prescribing
the procedures for conduct of state business or the orders or rules of a state agency if
strict compliance with the provisions,orders,or rules would in any way prevent,hinder,
or delay necessary action in coping with a disaster.
NOW,THEREFORE,I,GREG ABBOTT,Governor of Texas, under the authority vested
in me by the Constitution and Laws of the State of Texas, do hereby suspend Sections
41.0052(a) and (b) of the Texas Election Code and Section 49.103 of the Texas Water

TO ALL TO WHOM THESE PRESENTS SHALL COME:
WHEREAS,I,Greg Abbott,Governor of Texas,issued a disaster proclamation
on March 13,2020,certifying under Section 418.014 of the Texas Government
Code that the novel coronavirus(COVID-19)poses an imminent threat of
disaster for all counties in the State of Texas;and
WHEREAS,in each subsequent month effective through today,I have renewed
the disaster declaration for all Texas counties;and
WHEREAS,the Commissioner of the Texas Department of State Health Services,
Dr.John Hellerstedt,has determined that COVID-19 continues to represent a
public health disaster within the meaning of Chapter 81 of the Texas Health and
Safety Code;and
WHEREAS,pursuant to legislative authorization under Chapter 418 of the Texas
Government Code,I have issued executive orders,proclamations,and
suspensions of Texas laws in response to the COVID-19 disaster,aimed at using
the least restrictive means available to protect the health and safety of Texans
and ensure an effective response to this disaster;and
WHEREAS,Section 41.001(a)of the Texas Election Code provides that a general
or special election in this state shall be held on a uniform election date,and the
next uniform election date is occurring on November 3,2020;and
WHEREAS,I issued a proclamation on March 18,2020,suspending Sections
41.0052(a)and(b)of the Texas Election Code and Section 49.103 of the Texas
Water Code to the extent necessary to allow political subdivisions that would
otherwise have held elections on May 2,2020,to move their general and special
elections for 2020 only to the November 3,2020 uniform election date;and
WHEREAS,Texas law provides that eligible voters have a right to cast a vote in
person;and
WHEREAS,as counties across Texas prepare for the upcoming elections on
November 3,2020,and establish procedures for eligible voters to exercise their
right to vote in person,it is necessary that election officials implement health
protocols to conduct elections safely and to protect election workers and voters;
and
WHEREAS,in order to ensure that elections proceed efficiently and safely when
Texans go to the polls to cast a vote in person during early voting or on election
day for the November 3,2020 elections,it is necessary to increase the number of
days in which polling locations will be open during the early voting period,such
that election officials can implement appropriate social distancing and safe
hygiene practices;and

WHEREAS,Section 85.001(a)of the Texas Election Code provides that the
period for early voting by personal appearance begins 17 days before election
day;and
WHEREAS,Section 86.006(a-1)of the Texas Election Code provides that a voter
may deliver a marked mail ballot in person to the early voting clerk's office
while the polls are open on election day;and
WHEREAS,in consultation with the Texas Secretary of State,it has become
apparent that for the November 3,2020 elections,strict compliance with the
statutory requirements in Sections 85.001(a)and 86.006(a-1)of the Texas
Election Code would prevent,hinder,or delay necessary action in coping with
the COVID-19 disaster,and that providing additional time for early voting will
provide Texans greater safety while voting in person;and
WHEREAS,pursuant to Section 418.016 of the Texas Government Code,the
legislature has expressly authorized the Governor to suspend the provisions of
any regulatory statute prescribing the procedures for conduct of state business or
the orders or rules of a state agency if strict compliance with the provisions,
orders,or rules would in any way prevent,hinder,or delay necessary action in
coping with a disaster;
NOW,THEREFORE,I,GREG ABBOTT,Governor of Texas,under the authority
vested in me by the Constitution and laws of the State of Texas,do hereby suspend
Section 85.001(a)of the Texas Election Code to the extent necessary to require that,
for any election ordered or authorized to occur on November 3,2020,early voting
by personal appearance shall begin on Tuesday, October 13, 2020, and shall
continue through the fourth day before election day. I further suspend Section
86.006(a-1)of the Texas Election Code,for any election ordered or authorized to
occur on November 3, 2020, to the extent necessary to allow a voter to deliver a
marked mail ballot in person to the early voting clerk's office prior to and including
on election day.
The Secretary of State shall take notice of this proclamation and shall transmit a
copy of this order immediately to every County Judge of this state and all
appropriate writs will be issued and all proper proceedings will be followed to the
end that said elections may be held and their results proclaimed in accordance with
law.

SUMMARY:
Each year, the City Council appoints members of the public to serve on various boards,
commissions, and committees. Appointed members serve a two-year term, unless
appointed to fulfill an unexpired term. There are five existing board seats on the Economic
Development Advisory Committee that expire in 2020, four of which are recommended
for reappointment with one new member recommended for appointment.
GENERAL DESCRIPTION:
In 1998, City Council created the Economic Development Advisory Committee to provide
business and employee input on policies, plans and strategies that promote quality of life
and economic health in the city. The committee members consist of ten leaders serving
staggered two-year terms representing different spectrums of business.
Staff recommends the reappointment of four existing board members.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NORTH
RICHLAND HILLS, APPOINTING MEMBERS TO THE ECONOMIC
DEVELOPMENT ADVISORY COMMITTEE; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, City Council appoints members of the public to service on various boards,
commissions, and committees; and
WHEREAS, appointed members serve a two-year term, unless appointed to fulfill an
unexpired term; and
WHEREAS, each member serves until his or her successor has been duly appointed
and qualified.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
NORTH RICHLAND HILLS, TEXAS, THAT:
SECTION 1. The City Council hereby finds that the recitals set forth above are true and
correct and are incorporated into this Resolution as if written herein.

GENERAL DESCRIPTION:
At each Council meeting a member of the governing body announces upcoming events
in the City and recognizes an employee that exemplifies the City's core values.
Announcements:
The North Richland Hills Animal Adoption & Rescue Center is joining with animal
shelters from across North Texas for the annual Clear The Shelters campaign. Pet
adoption fees are being waived throughout the month of August in hopes of finding all
shelter pets a forever home. To view pets currently available for adoption, you can visit
the center in person or go online to nrhtx.com/aarc.
While slowing the spread of coronavirus has received much of our attention this year,
residents should also take steps to protect themselves from West Nile Virus and other
diseases carried by mosquitoes. Remember to wear insect repellent whenever you
spend time outdoors and eliminate standing water where mosquitoes breed around your
home. You can find a backyard checklist of eliminating mosquitoes on the city's website.

Every Council Meeting, we spotlight our employees for the great things they do. Tonight
we recognize:
Keane Menefee with Animal Services — A citizen took time to email her thanks to
Keane and the Animal Services staff after corresponding with him about pet adoptions.
