TUESDAY. MARCH 31, 1970 - 7:30 P.M. ROLL CALL PRESENT: Mayor: Councilmen: Calvin F. Luper P. M. Dodson J. R. Hubbard Harold B. Daley Dick Faram J. F. Cato J. B. Sandlin M. E. Cook ABsmT: None ITEMS ON THE AGENDA FOR CONSIDERATION: Mr. Paul C. Cook Review of results of Mr. Cook's letter to the other cities Consideration of instructions based on results of the preceding letter ... Mr. Cook advised the City Council that a negotiation meeting had previously been scheduled for tonight with representatives of the City of Richland'Hills, however, this meeting had to be cancèlled due to the illness of the father of Mayor Paul Daniels of Richland Hills. At this point the City Council asked Mr. Cook when the meeting would be re-scheduled and Mr. Cook was unable to give them a date but suggested he would telephone Mr. Christopher. After talking with Mr. Christopher by telephone, Mr. Cook informed the Council Mr. Christopher relayed to him that Mayor Daniels is ready to go as soon as the contracts have been prepared by Mr. Cook and a meeting will be re-scheduled soon. Mr. Cook, upon questioning by the City Council, informed the Council the results of responses to his letter of March 23, 1970: Azle - Unconditionally signed letter Lakeside - Bonafide attempt to respond favorably _ would consider satisfactory Richland Hills - no letter Mr. Cook again asked the City Council to not instruct him at this time to file our condemnation suit, subject to review, however, from day to day. After discussion by the City Council, Councilman Dodson moved, seconded by Councilman Daley, that the City Council extend the date set out at the last City Council meeting until the next City Council meeting, April 13, 1970, and at that time the City Council can consider the conditions. The mtion carried by a vote of 7-0. ADJOURNMENT There being no further items on the City Council agenda for consideration, Councilman Riddle moved, seconded by Councilman Sandlin, that the special City Council meeting be adjourned. Box 13305 Fort Worth, Texas 76118 Dear Mayor Luper: This letter will confirm the verbal advice which I gave you last Saturday regarding the negotiation meeting this evening with repre- sentatives of the City of Richland Hills. "-- As I informed you in our discussion last Saturday, a meeting was held in the offices of Mr. Tom Christopher on Saturday morning, March 28, attended by representatives of the various cities involved in the water and sewer utility systems problem, and it is my opinion that considerable progress was made at that meeting. At the conclu- sion of the Saturday morning meeting we scheduled a negotiation meeting with representatives of Richland Hills for 7 :30 p. m. on Tuesday, March 31, at the offices of Tarrant County Water Supply Corporation, and we scheduled a negotiation meeting jointly with representatives of Azle and Lakeside for 7 :30 p. m. on Wednesday, April 1, at the offices of Tarrant County Water Supply Corporation. I am definitely of the opinion that the program of negotiation sessions which we are now setting up will take us forward promptly toward voluntary settlement of all matters in controversy. On the other hand, the representatives of all cities are rather sensitive about undue pressures, and I think it is im- perative that we avoid destruction of the climate of negotiations by filing our condemnation suit at this point. I therefore strongly recommend that the City Council of North Richland Hills not instruct me at this time to file our condemnation suit, subject to review, however, from day to day. If the City Council at its special meeting this evening should be inclined to disregard this recommendation, I respectfully request that --'" Hon. Calvin F.
