CALL TO ORDER The meeting of the City Council of the City of North Richland Hills was called to order by Mayor Marion L. Massey at 7:30 P.M. ROLL CALL PRESENT: Mayor: Councilmen: Marion L. Massey M. Huston Dennis Morrow William R. Ratliff ABSENT: None INVOCATION The invocation at this City Council meeting was given by Reverend Michael Patison of the Richland Hills Methodist Church. APPROVAL OF THE MINUTES OF PREVIOUS MEETING Regular City Council Meeting - April 13, 1970 Councilman Hubbard moved, seconded by Councilman Riddle, that the City Council approve the Minutes of the regular City Council Meeting of April 13, 1970 as presented. The motion carried by a vote of 7-0. CITY MANAGER'S REPORT City Manager, Jack D. Russell, advised the City Council of receipt of communication from the Texas Highway Department containing information they have analyzed the estimated traffic data at the inter- section of State Highway 121 (Frontage Roads) with Bedford-Euless &)ad and Oakridge Terrace in North Richland Hills and determined there will be sufficient traffic volume at the intersections to meet the warrants for signalization. The Texas Highway Department proposes to install a Three-Dial Fixed-Time Interconnected Signal with Safety Lighting at the above intersections. Plans and specifications will be submitted to the City when they are completed by the Texas Highway Department. The City Manager stated it will no longer be necessary for the Watauga Fire Department to install a telephone in our department. The City of Watauga has corrected their problems. The City has received the proceeds from the sale of $500,000.00 of general obligation bonds. These funds have been invested with $450,000.00 in 90 day treasury bills at 6.50%. Texas Electric Service Company has exercised an inflationary provision of their rate agreement with the City and will be increasing rates ~ of 1% for the remainder of the year 1970 and 1% for 1971. The City of Richland Hills recently made available to its citizens personal property inventory forms whereby the serial numbers of property which might be stolen could be recorded before the theft to facilitate recovery and prosecution. We have extended this service to the North Richland Hills residents also. CITIZEN PRESENTATION A. F. Stepp 7217 Little Ranch Road Mr. Stepp appeared before the City Council asking for the discontinuance of issuance of building permits in the Morgan Meadows Addition and for the authorization by the City Council for the cleaning and opening of the ditches in the area. After discussion by the City Council, Councilman Polster moved, seconded by Councilman Riddle, that the City Manager be instructed to work with all facilities of the City Staff to investigate the entire problem in Morgan Meadows, determine the nature and proceed if possible to eliminate the problem. The motion carried by a vote of 7-0. COUNCIL APPOINTMENT BOARD OF ~UALIZATION Mayor Marion L. Massey announced the nomination of the following members for appointment to the Board of Equalization: RESOLUTION NO. 70-8 BILL LUSK JOHN MICHENER DR. ROBERT D. KEITH Councilman Hubbard moved, seconded by Councilman Riddle, that the City Council approve the appointments to the Board of Equalization as outlined above for the year 1970. 'rhe motion carried by a vote of 7-0. BOARD OF ADJUSTMENT Mayor Marion L. Massey announced the nomination of the following members for appointment to the Board of Adjustment: DR. E. K. HAHN JAY JONES GLENN GOODNIGHT Councilman Polster moved, seconded by Councilman Hubbard, that the City Council approve the appointments to the Board of Adjustment as outlined above for the two year term 1970-1972. The motion carried by a vote of 7-0. ELECTRICAL BOARD Mayor Marion L. Massey announced the nomination of the following members for appointment to the Electrical Board: FLOYD cTONES ARNOLD PAIR CoR. BALLENGER J. M. 'VEST WILLIAM R. RATLIFF Councilman Hubbard moved, seconded by Councilman Newman, that the City Council approve the appointments to the Electrical Board as outlined above. The motion carried by a vote of 7-0. APPOINTING REPRESENTATIVES TO THE TARRANT COUNTY WA TER SUPPLY CORPORATION BOARD OF ffiRECTORS Mayor Marion L. Massey presented the following Resolution to the City Council: "RESOLUTION NO. 70-8 A resolution by the City Council of North Richland Hills, Texas, appointing a member to the Board of Directors of Tarrant County Water Supply Corporation as provided for by Ordinance No. 55. ESTES SERVICE COMPANY COMPLAINT COMMITTEE NORTHEAST ADVISORY COUNCIL WHEREAS, the term of office of P. M. "Tex" Dodson to the Board of Directors of the Tarrant County Water Supply Corporation has expired. WHEREAS, the City Council needs to appoint another member to this Board as provided for; NOW BE IT RESOLVIID BY THE CITY COUNCIL OF NORTH RICHLAND HILLS, TEXAS, THAT: Mr. Morris E. Riddle is hereby the appointed representative to serve on the Board of Directors of Tarrant County Water Supply Corporation as it is the opinion of this Council that Mr. Morris E. Riddle of the City of North Richland Hills, Texas, possesses the mature judgment, experience and knowledge necessary to the appropriate discharge of responsibilities as a member of the Board of Directors of the Tarrant County Water Supply Corporation. This appointmnt is for a full term of office to begin April 1, 1970 and to expire on April 1, 1972." Councilman Polster moved, seconded by Councilman Hubbard, that the City Council approve Resolution No. 70-8 as presented. The motion carried by a vote of 6-0; Councilman Riddle abstaining. Mayor Marion L. Massey announced the nomination of the following members for appointment to the Refuse Complaint Committee: TOM E. NEWMAN, CITY COUNCILMAN J. F. GATO, CITY COUNCILMAN Councilman Riddle roved, seconded by Councilman Faram, that the City Council approve the appointment to the Refuse Complaint Committee as outlined above. The motion carril3d by a vote of 4-0; Councilman Newman, Councilman Cato and Councilman Hubbard abstaining. Mayor Marion L. Massey announced the nomination of the following members for appointment to the Northeast Advisory Council: DICK FARAM J. R. HUBBARD Councilman Polster moved, seconded by Councilman Newman, that the City Council approve the appointments to the Northeast Advisory Council as outlined above. The motion carried by a vote of 5-0; Councilmen Faram and Hubbard abstaining respectively. ORDINANCE NO. 316 Mayor Marion L. :Massey presented the following Ordinance to the City Council for consideration: "ORDINANCE NO. 316 AN ORDINANCE ESTABLISHING A PARKS AND RECREATION COMMISSION; PROVIDING FOR THE NUMBER OF MEMBERS AND TERMS OF OFFICE; FIXING THE METHOD OF APPOINTING THI!; FIRST CHAIRMAN THEREOF; FOR ELECTION OF 'THE CHAIRMAN BY THE COMMISSION THEREAFTER; AND PRESCRIBING ITS OOTIES WHICH SHALL BE ADVISORY AND SUBJECT TO SUPERVISION OF THE COUNCIL; REPEALING PRIOR ORDINANCES; PROVIDING A SAVINGS CLAUSE; AND DECLARING AN EMImGENCY. Councilman Owen moved, seconded by Councilman Hubbard, that the following nominations be appointed to serve in Place 4 and Place 5 until May 1, 1972: Place 4 - until 5/1/72 Place 5 - until 5/1/72 PA T DARNELL TOM CONNELL The motion carried by a vote of 7-0. Councilman Riddle moved, seconded by Councilman Faram, that the following nominations be appointed to serve in Place 6 and Place 7 until May 1, 1971: Place 6 - until 5/1/71 Place 7 - until 5/1/71 REV. W. C. TAYLOR ASA SHORT The motion carried by a vote of 7-0. Mayor Marion L. Massey reminded the City Council of the provision in Section III of Ordinance No. 316, stating: "The Mayor, subject to the approval of the City Council, sn~ll appoint the first Chairman of the Commission, who shall serve as Chairman until his term as such has expired." Mayor Marion L. Massey recommended the appointment of Mr. Ray Sprinkel as Chairman of the Parks and Recreation Commission; his term of office expiring May 1, 1973. Councilman Hubbard moved, seconded by Councilman Newman, that the City Council approve the recommendation of Mayor Massey and appoint Mr. Ray Sprinkel Chairman of the Parks and Recreation Commission until May 1, 1973. The motion carried by a vote of 7-0. 1970 EDITION OF CITY COUNCIL RULES OF PROCEDURE PUBLIC HEARING - CITY COUNCIL RULES OF PROCEDURE Mayor Massey declared first reading on the consideration of revision of the City Council Rules of Procedure and outlined the following sections to be revised: Section 2.11 - Amended to make clear that the provisions with J~gard to zoning shall not be suspended and requiring a unanimous vote for suspension of an~r other rules. Section 5.1 - Agenda delivered Friday instead of Thursday. Section 5.2 - Met.hod of getting on Council agenda revised. Section 5.3 - Provision made for citizen presentation at City Council n~eting. Section 5.4 - Council communications delivered Friday instead of Thursday. Section 5.6 - Changed to Section 8. Section 5.6.1 - Changed to Section 8.1. Section 8.2 - Added Section 5.6.2 - Changed to Section 8.3. Section 5.6.3 - Changed to Section 8.4 and amended. Section 6.7 - Changed to give Mayor right to vote to break tie. Section 8. - Changed to Section 9. Section 9. - Ch~nged to Section 10. Councilman Riddle moved, seconded by Councilman Polster, that the City Council approve the first reading of the 1970 Edition of the City Council Rules of Procedure, including amendments and changes as specified above. The motion carried by a vote of 7-0. THIS ITEM WILL APPEAR ON THE CITY COUNCIL AGENDA OF MAY 11, 1970 FOR SECOND READING AND FINAL COUNCIL ACTION PLANNING AND ZONING Ordinance No. 314 - Second Reading PZ 70-7 - JOHN BARFIELD Ordinance No. 315 - Second Reading PZ 70-8 - JOHN BARFIELD Mayor Massey declared the City Council meeting in Public Hearing on Ordinance No. 314, PZ 70-7 (application to rezone property from Agriculture to Planned Development) and also on Ordinance No. 315, PZ 70-8 (application to rezone property from Agriculture to Specific Use). Mayor Massey read into the minutes a letter from Edward K. Hahn, DDS apposing the approval of this zoning application. The original of this letter is attahced to these original minutes for permanent record. The following property owners appeared before the City Council asking the City Council for denial of these zoning applications: Mr. Charles Mangham Route 1, Box 440 Smithfield, Texas Mrs. L. 'T. Hansard Route 1, Box 446 Smithfield, Texas (MRS. HANSARD WAS REPRESENTED BY MR. CHARLES MANGHAM) Hazel Fetner 7033 Crabtree Lane Smithfield, Texas Upon a call by the Mayor, Mr. John Barfield appeared at this City Council meeting to ask the favorable consideration and approval of the zoning applications for rezoning under Ordinance No. 314 and Ordinance No. 315 as presented. There being no further persons interested in appearing before the City Council, Mayor Massey declared the Public Hearing closed. Councilman Riddle moved, seconded by Councilman Faram, that the City Council deny the approval of Ordinance No. 314 and disapprove the zoning application to rezone this property from Agriculture to Planned Development. The rootion carried by a vote of 7-0. Councilman Faram moved, seconded by Councilman Owen, that the City Council deny the approval of Ordinance No. 315 and disapprove the zoning application to rezone this property from Agriculture to Specific Use. The motion carried by a vote of 7-0. There was considerable City Council discussion concerning status of zoning materials received for review by the City Council as to content of information for an intelligent decision. Councilman Faram moved, seconded by Councilman Hubbard, that the City Manager be instructed to work with the City Staff and directive be issued so that all future zoning applications of Planned Development, and any others where necessary, be prepared at the time of application submission to include preliminary engineering. The motion carried by a vote of 7-0. SEWERAGE FACILITIES DIAMOND LOCH City Manager, Jack D. Russell, informed the City Council of the necessity for consideration and approval of oversizing of sewerage facilities for the development of the Diamond Loch Addition. Councilman Faram moved, seconded by Councilman Riddle, that the City Council approve and make the appropriation, up to $20,000.00, ~Dr the oversizing of sewerage facili- ties for the Diamond Loch Addition. The motion carried by a vote of 7-0. RESIGNATION Mayor Massey read the following letter to the City Council: "The Mayor and Councilmen The City of North Richland Hills City Hall North Richland Hills, Texas Gentlemen: For some time now, pressing business matters have made my service on our City's Planning and Zoning Commission increasingly burdensome. Now that a new administration is in office, it seems opportune to record here my desire for relief from these responsibilities. I am grateful to have been given the o pportuni ty to know many of the fine and dedicated citizens who willingly give so much of their time and energy to the welfare of their neighbors. My small service has been a valued privilege in which I shall continue to take much pride. Very truly yours, /s/ John W. I wish to call your attention to the toll owing items. North Richland Hills does not and will not have adequate tire protection to cover an area ot trailer homes in such density. While these units may contain tire retardant :materials, the per- sonal contents are tar £'rom being the same. As a matter ot observation, these units are tar £'rom tire sate. They apparently bum rapidly. Imagine, it you will, strong winds and tire in a densely concentra. ted area. There will be that many more possi- bilities ot tire accidents. It Y011 or your group have not seen a burned-out trailer home, I suggest you see one prior to making a decision. There is one on the south side ot starnes Rd. near Douglas Lane in Smithfield. There is another on Belknap dia- gonally opposite Sabine Valley Lumber Company. The recent rash of storms stri1d..ng trailer home sites should inf'luence you and the council as to wha t ~ happen. The toll is high in human loss, as well as monetarily. Some of our adjacent cities have had a second look at trailer homes. Hu.rst is an example. Have you looked closely at the site on Pipeline Road, east of I-Mart? The units overflow with personal belongings. Utility sheds are present. Look atone in our area on the southwest corner of Hwy. 121 and Precinct Line Road I It is not beautif'ul, but i t gives you an opportunity to see these units at various ages and in various states of :repair. There is another on Shady- Grove Rd. west of' Davis Blvd. The proposed area, since it will be close to the biggest north-south thoroughfare in North Rich- land Hills, would seem to have much better usage in other forms of zonþlg. Finally, sewage will continue to be a problem for several years even if North Richland Hills does pI1rchase part of' the Tarrant County Wa ti!":'~ Supply Corporation. Once again, :remember this is a high density development. Have you thought about schools for this area? There are none. It would seem that some goodly amount of thought should be given before embar1d..ng on this zoning request. In my EDWARD K. HAHN, D. D. III too of'ten no one opposes or agrees with these zoning requests, although they have been properly published. The legal terms mean little to most people. I would like to suggest tha t a brief' and contemporary identifioa tion of' the looa tion be added to the legal publication f'or the sake ot clarity. I would also like to have council consider a change in the notitica tion ot those wi thin 200 teet ot zoning oases. All too otten the individual may be his own neighbor, because he owns sufficient land around the parcel up tor re-zoning. A greater distance ot your choice is recommended.
