CALL TO ORDER The meeting of the City Council of the City of North Richland Hills was called to order by Mayor Marion L. Massey at 7:30 P.M. ROLL CALL PRESENT : Mayor: Councilmen: Marion L. Massey J. R. Hubbard Dick Faram W. F. Polster J. F. Cato Charles L. Owen STAFF PRESENT: City Manager: City Secretary: City Attorney: City Engineer: Jack D. Russell Evalyn R. Huston Dennis M. Morrow William R. Ratliff ABSENT: Councilman: Councilman: M. E. Riddle Tom E. Newman ~ INVOCATION The invocation at this City Council meeting was given by City Councilman Charles L. Owen. APPROVAL OF THE MINUTES OF THE PREVIOUg MEETIID Regular City Council Meeting - July 13, 1970 Councilman Polster moved, seconded by Councilman Cato, that the City Council approve the minutes of the regular City Council meeting of July 13, 1970 as presented. The motion carried by a vote of 5-0. ORDINANCE NO. 327 Mayor Marion L. Massey presented Ordinance No. 327 to the City Council, which is as follows: "ORDINANCE NO. 327 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, AMENDINJ THE LIBRARY COMMISSION ORDINANCE NO. 324, SECTION 1, AND DECLARIID AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS: That Section 1 of Ordinance Number 324 be amended to read as follows: I. There is hereby created and established a Library Commission to be composed of seven (7) members. All members shall serve without compensation. The fact that there is a public necessity and it is of utmost importance to the good and wel- fare of the community that this Ordinance be passed creates an emergency that this Ordinance be passed upon first reading and all rules requiring more than one (1) reading be hereby suspended and the same shall take effect immedi- ately from and after its passage." Councilman Hubbard moved, seconded by Councilman Polster, that the City Council approve and adopt Ordinance No. 327 as presented above. The motion carried by a vote of 5-0. APPOINTMENT Seventh (7th) Member of Library Commission Mayor Marion L. Massey informed the City Council that the potential seventh member of the Library Commission is on vacation and, therefore, a definite committment has not been made on this appointment and asked that this item be placed on the City Council agenda for August 10, 1970. 1970 CAPITAL IMPROVEMENTS PROORAM Additional items to be added for 1970 The City Engineer and City Manager recommended that the City Council consider approval of adding three drainage projects, previously eliminated, back in the 1970 Capital Improvements Program, being Contracts No. MLC, MLD and MLE. Councilman Faram moved, seconded by Councilman Polster, that the City Council authorize approval of drainage Contracts MLC, MLD and MLE, in the amount of $31,956.00 back in the Capital Improvements Program, Contract No.7. The motion carried by a vote of 5-0. PLANNING AND ZONIID PS 70-7 - REPLAT Block 42, Richland Terrace Addn. This case was on the Planning and Zoning agenda of July 23, 1970 with the purpose being to dedicate Cloyce Drive and Short Street and to further identify the property. The installation of Short Street and the drainage would be accomplished prior to the obtaining of building permits. The City has been furnished letters from all utility companies approving the replat- ting as requested. A two year maintenance bond from the date of completion of Cloyce Drive has been furnished the City. The Planning and Zoning Commission recommends approval of this request. Councilman Hubbard moved, seconded by Councilman Owen, that the City Council approve PS 70-7, Replatting of Block 42, Richland Terrace Addition, as recommended by the Planning and Zoning Commission. After discussion, Councilman Cato moved, seconded by Councilman Polster, that this item be tabled until the next City Council meeting. The motion carried by a vote of 5-0. PLANNING AND ZONIID PZ 70-H~ - JOHN W. BARFIELD ---- This zoning case appeared before the Planning and Zoning Commission meeting of July 23, 1970, which is a request of Mr. John W. Barfield to rezone 62.3849 acres out of the John Barlòugh Survey from Agriculture to IF-7 one family dwelling. The recommendation of the Planning and Zoning Commission was denial of approval. The City Council was notified of desire to appeal the decision of the Planning and Zoning Commission to the City Council on July 24, 1970. Mr. John W. Barfield appeared before the City Council asking that the City Council grant the appeal hearing as he feels his application is in order and just and complies with City Ordinances and is legal. Councilman Polster moved, seconded by Councilman Owen, that the City Council grant the appeal hearing to Mr. Barfield as requested. The motion carried by a vote of 5-0. ADDED TO AGENDA Councilman Cato moved, seconded by Councilman Hubbard, that the City Council approve adding item to the agenda concerning the riding of mini-bikes and motor bikes in the North Hills area on the property known as the City Park and Lake owned by the City of North Richland Hills. The motion carried by a vote of 5-0. Mr. Spence of 5908 North Hills Drive appeared before the City Council informing them that the situation of children riding mini-bikes and motor bikes on this property has improved very little, if any at all, at this location during the past two weeks and the problem of noise and dust still exists not only during the day time hours, but late into the night. City Manager, Jack D. Russell, advised the Police Department has not encountered any unusual pro- blems in policing this area as they were instructed to do for the past two weeks. The City Manager presented a petition to the City Council reading as follows: "WE THE UNDERSIGNED, CITIZENS OF NORTH RICHLAND HILLS, DO HEREBY STATE THAT WE HAVE NO OBJECTIONS TO THE USE OF CITY PROPERTY LOCATED IN THE NORTH HILLS ADDITION AS A RECREATIONAL AREA FOR MINI- BIKE RIDERS. THE PROPERTY IN QUESTION IS UN- DEVELOPED AND IS NOT SUITABLE FOR USE AS A CITY PARK. IT IS UNDERSTOOD THAT RULES FOR USE OF THE AREA WILL BE PROVIDED BY THE CITY OF NORTH RICHLAND HILLS AND COMPUANCE BY ALL RIDERS WILL BE MANDA TORY. " This petition contains the names and addresses of 55 property owners surrounding this property. The original petition is attached to these minutes as permanent record. Captain Houston A. Deggans, Police Department, appeared before the City Council and advised he has attempted to locate another accessible area for the children to ride these bikes without success. He stated most of the bikes in this area are small bikes. After due consideration, Councilman Polster moved, seconded by Councilman Cato, that the City Council issue orders restructing the riding of mini-bikes and motor bikes in the area known as the North Hills area City Park and Lake entirely and permit their riding in the City Park on Onyx Drive South, with proper signs and restrictions to be posted within the park immediately. The motion carried by a vote of 3-2; Councilmen Owen, Cato and Polster voting yes; Councilmen Hubbard and Faram voting no. RELATED ITEM Councilman Faram moved, seconded by Councilman Hubbard, that the City Council instruct the City Attorney and the City Manager to prepare the necessary Resolution for appraisal and public auction of sale of the property owned by the City of North Richland Hills in North Hills, known as the City Park and Lake, containing approximately 10 acres. The motion carried by a vote of 5-0. CITIZEN'S PRESENTATION Mr. V. L. Gibson 8333 Odell Street 28l-0128 Drainage problem on Odell Street Mr. Gibson presented completed form to the City Council to appear before them on the drainage problem on Odell Street. After discussion, Mr. Gibson was instructed by the Mayor to meet with the City Engineer and the City Manager concerning this problem and if satisfactory results are not accomplished he should appear before the City Council at that time, either being formally on the City Council agenda or as a Citizen's Presentation. ADJOURNMENT There being no further items on the City Council agenda for consideration, Councilman Polster moved, seconded by Councilman Hubbard, that the City Council meeting be adjourned.
