In compliance with the Texas Open Meetings Act and in accordance with
Section 418.016 of the Texas Government Code and such action issued by
the Governor of Texas on March 16, 2020, the North Richland Hills Zoning
Board of Adjustment will conduct its regular meeting via telephone and video
conference. The meeting will be conducted by telephone and video
conference in order to advance the public health goal of limiting face-to-face
meetings (also called "social distancing") to slow the spread of the
Coronavirus (COVID-19). There will be no public access to the City Hall
location described above.

The applicant, Reza Saif, 3820 Grand Meadow, Mansfield, was sworn in by Chair
Duer and presented the request.

or complaints regarding the garage.

Sterling Woods for a variance from Section 118-313 (lot and area
requirements) of the North Richland Hills zoning ordinance at 8721

SUMMARY
Sterling Woods is requesting approval of a variance to the lot and area requirements to
provide less than 20% rear yard open space on a residential lot located at 8721 Everglade
Drive.
BACKGROUND INFORMATION
The property is located on the north side of Everglade Drive,just west of Eden Road. The
lot is adjacent to an open space lot with a detention pond, which is owned by the Harmon
Farms homeowners association. The lot is 9,000 square feet (0.207 acres) in size. The
owner proposes to construct a 385-square-foot attached covered patio at the rear of the
house.
On December 9, 2020, the owner's contractor applied for a building permit to construct
the attached covered patio. During the review of the application, it was determined that
the design did not satisfy the standard for rear yard open space as required by the zoning
ordinance. The zoning ordinance requires that at least 20% of the lot area be maintained
as rear yard open space, and the addition would reduce the rear yard open space to
16.2% of the lot area. The applicant was advised that the design must be adjusted to
provide the required open space. Rather than adjust the design, the applicant has
submitted an application for variance.
The variance application and supporting materials are attached. The materials include a
copy of the application explaining the reasoning for the variance request, a survey of the
lot, plans showing the proposed improvements to the property, and relevant building
permit documents. An analysis of the request and relevant codes is below.
ANALYSIS
The variance request is related to the rear yard open space standards contained in
.Sec!ii!..o2 ,1,11,E „11, , of the zoning ordinance. This section requires that every lot provide at
least twenty percent (20%) of the lot area as open space in the rear yard. The rear yard
open space area is defined as:

...an area reserved as an open space in the rear portion of a yard which extends from one
side property line to another side property line and abutting the rear property line. The rear
yard open space shall not protrude beyond the two most extreme corners of the main
structure and no part of a residential dwelling unit may be constructed so as to occupy any
portion of the rear yard open space.
To assist in the interpretation and application of the 20% rear yard open space standard,
Article IX of the zoning ordinance (illustrations) provides the following exhibits:

The purpose of the rear yard open space is to provide areas for other improvements on
the property, such as swimming pools, accessory buildings, play equipment, and similar
features. Construction of these features do not count against the required open space.
However, since the 385-square foot unenclosed patio is attached to the house, it is
considered an addition to the main structure and affects the rear yard open space
requirement.

Based on the lot size of 9,000 square feet, at least 1,800 square feet of open space must
be provided in the rear yard. As developed, the lot provides 1,843 square feet. The owner
is requesting a variance to reduce the rear yard open space to 1,455 square feet to
accommodate the addition. This is a reduction from 20.5% to 16.2% of rear yard open
space.
The exhibits below show the rear yard open space percentage as applied to the current
house footprint and as applied if the addition is constructed. Only a 278-square foot
portion of the attached patio affects the rear yard open space, as part of the addition
would be constructed in the side yard. For reference, the property is encumbered by 7.5-
foot utility easements adjacent to the north (rear) and east (side) property lines.

affecting all or most properties in the same zoning district.
c. The relief sought will not injure the permitted use of adjacent conforming property.
d. The granting of the variance will be in harmony with the spirit and purposes of
these regulations.
OPTIONS FOR BOARD CONSIDERATION
The Zoning Board of Adjustment has the following options on this application.
1. Approve the variance as presented. This action would allow the property to provide
the rear yard open space as proposed.
2. Approve the variance with conditions. This action would allow the property to
provide less than 20% rear yard open space subject to the owner making
modifications to its size, location, or design as directed by the Board.
3. Deny the variance. This action would require the property to provide the required
20% rear yard open space as calculated on the entire lot area.

The Board of Adjustment shall have the powers and exercise the duties nfm Board in accordance with of the
Texas Local Government Code. Board members are representatives of the City and shall have the right to inspect premises
where required in the discharge of their responsibilities under the laws of the State of Texas and the ordinances of the City of /

appeals and applications, and to that end shall have the necessary authority to ensure continuing compliance with its decision.

of the zoning ordinance. All actions to discontinue a non-conforming use of land or structure shall be taken with doe
regard to the property rights of the persons affected when considered in light of the public welfare and the character of
the area surrounding the designated non-conforming use and the conservation and preservation of the property. The
Board may, from time to time on its own motion or upon cause presented by interested property owners, inquire into
the existence,continuation,or maintenance of any non-conforming use within the city.
• Variances.Authorize upon appeal, in specific cases,such variance from the terms ufthe zoning ordinance that are not

This specific variance being requested is due to "Irregular and Unknown" lot restrictions.
My wife and I purchased a "Model Home"at 8721 Everglade Drive in North Richland Hills in Jan 2017.Our
home is located in the Harmon Farms Subdivision off of Eden road and Rumsfield road. However,we were
not aware prior to purchase that NRH had specific ordinances related to rear open yard space (ROYS)
which requires 20%of the total lot size to be dedicated to rear yard open space. Had we known PRIOR
we definitely would NOT have purchased the model home at this location. The lot that the model home
sits on is very peculiar because although the lot is 9000 sq.ft.; interestingly the rear of the home is exactly
1800 sq. ft.which coincidently is the exact minimum which is required by the NRH zoning ordinance (Lot
size 9000 x 20%= 1800).One of our primary reasons for purchasing the lot was that we loved the view of
the backyard (nice trees and farmland) however the problem was that the existing patio cover that was
built with the home is very small in size (8 x10). Its barely big enough for 2 chairs and a small table. I
understand the homebuilders mindset was to impress the model home buyer with the impressive
"interior" look of the model home; however, that decision left the purchaser (my wife and 1) facing
unprecedented hardships in trying to obtain approval to add a custom patio to our home. This is a
situation that is not self-imposed as we had no say nor knowledge before purchasing the property of the
specific requirements.
At least 4 of our neighbors in the small community have built beautiful patio covers attached to the
side/rear of their home; however we have been denied twice. Our neighbors met the requirements to
build because the addition of the attached patio cover allowed them to remain within the 20%
requirement. By default, because we purchased the model home, the request to add a high-quality
attached patio to our home would place us @ 385sf outside of the total required open space. The addition
of the patios adds value to our neighbors home; while our being denied the opportunity leaves us at a
disadvantage because we are currently not allowed to add exterior amenities to our home to increase its
value.The variance we are requesting would not adversely affect the properties in the community, in fact
it would allow our home to have the same cohesive look as the other homes in the community that have
the attached patios.
As homeowners we are asking that the zoning board of adjustments grant the approval of the variance
request so that we have the same opportunity as our neighbors to construct an attached patio cover to
our home.The granting of this request will not create an unnecessary hardship of the affected property;
the situation was not self-imposed by us as the home owners; and will not affect the zoning as it relates
to other properties within our subdivision. We believe the granting of this variance will be within the
harmony with the spirit and purposes of the zoning regulations.

Good afternoon Mayor and City Manager, we hope this email finds you well
We are writing: to request assistance/guidance with a home improvement permit we are trying to obtain to have a patio
added to our home located at 8721 Everglade Drive, North Richland Hills, T . We have been denied a permit to build twice,
most recently through a contractor who is currently building a patio cover for someone else in our neighborhood.
The issue we have is that we have several neighbors in our small community of 28 homes that have already received permits
and are building (or have already built) structures that are very similar in design to what we keep getting denied access to
execute, According to the zoning map, all homes in our neighborhood are zoned R2, and would have the same restrictions
(20% of Total lot size must be rear yard open space) that is being applied to our request to justify denial. In fact we share a
fence line with one of the homes where the permit has been approved and confirmed with the builder (DFW Design.Homes)
that what we are requesting and what is being built for our neighbor are very similar in design (as far as the requested
dimensions), We also confirmed with a representative from home builder that there are no variances between the homes/lots
along the fence line. In addition,, we inquired with one of the NRH inspectors who was in the neighborhood reviewing one of
the projects underway, to see if maybe he could help us to understand why there would be a difference applied to our home
Vs some of the other homes in the community, and he could not determine a difference as to why one was approved and
another was denied.
During our initial conversation with Mary Salas in the permits department, we voiced the same concern about the other
homes in the community with approved permits, and was told by Mary that what she was discussing with us was related to
our property ONLY and not others in the community. I do understand that it is quite possible that some may have proceeded
without going through the proper permitting process; however we have inquired with several of our neighbors who have
assured us that their patio covers were built with an approved NRH permit and they did not face any of the issues we are
facing.
We are only trying to add a patio to our home that would not only add value to the home, but allow us to enjoy our home
even more by providing an escape from the hot Texas heat. If our permit cannot be approved, we would at least like to have
adequate justification as to why our home is being held to a different standard than others in our community. We are only
asking for fair and reasonable,treatment across the board, nothing more, nothing less, only consistency. Any
assistance/guidance you can provide is greatly appreciated.

Good evening Dave, first let me say I respect the rules and regulations that have been established by the city. I was a
military man that spent 22 years of my life abiding by the uniform code of military justice and by no means am I trying to
impede on any system. I have read the city Manager's response and although I have some issues with it (specifically the
home 4 doors down from me, their patio is almost finished) I will respect it. With all of that being said l would like to know
what I can and can't do as it pertains to the rear of my home. For clarity I need to know if I am allowed to build a .smaller
patio cover that is attached to the home or is it totally out of the question. My second question is if I build a detached patio
cover what's the largest it can be? Finally I have been a guest of @ least 2 of my neighbors' homes, specifically on their
patios and there is NO WAY their hear yard is larger than mine and they have 2 large/lovely patio covers pretty much the
same size or similar to what I was attempting to build. My point is I am not here to be a whistleblower by no means I am just
pointing out the obvious. Maybe just maybe the sides of their homes were included in their total BOYS measurements by
mistake which allowed their rear yard to exceed the 20%ca capacity. If by chance you would like to speak by phone v
