In compliance with the Texas Open Meetings Act and in accordance with
Section 418.016 of the Texas Government Code and such action issued by
the Governor of Texas on March 16, 2020, the North Richland Hills City
Council will conduct their regular meeting via telephone and video
conference. The meeting will be conducted by telephone and video
conference in order to advance the public health goal of limiting face-to-face
meetings (also called "social distancing") to slow the spread of the
Coronavirus (COVID-19). There will be no public access to the location
described above.

EXECUTIVE SESSION
The Planning and Zoning Commission may enter into closed Executive
Session as authorized by Chapter 551, Texas Government Code. Executive
Session may be held at the end of the Regular Session or at any time during
the meeting that a need arises for the Planning and Zoning Commission to
seek advice from the city attorney (551.071) as to the posted subject matter of
this Planning and Zoning Commission meeting.
The Planning and Zoning Commission may confer privately with its attorney to
seek legal advice on any matter listed on the agenda or on any matter in
which the duty of the attorney to the governmental body under the Texas

SUBJECT: RP 2020-12 Consideration of a request from Barton Surveying &
Laser Scanning LLC for a replat of Lots 2R1 and 2R2, Block 4,
Hewitt Estates, being 0.995 acres located at 7600 Hewitt Street.
PRESENTER: Clayton Comstock, Planning Director
SUMMARY:
On behalf of Crumpler Group LLC, Barton Surveying & Laser Scanning LLC is requesting
approval of a replat of Lots 2R1 and 2R2, Block 4, Hewitt Estates. This 0.995-acre
property is located at 7600 Hewitt Street.
GENERAL DESCRIPTION:
The property is located on the south side of Hewitt Street between Meadow Road and
Post Oak Drive. The property also extends south to and has frontage on Frankie B Street.
The property is a platted lot with an existing house. The lot was platted in 1983 as part of
the Hewitt Estates subdivision.
The replat would make the following revisions to the previous plat.
1. The property would be subdivided into two lots for the purpose of constructing new
single-family residences. Each lot would be approximately 171 feet wide, 120 feet
deep, and 20,470 square feet in area.
2. A sanitary sewer easement would be dedicated on Lot 2R2 in order to extend a
main line to service Lot 2R1 .
3. A new 7.5-foot utility easement would be dedicated adjacent to the rear property
lines of both lots.
4. A right-of-way reservation strip would be added to Lot 2R1 to address future
dedication needs for Hewitt Street.
The plat does not alter or remove any recorded covenants or restrictions, if any, on the
property.
As required by Section 212.015(f) of the Texas Local Government Code, written notice of
this replat will be mailed to each owner of the lots in the Hewitt Estates subdivision that
are within 200 feet of the lots being replatted. The notice is required to be sent no later
than 15 days after approval of the plat by City Council.

LAND USE PLAN: This area is designated on the Land Use Plan as Low Density
Residential. This designation promotes quality neighborhoods of conventional suburban
single-family detached homes. General characteristics of these neighborhoods include a
density of two to six dwelling units per acre and houses of one- and two-stories.
CURRENT ZONING: The property is currently zoned R-1 (Single-Family Residential).
This district is intended to provide areas for very low density development of single-family
detached dwelling units which are constructed at an approximate density of 2.9 units per
acre.
TRANSPORTATION PLAN: The development has frontage on the following streets.
Right-of-way dedication is required for this plat. A dedication of approximately twelve feet
will be provided on the plat for Hewitt Street.

DRC REVIEW & RECOMMENDATION: The Development Review Committee (DRC)
recommends approval of the plat subject to the attached DRC comments. These
comments include minor revisions to notations and labeling on the drawing, dedication
and reservation of right-of-way for Hewitt Street, and dedication of sanitary sewer and
utility easements.

The City of North Richland Hills received this plat on November 19, 2020. The Development Review
Committee reviewed this plat on November 24, 2020.The following represents the written statement of
the conditions for conditional approval of the plat.
1. There is a minor discrepancy in the owner's certificate.Verify and update as needed.NRHSubdivision
Regulations§110-331(Requirements for all plat drawings—metes and bounds description)
a. In the first call, the recording information for Lot 4 Block 4 line distance not match the
drawing.The description shows Vol 388-168 and the drawing shows Vol 388-181.
2. Add the following note to the plat: No above ground franchise utility appurtenances are allowed
in the fronts of the properties.NRH Subdivision Regulations§110-331(Requirements for all plat drawings—plat notes
and conditions)
3. In order to address future right-of-way dedication requirements for Hewitt Street, a reservation
strip must be added to Lot 2R1. The strip should be an area between the south line of the
proposed right-of-way dedication and a line connecting the front property corners of the adjacent

DESIGN PRINCIPLES
The following comments represent suggested modifications to the plat drawing based on general NRH
design principles and standard practices in city planning. While conformance to these principles is not
required by the subdivision regulations,the applicant is encouraged to include these modifications as part

2. Informational comments. These comments are informational only and do not need to be added

SUMMARY:
On behalf of SE Legacy Drive Investments LLC, Mark Barakat is requesting a special use
permit for a quick service restaurant on 0.98 acres located at 7100 Rufe Snow Drive.
GENERAL DESCRIPTION:
The site is located at the northeast corner of Rufe Snow Drive and Hightower Drive. The
property is currently developed as a convenience store with fuel sales. The applicant
proposes to renovate and remodel a portion of the store for a new tenant, G. pl. ca„irk Q1„1„ii c lh.
The property owner also owns and operates a convenience store with fuel sales and
Golden Chick restaurant at the northeast corner of Mid-Cities Boulevard and Holiday
Lane.
A site plan for the proposed development is attached. Planned improvements to the site
include the remodel and finish out of the interior space; construction of a drive through
lane with menu boards and canopy; the installation of landscaping; and modifications to
the building exterior. The zoning ordinance includes specific standards for the design and
layout of drive-through lanes, and the proposed project satisfies these design standards.
The proposed conditions of approval for this special use permit are attached. The zoning
ordinance provides that special use permits may establish reasonable conditions of
approval on the operation and location of the use to reduce its effect on adjacent or
surrounding properties. These conditions are based on the applicant's proposed
development of the property, and include the items described in detail below.
These conditions may be modified by the Planning and Zoning Commission. Any other
conditions recommended by the Commission will be included in the proposed ordinance
considered by City Council.

Land use
In 2015, the zoning ordinance was amended to create new land use types for restaurants.
One of the land use types is "quick service restaurant," commonly referred to as a fast
food restaurant. This land use requires approval of a special use permit in the C-1
(Commercial) zoning district.
Landscaping
During the application review, it was noted that the existing landscaping on the site was
not in compliance with the approved landscape plans for the property. There are
numerous trees and shrubs missing from the site that must be reestablished on the
property. The applicant provided a landscape plan that indicates trees and shrubs will be
reestablished on the site to replace the missing plant materials. The site provides a
landscaped area covering 19% of the lot. The proposed improvements are shown on the
site plan exhibit and include the following elements-
1. Cedar elm trees, shrubs, and ornamental grasses would be installed in the
landscape setback adjacent to Rufe Snow Drive
2. Shrubs and ornamental grasses would be installed in the landscape setback
adjacent to Hightower Drive.
3. A Cedar elm tree and shrubs would be installed in the area north of the drive
through lane and pickup window on the north side of the building.
LAND USE PLAN: This area is designated on the Land Use Plan as Retail Commercial.
This designation provides sites for community and regional shopping centers, commercial
establishments, and employment centers. These sites are typically located on highways
and major thoroughfares at key intersections.
CURRENT ZONING: The property is currently zoned C-1 Commercial. This district is
intended to provide for development of retail service and office uses principally serving
community and regional needs. The district should be located on the periphery of
residential neighborhoods and be confined to intersections of major arterial streets. It is
also appropriate for major retail corridors as shown on the comprehensive plan.

7100 Rufe Snow Drive, North Richland Hills,Texas
This Special Use Permit (SUP) must adhere to all the conditions of the North Richland Hills Code
of Ordinances, as amended, and the base zoning district of C-1 (Commercial). The following
regulations shall be specific to this Special Use Permit. Where these regulations conflict with or
overlap another ordinance, easement, covenant or deed restriction, the more stringent
restriction shall prevail.
A. Permitted land uses. A special use permit is authorized for a quick service restaurant on the
property.
B. Site development standards. Development of the property shall comply with the
development standards of the C-1 (Commercial) zoning district and the standards described
below.
1. The site improvements must be constructed as shown on the site plan attached as Exhibit
„C

2. Landscaping must be installed as shown on the site plan attached as Exhibit "C" and the
standards described below.
a. All landscaped areas must be watered by an automatic underground irrigation system
equipped with rain and freeze sensors. All large and ornamental trees must be on
bubbler/drip irrigation on separate zones from turf grass.
b. The landscaping must be installed prior to the issuance of a certificate of occupancy.
3. The drive-through components on the site must comply with Section 118-633(26) of the
zoning ordinance.
C. Building design standards. Building design and appearance must comply with the building
elevations attached as Exhibit "C" and the standards described below.
1. Signs on the site must comply with Chapter 106 (Signs) of the Code of Ordinances.
D. Amendments to Approved Special Use Permits. An amendment or revision to the special use
permit will be processed in the same manner as the original approval. The application for an
amendment or revision must include all land described in the original ordinance that
approved the special use permit.
E. Administrative Approval of Site Plans. The development is subject to final approval of a site
plan package. Site plans that comply with all development-related ordinances, and this
Ordinance may be administratively approved by the Development Review Committee.
The city manager or designee may approve minor amendments or revisions to the standards
provided the amendment or revisions does not significantly:
1. Alter the basic relationship of the proposed uses to adjacent uses;
2. Change the uses approved;
3. Increase approved densities, height, site coverage, or floor areas;
