Present: Sally Bustamante Civil Service Chairperson, Place 1 September Daniel Civil Service Commission, Place 2 Melissa Kates Civil Service Commission, Place 3 Gregory Hoffa Civil Service Commission, Place 5 Justin Paeltz Civil Service Commission, Ex-Officio Staff Members: Patrick Hillis Director of Human Resources Ellen Cooper Human Resources Analyst Sabrina Markum Human Resources Generalist 1.CALL TO ORDER Chairperson Sally Bustamante called the meeting to order at 6:00 P.M. on July 15, 2020 for Appeal Number 2020-01. 2.APPROVAL OF MINUTES Sally Bustamante asked for approval of the minutes from the January 23,2020 meeting. Melissa Kates made the first motion,September Daniel made the second motion.The Commission unanimously approved the minutes. 3.SWEARING IN OF WITNESSES Sally Bustamante asked all witness to stand as she swore them in,City Attorney Maleshia McGinnis evoked"the ruling."Witnesses made the required exit out of the council chambers to be called in at a later time in the hearing. 4.OPENING ARGUMENTS City Attorney Maleshia McGinnis presented opening arguments defending disciplinary action of City employee John Hyde,which were implemented by Jimmy Perdue in regards to direct violations of Special Order 2020-02. Appellant's Attorney John Snider presented opening arguments requesting dismissal of John Hyde's 8-hour unpaid suspension. 1 of 3 5. DEFENDANT CALLED TO STAND Director of Public Safety and Chief of Police,Jimmy Perdue,is called to the stand.City Attorney Maleshia McGinnis begins questioning in regards to John Hyde's violations of Special Order 2020-02 and the decision for discipline Defendant is passed to Attorney John Snider for questioning. Defendant is passed again to City Attorney Maleshia McGinnis for further clarifications.Jimmy Perdue exits the stand by approval of Civil Service Commission Chair Sally Bustamante. 6.WITNESSES CALLED TO STAND City Attorney Maleshia McGinnis begins to call witnesses to the stand one by one. Each witness is questioned by City Attorney Maleshia McGinnis and Appellant Attorney John Snider in regards to knowledge of Special Order 2020-02, knowledge of memorandums passed throughout the department and recollection of multiple events that occurred while Special Order 2020-02 was being violated by employee John Hyde.After questioning,each witness exits the stand by the approval of Civil Service Commission Chair Sally Bustamante. The following witnesses testified in this order:Officer Kevin Mackenzie,Officer Ken Boyer,Sgt.Dustin Black, Lt.Ed Wright,Captain Kevin Palmer,Officer Chad Hathorn,Officer Dan Hollister,Assistant Chief of Police Rick Scott. 7.APPELLANT CALLED TO STAND Officer John Hyde is called to the stand.Attorney John Snider begins questioning the events that led to the direct violations of Special Order 2020-02.Appellant is passed to City Attorney Maleshia McGinnis for further questioning and clarification on those events Officer John Hyde exits the stand by approval of Civil Service Commission Chair Sally Bustamante. 8. FINAL ARGUEMENTS Appellant Attorney John Snider presents closing arguments requesting dismissal of John Hyde's 8-hour unpaid suspension. City Attorney Maleshia McGinnis presents closing arguments defending disciplinary action of City employee John Hyde regarding direct violations of Special Order 2020-02.Civil Service Commission exits the Council Chambers to deliberate at 11:34 P.M. on July 15,2020. 9 COMMISSION DECISION The Civil Service Commission returns to the Council Chambers with their decision at 12.18 A.M on July 16, 2020.Sally Bustamante made the first motion, Melissa Kates made the second motion The 8-hour suspension for Officer John Hyde by Chief Perdue is unanimously upheld by the Commission. 10.ADJOURMENT Sally Bustamante called for meeting adjournment.September Daniel made the first motion and Melissa Kates made the second.The motion passes and the meeting adjourned. 2 of 3 Sally Bustaman e, Civil Serv' ommission Chair , Patrick H. is, Director of Human Resources 3 of 3
