In compliance with the Texas Open Meetings Act and in accordance with
Section 418.016 of the Texas Government Code and such action issued by
the Governor of Texas on March 16, 2020, the North Richland Hills City
Council will conduct its regular meeting via video conference in order to
advance the public health goal of limiting face-to-face meetings (also called
"social distancing") to slow the spread of the Coronavirus (COVID-19). There
will be no public access to the City Hall location described above, unless
otherwise noted.

SUBJECT: Discuss service level requirements for proposals for solid waste and
recycling services.

SUMMARY:
On January 11, 2021 City Council approved the final 1-year contract extension with
Republic Waste Services of Texas, Ltd. and directed staff to schedule a work session
item to discuss service levels to include in the request for proposal to be issued for solid
waste and recycling services.
GENERAL DESCRIPTION:
The City of North Richland Hills has contracted with Republic Waste Services of Texas,
Ltd. (formerly Duncan Waste) since 2008. The current contract, including two (2) optional
1 year extensions, expires on January 31, 2022. Because of ongoing customer service
concerns with Republic, it was determined to be in the City's best interest to issue a
request for proposals (RFP) for a new contract that would commence on February 1,
2022.
The current contract terms include:
• Twice a week "take all" service on Monday/Thursday or Tuesday/Friday
o Including up to 4 cubic yards of bundled and bulky waste per week
• Once a week residential curbside recycling on one of the regularly scheduled trash
days
o Only collect what fits in the recycling cart
• Curbside Christmas tree collection, plus central drop-off locations
o 2 curbside days and 2 drop off locations
• Landfill privileges for residents twice a year
• Free trash and recycling service for city facilities, including Iron Horse Golf Course
• 84 free roll-off hauls
o Includes regular city operations as well as community events
o This amount is exceeded each year
• Free landfill privileges for city operations up to 400 cubic yards per month
o Excess of 400 cubic yards charged per rate schedule
• $15,000 donation each year to Keep NRH Beautiful
0 $10,000 per year donation for senior programming

Staff has researched services provided to residents of other North Texas cities to
determine what service level enhancements could be included in a new contract. The
cities surveyed included cities serviced by Republic Waste as well as other trash
companies. These services include:
• Home collection and/or drop off locations for electronics disposal
• Curbside collection of household hazardous waste
• "Green" collections that do not get disposed of in a landfill
• Periodic "bulky" collection in addition to take all service
• Leaf collection during "leaf season"
• Collection of cardboard that does not fit into recycling container
• Recycling drop off locations
• Free landfill entry for residents (not limited to 2 times per year)
• Storm debris cleanup collections
In the past, the request for proposal (RFP) was written in such a way that it required a
proposal for general service requirements plus allowed for "alternate" proposals for
service modifications and/or enhancements. Drafting the RFP in such a way provides a
means to do an apples to apples comparison for what is determined to be the general
requirements, as well as considerwhich modifications/enhancements to the service levels
would be desirable and/or affordable.
Staff has been in contact with a consultant to assist us with drafting the request for
proposal. Additionally, they would work with us to evaluate the proposals we receive,
assist with negotiations as well as help us in drafting a contract. While the cost for this
service is below the amount requiring City Council approval, staff is seeking City Council
consensus on whether or not to engage with an outside consultant.
In summary, staff is seeking City Council input on the following:
• What services you would like to see included in the general service requirements?
• Is City Council in agreement with accepting alternate proposals for service
modifications/enhancements?
• Is there City Council consensus to use a consultant to assist us in the procurement
of a new solid waste and recycling vendor/contract?

The City Secretary's Office prepares action minutes for each City Council meeting. The
minutes for the previous meeting are placed on the consent agenda for review and
approval by the City Council, which contributes to a time efficient meeting. Upon
approval of the minutes, an electronic copy will be uploaded to the City's website.

Mayor Trevino stated in accordance with the Texas Governor's March 13, 2020 Disaster
Declaration and subsequent suspension of certain Texas Open Meetings Act Provisions,
this January 25, 2021 meeting of the North Richland Hills City Council is hereby called to
order at 6.00 p.m.
Mayor Trevino stated that tonight's meeting will be conducted using Webex video
conference in order to observe physical distancing to mitigate the spread of COVID-19.
Mayor Trevino conducted a roll call of City Council members to confirm the presence of
a quorum.

REGARDING PARKING SURFACES ON PUBLIC PROPERTY WITHIN A
FLOODPLAIN.

Mayor Trevino opened the public hearing and called on Director of Planning Clayton
Comstock to introduce the item.

Mr. Comstock informed City Council the proposed text amendment provides for the use
of alternative parking surface materials (permeable) for public property located within a
floodplain. If approved, the following language will be added to Chapter 118, Section
118-831(f) minimum parking requirements "(11) Exception for city-owned property
within floodplain. Parking, driving, and maneuvering areas located on city-owned
property within FEMA-designated floodplain zone and used for passive open space
recreation may be constructed of permeable parking surfaces such as permeable
asphalt, permeable concrete, permeable pavers, or flexible base. Flexible base must
meet minimum testing standards established by the Texas Department of Transportation
and be approved by the City Engineer."
Mr. Comstock stated that the revision would allow a small flex-base parking lot area to be
installed within the floodplain of Fossil Creek off of Onyx Drive. The Planning and Zoning
Commission, at their January 25, 2021 meeting, recommended approval with a vote of
6-0.
In response to Council member Deupree's question, Mr. Comstock informed City Council
he believes the permeable parking material is durable and will not wash away.
Director of Public Works Caroline Waggoner informed City Council the permeable
material is required to be compacted upon installation. The application of permeable
material would not be applied in every circumstance and staff would not recommend it in
a high velocity floodway.
Mayor Trevino asked Assistant City Secretary Traci Henderson to call on those who
completed a public meeting appearance form to speak during the public hearing. There
being no forms submitted, Mayor Trevino asked if there was anyone on the video
conference wishing to speak for or against the item to raise their hand. There being no
one wishing to speak, Mayor Trevino closed the public hearing.

A CONSTRUCTION CONTRACT BY TARRANT COUNTY TO EXCEL 4
CONSTRUCTION, LLC FOR THE MATSON STREET SANITARY SEWER
IMPROVEMENTS PROJECT FOR THE 46TH ANNUAL COMMUNITY
DEVELOPMENT BLOCK GRANT PROJECT IN THE TOTAL CONTRACT
AMOUNT OF $228,896.50.

Director of Public Works Caroline Waggoner informed City Council the resolution
number on the agenda is incorrect and should read Resolution No. 2021-004. The
request is to award a construction contract by Tarrant County to Excel 4 Construction,
LLC for the Matson Street sanitary sewer improvement project. The project consists of
reconstructing approximately 1,300 linear feet of sanitary sewer main.
Ms. Waggoner stated that the Community Development Block Grant (CDBG) funding will
cover 100% of the cost for design and construction. Ms. Waggoner informed City
Council the project came in under budget and staff is working with Tarrant County and
the contractor to expand the scope of the project.

(ST2110).

Director of Public Works Caroline Waggoner informed City Council this is the first
project associated with the successful 2020 bond election for street projects. The
request is a professional services agreement for engineering design services with
Binkley and Barfield, Inc. for the reconstruction (approximately 3,100linear feet) of
Glenview Drive from Honey Lane to the city limit. The improvements include
reconstructing the existing roadway with reinforced concrete and the addition of
sidewalks where possible. The road will be rebuilt to its current width.

Director of Public Works Caroline Waggoner informed City Council this is the second
project associated with the successful 2020 bond election for street projects. The
request is a professional services agreement for engineering design services with Kimley
Horn and Associates, Inc. for the reconstruction (approximately 2,800linear feet) of
Bedford Euless Road from Booth Calloway to Strummer. The improvements include
reconstructing the existing roadway with reinforced concrete and the addition of
pedestrian facilities on the south side of the roadway to supplement the existing trail
located on the north side of the roadway. The road will be reconstructed within the
existing right-of-way based on the 2019 Transportation Plan recommendation to be
reduced to a three-lane configuration.

Alamo, LLC to facilitate the reopening of the Alamo Drafthouse Cinema located at 8380
Davis Boulevard. The City Council, at their February 7, 2019 meeting, approved an
economic development 380 program agreement for the construction of the 32,000 square
foot theater. Shortly after Alamo Drafthouse opened their doors in April 2019, the theater
closed due to the economic impact of COVID-19. The City was approached by North
Richland Hills Alamo, LLC to amend the economic development incentive advance to

entrepreneurs. If you know someone who is thinking of starting a business or if you
might be starting a business yourself, 1 Million Cups may be able to help. Please contact
the NRH Economic Development Department for more information.
The City of NRH and Republic Services remind residents to have your garbage and
recycling on the curb by 7.00 a.m. on your day of service. Recent changes to collection
routes have changed the time of day that some neighborhoods are collected. To ensure
your garbage and recycling is picked up, you should always have them on the curb by
7.00 a.m.
Kudos Korner - Maintenance Staff in the Parks Department - A resident called to
complement our Parks & Recreation Department on how well they take care of Northfield
Park. He walks in the park daily and he always sees staff out there tending to the area.

September 1, 2020, includes a compensation increase for the TAG Center
Administrator equivalent to the 2020 Dallas-Fort Worth Locality Pay GS Grade 14-2
for the period September 1, 2020 — December 31, 2020, and the 2021 Dallas-Fort
Worth Locality Pay GS 14-2 for the period January 1, 2021 — August 31, 2021, to
include 30% fringe rate increasing the total annual rate of compensation to
$157,660.10.
General Description:
Pursuant to the FY 2021 grant award for the TAG Center by the Office of the Governor,
the City of North Richland Hills as the grant fiduciary is charged with conducting
transactions for the grant on behalf of the TAG Center. As such, effective January 1,
2021 , the total annual rate of compensation for the services rendered by the TAG
Center Administrator increased to $157,660.10, rendered in equal installments of

The parties to this Independent Contractor Agreement ("Agreement"), are the City of North
Richland Hills, Texas, a home rule municipality located in Tarrant County, Texas ("City"), and Kevin
Scott McRory ("TAG Center Administrator"). For convenience, the City and the TAG Center
Administrator may be referred to collectively as "parties" and individually as a "party."
WHEREAS, the parties hereto in 2019 entered into an agreement ("Original Agreement")
for contracted services; and,
WHEREAS, the FY21 Texas Anti-Gang Program (TAG) Grant #2848906 budget, effective
September 1, 2020, includes a compensation increase equivalent to the 2020 Dallas-Fort Worth
Locality Pay GS Grade 14-2, September 1, 2020 - December 31, 2020, and the 2021 Dallas-Fort
Worth Locality Pay GS Grade 14-2, January 1, - August 31, 2021, to include 30% fringe for the TAG
Center Administrator;
NOW THEREFORE, for and in consideration of the mutual promises and covenants set forth in this

funds and to the extent they are included in TAG's approved fiscal year budget, NRH will reimburse
the TAG Center Administrator for transportation reimbursed at the current IRS standard mileage
rate per mile, lodging, subsistence, and related items incurred while traveling on official TAG-related
business in support of the grant's objectives. The TAG Center Administrator is not entitled to receive
and is prohibited from accepting any compensation or other benefit from either the City or from any
other person or entity in exchange for the TAG Center Administrator's services rendered under this
Agreement except as provided in this Agreement.

SUMMARY:
The Office of the Governor's Criminal Justice Division (CJD) has announced the FY22
Violence Against Women Justice and Training Program Grant #3367205 authorized by
the Violence Against Women Act (VAWA) of 1994. The Police Department will use the
funds as a renewal of the FY22 VAWA grant-funded detective position focusing on violent
offenses against women.
GENERAL DESCRIPTION:
The Police Department is seeking authorization to apply for and utilize continuation grant
funds offered through the CJD's Violence Against Women Justice and Training Program.
To combat the many and varied forms of crimes against women, this program promotes
a coordinated, multi-disciplinary approach to reduce domestic violence, dating violence,
sexual assault, and stalking through targeted investigations and prosecution, targeted
response operational support. The detective position funded by the FY18 grant award
was staffed October 1, 2017.
The total grant application is for $142,857.14. There is a 30% match requirement.
Volunteer hours valued at $25,379.81 will be applied as an in-kind match. The remaining
$17,477.33 will be met as a cash match to cover additional personnel costs with the grant
providing $100,000.00.

WHEREAS, The City of North Richland Hills, Texas possesses legal authority to apply
and make appointments for the conduct of business relative to the
Governor's Office Criminal Justice Division Violence Against Women
Justice and Training Program Grant #3367205; and
WHEREAS, The City of North Richland Hills, Texas finds it in the best interest of the
citizens of North Richland Hills that we request the funds available under
this Program to strengthen effective law enforcement, prosecution and
court strategies to combat family violence, sexual assault, dating violence,
stalking crimes against women and to develop and strengthen victim
services in such cases; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
NORTH RICHLAND HILLS, TEXAS, THAT:
SECTION 1. The City Council of the City of North Richland Hills hereby finds that the

SECTION 3. The City Council of North Richland Hills agrees to provide 30% of the total

SUMMARY:
The Office of the Governor's Criminal Justice Division ("CJD") has announced the FY22
General Victim Assistance Grant Program funded under the Victims of Crime Act. The
purpose of the program is to provide services and assistance directly to victims of crime
to speed their recovery and aid them through the criminal justice process. The Police
Department is seeking authorization to apply for FY22 grant funding to fund the Victim
Assistance Program's ("VAP") personnel, related costs and equipment.
GENERAL DESCRIPTION:
The partner cities of North Richland Hills (NRH), Haltom City, Richland Hills, and Watauga
entered into a Joint Crime Victim Assistance Program Interlocal Agreement
("Agreement") effective October 1, 2018 to provide prompt, comprehensive and
compassionate victim services to all victims of violent crime in the four cities. As provided
in Section 3 Scope of Services of the Agreement, NRH is responsible for the management
of the program and the application for available grant funding to fund the VAP's personnel,
related costs, and equipment needed to effectively provide services to crime victims.
The Police Department is seeking authorization to apply for grant funding, offered through
the CJD's FY22 General Victim Assistance Grant Program, in the total amount of
$251,837.50. There is a 20% match requirement, which equals $50,367.50 with the grant
providing $201,470.00 over the 12-month period. The matching requirements and
additional program costs will be shared with the partner cities based on percentages
outlined for program expense sharing. The NRH portion will be included in our CCD fund
budget.

impact of the crime, aid in survivor's recovery and encourage participation
in the criminal justice system; and
WHEREAS, The City Council of North Richland Hills desires to respond to the emotional
and physical needs of crime victims in the four-city area by providing
trained crime victim advocates to assist them throughout the process and
beyond once any criminal proceedings are concluded.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
NORTH RICHLAND HILLS, TEXAS, THAT:
SECTION 1. The City Council hereby finds that the recitals set forth above are true and
correct and are incorporated into this Resolution as if written herein.
SECTION 2. The City Council of the City of North Richland Hills hereby authorizes and
approves the submission of the application and acceptance if awarded for
the Governor's Office Criminal Justice Division FY22 General Victim
Assistance Grant Program, Grant #3544403.
SECTION 3. The City Council of North Richland Hills agrees to provide 20% of the total
project for the required match funding.

The Office of the Governor's Criminal Justice Division (CJD) has announced the FY2022
Edward Byrne Memorial Justice Assistance Program, Grant #4269801 , made available
through the Bureau of Justice Assistance. The Police Department will use the grant funds
for the purchase of a portable video event detection and alerting system that would be
used in support of planned City events or critical incidents to minimize the risk of property
loss and danger.
GENERAL DESCRIPTION:
The Police Department is seeking authorization to apply for and utilize grant funds offered
through the CJD's Edward Byrne Memorial Justice Assistance Program. Funding through
the program may be used to provide additional equipment, supplies, training and
information systems for law enforcement. The department will use the grant funds for the
purchase of a portable video detection and alerting system. The self-contained system
provides real-time remote site monitoring suitable for unmanned operations. The tamper-
resistant unit is powered by maintenance-free batteries and an automated solar-based
charging system. The unit contains a telescoping 20-foot vertical tower, integrated
camera and sensor-controlled LED lights. The detection and alerting capabilities
operational during special events or longer-term deployments will help minimize danger
and provide safety of property and assets of the City and its citizens.
The total grant request will not exceed $100,000 and there is no match requirement. The
specified goals, objectives and targets for the project are being developed and will be
completed before the February 11, 2021 grant submission deadline.

General Description:
The City of Helotes is requesting to enter into an interlocal agreement for the purchase
of goods and services from vendors selected through the competitive bidding process.
The City of Helotes is interested in purchasing from a current City of North Richland Hills
contract for Slurry Sealing (RFB 20-019, Intermountain Slurry Seal). Council has
authorized several of these interlocal agreements in the past and they have been
mutually beneficial to North Richland Hills and the other agencies. Participation
reduces the overall expense of soliciting bids and purchasing in larger quantities
often lowers the cost of the goods and/or services. Each agency will place its orders
and pay the vendors directly. The City of North Richland Hills or the City of Helotes may
change or cancel the agreement with a 30-day written notice. North Richland Hills
currently participates in interlocal agreements with several local governments
throughout the DFW Metroplex and various parts of Texas.
Recommendation:

Section One. Approval. The Interlocal Agreement between the City of Helotes and City of
North Richland Hills to facilitate the procurement of goods and services is hereby approved and
attached hereto as Exhibit A.
Section Two. Authorization. The Mayor is authorized to execute said Agreement and the
City Administrator is authorized to take all necessary steps to implement the provisions of this
Resolution.
Section Three. Recitals. The City Council finds all of the above recitals to be true and
correct and incorporates the same in this Resolution as findings of fact.
Section Four. Severability. If any section, subsection, sentence, clause, or phrase of this
Resolution is for any reason held to be unconstitutional or illegal,such decision shall not affect the
validity of the remaining sections of this Resolution. The City Council hereby declares that it would
have passed this Resolution,and each section,subsection,clause,or phrase thereof,irrespective of
the fact that any one or more sections, subsections, sentences,clauses,or phrases be declared void.

This Agreement made and entered into by and between the City of North
Richland Hills, Texas, hereinafter referred to as "NRH", and the City of Helotes, Texas,
hereinafter referred to as "HELOTES".
Pursuant to the authority granted by the Texas Interlocal Cooperation Act
{Chapter 791 Texas Government Code} providing for the cooperation between local
governmental bodies, the parties hereto, in consideration of the premises and mutual
promises contained herein, agree as follows:
NRH and HELOTES desire to enter into an Agreement for the purchase of goods
and services from vendors selected through the competitive bidding process as
authorized by Section 791.025 Tx. Govt. Code. Specifications for said items should be
determined in cooperation with the final approval of the entity processing the bid.
The responsibility of each entity shall be as follows:
1. NORTH RICHLAND HILLS
1. NRH shall be allowed to purchase goods and services from vendors who have
been selected by HELOTES through the competitive bidding process. NRH will
place orders directly with and pay directly to the selected vendor for goods and
services purchased through a contract.
2. All purchases will be within the specifications that have been agreed to. NRH
shall be responsible for the Vendors compliance with all conditions of delivery,
price and quality of the purchased goods or services.
3. NRH shall give a 34-day written notification to all participating agencies of any
change or cancellation of participation.
4. The Purchasing Agent, shall be designated as the official representative to act for
NRH all matters relating to this cooperative purchasing agreement.

III. MISCELLANEOUS

This Agreement may not be altered, amended, or modified except in writing
signed by all parties to this Agreement. No official, agent, employee, or
representative of either North Richland Hills or Helotes has the authority to alter,
amend, or modify the terms of this Agreement.
2. Any clause, sentence, paragraph or article of this Agreement which is determined
by a court of competent jurisdiction to be invalid, illegal, or unenforceable in any
respect shall not be deemed to impair, invalidate, or nullify the remainder of this
Agreement if the Agreement can be given effect without the invalid portion.
3. Any act of forbearance by either party will not constitute and will not have the
effect of an amendment of this Agreement. The failure of either party to exercise
any right under this Agreement under certain circumstances does not imply a
waiver of such right under like circumstances later occurring.
4. This Agreement shall be governed by, and construed in accordance with, the
laws of the State of Texas.
5. This Agreement shall take effect upon execution by the signatories and shall be
in effect from date of execution until terminated by either party with thirty (30)
written notice.

SUBJECT: Consider and approve Resolution No. 2021-011, calling the May 1,
2021 City Council Election, and authorizing the Mayor to execute a
joint election agreement with Tarrant County and other political
subdivisions for election services.

SUMMARY:
The City Council is required by the Texas Election Code to order the city's general
election of officials. Resolution No. 2021-011 orders the city's election for May 1, 2021.
The resolution also authorizes the city to hold its election jointly with other Tarrant
County entities, contract with Tarrant County to administer the joint election, and
establishes voting locations.
GENERAL DESCRIPTION:
The City Secretary's Office is responsible for conducting municipal elections as
prescribed by the Election Code of the State of Texas and the City of North Richland
Hills' City Charter.
The City Charter states that the governing body of the city shall consist of a Mayor and
seven (7) Council persons who shall be elected for terms of two years. All places,
including the Mayor, will be elected at large. The Mayor and Council persons in Places
2, 4, and 6 shall be elected in even-numbered years and Council persons in Place 1, 3,
5 and 7 elected in odd-numbered years.
Pursuant to Section 3.004 of the Texas Election Code, the governing body of a political
subdivision shall order the general election. An election may only be held on a uniform
election date - first Saturday in May or the first Tuesday after the first Monday in
November.
In accordance with state law, Resolution No. 2021-011 orders the city's general election
of officials to be held on May 1, 2021. Persons elected to offices of City Council Places
1, 3, 5 and 7 shall be for a term of two years. The resolution establishes Election Day
voting locations, provides for the appointment of election officials, early voting and
Election Day procedures, and authorizes the Mayor to execute a joint election
agreement and contract for election services with Tarrant County.

The filing period for the 2021 general election began January 13, 2021 and concludes
on February 12, 2021. Candidates will file their completed application with the City
Secretary's Office during the business week between the hours of 8.00 a.m. and 5.00
p.m.
Early voting will begin April 19, 2021 and continue through April 27, 2021. In the event a
run-off election should be needed, the resolution sets June 5, 2021 as the run-off date,
provides for early voting days and times and allows the contract with Tarrant County to
be extended to the run-off election.
Tarrant County has been approved to utilize vote centers on Election Day. The Tarrant
County Commissioner's Court approved participation in the countywide polling place
program. This allows qualified voters the ability to cast their ballot on Election Day at
any polling location within Tarrant County. Previously, qualified voters were required to
cast their ballot on Election Day at their preassigned polling location based on their
precinct.
As in previous years, the city's election will be held jointly with other Tarrant County
political entities holding an election to be administered by Tarrant County. Following the
filing period (February 12, 2021), Tarrant County will provide a finalized contract that
includes all entities participating and holding an election. It is anticipated that the
election contract will be similar to previous contracts with the county and will include the
following provisions:
• Tarrant County Elections Administrator, or his designee, will serve as the
administrator of the joint election with each participating entity and be responsible for
decisions and actions as required by law.
• Early voting will be conducted jointly with all participating entities beginning on April
19, 2021 and ending on April 27, 2021 at the locations and times established by the
county. North Richland Hills voters may vote early at:
+ Tarrant County Elections Center, 2700 Premier, Fort Worth; (Main Early Voting
Location)
+ Dan Echols Center, 6801 Glenview Drive;
+ North Richland Hills Library (Community Room), 9015 Grand Avenue; or
+ any of the other joint early voting locations within Tarrant County.
• Voting will be conducted exclusively on the county's Hart InterCivic Verity Voting
System. This hybrid system provides a paper trail for every voter, combined with the
latest advancement in digital security.
• Ballots that contain content for more than one joint participant because of
overlapping territory will be arranged in the following order: Independent School
District, City, Water District(s), College District and other political subdivisions.
• Vote Centers on Election Day — qualified North Richland Hills voters are able to cast
their ballot at any polling location within Tarrant County.
• The Tarrant County Elections Administrator will release unofficial cumulative totals
and precinct returns of the election as precincts report to the central and remote

tabulating stations and the returns are tabulated. The unofficial cumulative totals and
precinct returns will be released to the joint participants, candidates, press and
general public by distribution of hard copies at the central counting station (2700
Premier Street, Fort Worth) and by posting to the county web site. Each participating
entity will receive their election results from the county's website.
• Election expenses will be allocated among the participating entities.
• The Elections Administrator will be the general custodian of the voted ballots and all
records of the joint election.

PLACES 1, 3, 5 AND 7 FOR A TERM OF TWO YEARS; ESTABLISHING
ELECTION DAY VOTING LOCATIONS, CANDIDATE FILING PERIOD,
EARLY VOTING, RUNOFF ELECTION, METHOD OF VOTING, AND
PUBLICATION AND POSTING REQUIREMENTS; AND AUTHORIZING
JOINT ELECTION AGREEMENTS AND SERVICES.
WHEREAS, the City of North Richland Hills, Texas ("City") is a home rule city acting
under its charter adopted by the electorate pursuant to Article XI, Section
5 of the Texas Constitution and Chapter 9 of the Local Government code;
and
WHEREAS, the City of North Richland Hills Charter provides that city elections shall be
held in accordance with laws of the State of Texas; and
WHEREAS, Section 41.001(a)(1-2) of the Texas Election Code establishes the first
Saturday in May as a uniform election date for the purposes of conducting
a General Election; and
WHEREAS, Section 3.004(b) of the Texas Election Code provides that the governing
body of a municipality shall be the authority to order a General Election for
the purposes of electing members to the governing body; and
WHEREAS, the City will enter into joint election agreements and contracts for general
election services with Tarrant County pursuant to Texas Election Code
("Code) Sections 31.092 and 271.002.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
NORTH RICHLAND HILLS, TEXAS:
Section 1. That the recitals set forth above are true and correct and are hereby
incorporated into and made a part of this Resolution.
Section 2. General Election Called. An election is hereby called to elect persons to
the office for City Council Places 1, 37 5 and 7 to serve from May 2021
until May of 2023, or until their successors are duly elected and qualified.
The election shall be held on May 1, 2021 between the hours of 7.00 a.m.

Qualified North Richland Hills voters will also be able to cast their ballots
at any countywide polling location on Election Day.
Section 3. Application for Place on Ballot. Qualified persons may file as
candidates by filing with the City Secretary, or her designee, between the
hours of 8.00 a.m. and 5.00 p.m., Monday through Friday, beginning
January 13, 2021, and ending February 12, 2021. Each application for a
place on the ballot shall be accompanied by either a filing fee of One
Hundred Fifty ($150.00) Dollars payable to the City, or in lieu of the filing
fee, a petition seeking the candidate's name to be placed on the ballot.
Such petition must be signed by at least one hundred fifty (150) qualified
voters of the City.
Section 4. Joint Election Agreements Approved. The Mayor is authorized to enter
into joint election agreements and other contracts as necessary for
election services with Tarrant County conducted under the authority of
Chapter 271 of the Election Code (the "Agreements"). The election shall
be conducted pursuant to the election laws of the State of Texas.
Section 5. Early Voting.
a. Early voting by personal appearance. Early voting by personal
appearance will be held jointly with other political subdivisions in
Tarrant County beginning on April 19, 2021 and will continue through
April 27, 2021 at the locations established by Tarrant County on the
dates and times as follows or as may be amended by Tarrant County:
April 19 —April 23 8.00 a.m. to 5.00 p.m.
April 24 7.00 a.m. to 7.00 p.m.
April 26 11.00 a.m. to 4.00 p.m.
April 26 —April 27 7.00 a.m. to 7.00 p.m.

b. Early voting by mail. Tarrant County Chief Elections Administrator,
or his designee, is hereby designated as Early Voting Clerk for the
city's election. The Tarrant County Chief Elections Administrator may
appoint other deputy early voting clerks as necessary. Applications for
early voting by mail may be delivered to the Chief Elections
Administrator at the following address: Early Voting Clerk, 2700
Premier Street, Fort Worth, Texas 76111, beginning January 1, but not
later than April 20, 2021 if delivered by mail. Early voting by mail
ballots shall be mailed to the Chief Elections Administrator at the same
address.
c. Early voting by Ballot Board. Early voting, both by personal
appearance and by mail, shall be canvassed by the Early Voting Ballot
Board, which is hereby created. The Presiding Election Judge and
Alternate Presiding Election Judge, as set forth in the Agreements,
shall serve as the presiding officer and alternate presiding officers,
respectively, of the Early Voting Ballot Board. The other election
officers serving at the election shall serve as the other members of the
Early Voting Ballot Board.
Section 6. Runoff Election. In accordance with Section 2.025 of the Texas Election
Code, in the event no candidate receives a majority of votes for an office,
there shall be a runoff election held on June 5, 2021. The polling place on
Election Day for the runoff election shall be at the same polling places as
those of the original election, or as amended, and the hours of voting shall
be between 7.00 a.m. and 7.00 p.m. Early voting by personal appearance
shall be held at the same locations set out in Section 5 on the dates and
times as follows or as may be amended by Tarrant County:
May 24 — May 28 8.00 a.m. 5.00 p.m.
May 29 7.00 a.m. — 7.00 p.m.
May 30 11.00 a.m. —4.00 p.m.
May 31 — June 1 7.00 a.m. to 7.00 p.m.
Section 7. Method of Voting. Early voting by personal appearance and voting on
Election Day shall be conducted exclusively on Tarrant County's Hart
InterCivic Verity Voting System. All expenditures necessary for the
conduct of the election, the purchase of materials therefore, and the
employment of all election officials are hereby authorized, and shall be
conducted in accordance with the Agreements and the Code.

Section 8. Governing Law and Qualified Voters. The election shall be held in
accordance with the Constitution of the State of Texas and the Code, and
all resident qualified voters of the City shall be eligible to vote at the
election.
Section 9. Publication and Posting of Notice of Election. Notice of the election
shall be given as required by Chapter 4 of the Code.
Section 10. Necessary Actions. The Mayor is authorized to execute a joint election
agreement and contract for election services with Tarrant County whereby
Tarrant County will provide all material, supplies and personnel to hold the
election contemplated hereby, including any runoff election which may be
required, and will be responsible for coordinating, supervising and
administering the joint election. This resolution shall be construed with
any action of the governing bodies of other Tarrant County political
subdivisions providing for the conduct of a joint election as herein
contemplated. The Mayor and the City Secretary of the City, in
consultation with the City Attorney, are hereby authorized and directed to
take any and all actions necessary to comply with the provisions of the
Code in carrying out and conducting the election, whether or not expressly
authorized herein.

The City Council is requested to consider Mayor Trevino's nomination of Greg Stamps
to serve as the ex-officio member on the Planning and Zoning Commission and the
Capital Improvement Advisory Committee.
GENERAL DESCRIPTION:
On January 11, 2021, the City Council approved Mayor Trevino's recommendation to
appoint Kelvin Deupree to fulfill the vacancy on City Council (Place 7) created by Mr.
Timothy J. Welch's resignation. Mr. Deupree served on the Planning and Zoning
Commission (Place 6) and upon his appointment by City Council, his seat on the
Commission became vacant.
On January 25, 2021, the City Council approved Mayor Pro Tern Turnage's
recommendation to appoint Gregory Hoffa to fulfill the vacancy in Place 6 on the
Planning and Zoning Commission. At the time of his appointment, Mr. Hoffa served as
the ex-officio member on the Planning and Zoning Commission. Subsequently, Mr.
Hoffa's appointment created a vacancy in the ex-officio position.
The position of ex-officio is the mayor's recommendation with confirmation of City
Council. Mayor Trevino recommends the appointment of Greg Stamps to ex-officio on
the Planning and Zoning Commission and Capital Improvement Advisory Committee,
term expiring June 30, 2022. The members of the Planning and Zoning Commission
also serve as the Capital Improvement Advisory Committee.

Children are invited to celebrate Valentine's Day with a Take It / Make It Craft Kit from
the NRH Library. The free kits are available for pickup at the children's area of the
library or through curbside pickup, while supplies last. Please visit the library's website
or give them a call for more information.
The Animal Adoption & Rescue Center will hold a Low Cost Pet Vaccination Clinic on
Saturday, February 27 from 10 a.m. to noon. The clinic will provide rabies shots,
booster shots, city pet licenses and microchips. Please contact the animal shelter for
pricing and more information.
Kudos Korner:
Every Council Meeting, we spotlight our employees for the great things they do. Tonight
we recognize:
Staff and volunteers from the Library, Parks & Recreation, Police, Fire and
Finance Departments — Numerous comments have been received thanking everyone
who is helping to run the COVID-19 vaccine site at the Hurst Convention Center. We've
had over 30 people from NRH working at the center, assisting with everything from
traffic control and check in to data entry and giving shots. Residents have said they are
grateful for how efficiently the site is run, and they have complimented everyone for
being helpful and kind throughout the vaccination process.
