The meeting of the City Council was called to order at 7:30 P.M. by Mayor Calvin F. Luper. PRESENT: Mayor Councilmen: Calvin F. Luper P. M. Dodson J. R. Hubbard Harold B. Daley Dick Faram J. F. Cato J. B. Sandlin M. E. Riddle STAFF PRESENT: City Secretary, Evalyn R. Reed City Attorney, Marion L. Massey Consulting Engineer, William R. Ratliff ABSENT: City Manager, Stephen K. Shutt The invocation at this City Council Meeting was given by Mayor Calvin F. Luper. MINUTES OF THE REGULAR MEETING JUNE 10, 1968 Councilman Faram moved, seconded by Councilman Riddle, that the minutes of the meeting of June 10, 1968 be approved as submitted. The motion carried by a vote of 6-0, with Council- man Daley abstaining due to absence from this meeting. PS 68-1 - Ordinance No. 188 Second Reading A plat vacation approved on first reading by the vote of 6-0 Councilman Sandlin moved, seconded by Councilman Faram, that the Council approve the second read- ing of this Planning and Zoning Case and adopt Ordinance No. 188. The motion carried by a vote of 7-0. PZ 68-4 - Ordinance No. 189 Second Reading A rezoning from Agricultural to MF approved on first reading by a vote of 4-2 Councilman Dodson moved, seconded by Councilman Sandlin, that the Council approve the second reading of this Planning and Zoning Case and adopt Ordinance No. 189. The motion carried by a vote of 6-1 with Councilman Cato voting no. PZ 68-5 - Ordinance No. 190 Second Reading A rezoning from Agricultural to Local Retail approved on first reading by a vote of 4-2 Councilman Daley moved, seconded by Councilman Hubbard, that the Council approve the second reading of this Planning and Zoning Case and adopt Ordinance No. 190. The motion carried by a vote of 6-1 with Councilman Cato voting no. PZ 68-9 - Ordinance No. 191 Second Reading A rezoning from Local Retail to Commercial approved on first reading by a vote of 4-3 Councilman Sandlin moved, seconded by Council- man Hubbard, that the Council approve the second reading of this Planning and Zoning Case and adopt Ordinance No. 191. The motion carried by a vote of 5-2, with Councilmen Cato and Riddle voting no. PZ 68-8 - Ordinance No. 192 Second Reading A rezoning from Agricultural to Local Retail approved on first reading by a vote of 6-0 Councilman Hubbard moved, seconded by Council- man Dodson, that the Council approve the second reading of this Planning and Zoning Case and adopt Ordinance No. 192. The motion carried by a vote of 7-0. PZ 68-7 - Ordinance No. 193 Second Reading A rezoning from Agricultural to MF approved on first reading by a vote of 4-2 Councilman Hubbard moved, seconded by Councilman Sandlin, that the Council approve the second reading of this Planning and Zoning Case and adopt Ordinance No. 193. The motion carried by a vote of 6-1 with Councilman Cato voting no. PZ 68-3 - Ordinance No. 194 First Reading A zoning request by Mr. McClennahan and Mr. Folsom, from Residential to Local Retail Councilman Hubbard moved, seconded by Councilman Dodson, that the City Council approve the recommendation of the Planning and Zoning Commission on PZ 68-3 and adopt Ordinance No. 194. As an amendment Councilman Dodson moved, seconded by Councilman Hubbard, that the Council include an emergency clause in Ordinance No. 194 in order to pass this ordinance on first reading. The motion carried by a vote of 4-3, with Councilmen Dodson, Hubbard, Daley and CONSIDERATION OF CONTRACT WITH KNOWLTON, RATLIFF AND ENGLISH CONSIDERATION OF EASEMENT AND RIGHT OF WAY OFFERS Sandlin voting yes and Councilmen Faram, Cato and Riddle voting no. The original motion carried by a vote of 4-3, with Councilmen Dodson, Hubbard, Daley and Sandlin voting yes and Councilmen Faram, Cato and Riddle voting no. Consulting Engineer, William R. Ratliff, pre- sented Articles of Agreement for Engineering Services to the City Council pertaining to water and sewerage systems within the City of North Richland Hills. Councilman Hubbard moved, seconded by Councilman Dodson, that the City Council approve the contract as presented by Knowlton-Ratliff-English for negotiation, acquisition, improvement and extension of existing water and sewerage systems serving the City of North Richland Hills. The motion carried by a vote of 7-0. The following easement and right of way offers were presented to the council as negotiated and approved by Don Edmonds of the firm of Knowlton- Ratliff-English: 1. PARCEL NO.6 - W. L. Anglin property located on Rufe Snow Drive in the M. Lynch Survey A953. The owner was offered lOt per commercial foot for 1,143.8 square feet. This was a standard offer in the amount of $114.38. The owner accepts this portion of the offer but wants $200.00 for a stone wall across the front of his property. This appears to be a very reasonable offer and therefore its approval is recommended by Don Edmonds and City Manager, Stephen K. Shutt, for a total payment of $314.38. Councilman Dodson moved, seconded by Councilman Hubbard, that the Council accept the recommendation of the City Engineer and City Manager as outlined above. The motion carried by a vote of 7-0. 2. PARCEL NO. 18 - Leo F. Davis, etux, Virginia. The owners were offered $29.97 at lOt per commercial foot, the standard offer. Owners made a counter offer of $29.97 for the property which consists of 299.7 square feet plus $100.00 for shrubs and rose bushes, however, Mr. Edmonds reports that Mr. Davis is firm on this offer and suggests that the difference would not justify condemnation. Since Mr. Davis is accepting the standard lOt per foot offer on the ground itself, City Manager, Stephen K. Shutt, recommends the acceptance of his offer of $129.97 for the parcel and shrubs. Councilman Hubbard moved, seconded by Councilman Daley, that the Council accept and approve the recommendation of the City Manager on this parcel as outlined above. The motion carried by a vote of 7-0. 3. PARCEL NO.8 - Jack F.and Lucille Andrews Eaton. The property owners were offered $39.24 for 392.4 square feet at lOt per square foot. This is the standard offer for commercial ¡:>roperty. The owners are asking an additional $25.00 for the relocation of a wire fence for a total counter offer of $64.24. This seems to be a reasonable offer and City Manager, Stephen K. Shutt, recommends approval. Councilman Daley moved, seconded by Councilman Hubbard, that the Council approve the recommendation of the City Manager as outlined above. The motion carried by a vote of 7-0. ADDITIONAL ITEMS Councilman Dodson moved, seconded by Council- man Sandlin, to allow the Consulting Engineer, William R. Ratliff, to be added to the agenda pertaining to assessment policy and procedure on Rufe Snow Drive and Harwood Road. The motion carried by a vote of 7-0. Councilman Dodson moved, seconded by Council- man Daley, that the Consulting Engineers be allowed to proceed immediately with the City's assessment policies and procedures as previously established in regard to the assessment procedures necessary on Rufe Snow Drive and Harwood Road. The motion carried by a vote of 7-0. ADJOURNMENT There being no further items to be considered at this City Council meeting Councilman Daley moved, seconded by Councilman Sandlin, that the meeting be adjourned.
