ORDINANCE NO. 614
AN ORDINANCE PROVIDING FOR THE LEVY AND COLLECTION OF
AN ANNUAL DIRECT AD VALOREM TAX ON ALL PROPERTY, REAL,
PERSONAL AND MIXED, SITUATED IN THE TERRITORIAL LIMITS
OF THE CITY OF NORTH RICHLAND HILLS, AND ALL PERSONAL
PROPERTY OWNED IN SAID CITY OF NORTH RICHLAND HILLS ON
THE FIRST DAY OF JANUARY, A.D., 1975, EXCEPT SUCH PROPERTY
AS MAY BE EXEMPT FROM TAXATION BY THE CONSTITUTION AND
LAWS OF THE STATE OF TEXAS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND
HILLS, TEXAS:
SECTION 1.
There is hereby levied and there shall be collected as provided by
law, an annual direct special ad valorem tax for the year 1975-76 for General
Fund operations of ONE AND 02/100 DOLLARS ($1.02) on every ONE HUNDRED DOLLAR
($100.00) valuation, being 55% of the appraised valuation, on all property, real,
personal and mixed, situated in and all personal property owned in the City of
North Rich1and Hills, Texas, on the first day of January, A.D., 1975, liable
under the law to taxation and not exempt therefrom by the Constitution and laws
of the State of Texas.
SECTION II.
The ad valorem taxes herein levied and authorized and required to be
collected shall be and become due and payable on the first day of October, A.D.,
1975.
SECTION I I I.
The ad valorem taxes herein levied and authorized and required to be
collected shall become delinquent on the first day of February, A.D., 1976.
SECTION IV.
Should any taxpayer permit his taxes to become delinquent that is to
say, should fail or refuse to pay his taxes then and in the event, a penalty
shall be attached to the payment of such taxes as follows:
If paid in the month of February, one (1%) percent of the taxes and
interest due thereon;
If paid in the month of March, two (2%) percent of the taxes and interest
due thereon;
If paid in the month of April, three (3%) percent of the taxes and
interest due thereon;
If paid in the month of May, four (4%) percent of the taxes and interest
due thereon;
If paid in the month of June, five (5%) percent of the taxes and
interest due thereon;
If paid on or after the first day of July, eight (8%) percent of the
taxes and interest due thereon.
SECTION V.
All deliquent taxes shall bear interest from February 1 at the rate
of one-half of one percent (0.5%) per month, or fraction thereof, until paid.
SECTION VI.
All deliquent taxes, together with all interest and penalties thereon,
as above provided, shall be and become a lien upon the property on which said
taxes are levied.
SECTION VI I.
Should any part, portion, section or part of a section of this ordinance
be declared invalid or inoperative or void for any reason by a court of competent
jurisdiction, such decision, opinion or judgment shall in no way affect the remaining
portions, parts, sections or parts of sections of this ordinance, which provision
shall remain and continue to be in full force and effect.
SECTION VIII.
The fact that the fiscal period begins on October 1, 1975, requires that
this ordinance be effective upon its passage and adoption to preserve the public
peace, prosperity, health and safety, and the rules requiring ordinances to be
read and passed on two separate dates is hereby suspended and this ordinance shall
be in full force and effect from and after its passage and adoption.
