CALL TO ORDER The meeting of the City Council was called to order by Mayor Calvin F. Luper at 7:30 P.M. ROLL CALL PRESENT: Mayor: Councilmen: Calvin F. Luper P. M. Dodson J. R. Hubbard Harold B. Daley Dick Faram J. F. Cato J. B. Sandlin Morris E. Riddle STAFF PRESENT: City Manager, Stephen K. Shutt Secretary to City Manager, Donna Huckabee City Attorney, Dennis Morrow Consulting Engineer, William R. Ratliff ABSENT: City Secretary, Evalyn R. Huston INVOCATION: The invocation at this City Council neeting was given by Councilman J. F. Cato. APPROVAL OF THE MINUTES OF PREVIOUS M&ETIID Regular Meeting - April 14, 1969 Councilman Riddle roved, seconded by Councilman Sandlin, that the minutes of the regular City Council meeting of April 14, 1969 be approved by the City Council as submitted. The rotion carried by a vote of 6-0; with Councilman Hubbard abstaining due to absence from this meeting. CITY MANAGER'S REPORT City Manager, Stephen K. Shutt, advised the City Council that Rufe Snow Drive is in the process of being cut. City Manager Shutt also advised the Council that the City was in the process of getting larger colored zoning maps for the City. CITY ATTORNEY'S REPORT Mayor Luper advised the City Council that the City Attorney's Report has been deleted from this agenda. PLANNIm AND ZONIID Ordinance No. 252 - First Reading - Public Hearing PZ 69-7- Mr. Alton B. Collins Mayor Luper declared the City Council meeting in public hearing at this point of the meeting and Councilman Faram mved, seconded by Councilman Sandlin, that PZ 69-7, Ordinance No. 252 be continued until the next regularly scheduled City Council meeting as Mr. Collins was not present at this time. The rotion carried by a vote of 7-0. Councilman Cato roved, seconded by Councilman Hubbard, that the City Council reconsider Ordinance No. 252, PZ 69-7 at this meeting as Mr. Collins was now present. The motion carried by a vote of 7-0. Mr. Alton B. Collins of Dallas, Texas appeared before the Council asking that the Council approve this case. Mayor Luper asked Mr. Collins to work out the plat vacation and replatting and this case would be held in public hearing until that time. Councilman Daley roved, seconded by Councilman Faram, that the City Council refer PZ 69-7 back to Planning and Zoning Commission and then bring both forward at the City Council meeting. The lOOtion carried by a vote of 7-0. Ordinance No. 253- First Reading- Public Hearing PZ 69-B - Richland Enterprises, Inc. Mayor Luper declared the City Council meeting in public hearing at this point of the meeting and Mr. Alan Hanm of 7201 Riviera Drive, North Richland Hills, Texas appeared before the Council asking that the Council approve this case. There being no further persons to appear before the City Council for or against the zoning case, Mayor Luper declared the public hearing closed. Councilman Hubbard JOOved, seconded by Councilman Faram, that the City Council amend Ordinance No. 253 to add the emergency clause. The motion carried by a vote of 6-0; with Councilman Sandlin abstaining due to an interest in the property. Councilman Hubbard roved, seconded by Councilman Riddle, that the City Council approve Ordinance No. 253, PZ 69-B with the emergency clause added. The lOOtion carried by a vote of 5-1; with Councilmen Dodson, Hubbard, Daley, Faram and Riddle voting yes; Councilman Cato voting no; Councilman Sandlin abstaining due to an interest in the property. Ordinance No. 254 - First Reading - Public Hearing PZ 69-9 - Richland Enterprises, Inc. The mtion carried by a vote of 6-0; with Councilman Sandlin abstaining due to an interest in the property. Ordinance No. 255 - First Reading - Public Hearing PZ 69-10 - Richland Enterprises, !nc. Mayor Luper declared the City Council meeting in public hearing at this point of the meeting and Mr. Alan Hanm appeared before the City Council asking that the Council approve this case. There being no further persons to appear before the Council for or against the zoning case, Mayor Luper declared the public hearing closed. Councilman Daley roved, seconded by Councilman Dodson, that the City Council amend Ordinance No. 255 to add the emergency clause. The motion carried by a vote of 6-0; with Councilman Sandlin abstaining due to an interest in the property. Councilman Riddle moved, seconded by Councilman Hubbard, that the City Council approve Ordinance No. 255, PZ 69-10 as amended. The motion carried by a vote of 6-0; with Councilman Sandlin abstaining due to an interest in the property. Oakvale Addition Subdivision - Preliminary Plat PS 69-3 - Norman·Kilgore Norman Kilgore appeared before the City Council asking for approval of Oakvale Addition Subdivision - Preliminary Plat. After discussion, Councilman Daley moved, seconded by Councilman Sandlin, that the City Council approve Oakvale Addition Subdivision- Preliminary-Plat, without the recommendation of the City Engineers. The JOOtion carried by a vote of 6-1; with Councilmen Dodson, Hubbard, Daley, Faram, Cato and Sandlin voting yes; Councilman Riddle voting no. '-- CITY ENGINEER'S REPORT Consulting Engineer, William R. Ratliff, appeared before the City Council reporting on the following items: a. Status report - Capital Improvement Prop;ram Consulting Engineer Ratliff submitted a list recommending streets and drainage for the coming year Capital Improvement 3rd Program. Original list attached to these minutes as permanent record. b. Estimate of Glenview Drive from Dawn Drive to Citr Limits Consult1Dg Engineer Ratliff reported the rough estimate of Glenview Drive from Dawn Drive to the City Limits to be $80,000. The City Council indicated that this should not be added to this Capital Improvement Program. c. Recommended priorities for 1970 Capital Improve- ment Program Consulting Engineer Ratliff recommended priorities as shown on the attached report. The City Council will consider and act on this at a later date. Original report attached to these minutes as permanent record. d. Report on extending e::rlsting contract to cover Cumminp;s Drive Consulting Engineer Ratliff reported that extending the existing contract to cover Cummings Drive would be approximately $19,000.00 in cost. Mr. Ratliff recommended to take bids and not to extend Contract No.2, Cummings Drive, West of Turner Terrace. e. Authorization for payment to Sinclair Oil for lowering pipeline on Maplewood Drive Consulting Engineer Ratliff reported the approximate cost would be $1,200. Councilman Hubbard roved, seconded by Councilman Cato, that the City Council authorize Sinclair Oil to lower pipeline on Maplewood. The rotion carried by a vote of 7-0. ITEMS ADDED TO AGENDA: Councilman Daley JOOved, seconded by Councilman Dodson, that the City Council add Invoices CIP 3-301s, CIP 3-301 and CIP 3-302 and Texas Highway Speed Zone Ordinances be added to this agenda. The motion carried by a vote of 7-0. '-- INVOICE CIP 3-301s Estimate No. 1 - Street Contract Rufe Snow Drive Project - Texas Bitulithic Company Councilman Riddle moved, seconded by Councilman Sandlin, that the City Council approve Estimate No.1, 3-301s, Street Contract, Texas Bitulithic Company, in the amount of $8,700.21, as recommended by Knowlton-Ratliff-English. The motion carried by a vote of 7-0. INVOICE CIP 3-301 Estimate No. 6 - Drainage Contract Rufe Snow Drive Project - E. H. Shaw Construction Company Councilman Hubbard mved, seconded by Councilman Faram, that the City Council approve Estimate No.6, 3-301, Drainage Contract, E. H. Shaw Construction Company, in the amount of $9,930. 57, as recommended by Knowlton-Ratliff-English. The motion carried by a vote of 7-0. INVOICE CIP 3--302 Estimate No. 4 - Street Contract Cummings Drive Project- Texas Bitulithic Company Councilman Riddle m:>ved, seconded by Councilman Hubbard, that the City Council approve Estimate No.4, 3-302, Street Contract, Texas Bitulithic Company, in the amount of $15,043.51, as recommended by Knowlton-Ratliff-English. The rotion carried by a vote of 7-0. TEXAS HIGHWAY DEPARTMENT -- SPEED ZONE ORDINANCES Ordinance No. 256 - Interstate Hwy. 820 (Frontage Roads) Councilman Hubbard moved, seconded by Councilman Sandlin, that the City Council approve Ordinance No. 256. The motion carried by a vote of 7-0. Ordinance No. 257 - State Highway 121 Councilman Dodson moved, seconded by Councilman Daley, that the City Council add the emergency clause to Ordinance No. 257. The motion carried by a vote of 7-0. Councilman Riddle moved, seconded by Councilman Sandlin, that the City Council approve Ordinance No. 257 with the emergency clause added. The rotion carried by a vote of 7-0. Ordinance No. 25B - State Highway 121 (Frontage Roads) Councilman Daley roved, seconded by Councilman Sandlin, that the City Council add the emergency clause to Ordinance No. 25B. The motion carried by a vote of 7-0. Councilman Dodson moved, seconded by Councilman Sandlin, that the City Council approve Ordinance No. 258 with the emergency clause added. The JOOtion carried by a vote of 7-0. Ordinance No. 259 - State Highway IB3 Conn. (Rute Snow Drive) Councilman Daley moved, seconded by Councilman Dodson, that the City Council add the emergency clause to Ordinance No. 259. The motion carried by a vote of 7-0. SKY-WAY HELICOPTER SERVICE Councilman Cato roved, seconded by Councilman Dodson, that the City Council add this item to the agenda for this meeting. The rotion carried by a vote of 7-0. Councilman Dodson roved, seconded by Councilman Hubbard, that the City Council approve the request of Mr. Cliff Byers of Sky-Way Helicopter Service. The motion carried by a vote of 7-0. Mr. Byers had requested to have passenger ride services at Richland Plaza.
