MINUTES OF THE CITY COUNCIL MEETING
OF THE CITY OF NORTH RICHLAND HILLS,
TEXAS, HELD AT THE CITY HALL, 4101
MORGAN CIRCLE, MONDAY JULY 28, 1969
at 7:30 P.M.
The meeting of the City Council was called to
order by Mayor Calvin F. Luper at 7:30 P.M.

The invocation at this City Council meeting was
given by Mr. Wilson Newberry.
Regular City Council Meeting - July 14, 1969
Councilman Dodson moved, seconded by Councilman
Hubbard, that the minutes of the regular City
Council meeting of July 14, 1969 be approved as
submitted. The motion carried by a vote of 5-0;
Councilman Faram abstaining due to absence from
the meeting.
City Manager, Stephen K. Shutt, reminded the City
Council of the Region 8 Texas Municipal League
Dinner meeting to be held in Denton, Texas
August 4, 1969.

SALES TAX
Mr. Shutt also informed the City Council of a large
water main break at Rufe Snow Drive and Tabor Drive
late this afternoon. An investigation is in pro-
cess to determine the fault of this; i.e., whether
it is the fault of the contractor under the CIP
program or Tarrant County Water Supply Corporation.
A report will be given the City Council when the
investigation is complete.
Swimming Pools
The ordinance covering the draining of swimming
pools is inadequate in the opinion of the City
Attorney. The City Attorney suggests the City
Council consider adopting an ordinance more
specifically describing the situation and offering
a solution. Councilman Dodson moved, seconded by
Councilman Hubbard, that the City Council instruct
the City Attorney, City Engineer and City Manager
to prepare a revision to Ordinance No. 69 which
would permit the draining of swinming pools in
the streets and also combine their recommendations
regarding the advisability of making the draining
of a swimming pool a one time permit type operat-
ion. Councilman Faram moved, seconded by Council-
man Riddle, as an amendment that the City Council
authorize revising Ordinance No. 69 or prepare a
new ordinance to cover this situation and present
it to the City Council for consideration. Upon
a call for a vote on the amendment the motion carried
by a vote of 6-0. Upon a call for vote on the
original motion, ,as amended, the motion carried by
a vote of 6-0.
Mayor Luper declared the meeting to be in joint
session between the City Council and the Mayor's
Planning Advisory Council. As member representa-
tives of the Mayor's Planning Advisory Council,
the following members appeared before the City
Council asking that the City Council consider the
calling of an election to present this favorable
and equitable sales tax before the residents of
our city for a vote:

Mr. Charles Owen stated to the City Council that
the Mayor's Planning Advisory Council would like
to go on record as being unanimously in favor of
submitting this sales tax election to the citizens
of the city for a vote and the Mayor's Planning
Advisory Council will assist the City Council and
the city officials in any way possible toward the
approval of this election.
FIVE MINUTE RECESS
After reconvening of the City Council meeting,
Mr. Charles Owen, temporary chairman of the Mayor's
Planning Advisory Council, informed the City Council
,his committee unanimously voted to call the Sales
Tax Election on August 26, 1969 and recommends this
to the City Council.
Mr. Daley moved, seconded by Mr. Hubbard, that the
City Council call the Sales Tax Election for
Tuesday, August 26, 1969 as recommended by the
Mayor's Planning Advisory Council. Upon a vote of
calling for the question by Mayor Luper, the vote
was 6-0. The vote on the motion carried by vote
of 6-0.
Mr. Hubbard suggested and the City Council unani-
mously agreed that the Mayor's Planning Advisory
Council appoint a committee to work toward educat-
ional promotion of this election with the citizens
of our city.
Mr. Hubbard moved, seconded by Councilman Riddle,
that the City Council adopt and approve Ordinance
No. 268, which is an ordinance as follows:
"AN ORDINANCE ORDERING A SPECIAL
ELECTION TO BE HELD IN THE CITY
OF NORTH RICHLAND HILLS OF TARRANT
COUNTY, TEXAS, ON THE QUESTION OF THE
ADOPTION OF A ONE PERCENT (1%) LOCAL
SALES AND USE TAX WITHIN THE CITY;
DESIGNATING THE DAY OF THE ELECTION AND
THE POLLING PLACES; APPOINTING ELECTION
OFFICIALS THEREFOR; PROVIDING THAT ALL
DULY QUALIFIED RESIDENT ELECTORS SHALL BE
QUALIFIED TO VOTE; PRESCRIBING FORM
OF BALLOT; PROVIDING FOR NOTICE OF
ELECTION; CONTAINING OTHER PROVISIONS
RELATING TO SAID ELECTION; PROVIDING
FOR SEVERABILITY; AND DECLARING AN
EMERGENCY."
The motion carried by a vote of 6-0.
The City Manager suggested that the City Council
consider the use of voting machines for this
election. After consideration, Councilman Hubbard
moved, seconded by Councilman Daley, that the City
Council authorize the use of two voting machines
at the City Hall and two voting machines at Fire
Station No.1. The motion carried by a vote of
5-1; Councilman Dodson voting no.
ADJOURNMENT There being no further items on the agenda for
consideration, Councilman Riddle moved, seconded by
Councilman Daley, that the City Council meeting be
adjourned. The motion carried by a vote of 6-0.
