MINUTES OF THE MEETING OF THE CITY COUNCIL OF
THE CITY OF NORTH RICHLA.ND HILLS, TEXAS, HELD
AT THE CITY HALL, 4101 MORGAN CIRCLE, MONDAY,
SEPTEMBER 8, 1969 - 7:30 P.M.
CALL TO ORDER
The meeting of the City Council was called to order
by Mayor Calvin F. Luper at 7:30 P.M.

The invocation at this City Council meeting was
given by Councilman Dick Faram.
APPROVAL OF THE
MINUTES OF
PREVIOUS MEETING
Regular City Council Meeting - August 11, 1969
Councilman Cato moved, seconded by Councilman Hubbard,
that the Minutes of the City Council Meeting of
August 11, 1969 be approved as submitted by the
City Secretary. The motion carried by a vote of
6-0; Councilman Daley abstaining due to absence from
the meeting.
CANVASS OF
CITY SALES TAX
ELECTION
Mayor Luper presented Resolution No. 69-12, A
Resolution and Order Canvassing Returns and declaring
results of Special Election held in the City of
North Richland Hills, Texas, on August 26, 1969, on
the question of adoption of a one percent (1%) local
sales and use tax within said City. Election Judge
Offical Returns were presented and reviewed, covering
Precincts 140, 42, 131, 41 and 32, with these
returns indicating 350 votes for and 205 votes
against; a majority for adoption of the one percent
(1%) local sales and use tax of 145 votes.
Councilman Hubbard moved, seconded by Councilman
Sandlin that the City Council approve and adopt
Resolution 69-12 as presented. The motion carried
by a vote of 7-0.

CITY ATTORNEY'S
REPORT
City Attorney, Dennis Morrow, reported to the
City Council, as previously requested, he has
prepared contract agreement for execution by
Lincoln Properties, Inc. stating their willingness
to use water and sewage services of the City of
North Richland Hills at the time they may become
available.

ZONING
Ordinance No. 269 - PUBIJC HEARING
PZ 69-19 W. H. Long
Mayor Luper declared the City Council meeting in
public hearing to consider the case of W. H. Long
to rezone Tract 1 and Tract 2, 6.18 acres, William
D. Barnes Survey from Agriculture to IF-7 and
Commercial. Mr. W. H. Long, owner, appeared before
the City Council seeking approval of this zoning
from the City Council. Upon a call from the Mayor,
there was no one present to ask for denial of the
zoning. Mayor Luper declared the public hearing
closed. After discussion by the City Council and
the City Engineer, Councilman Dodson moved, seconded
by Councilman Cato, that the City Council amend
Ordinance No. 269 to include the emergency clause.
The rootion carried by a vote of 7-0. Councilman
Dodson moved, seconded by Councilman Faram, that the
City Council approve and adopt Ordinance No. 269,
as amended, to rezone Tract 1, William D. Barnes
Survey as IF-7 and Tract 2, William D. Barnes Survey
as Commercial. The motion carried by a vote of 7-0.
Ordinance No. 274 - FIRST READIID - PUBLIC HEARING
PZ 69-16 Richland Enterprises, Inc.
Mayor Luper declared the City Council meeting in
public hearing. Mr. Alan Hamm, 7201 Riviera Drive,
appeared before the City Council asking for rezoning
of 10.77 acres out of the W. W. Wa:Dace Survey from
IF-9 to Multiple Family Dwelling. Upon a call from
the Mayor there was no one present opposing the
rezoning request. Mayor Luper declared the public
hearing closed. Councilman Hubbard moved, seconded
by Councilman Faram, that the City Council add the
emergency clause to Ordinance No. 274. The motion
carried by a vote of 6-0; Councilman Sandlin
abstaining due to a stated interest in this project.
Councilman Hubbard moved, seconded by Councilman
Faram, that the City Council approve and adopt
Ordinance No. 274, as amended, to include the
emergency clause. The motion carried by a vote of
5-1; Councilman Cato voting no; Councilman Sandlin
abstaining due to a stated interest in the project.
Councilman Cato moved, seconded by Councilman Sandlin,
to add a report from R. E. Porter, Chairman of the
Planning and Zoning Commission, to the City Council
agenda
R. E. Porter, Chairman of the Planning and Zoning
Commission, appeared before the City Council to
inform them that the Planning and Zoning Commission
has discussed the zoning requests being presented
to the City and has some apprehension of the possibility
of speculative zoning and some ideas to possibly
prevent this. Mr. Porter advised the City Council
that it is the desire of the Planning and Zoning
Commission to arrange a meeting as soon as possible
between the Planning and Zoning Commission and the
City Council to review policies relating to zoning.
Ordinance No. 275 - FIRST Reading - PUBLIC HEARIm
PZ 69-17 Richland Enterprises, Inc.
Mayor Luper declared the City Council meeting in
public hearing. Mr. Alan Hamm, 7201 Ri viera Drive,
appeared before the City Council asking for rezoning
of 2.73 acres out of the W. W. Wallace survey from
IF-9 to 2F-9 Two Family Dwelling. Upon a call from
the Mayor there was no one present opposing the
rezoning request. Mayor Luper declared the public
hearing closed. Councilman Hubbard moved, seconded
by Councilman Riddle, that the City Council add the
emergency clause to Ordinance No. 275. The motion
carried by a vote of 6-0; Councilman Sandlin
abstaining due to a stated interest in the project.

Faram, that the City Council approve and adopt
Ordinance No. 275, as amended, to include the
emergency clause. The motion carried by a vote of
6-0; Councilman Sandlin abstaining due to a stated
interest in the project.
Ordinance No. 276 - FIRST READING PUBLIC HEARING
Richland Enterprises, Inc. PZ 69-18
Mayor Luper declared the City Council meeting in
public hearing. Mr. Alan Hamm, 7201 Riviera Drive,
appeared before the City Council asking for rezoning
of 22.86 acres out of the \Iv. W. Wallace Survey from
its present classification of a part IF-9 and a part
Multiple Family, to a proposed classification of Local
Retail. Upon a call from Mayor Luper there was
no one present opposing the rezoning request.
Mayor Luper declared the Public Hearing closed.
Councilman Hubbard moved, seconded by Councilman
Dodson, that the City Council add the emergency clause
to Ordinance No. 276. The motion carried by a vote
of 6-0; Councilman Sandlin abstaining due to a
stated interest in the project. Councilman Faram
moved, seconded by Councilman Hubbard, that the
City Council approve and adopt Ordinance No. 276,
as amended, to include the emergency clause. The
motion carried by a vote of 6-0; Councilman Sandlin
abstaining due to a stated interest in the project.
PS 69-7 FINAL PLA.T
HOLIDAY NORTH ADDITION
RICHLA.ND ENTERPRISES, INC.
Councilman Hubbard moved, seconded by Councilman
Daley, that the City Council approve the final plat
of Holiday North Addition as recommended by the
City Engineer. The recommendation of the City
Engineer is as follows:
"We have received and reviewed the final plat for the
Holiday North Addition, Section 1, and recommend it
for approval. We should note that final construction
plans for storm drainage were not submitted and
should be submitted and approved prior to the
execution of the City-Developer Agreement as provided
in your Subdivision Ordinance."

PRELIMINARY PLA.N - Drainage
HOLIDAY NORTH ADDITION
RICHLA.ND ENTERPRISES, INC.
Councilman Hubbard moved, seconded by Councilman
Daley, that the City Council approve the preliminary
drainage plan of Holiday North Addition following
the recommendations of the City Engineer as outlined
in their letter of August 5, 1969, which reads as
follows:
"As requested by Mr. Ballenger on August 1, 1969, we
have reviewed the preliminary plan for the Holiday
North Addition to the City of North Richland Hills.
We would point out that Susan Lee Lane and North
Richland Blvd. provide right-of-way widths necessary
for collector streets consistent with previous
planning. Drainage provisions shown have been
designed according to your City Policies. We, there-
fore, recommend your approval of this preliminary
plan.
We would except from this recommendation the areas
East of Crestwood Circle and North of the TESCo
right-of-way, since drainage provisions are not
indicated; however, we realize that such provisions
will be influenced by the site planning in these
areas, and this information may be reviewed along
with those site plans.
If we can furnish further assistance in this regard,
please advise."

ORDINANCE NO. 273
E. P. HALTOM EASEMENT
Mayor Luper presented Ordinance No. 273, an ordinance
relinquishing a certain permanent easement in the
City of North Richland Hills on the Glenview Drive
right-of-way on Evanda P. Haltom's property to
Evanda P. Hal tom and giving up the permanent easement
on this tract of land as described in this Ordinance
that the City of North Richland Hills may have.
Councilman Sandlin moved, seconded by Councilman
Faram, that the City Council approve and adopt
Ordinance No. 273 as presented. The motion carried
by a vote of 7-0.
TARRANT COUNTY
WATER SUPPLY
CORPORATION
PROPERTY FOR
SALE
Mayor Luper, Councilman Dodson and Councilman taley
reviewed this item with the City Council, being
the Highland Terrace System of the Tarrant County
Water Supply. The Board of Directors of T.C.W.S.C.
has approved this sale of property, however, it does
require the consent of each Jœmber city. The legal
description of this property is attached for
permanent record. Councilman Hubbard moved, seconded
by Councilman Sandlin, that the City Council approve
and authorize the sale of this property of T.C.W.S.C.
as recommended and requested. The motion carried by
a vote of 7-0.
ENGINEER'S
REPORT
Consulting Engineer, William R. Ratliff, advised
the City Council that the plans for Glenview Drive
should be prepared for presentation to the City
Council within a short time.
Also, Mr. Ratliff advised the Council he has secured
two proposals for the signalization of Highway 121 and
Davis Boulevard. This cost will run between $23,000
and $25,000. Mr. Ratliff suggested that the Council
might like to consider including this in the next
bond issue.

Councilman Hubbard moved, seconded by Councilman
Faram, that the City Council approve and authorize
payment of Estimate No.4, 3-301 - Rufe Snow Drive
as recommended by the Consulting Engineers, in the
amount of $42,076.26. The motion carried by a vote
of 7-0.
3-302 Estimate No. 6
TEXAS BITULITHIC COMPANY
CUMMINGS DRIVE, TURNER TERRACE, CATALINA, RIVIERA
AND BLA.NEY
Councilman Hubbard moved, seconded by Councilman
Faram, that the City Council approve and authorize
payment of Estimate No.6, 3-302 as recommended
by the Consulting Engineers, in the amount of
$15,996.15. The motion carried by a vote of 7-0.
3-303 Estimate No. 12 FINAL
AUSTIN ROAD AND VORTH CONSTRUCTION COMPANY
HARWOOD ROAD
Councilman Faram moved, seconded by Councilman
Hubbard, that the City Council approve and
authorize payment of Estimate No. 12 - Final,
3-303 - Harwood Road, as recommended by the
Consulting Engineers, in the amount of $19,978.29.
The motion carried by a vote of 7-0.
3-306 Estimate No. 4
ORVAL HALL EXCAVATIm COMPANY
RICHLAND OAKS
Councilman Hubbard moved, seconded by Councilman Cato,
that the City Council approve and authorize payment
of Estimate No.4, 3-306 - Richland Oaks, as
recommended by the Consulting Engineers, in the
amount of $37,125. The motion carried by a vote
of 7-0.
ADJOURNMENT
There being no further items on the agenda for
consideration, Councilman Cato moved, seconded by
Councilman Hubbard, that the City Council meeting
be adjourned.
