GENERAL DESCRIPTION:
The Planning and Zoning Office prepares action minutes for each Zoning Board of
Adjustment meeting. The minutes from each meeting are placed on a later agenda for
review and approval by the Board. Upon approval of the minutes, an electronic copy will
be uploaded to the City's website.

Chair Duer stated in accordance with the Texas Governor's March 13, 2020, Disaster
Declaration and subsequent suspension of certain Texas Open Meetings Act
provisions, this January 28, 2021, meeting of the North Richland Hills Zoning Board
of Adjustment is hereby called to order at 6.00 p.m.
Chair Duer conducted a roll call of Zoning Board of Adjustment members to confirm
the presence of a quorum.

DESCRIBED AS LOT 2, BLOCK 1, HARMON FARMS.
Chair Duer read the rules and regulations of the Zoning Board of Adjustment. He
stated Board member Thomas Clemmons is acting in place of absent Board Member
Kemp and would be voting on the request.
Chair Duer opened the public hearing, and called for Principal Planner Clayton
Husband to introduce the request. Mr. Husband introduced the request.
Chair Duer called for the applicant to present the request and be sworn in prior to
speaking.
The applicant, Sterling Woods, 8721 Everglade Drive, North Richland Hills, Texas,
was sworn in by Chair Duer and presented the request.
Chair Duer and Mr. Woods discussed the owner's move-in date, the home's square
footage, and details of how this request came about.
Mr. Husband discussed the correspondence received by the City from two property
owners and shared additional information with the Board regarding the history of the
property and the proposed patio cover addition.
Board Member Gibbs and the applicant discussed whether the patio was open or

enclosed.
Chair Duer and Mr. Husband discussed how the rear yard open space was
calculated.
Board Member Ibe and the applicant discussed whether the existing concrete was the
portion to be covered.
Chair Duer and Mr. Husband discussed whether or not the yard could be paved all
the way to the rear and the side and rear setbacks.
Board Member Koons and Mr. Husband discussed the proposed patio cover size and
the size that would meet ordinance requirements.
Chair Duer and Mr. Woods discussed the quality of the proposed patio cover and the
proposed patio dimensions.
Board Member Koons and Mr. Husband discussed whether there were similar
examples of this request considered by the Board.
Chair Duer and Mr. Husband discussed whether the applicant was tied to certain
quality standards.
Board Member Ibe and the applicant discussed the exact placement of the proposed
patio cover in relation to the existing windows.
Chair Duer stated the public hearing was open and asked for anyone wishing to
speak for or against the request to be connected to the meeting. There being no one
wishing to speak, Chair Duer closed the public hearing and called for a motion.
A MOTION WAS MADE BY BOARD MEMBER GIBBS, SECONDED BY BOARD
MEMBER IBE TO APPROVE BA 2021-01, WITH THE CONDITION THT THE
APPLICANT USE UPGRADED BUILDING MATERIALS.
MOTION TO APPROVE CARRIED 4-1, WITH BOARD MEMBER KOONS
OPPOSING.

SUBJECT: BA 2021-02 Public hearing and consideration of a request from Jim
Fentress for a variance from Section 118-313 (lot and area
requirements) and Section 118-718 (accessory buildings and
structures) of the North Richland Hills zoning ordinance at 7905 Irish
Drive, being 0.21 acres described as Lot 2, Block 1, Irish Meadows
Section 1 Addition.

SUMMARY
Jim Fentress is requesting approval of a variance to the lot and area requirements and
accessory buildings and structures standards to allow a carport addition to the house.
The property is located at 7905 Irish Drive.
BACKGROUND INFORMATION
The property is located on the north side of Irish Drive, between Mockingbird Lane and
Ulster Drive. The property is zoned R-3 (Single-Family Residential) and is developed with
a single-family residence constructed in 1979. The 9,142-square-foot lot is part of the Irish
Meadows subdivision, which was platted in 1977. The lot is rectangular in shape, being
approximately 73 feet wide and 130 feet deep. The property is owned by the applicant,
James (Jim) Fentress, and is occupied by a family member.
In September 2020, the City received a complaint about construction work taking place
on the property. The work included construction of a cover over a driveway and patio on
the northwest side of the house. The covered area extends along the side property line
from the front of the house to the rear property line, and wraps behind an existing
detached garage behind the house. An inspection of the property determined that a permit
had not been issued for the construction. As a result, a stop work order was issued on
the work on October 3, 2020
Prior to the issuance of the stop work order, the chief building official and the occupant
discussed the zoning and building standards that apply to the property. An email
summarizing the conversation was sent to the occupant on September 29, 2020, which
included a list of known zoning and building code violations. A copy of the email is
attached.
On October 5, 2020, a code compliance case was opened and an initial notice of violation
letter was mailed to the owner and occupant. Additional notices were mailed on October
19, 2020, and January 4 and January 15, 2021. Copies of the notices are attached.

Since a permit application was not submitted and the property was not brought back into
compliance by the required deadlines, a probable cause affidavit was submitted to the
municipal court. Following a court hearing on March 17, 2021, the owner was given 14
days to submit a building permit application. The permit application was submitted on
April 5, 2021.
After the building permit application was reviewed, a plan review report was provided to
the applicant on April 20, 2021. A copy of the report is attached, which identifies where
the construction does not comply with certain zoning regulations and building code
standards. The applicant was advised that the design must be adjusted to comply with
the applicable code requirements. Rather than adjust the design, the applicant has
submitted an application for variance on May 18, 2021.
The variance application and supporting materials are attached. The materials include a
copy of the application explaining the reasoning for the variance request and other
relevant documents. An analysis of the request and relevant codes is below.
ANALYSIS
The variance request is to standards contained in two sections of the zoning ordinance.
These include the lot and area requirements of the R-3 (Single-Family Residential)zoning
district contained in 5eact"lioirl 11118 3113 and the accessory building and structures
standards contained in eac lioirl 11118. I118.
The carport/covered driveway structure is built on the northwest side of the house. The
structure is approximately 9.7 feet wide and 104 feet long, extending adjacent to the side
property line to the rear property line. The structure also extends approximately 30 feet
adjacent to the rear property line. The structure also encroaches into a platted five-foot
utility easement along the rear property line. The structure covers approximately 1,112
square feet. The exhibit below shows the location of the structure on the lot.

Given its location on the property, the structure is not in compliance with the following
zoning ordinance requirements related to building setbacks and accessory building
standards. The table below provides a comparison of the relevant requirements and the
existing condition on the property

There are other code violations associated with the structure related to building code
standards and utility easement encroachments. Some of these violations are noted in the
plan review report. However, those violations cannot be addressed through action by the
Zoning Board of Adjustment. In the event variances are approved for the structure, these
violations would have to be addressed before a building permit could be issued. Denial
of variances would ultimately require that all or portions of the structure be removed in
order to achieve compliance with code standards.
FINDINGS FOR VARIANCE APPROVAL
Section ,11,11,E , , „�, ,,�, of the zoning ordinance authorizes the Zoning Board of Adjustment
...to authorize upon appeal, in specific cases, such variance from the terms of [the
Zoning Ordinance] as will not be contrary to the public interest and where, because of
special conditions, the enforcement of the [Zoning Ordinance] would result in an
unnecessary hardship."
In exercising it powers to grant a variance, the board of adjustment must make specific
findings and show in its minutes that:
a. Literal enforcement of the controls will create an unnecessary hardship or practical
difficulty in the development of the affected property.
b. The situation causing the hardship or difficulty is neither self-imposed nor generally
affecting all or most properties in the same zoning district.

c. The relief sought will not injure the permitted use of adjacent conforming property.
d. The granting of the variance will be in harmony with the spirit and purposes of
these regulations.
OPTIONS FOR BOARD CONSIDERATION
The Zoning Board of Adjustment has the following options on this application.
1. Approve the variance as presented. This action would approve variances to the
building line setbacks and accessory building standards for the structure. The
structure would still be subject to other building code and property standards.
2. Approve the variance with conditions. This action would approve variances to the
building line setbacks and accessory building standards for the structure, subject
to the owner making modifications to its size, location, or design as directed by the
Board.
3. Deny the variance. This action would require the structure to be built in compliance
with building line setbacks and accessory building standards or removed from the
property.

R3 Zoning violations identified:
a.The original plat shows no easment restrictions on west side of property
Carports and/or garages have been built in this&nearby additions against property lines.
b.The original plat shows 5'easment on rear property line
Rear section of carport can be removed if required, however its not visible(back of bldg.)
c.The roof pitch was designed to be at 4:12 pitch... confirmation of this pitch is being verified.
The intent of this carport was 4:12 by design... if granted it would be brought into compliance.
d. Stop work order issued prior to completion of the work.
If a fire rated wall is required it will be added if variance is granted.
e.A survey(from a registered Surveyor Firm)has been aquired showing diminsions for the property and structures.
Currently the side yard carport(measured from corner of house to back of carport)does not exceed compliance.
3,. Explain any special circumstances, if applicable, not considered by the zoning ordinance. Examples: (1) if the subdivision
plat was approved prior to the current zoning ordinance requirements; or (2)the zoning ordinance was amended or a policy
change was adopted after submitting an application for a building permit or other phase of the development process. If

None of the examples listed in item 3. apply here.
This carport build was contracted to an individual(Juan Sanchez)that claimed he had the design,was a registered
contractor in NRH, and would file for and aquire a permit for this project. I was to supply materials and he would furnish
the labor,the design,and permit. Upon approximately 90%completion of structure his crew was questioned by a City of
NRH building inspector and notified the project was not permitted with the city,and not under construction in compliance
of the zoning and building codes in place for NRH. (I thought the design and plan was reasonable since the carport
would be constructed behind the fence, and there are several other carports and/or bldgs.similar to this in the area.)
A stop work order was issued from the city two or three days later, however I had stopped the contractor the day of the
linquiry from the inspector and upon requesting the design/drawings and permitting for the project, I was told he would
(send them to me and now he is not returing calls, and cannot be found.-I am now requesting a review with the Zoning
Board of Adjustment to see if I can bring this structure within code&zoning requirements.With the possibility of some
variances of some of the zoning requirements to save having to perform a complete demolotion of the structure.

SUMMARY OF THE ZONING BOARD OFADJUSTMENT |

The Board of Adjustment shall have the powers and exercise the duties of a Board in accordance with of the /
Texas Local Government Code. Board members are representatives of the City and shall have the right to inspect premises �
where required in the discharge of their responsibilities under the laws of the State of Texas and the ordinances of the City of �
North Richland Hills. The Board's jurisdiction shall extend to and include the hearing and deciding of the following topics of �
appeals and applications, and to that end shall have the necessary authority to ensure continuing compliance with its decision. �
The Board of Adjustment, in specific cases,may authorize or order the following: �
• Interpretation. Hear and decide appeals where it is alleged there is error on any order, requirement, decision, or
interpretation of the zoning regulations by the Building Official in the enforcement of this ordinance or a zoning district /
boundary. In reaching its decision, the Board shall establish firm guidelines for future administrative actions on like !
mattes.

• Permits for nonconformity.Authorize a building permit for the reconstruction, extension, or enlargement of a building
occupied by non-conforming uses,on the lot or tract occupied by such building, provided such reconstruction does not
prevent the potential return uf such property toa conforming use.
w Discontinuance of nonconformity. Require the discontinuance of non-conforming uses of land or structures under any
plan whereby the full value of the structure and facilities can be amortized within a definite period of time,taking into �
consideration the general character of the neighborhood and the necessity ofoUprnpertytn000fonntothenego|atinna
of the zoning ordinance. All actions to discontinue a non-conforming use of land or structure shall be taken with due
regard to the property rights of the persons affected when considered in light of the public welfare and the character of
the area surrounding the designated non-conforming use and the conservation and preservation of the property.The
Board may, from time totime on its own motion or upon cause presented by interested property owners, inquire into
the existence,continuation,or maintenance of any non-conforming use within the city.
• Variances.Authorize upon appeal, in specific cases,such variance from the terms of the zoning ordinance that are not
contrary to the public interest,and where, because of special conditions,the enforcement of the ordinance would result
in an unnecessary hardship. However, the Bound ahoU not have the power to grant variances from the terms of the
zoning ordinance for a change in use not allowed ino district. |n exercising it powers bo grant a variance,the Board of
Adjustment shall make findings and show in its minutes that:
a. Literal enforcement of the controls will create mn unnecessary hardship or practical difficulty in the development
nf the affected property.
b. The situation causing the hardship or difficulty is neither self-imposed nor generally affecting all or most
properties in the same zoning district.
c. The relief sought will not injure the permitted use of adjacent conforming property.
d. The granting nf the variance will beiu harmony with the spirit and purposes of the zoning regulations.

Attached to this email is a link to the city's zoning regulations that deals with building setbacks.
Please follow all references to the R-3 zoning district since that is where your home is located. By
the way, since you are in the R-3 zoning district, you only need to have 6 feet of side yard setback
(not 10 feet as I originally told you). However, the rear yard requires a minimum of 10 feet.

As mentioned during our conversation, any variance approvals will be very unlikely since you have to
prove to the Zoning Board of Adjustments that you have a hardship that you did not cause; and that
your situation is unique from other property owners. Additionally, there was a complaint made
about the construction of your carport which makes the variance approval process even less likely.
Please see the following list of known zoning and building code violations:
1. Carport addition does not meet the minimum side yard setback of 6' (zoning violation)
2. Carport addition does not meet the minimum rear yard setback of 10' (zoning violation)
3. Carport addition appears to be violating the 20% rear yard open space (zoning violation)
4. Carport addition does not have the minimum roof pitch of 4:12 (zoning violation)
5. No building permit was obtained prior to construction of the carport (building code
violation)
6. Additions to residential structures require a 1-hr rated fire rated wall whenever they are
built closer than three feet to a property line. Both the west and north side of the addition
would require this wall (building code violation)
7. Substandard/incorrect framing(building code violation)
a. Metal rafters are not directly supported on the west side of the carport. Inserting
the rafters inside of a C-channel and supporting them from the bottom flange of that
C-channel requires an engineer's design
b. Metal rafters that are supported by the existing roof have been trimmed to match
the pitch of the existing roof. Metal rafters must be full width at their support ends
unless an engineer has designed it
c. The columns supporting the beam between the house and the detached garage
don't appear to have a footing or lateral support
d. The beam between the house and the detached garage is cantilevered on both ends
and requires an engineer's design
e. The columns supporting the west side of the roof don't appear to have a footing or
lateral support
f. The lips of the rafter C-channels have be damaged or deformed in areas and are
being used as a header at the front and rear of the structure. This is beyond the
prescriptive measures of the building code and needs to be engineered
8. An unauthorized addition was made to your house between January of 2016 and January of
2017. This will need to be permitted, inspected, and corrections made to bring the addition
into compliance with the building code

9. The contractor who built the carport addition is not registered with the City of North
Richland Hills
10. The contractor who built the carport without out a permit is subject to a $525 unautorized
construction fee in addition to the standard building permit fee
As mentioned during our conversation, I don't believe you will be able to get zoning approval from
the building setback encroachments, the flat roof pitch, and the minimum rear yard open spaces.
Knowing this, my advice would be to remove the new constrution in its entirety.
