The City Council meeting was called to order at
7:40 p. M. by Mayor Calvin F. Luper.

The invocation at this City Council meeting was
given by Mayor Calvin F. Luper.
Regular Meeting - October 9, 1967
Councilman Dodson moved, seconded by Councilman
Daley, that the minutes of this meeting be approved
as submitted. The motion carried by a vote of 7-0.
Special Meeting - October 16, 1967
Councilman Sandlin moved, seconded by Councilman
Daley, that the minutes of this Special City
Council meeting be approved as submitted. The
motion carried by a vote of 7-0.
PUBLIC HEARING: Mayor Calvin F. Luper declared the City Council
meeting to be in public hearing at this point
in regard to the Proposed Comprehensive
Ordinance and Zoning District Map. 23 property
owners or their representatives within the
corporate limits of the City appeared before the
Planning and Zoning Commission and the City
Council pertaining to the proposed zoning of their
individual property. After all citizens, property
owners or representatives had been heard Mr. Clarence
Pyron, Acting Chairman of the Planning and Zoning
Commission declared the Public Hearing closed in
behalf of the Planning and Zoning Commission.
Councilman Chester moved, seconded by CJuncilman
Sandlin that the City Council close the Public
Hearing. The motion carried by a vote of 7-0.
After review and discussion of the Public Hearing
Councilman Daley moved, seconded by Councilman
Hubbard, that the Public Hearing be continued on
the next regular City Council meeting of November
13, 1967 for finalization and only those items
discussed at this meeting be considered during the
Public Hearing. The motion carried by a vote of 7-0.

Councilman Chester moved, seconded by Councilman
Hubbard, to approve the recommendations of the
Planning and Zoning Commission and approve the
preliminary and final plat of the 0 and P
Corporation as submitted on this case. The motion
carried by a vote of 7-0.
ELECTRICAL CODE
As instructed, William R. Ratliff, Consulting
Engineer, secured and submitted formal report to
the City Council regarding the use of Romex wiring
in multi-family, two story, brick veneer, garden
type apartment buildings. This opinion and report
was furnished by Romine and Slaughter, Inc., a copy
of which is attached to these original minutes for
permanent record. Councilman Dodson moved, seconded
by Councilman Chester, that the City Council deny
the request from Mr. George Macatee for variance from
the Electrical Code of the City and, therefore, not

Dear Sirs:
In accordance with your request by Council action of October 9, we have
secured from Romine & Slaughter, Inc., Consulting Engineers, a professional
opinion regarding the propriety of the use of Romex wiring in multi-family,
two story, brick veneer, garden type apartment buildings. Mr. Romine's
comments are attached. We consider this firm to be fully capable in this
field; and therefore, for the reasons enumerated in his letter, we would
recommend that your present Ordinance requirements be maintained.
If we can furnish further information in this regard, please advise.

Subject: E lectrica 1 Code Requi rements

Dear Mr. Ratliff:
In accordance with your request, I am pleased to offer herewith my professional
opinions regarding the propriety of various possible wiring methods for use in
multi-family, two-story, brick veneer, garden type apartment buildings.
Let me first say that while I am not particularly familiar with the electrical
code currently in use at North Richland Hills, all codes with which we have come
in contact over the state and throughout the country do not permit the use of non-
metallic sheath~d cable in this application. For your reference I am quoting
Paragraph (I) from Section 14-74, Article V of the Fort Worth City Code.
"(1) All electrical wiring methods used within or on all buildings to be
erected and all alterations in and additions to such wiring in or on
existing buildings shall be Type HI cable, approved raceway system or
approved multi-outlet assemblies, except that this provision shall not
apply to private residences and duplex apartment building which are not
located in Fire Zone 1 or Fire Zone 2, as such fire zones are designated
and defined by the City Co unci 1."
The Type HI cable noted in this code reference is a mineral insulated metal
sheathed cable and is in no way similar to nonmetallic sheathed (Romex) customarily
permitted in residences.
It is my opinion that this code restriction is based on sound engineering principles,
and that such a restriction would almost certainly be effected in the event of a
common code adoption presently under consideration by the North Central Texas
Council of Governments.
The reason that I believe this limitation to be so universally required is from
the standpoint of safety, from both fire and electric shock. The obvious
difference is that of physical protection of the conductors, wherein a metallic
raceway is far superior in protecting against rodents, nai Is, screws, and other
forms of inadvertent damage.
I believe that the philosophy in permitting nonmetallic sheathed cable to be
installed in a single or two family dwelling is based on two principles, as

1. Legislative bodies have always recognized the intrinsic difference In
setting limiting requirements upon a man in the construction of his
own private residence and those upon a man constructing something for
use by the general public. In other words, if a man chooses to save a
few dollars and incur a slightly greater risk In so doing, this is a
decision which he may make upon its own merit. The renting public,
on the other hand,has a considerably greater right to expect to be
protected by the municipality involved, since in this case, the actual
occupant has little or no control over, or even knowledge of, the
construction practices involved.
2. The second point is that of the considerable difference in construction
procedures between a single or two family dwelling and a large apart-
ment complex. In the first case, due to the sheer difference in
magnitude, the person or persons in charge of a small project have a
considerably greater control over and opportunity to inspect and/or
correct deficiencies in electrical wiring, than does the supervisor of
a large project where a great number of men in a number of different
trades may be working at various places throughout the job at the same
time. In the latter case it is simply not possible to be everywhere
at once, and the opportunities for accidental damage to unprotected
wiring are considerably greater.
Finally, I wish to comment only that while it is always easy for municipalities
to give in to pressures of one kind or another for the lowering of standards,
it is exceedingly difficult to ever reverse the procedure. It is therefore my
strong recommendation that the City Fathers of North Richland Hi lis be urged to
retain this desirable requirement with regard to electric wiring.

SLURRY SEAL
As instructed, William R. Ratliff, Consulting
Engineer, made onsite investigations of slurry
seal applicatiDns which were being rapid-cured by
means of a Cationic drying agent. After his
investigation Mr. Ratliff recommended to the City
Council that they use this type slurry seal with
the stipulation that no slurry would be applied
under weather conditions which would not allow
traffic on the application within three hours or by
six o'clock p. M. Councilman Dodson moved, seconded
by Councilman Chester, that the City resubmit slurry
seal program bids and require specifically the
Cationic agent be used and also request that the
bidders detail their past experience in the use of
the Cationic agent. The motion carried by a vote
of 7-0.

The City Council discussed the possibility of
additional slurry seal application in various
sections of the City and in order to apprise the
City Counc~l of the need for this application,
Mayor Luper appointed the following committee to
make this investigation and submit a formal report
to the City Council:

agenda Councilman Daley moved, seconded by Councilman
