GENERAL DESCRIPTION: The Neighborhood Services Department prepares action minutes for each Substandard Building Board Meeting. The minutes from each meeting are placed on a later agenda for review and approval by the Board. Upon approval of the minutes, an electronic copy is uploaded to the City's website. RECOMMENDATION: Approve Minutes of the July 13, 2021, Substandard Building Board Meeting. C.2 SBB 2021-81 PUBLIC HEARING AND CONSIDERATION WHETHER THE STRUCTURES AND ACCUMULATION ON THE PROPERTY LOCATED AT 7405 HIGHTOWER DRIVE KNOWN TRACTS 413, & 4131 & 413113 ABSTRACT NO. 311 OF THE JOHN CONDRA SURVEY IN THE CITY OF NORTH RICHLAND HILLS, TARRANT COUNTY, TEXAS ARE SUBSTANDARD OR A NUISANCE WITHIN THE MEANING OF THE CITY'S ORDINANCES AND ORDER REPAIR OR DEMOLITION AND/OR REMOVAL OF ACCUMULATION. APPROVED Vice Chairman Wait called on Stefanie Martinez, Director of Neighborhood Services, to present the case. Ms. Martinez stated it was the intent of the City to bring the case but it was determine that the property owners were requesting continuants on this case based on the medical conditions of their attorney and the wife. Staff recommends that the Board considers a continuants to the next hearing on August 10, 2021. Vice Chairman Wait asked Ms. Martinez, so the City doesn't want to present the SBB packet tonight. PRESENTER: Stefanie Martinez, Director of Neighborhood Services SUMMARY Neighborhood Services will present evidence to the Board for consideration as to whether the single family structure and garage structure are substandard as described in Chapter 98 of the City of North Richland Hills' Ordinances. Staff will also provide evidence that conditions exist on the property which are in violation of the Chapter 34 of the Nuisance Ordinance. BACKGROUND INFORMATION The property is located on the north side of Hightower Drive, between Douglas Lane and Meadow Creek Road. The property is zoned AG (Agricultural) and has a single-family residence and two level accessory structure. The 2.38 acre property is within the Residential Estate Land Use District. The property is owned and occupied by Robert and Susan Famigletti. In February 2019, the City received a complaint about conditions at the property. The initial violations included unlawful outdoor accumulation, a stagnant pool, dilapidated and falling six foot fence as well as substandard structures. Since the inception of the cases minor improvement has been made in that the pool has been filled and some accumulation has been removed. The fence was corrected; however is now in violation again. An area of the rear of the residential structure has been secured, yet it remains in violation. PRESENTER: Stefanie Martinez, Director of Neighborhood Services SUMMARY Neighborhood Services will present evidence to the Board for consideration as to whether conditions exist on the single family property which are in violation of the Chapter 34 of the Nuisance Ordinance. BACKGROUND INFORMATION The property is located on the northeast corner of Newman Drive and Emerald Hills Drive. The property is directly across the street from the Academy at C.F. Thomas Elementary School. The property is zoned R-3 (Single Family Residential) with a single-family residence. The 8,046 square foot property is owned and occupied by Floyd Smith. The case was initiated in February 2021 when the property was identified to have an unlawful accumulation of household furniture, trash, debris, tires and dismantled motor parts in the driveway and side of the house. Several notices of violation have been issued to the property owner and the property owner's grandson who also resides at the location. Although the property had shown minimal improvement in March of this year, the accumulation violation returned and continues to be present at the property. In April of this year a probable cause affidavit was issued to the property owner's grandson who continues to bring debris to the property. The case was brought to the municipal court in June and found to be in violation. A fine was issued and the grandson was given a 90 day probation. The Code Compliance office continues to receive citizen complaints regarding this property. Find the conditions on the property are in violation of the specific nuisance ordinance (Chapter 34). 2. Order the owner remove the unlawful outdoor accumulation at the property within a specific timeframe. 3. Find that the conditions on the property are not in violation of the specific nuisance ordinance (Chapter 34).
