PRESENTER: Clayton Comstock, Planning Director SUMMARY: City Attorney Maleshia McGinnis will present a training session for the Planning and Zoning Commission regarding open meetings requirements, electronic communications, ethics, and the general roles and responsibilities of the Commission. Sections 2-121 (p) and (q) of the North Richland Hills Code of Ordinances requires an annual orientation and training for all board and commissions regarding their roles and responsibilities, state and local laws, and rules of procedure. Attached is a copy of the Planning and Zoning Commission rules of procedure, which provides for the general rule of order for meetings. The links below are references in the City Charter and City Code related to the Planning and Zoning Commission. Additional materials will be provided at the meeting. RULES OF PROCEDURE Planning and Zoning Commission City of North Richland Hills The following general procedures shall be in effect for the Planning and Zoning Commission. 1. A quorum of the Commission is a majority of the members appointed. A chairperson, vice chair and secretary shall be elected annually at the earliest opportunity after members are appointed by the city council_ If the chairperson is not present at a meeting the vice chair shall preside. If the chairperson and vice chair are not present the secretary shall preside. If the chairperson, vice chair or secretary are not present the members present shall choose one of their number to preside and act as chairperson of that meeting. 2. No matter shall be brought before the Commission for action other than organizational and procedural issues or a work session except after a public hearing at which any applicant, city staff and members of the public are afforded an opportunity to speak and Commission members are allowed to question the applicant, his representatives and city staff. All meetings are subject to the Texas Open Meetings Act (Chapter 551, Texas Government Code) and agendas of meetings posted as therein required. 3. The chairperson shall be responsible for conducting meetings and shall require that hearings and meetings be fair and orderly. If deemed necessary by the chairperson, he shall require that any participant first be recognized by the chair before beginning to address the Commission or question staff or the applicant. The chairperson may warn or to refuse to recognize persons other than members of the Commission who previously have been afforded an opportunity to speak or ask questions who, in the opinion of the chairperson, are engaging in personal attacks or are Planning and Zoning Commission Rules of February 2018 Page 1 of 3 Procedure attempting to prevent the Commission from carrying out its functions. The refusal by the chair to recognize a person is subject to appeal by any member of the Commission who makes a motion to appeal the decision of the chair. If the motion is made and is seconded, the chairperson must immediately without any opportunity for debate, call for a vote on whether the decision of the chair shall be sustained and if not sustained, shall recognize the person who unsuccessfully attempted to speak. If deemed necessary by the chairperson he may at the beginning of the hearing or discussion restrict the time for each side or person to speak, which restriction shall be subject to the same appeal rights. 4. The chairperson shall, at the conclusion of each public hearing, entertain a motion by any member of the Commission or may allow members to discuss the matter among themselves prior to action. No vote shall be taken on any motions until after it is seconded and members are afforded an opportunity to express their opinions. Motions that have been made and seconded may be withdrawn or changed only with the concurrence of the maker of the motion and the person who seconded. Motions may be amended without consent if seconded, and successive amendments may be made without consent. At the conclusion of discussions, the amendments shall be first voted on in reverse order to their order of making. Those which are approved by a majority of those members present and voting will be incorporated into the next vote until the matter is finally voted on. 5. All members present at a meeting shall vote unless an affidavit is filed with the secretary describing a conflict of interest by the member and an announcement is made prior to discussion of the nature and existence of such conflict. Members who are present but who are disqualified from voting based on the existence of such conflict shall be counted for the purpose of determining a quorum but shall not be counted for the purpose of determining whether a vote has carried by a majority. Motion to adjourn Motions to table, to move the question, or to adjourn are undebatable. A motion to table if passed will postpone action to a future meeting. To move the question, a member is calling for an end to debate. A vote must first be taken on whether debate will cease. Only if it passes will debate end and a vote then be taken without further debate or discussions on the issue before the Commission. Motions to adjourn, if seconded, are undebatable and, if passed by a majority of those Commission members present, will end the meeting. Chair Welborn and Planning Director Clayton Comstock discussed the Parks, Recreation and Open Space Master Plan and subsequent 20116 update, and how that plan relates to this property, the Land Use Plan recommendations for the property, and the power lines traversing the property. PRESENTER: Clayton Husband, Principal Planner SUMMARY: Dohrman Wintermute is requesting a special use permit to authorize an addition to a permanent accessory building on 2.015 acres located at 7504 Bursey Road. GENERAL DESCRIPTION: The property under consideration is located on the south side of Bursey Road between Londonderry Drive and Bursey Road South. The lot is 2.015 acres in size, 184 feet wide, and 453 feet deep. The property is developed with a single-family residence and one permanent accessory building. The property is zoned R-1 (Single-Family Residential). City Council approved the special use permit for the original accessory building on October 2, 2017 (Ordinance 3480). This ordinance authorized a 1,500-square-foot building with a 750-square-foot attached covered parking area on the property. Since that time, the owner made a 300-square-foot addition to the rear of the building that includes an unenclosed covered area. The addition was constructed without a permit. Since the building does not comply with applicable zoning standards, the owner is requesting a special use permit to allow the design as proposed. If the special use permit is approved, the owner must apply for a building permit for the addition. For lots greater than 40,000 square feet in area, the zoning ordinance allows for consideration of a special use permit for varying from specific development standards. Since the covered area is attached to the existing accessory building and is considered an addition to the building, proposals to modify the design standards may be authorized through approval of a special use permit. A site plan and photos of the building are attached. The building is located near the middle of the lot, with side setbacks of 52 feet and 94 feet and a rear setback of 104 feet. The 300-square-foot covered area is attached to the rear of the building, measuring 30 feet in width, 10 feet in depth, and 8.5 feet in height. My name is Dohrman Wintermute, my wife's name is Francie and our 21-year-old son, Ryan,will be a senior at the University of Alabama this fall. I've been a resident of North Richland Hills for over 25 years and we're very proud to live in such a great city. We purchased our home on Bursey Road in December 2015 after falling in love with the large oak trees and natural beauty of the property. In 2016,we completed extensive renovations to the home, adding additional rooms and updating to current standards. In 2017, special use permit SUP 2017-06 was approved for a 30'x 50' garage/workshop with 30'x 25' covered carport to facilitate consolidation and removal of 4 unsightly buildings. Maintaining a property of this size, with many trees, requires significant lawn equipment and tools in order keep the property looking nice. We store these items in the garage/workshop to give the property a clean and neat appearance. In 2018, my father passed away and I inherited a large amount of black walnut lumber, a small Kubota tractor and woodworking equipment including a table saw,jointer, planer, drill press, lathe and sander that have consumed space in the workshop I'd not anticipated, leaving little space for the Kawasaki mule, zero turn mower and tractor. We're requesting a revision to the original SUP to include a 10' x 30' covered equipment area at the rear of the workshop (south side)for the Kawasaki Mule, tractor,and other lawn equipment.
