ORDINANCE NO. 2478
AN ORDINANCE OF THE CITY OF NORTH RICHLAND HILLS, TEXAS,
AMENDING, ORDINANCE NUMBER 2171 and 2317; TO EXTEND THE
TIME PERIOD FOR SUBMISSION OF SITE PLAN AND BUILDING
PERMITS; AMENDING THE DEVELOPMENT RULES AND
REGULATIONS OF PLANNED DEVELOPMENT DISTRICT NUMBER 23;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS
CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Ordinance 2171, established Planned Development District 23, and established a
July 31,1998 expiration date for issuance of any building permits for multi-family development
within this planned development, and
WHEREAS, Ordinance 2317, extended the deadline for a building permit until October 31, 1998
for Phase I and April 30, 2000 for Phase II, and
WHEREAS, the Planning & Zoning Commission has recommended a two year time extension
for submission of multi-family site plans and building permits for all the land described as
Planned Development No. 23 and to add development rules and regulations for multi-family
development.
WHEREAS, after appropriate notice and public hearing, the Planning and Zoning Commission
of the City of North Richland Hills, Texas, has forwarded a recommendation to the City Council
for amendment of Ordinance No. 2317; now therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS,
TEXAS:
1.
THAT, Planned Development District Number 23, Section 1 of Ordinance No. 2317, be hereby
amended to read as follows:
Multi-family Residential- Multi-family dwellings, including all those uses permitted in the R-7-MF
zoning district as provided in Section 310, Table of Permitted Uses, Ordinance Number 1874, as
amended, shall be allowed. Prior to the issuance of a building permit for any development, a
site-plan for each development shall be submitted to the Planning and Zoning Commission for
review and comment and forwarded to the City Council for approval. The deadline for submitting
any amended site plan is extended to April 30, 2002 for any of the property in Planned
Development District No. 23. The time for any building permit accepted in Planned
Development No. 23 is extended to July 30, 2002.
THAT, the following additional development regulations be adopted with respect to Multi-Family
Planned Development District Number 23, shall hereafter read as follows:

a. The zoning established by this ordinance is permanent until amended pursuant to
the Zoning Laws of the State of Texas and this City. Rebuilding in the event of
casualty loss is permitted with the requirement that the same architectural style and
materials as the original application be used.
b. Existing R-7 Multi Family Zoning Requirements, that do not conflict with this
ordinance, shall apply to this property.
c. 1-2 Medium Industrial uses are not permitted and hereby removed from the planned
development.
d. The fencing on the west side of the property which abuts the Iron Horse Golf
Course, shall be of comparable material and in appearance with the existing
wrought iron fence shown on Planned Development District Number 22, adjacent to
the golf course.
e. The fencing abutting the railroad right-of-way along the east side of the subject
property shall be a solid fence constructed of acceptable masonry materials.

SAVINGS CLAUSE. That, all regulations contained in the Zoning Ordinance No. 1874, as
amended, which are not in conflict with the terms of this Planned Development District Number
23, shall remain in effect regarding this property.
3.
SEVERABILITY CLAUSE. That it is hereby declared to be the intention of the City Council that
the section, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if
any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or
unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences,
paragraphs or sections of this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase,
clause, sentence, paragraph or section.
4.
EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage.
