RECITALS This AGREEMENT is applicable to the furnishing of Basic and Special Engineering Services by the ENGINEER to the OWNER for the design and construction of SPREAD SPECTRUM RADIO COMMUNICATION SYSTEM for City Traffic Signal System hereinafter called the PROJECT. CONTRACTUAL UNDERTAKINGS SECTION I EMPLOYMENT OF ENGINEER The OWNER agrees to employ the ENGINEER and the ENGINEER agrees to furnish the Basic and Special Engineering Services in connection with the PROJECT as stated in Section II following, and for having rendered such services the OWNER agrees to pay to the ENGINEER compensation as stated in Section VI following. SECTION II CHARACTER AND EXTENT OF SERVICES 1. The BASIC ENGINEERING SERVICES, to be rendered by the ENGINEER, include and are limited to the Scope of Services outlined in Attachment "A". SECTION III AUTHORIZATION OF SERVICES No professional services of any nature shall be undertaken by the ENGINEER under this AGREEMENT until he has received written authorization from the OWNER. SECTION IV PERIOD OF SERVICE This AGREEMENT shall be effective upon execution by the OWNER and the ENGINEER, and shall remain in force until terminated under the provisions hereinafter provided in Section X. SECTION V COORDINATION WITH THE OWNER The ENGINEER shall hold periodic conferences with the OWNER, or its representatives in accordance with the Scope of Services, to the end that the project shall have full benefit of the OWNER'S EXPERIENCE AND KNOWLEDGE OF EXISTING NEEDS AND FACILITIES, AND BE CONSISTENT WITH ITS CURRENT POLICIES AND CONSTRUCTION STANDARDS. To implement this coordination, the OWNER shall make available to the ENGINEER for use in planning the project, all existing plans, maps, field notes, statistics, computations and other data in his possession relative to existing facilities and to the project without additional cost to the ENGINEER, and upon which the ENGINEER may rely. JOC),3' bill Page 1 m City Secretary Office ~ Official Record Copy SECTION VI THE ENGINEER'S COMPENSATION For and in consideration of the Basic and Special Engineering Services to be rendered by the ENGINEER, as cited in Section II above, the OWNER shall pay and the ENGINEER shall receive the compensation hereinafter set forth: 1. BASIC ENGINEERING SERVICES Compensation for the Basic Engineering Services (Project Definition, Review Meetings, Management, and Control, Signal System Communications Design, Bidding, Construction Contract Administration, and Signal Timing Optimization) phases of the PROJECT, the ENGINEER will provide the services described in the Scope of Services on a lump sum basis. All permitting, application, and similar project fees will be paid directly by the OWNER and are in addition to the ENGINEER's total compensation. The total compensation to the ENGINEER for the Basic Engineering Services shall be $87,500 without additional negotiation and authorization. Payment to the ENGINEER shall be due in monthly installments made upon receipt of an invoice from the ENGINEER including an amount charged based upon the percentage of services completed as of the invoice date. 2. ADDITIONAL SERVICES (if needed) Services other than those set forth in the Scope of Services shall constitute Additional Services. Additional Services, such as attendance at meetings other than those included in the Scope of Services, or any others, shall be performed only with OWNER's authorization, and shall be computed the same as Basic Engineering Services. Additional Services will be in addition to the total amount in sub-paragraph 3 below. 3. TOTAL COMPENSATION Total compensation to the ENGINEER for "Basic Engineering Services", ($87,500), shall be the lump sum amount of $87,500 without additional negotiation and authorization. The compensation for engineering services stated does not include sales tax. If the State of Texas imposes a sales tax on engineering services during the time of this contract, then the Owner agrees to pay the sales tax as an extra payment, above and beyond the agreed compensation for engineering services. SECTION VII REVISION OF REPORTS, PLANS, SPECIFICATIONS AND OTHER DOCUMENTS The revision and redrafting of reports, plans, specifications and other documents during the formative stages as an orderly process in the development of the project to meet the needs of the OWNER shall be considered as part of the Basic Engineering Services; however after a definite plan has been approved by the OWNER, if a decision is sUbsequently made by the OWNER, which, for its proper execution involves extra services and expenses for changes in, or additions to the drawings, specifications or other documents, or if the ENGINEER incurs extra labor cost or expenses due to delays imposed on him from causes not within his control, the ENGINEER shall be compensated for such extra expense which shall be considered as Special Services. The ENGINEER is responsible for notifying the OWNER as soon as possible if this circumstance arises. SECTION VIII OWNERSHIP OF DOCUMENTS Original documents, plans, design and survey notes represent the product of training, experience, and professional skill, and accordingly belong to, and remain the property of the ENGINEER who produced them, and the OWNER regardless of whether the instruments were copyrighted or whether the project for which they were prepared is executed. The OWNER shall be furnished with three sets of record drawinos. one set of labeled aperture cards of record drawino plan sheets. and a CD-ROM containino a reproducible COpy of all reports. orioinal drawinas. opinion of probable construction cost. field notes. and data. The OWNER will use these plans and data in connection with the project only as a source of information as to construction. Any electronic copies given out by the OWNER will not contain the ENGINEER's seal. Page 2 m City Secretary Office ~ Official Record Copy SECTION IX COMPLETION SCHEDULE See Attachment "B" for completion schedule. SECTION X TERMINATION Either party to this AGREEMENT may terminate the AGREEMENT by giving to the other 30 days notice in writing. Upon delivery of such notice by the OWNER to the ENGINEER, the ENGINEER shall discontinue all services in connection with the performance of this AGREEMENT and shall proceed to cancel promptly all existing orders and contracts insofar as such orders or contracts are chargeable to this AGREEMENT. As soon as practicable after receipt of notice of termination, the ENGINEER shall submit a statement, showing in detail the services performed under this AGREEMENT to the date of termination. The OWNER shall then pay the ENGINEER promptly that proportion ofthe prescribed charges which the services actually performed under this AGREEMENT bear to the total services called for under this AGREEMENT less such payments on account of the charges as have been previously made. Copies of all completed or partially completed designs, plans and reports prepared under this AGREEMENT shall be delivered to the OWNER when and if this AGREEMENT IS TERMINATED, but subject to the restrictions, as to their use, as set forth in Section VIII. SECTION XI LIABILITY The ENGINEER agrees to indemnify, and hold City whole and harmless against any and all claims for damages, costs, and expenses of persons or property that may arise out of, or be occasioned by, or from any negligent act, error or omission of ENGINEER, or an agent, servant, or employee of ENGINEER in the execution or performance of this Contract, without regard to whether such persons are under the direction of City agents or employees. The ENG INEER agrees to carry an errors and omissions type of professional liability insurance policy and will furnish the OWNER a certificate of insurance for the OWNER'S file. SECTION XII SUCCESSORS AND ASSIGNMENTS The OWNER and the ENGINEER each binds himself and his successors, executors, administrators and assigns to any other party of this AGREEMENT and to the successors, executors, administrators, and assigns of such other party, in respect to all covenants of this AGREEMENT. Except as above, neither the OWNER nor the ENGINEER shall assign, sublet or transfer his interest in this AGREEMENT without the written consent of the other. Nothing herein shall be constituted as creating any personal liability on the part of any officer or agent of any public body which may be a party thereto. Page 3 m City Secretary Office ~ Official Record Copy SECTION XIII SPECIAL CONDITIONS Special conditions, under the AGREEMENT, include and are limited to those listed hereinafter; the conditions shall become part of the AGREEMENT: Other provisions contained in the written "Authorization of Services", issued by the OWNER, under Section III, and accepted by the ENGINEER, shall become part of the AGREEMENT. Page 4 ~ City Secretary Office ~ Official Record Copy ATTACHMENT "A" SCOPE OF SERVICES PROJECT UNDERSTANDING Prepare construction contract documents for the installation of a spread spectrum radio communications system and develop coordinated signal timing for the City's existing traffic signal system. Basic Engineering Services (outlined in the following Scope of Services) include and shall be limited to the following: 1. Project Definition, Review Meetings, Management, and Control; 2. Signal System Communications Design; 3. Bidding; 4. Construction Contract Administration Services; and 5. Signal Timing Optimization. I. PROJECT DEFINITION, REVIEW MEETINGS, MANAGEMEN~ AND CONTROL A. Project Definition. For purposes of this Project the following OWNER intersections shall be included. 1. OWNER maintained intersections (22) to be included in both the signal system communications design and signal timing optimization phases of this project: a. Grapevine Highway at Rufe Snow Drive; b. Grapevine Highway at Vance Road; c. Grapevine Highway at Glenview Drive; d. Grapevine Highway at Road to the Mall; e. Grapevine Highway at Rodger Line Drive; f. Grapevine Highway at IH 820; g. Grapevine Highway at Strummer; h. Grapevine Highway at Harwood; i. Grapevine Highway at Emerald Hills Way; j. Grapevine Highway at TCC/NRH20; k. Grapevine Highway at Walker Boulevard/Cannon; I. Davis Boulevard at IH 820; m. Davis Boulevard at Maplewood Avenue; n. Davis Boulevard at Harwood Road/Lola Drive; o. Davis Boulevard at Emerald Hills Way; p. Davis Boulevard at College Circle; q. Davis Boulevard at Bridge Street; r. Davis Boulevard at Mid Cities Boulevard; s. Davis Boulevard at Main Street; t. Mid Cities Boulevard at Smithfield Road; u. Smithfield Road at Starnes Road; o. Smithfield Road at Chapman Road; p. Precinct Line Road at North Tarrant Parkway; and q. Mid Cities Boulevard at Home Depot Entrance. B. Review Meetinas. Unless otherwise stated herein, it is assumed that all project review meetings will be held at the OWNER Public Works Service Center. It is agreed that up to three (3) review meetings will be held relative to the project. C. Manaaement and Control. Project management spans the entire duration of the project. This task involves the monitoring and coordination of services provided to the OWNER. Included in this task are documentation, reporting requirements, meetings, coordination, and schedule. 1. Documentation. Surveying notes, reports, technical memoranda, status reports, invoices, and other correspondence relevant to the project will be summarized and copies turned over to the OWNER at the conclusion of the project or as requested by the OWNER. 2. Meetinas. The ENGINEER will prepare agendas, materials, and meeting summaries for up to three (3) meetings. 3. Proiect Coordination. The ENGINEER will coordinate data collection and design efforts with OWNER staff and/or consultants working within or adjacent to the project limits. 4. Project Schedule. The ENGINEER will prepare a project schedule. II. SIGNAL SYSTEM COMMUNICATIONS DESIGN A. Data Collection and Field Survey. The ENGINEER will collect and organize data for use in future project tasks. The specific type, quantity and other requirements of the data to be collected, reduced, and organized by the ENGINEER are described in the following subtasks. 1. Field Survey. The ENGINEER will conduct a field survey for the system layout. The compiled field data will provide detail to facilitate the construction of communications equipment. Page 6 ~City Secretary Office ~ Official Record Copy 2. Photoloa Summary. The ENGINEER will photograph each location where new hardware is anticipated. The photolog will be provided to the OWNER at the conclusion of the project. 3. Compilation of Desian Information. The ENGINEER will organize design information required for completion of this project. The ENGINEER will compile available specifications, standard detail drawings, and other design information from the OWNER or TxDOT and other sources and will prepare a list of other needed data. B. Communications Master Plan. 1. Wireless Evaluation. Prior to design, the ENGINEER will conduct field verifications of antenna locations, as identified in the data collection task. Connection locations to the OWNER's existing service center will also be identified. A topographic map study will be conducted to determine if a planned path provides favorable line-of-sight conditions and path performance. 2. Network Master Plan. Based on the location of the OWNER's signalized intersections, the ENGINEER will design a wireless data communications network master plan. This design will indicate communication routings, communications nodes (if any), and network hardware requirements. The proposed communications media will be spread-spectrum radio. C. Plans Preparation. The ENGINEER will prepare construction plans for the OWNER's traffic signal communications system. Radio antenna locations will be described in the general notes and equipment summary tables in accordance with the latest applicable standards and procedures of the OWNER. Intersection antenna mounting details and connections between the antenna and traffic control cabinet will be highlighted in the standard detail drawings and plans. Communications interconnect between the omni- directional antenna and the existing service center will be shown in layout form. The ENGINEER will prepare and submit construction plans to the OWNER for review and comments at the following stages of development: 1. Preliminarv plans review. Preliminary plans showing title sheet, system conceptual design, and preliminary communications detail drawings. 2. Pre-final plans review. Pre-final plans showing title sheet, general notes, equipment summary tables, special/standard detail drawings, as well as a design layout including street names, legend, scale, north arrow, equipment locations, network schematics, and communications sizing and routing. 3. Final plans review. Final plans will incorporate appropriate review comments from prior plan reviews. A total of two (2) plans packages will be submitted at each review stage. The ENGINEER will establish target dates on which the plans will be submitted for review at the above stages of development. The ENGINEER will submit the revised plans prior to the next review meeting. Completion and compensation of Additional Services will be agreed to and authorized by the OWNER prior to their performance. D. Preparation of Specifications. This task involves the preparation of specifications, special specifications, and special provisions that will be included in the construction contract bid documents. The ENGINEER will prepare specifications for the procurement and installation of system elements for which design requirements are to be established and are not already developed by the OWNER. The final specifications will include: 1. Central control hardware and software functional requirements; and 2. Communications equipment, including intersection interface equipment. The ENGINEER will prepare and submit to the OWNER three (3) copies of the specifications at each stage of development: 1. Preliminary outline with description of section content. Submit with preliminary plans review. 2. Pre-final specifications. Submit with pre-final plans review. 3. Final specifications. Submit with final plans review. E. Preparation of Enaineer's Opinion of Probable Construction Cost. The ENGINEER will prepare preliminary and final ENGINEER's opinion of probable construction costs for the traffic signal system upgrade and communications construction package as specified in the plans and specifications. These cost projections will include the total items contained in the bid documents and individual unit costs for each pay item. The final cost projection will be submitted electronically to the OWNER. F. Preparation of Bid Documents. The ENGINEER will prepare preliminary and final bid documents for the traffic signal system and communications construction package. One (1) bound set of the preliminary bid documents will be submitted to the OWNER for review and comments. One (1) reproducible set of the final bid documents will be submitted to the OWNER. III. BIDDING Bidding shall include: A. Assist the OWNER in the placement of the advertisement for bids (advertisement to be paid for directly by the OWNER), issue contract documents to prospective bidders and maintain a list of bidders to whom bidding documents have been issued. B. Issue addenda as appropriate to interpret, clarify, or expand the bidding documents. C. Attend the bid opening, prepare a tabulation of the bids as received, and prepare a recommendation of award of the construction contract to the lowest qualified bidder. D. Assist the OWNER in determining the qualifications and acceptability of the low bidder. Page 8 ~ City Secretary Office ~ Official Record Copy ---~~,~---_.. E. Prepare the contract documents for execution by the contractor, receive, review and forward such documents to the OWNER for review and execution. IV. CONSTRUCTION CONTRACT ADMINISTRATION SERVICES The ENGINEER will provide professional construction contract administration services for assisting the OWNER during construction. These services will include the following: A. Visits to Site and Observation of Construction. Provide on-site construction observation services during the construction phase of the subject project. Observations will vary depending on the type of work being performed by the contractors, the location, and the contractors' schedules. . Such visits and observations by the ENGINEER are not intended to be exhaustive or to extend to every aspect of CONTRACTOR's work in progress. Observations are to be limited to spot checking, selective measurement, and similar methods of general observation of the Work based on the ENGINEER's exercise of professional judgment. Based on information obtained during such visits and such observations, the ENGINEER will determine if CONTRACTOR's work is generally proceeding in accordance with the construction contract documents, and the ENGINEER shall keep the OWNER informed of the general progress of the Work. The purpose of the ENGINEER's visits to the site will be to enable the ENGINEER to better carry out the duties and responsibilities assigned in this Agreement to the ENGINEER during the construction phase by the OWNER, and, in addition, by the exercise of the ENGINEER's efforts, to provide the OWNER a greater degree of confidence that the completed Work will conform in general to the construction contract documents and that the integrity of the design concept of the completed Project as a functioning whole as indicated in the construction contract documents has been implemented and preserved by CONTRACTOR. The ENGINEER shall not, during such visits or as a result of such observations of CONTRACTOR's work in progress, supervise, direct, or have control over CONTRACTOR's work, nor shall the ENGINEER have authority over or responsibility for the means, methods, techniques, equipment choice and usage, sequences, schedules, or procedures of construction selected by CONTRACTOR, for safety precautions and programs incident to CONTRACTOR's work, or for any failure of CONTRACTOR to comply with laws and regulations applicable to CONTRACTOR's furnishing and performing the Work. Accordingly, the ENGINEER neither guarantees the performance of any CONTRACTOR nor assumes responsibility for any CONTRACTOR's failure to furnish and perform its work in accordance with the construction contract documents. B. Recommendations with Respect to Defective Work. Recommend to the OWNER that CONTRACTOR's work be disapproved and rejected while it is in progress if, on the basis of such observations, the ENGINEER believes that such work will not produce a completed Project that conforms generally to construction contract documents or that it will prejudice the integrity of the design concept of the completed Project as a functioning whole as indicated in the construction contract documents. Page 9 m City Secretary Office ~ Official Record Copy C. Clarifications and Interpretations. Issue necessary clarifications and interpretations of the construction contract documents to the OWNER as appropriate to the orderly completion of CONTRACTOR's work. Such clarifications and interpretations will be consistent with the intent of and reasonably inferable from the construction contract documents. Field Orders authorizing variations from the requirements of the construction contract documents will be made by the OWNER. D. Chance Orders. Recommend Change Orders to the OWNER, as appropriate. Review and make recommendations related to Change Orders submitted or proposed by the CONTRACTOR. E. Substitutes and "or-equal". Evaluate and determine the acceptability of substitute or "or- equal" materials and equipment proposed by CONTRACTOR, but subject to the provisions of applicable standards of state or local government entities. F. Disaareements between the OWNER and CONTRACTOR. As necessary, render written decision on all claims of the OWNER and CONTRACTOR relating to the acceptability of CONTRACTOR's work or the interpretation of the requirements of the construction contract documents pertaining to the execution and progress of CONTRACTOR's work. In rendering such decisions, the ENGINEER shall be fair and not show partiality to the OWNER or CONTRACTOR and shall not be liable in connection with any decision rendered in good faith in such capacity. G. Final Notice of Acceptabilitv of the Work. Conduct a final site visit to determine if the completed Work of CONTRACTOR is generally in accordance with the construction contract documents so that the ENGINEER may recommend, in writing, final payment to CONTRACTOR. Accompanying the recommendation for final payment, the ENGINEER shall also provide a notice that the Work is generally in accordance with the construction contract documents to the best of the ENGINEER's knowledge, information, and belief and based on the extent of the services provided by the ENGINEER under this Agreement. H. Limitation of Responsibilities. The ENGINEER shall not be responsible for the acts or omissions of any CONTRACTOR, or of any of their subcontractors, suppliers, or of any other individual or entity performing or furnishing the Work. The ENGINEER shall not have the authority or responsibility to stop the work of any CONTRACTOR. I. Pre-construction conference. The ENGINEER will prepare for and attend the pre- construction conference. V. SIGNAL TIMING OPTIMIZATION A. Data Collection. The ENGINEER will collect the following data: 1. Turnina Movement Counts. New turning movement count data will be collected and reduced for three (3) one and one-half (1.5)-hour time periods at each project intersection. Data will be tabulated by 15-minute increments, by approach direction (e.g., northbound, etc.), and by turning movement (e.g., left, straight, or right). In addition, the number of vehicles with more than four tires will be classified by 15- minute increments and by approach. Page 10 ~."~ City Secretary Office ~ Official Record Copy The time periods shall be defined as follows: · AM Peak = six (6) consecutive 15-minute periods (normally 7:00 AM to 8:30 AM) on a non-holiday Tuesday, Wednesday, or Thursday; · Noon Peak = six (6) consecutive 15-minute periods (normally 11 :45 AM to 1 : 15 PM) on a non-holiday Monday, Tuesday, Wednesday, or Thursday; · PM Peak = six (6) consecutive 15-minute periods (normally 4:45 PM to 6:15 PM) on a non-holiday Tuesday, Wednesday, or Thursday; and It is understood that the beginning and ending times of the AM Peak, Noon Peak, and PM Peak counts may be adjusted based on the results of recording machine count data. 2. Adiust Count Data. Using information from the traffic counts, the ENGINEER will make adjustments as necessary to ensure the reasonableness of the turning movement counts for each intersection. If any adjustments are deemed necessary the changes will be made upon conference with the OWNER. 3. Recordina Machine Counts. For each of the following locations, new Tuesday through Thursday directional recording machine count data will be collected and reduced. For each location and direction, a minimum of seventy-two (72) hours of data will be recorded by 15-minute increments, beginning on or before 11 :00 PM on a Tuesday and ending on or after 1 :00 AM on Thursday. Counts will not be made on holidays, during adverse weather conditions, or when school is not in session. One (1) additional count will be made on a Saturday at a location to be determined by the ENGINEER. Recording machine counts will be made at the following locations: On Grapevine Highway - · Between Glenview and Road to the Mall · Between Emerald Hills Way and TCC/NRH20 On Davis Boulevard - · Between Maplewood Avenue and Harwood Road/Lola Drive · Between Mid Cities Boulevard and Main Street 4. Travel Time Runs. Both "before" and "after" travel time runs will be made using floating car techniques for each of the following routes during the time periods shown in Section V.A.1 above. · Grapevine Highway from Rufe Snow Drive to Precinct Line Road (five runs per time period minimum per direction) · Davis Boulevard from IH 820 to Main Street The before runs will be made prior to the development of the new signal timing to establish baseline conditions (speeds, delay, and number of stops) and to determine appropriate progression speeds, areas where queue management is critical, and areas where recurrent congestion may affect progressive traffic movement. After the fine-tuning and adjustment of the new, optimized signal timing, the after runs will be made to document the changes. Page 11 ~ City Secretary Office ~ Official Record Copy ---------- 5. Conduct Field Observation. Prior to the development of new signal timing, the ENGINEER shall conduct field observation on each route during each time period. 6. Verify Geometrics. For each project intersection, the ENGINEER will verify the followirig elements of intersection geometrics and pedestrian accommodation that affect signal timing: · The number of lanes on each approach and the required or permitted usage of each lane (Le., "left only"; "left or straighf; "straight only"; "straight or righf'; "right only"; or "left, straight, or righf); · Approximate street widths, crosswalk lengths, and grades; and · Existence of pedestrian signal indications (Le., 'Walk" and "Don't Walk") and/or pedestrian actuation. B. Generate Timina Plans. 1. Assemble Controller Interval Timing. Based on approach speeds and intersection geometrics, the ENGINEER will assemble the appropriate controller interval timing. Minimum green, passage, yellow, all-red, MAX I, MAX II, etc. will be provided by the OWNER to the ENGINEER. 'Walk" and pedestrian clearances will be calculated by the ENGINEER. Existing yellow and all-red clearance intervals will be utilized. 2. Generate Timina Plans. Using Synchro™ 5.0, the ENGINEER will generate new signal timing plans. It is anticipated that up to three (3) unique plans will be generated for all subsystems of the Project. This generally will consist of unique plans for the AM Peak, Noon Peak, and PM Peak time periods. Progression bandwidths for all timing plans will be optimized to the maximum practical extent using dual leading left-turns. After this optimization is complete, the arterial will be re-optimized allowing the variation of the signal phase sequence (i.e., a particular left-turn phase may be "leading" during one timing plan but lagging during one or more other timing plans). The ENGINEER will identify locations where a "yellow trap" condition would result because of a leading "protected-permitted" left- turn phase on the opposite approach. This information will be provided to the OWNER and reviewed with them to determine the most appropriate method for eliminating the yellow trap condition. The final timing will make use of lagging left- turns only at those locations where the "yellow trap" will not occur. Each Synchro timing plan will include a cycle length, offset, and split for each intersection and a time space diagram for each corridor peak period. The plans will be submitted for review. At a subsequent review meeting, the ENGINEER will discuss the characteristics of each plan and receive comments. The ENGINEER will then finalize each timing plan to incorporate such comments. This project will follow current TxDOT requirements for traffic signal timing along State roadways. 3. Finalize Timina Plans. The ENGINEER will furnish the final timing plan data showing the cycle length, offset, splits, and modifications to the existing clearance intervals. Page 12 ~ City Secretary Office ~ Official Record Copy ~.~._---._----- The following is assumed relative to actual implementation of the timing: · The timing data will be entered by OWNER personnel; · It is assumed that the ENGINEER's role relative to timing plan implementation will be limited to responding to questions that may arise during the implementation process. 4. Timina Plan Fine-Tuning. When the new timing is operational, the ENGINEER will provide qualified staff members for on-site fine-tuning assistance. During the course of this assistance, the ENGINEER will observe the actual operation of the new timing plans and suggest minor adjustments to improve the operation. It is assumed that OWNER personnel will participate in this process, thereby gaining familiarity with the timing plans. The ENGINEER will provide up to four (4) hours per intersection for on-site fine- tuning. A total of 23 intersections are assumed for this project. It is mutually understood and agreed to that no more than ninety-two (92) man-hours will be expended under this contract for fine tuning purposes. The OWNER will send the ENGINEER a copy of the implemented timing plans for review and comparison against the recommended' timing plans. 5. Final Report. At the conclusion of the project, the ENGINEER will prepare a final report that will include the following: · The updated information originally provided in the technical memoranda; and · A summary of project benefits as determined from an analysis of the "before" and "after" travel time runs data. The following additional information, provided in the appendix: · Final Synchro signal timing data along with time-space diagrams; and · "After" travel time runs. The ENGINEER will submit a draft final report for review. The ENGINEER will meet with the OWNER to receive comments. The ENGINEER will incorporate review comments and submit the final report. ADDITIONAL SERVICES Services not specifically identified in the Scope of Services above shall be considered additional and shall be performed on an individual basis upon authorization by the OWNER.
