PRESENTER: Clayton Husband, Principal Planner SUMMARY: On behalf of Zarr Management & Development Inc., MEL/ARCH Architecture Studio is requesting a zoning change from C-2 (Commercial) to NR-PD (Nonresidential Planned Development) to allow for the development of an office-warehouse project to include contractors offices, merchandise distributors, and other service uses. The site is located at 6721 Boulevard 26. GENERAL DESCRIPTION: The 37,871-square-foot site under consideration is located at the northwest corner of Boulevard 26 and Flory Street. The owner proposes to develop a single-story office- warehouse building on the site. The property is currently vacant. A site plan package for the development is attached. Planned improvements to the site include a 9,390-square-foot building. The building design includes eight tenant spaces with pedestrian and roll-up doors on the Flory Street side of the building. Primary driveway access is from an existing driveway on Flory Street, and the site has access to Rufe Snow Drive through a common access easement shared with the property to the west. The site provides a landscaped area of 13,595 square feet (30% of the site). Landscaped setbacks are provided adjacent to Flory Street and Boulevard 26, and the setbacks include street trees, parking lot screening shrubs, and other plantings. Parking lot trees are provided at two locations. Additional trees are recommended by the Development Review Committee to be planted in the turf grass area adjacent to the north property line. The proposed conditions of approval for this NR-PD district are attached. Applications for rezoning to this district provide an opportunity to address modifications to specific site development and building design standards for the site. These conditions are based on the applicant's proposed development of the property and the items described below. These conditions may be modified throughout the public hearing process, but they are subject to final approval by City Council. "K NOKTH KICHLAND HILLS Land uses The proposed planned development would permit those land uses allowed in the C-2 (Commercial) zoning district, which is the current zoning of the property. The applicant is also seeking approval to allow additional land uses on the property, including contractor's offices with shop and garage, and wholesale distributors. These uses currently require approval of a special use permit in the C-2 (Commercial) district. Parking Based on the size of the building, the development requires 38 parking spaces, but the site only provides 27 spaces. However, there is an existing recorded reciprocal access and parking easement agreement in place between the subject property and the property to the west. In part, the agreement allows for the joint use of parking spaces between the two properties. Since the required number of parking spaces for the subject property includes the use of spaces on the adjacent site, the proposed development standards for the planned development require that the agreement must be maintained in good standing. In the event a tenant or use requires parking for fleet vehicles, the development standards also include a requirement fleet vehicles must be parked on the west side of the building. The parking of fleet vehicles would be prohibited in front of the building adjacent to Flory Street. LAND USE PLAN: This area is designated on the Land Use Plan as Retail Commercial. This designation provides sites for community and regional shopping centers, commercial establishments, and employment centers. These sites are typically located on highways and major thoroughfares at key intersections. A supplemental recommendation of the Land Use Plan is to prioritize commercial uses at key intersections where retail is most likely to thrive. CURRENT ZONING: The property is currently zoned C-1 (Commercial). This district is intended to provide for development of retail service and office uses principally serving community and regional needs. The district should be located on the periphery of residential neighborhoods and be confined to intersections of major arterial streets. It is also appropriate for major retail corridors as shown on the comprehensive plan. PROPOSED ZONING: The proposed zoning is NR-PD Nonresidential Planned Development following the C-2 (Commercial) district land uses and development standards. The proposed change is intended to permit office or retail development on the site and allow for the modifications to the site development standards for the property. IP, + IJ14 � III v '� r � �� IIIIIIIII IIIIIIII U����� Exhibit B— Land Use and Development Regulations—Ordinance No. xxxx— Page 1 of 2 Zoning Case ZC 2021-08 Lot 8R, Block 2,Jack M Estes Subdivision. 6821 Boulevard 26, North Richland Hills,Texas This Nonresidential Planned Development (NR-PD) District must adhere to all the conditions of the North Richland Hills Code of Ordinances, as amended, and adopt a base district of C-2 (Commercial). The following regulations are specific to this NR-PD district. Where these regulations conflict with or overlap another ordinance, easement, covenant or deed restriction, the more stringent restriction will prevail. A. Permitted Land Uses. Uses in this NR-PD are limited to those permitted in the C-2 (Commercial) zoning district, as amended, with the addition of and subject to the following. 1. Contractor's office with shop and garage 2. Wholesale distributor 3. Any land use requiring a special use permit in the C-2 (Commercial) zoning district, as amended, is only allowed if a special use permit is issued for the use. 4. Any land use prohibited in the C-2 (Commercial) zoning district, as amended, is also prohibited. B. Site development standards. Development of the property must comply with the site plan attached as Exhibit "C," the development standards of the C-2 (Commercial) zoning district, and the standards described below. 1. A site plan and associated plans for the development must be approved by the Development Review Committee prior to the issuance of a building permit for the property. 2. At least two (2) large canopy trees must be installed in the landscape area located adjacent to the north property line.The trees must be located at least seven (7)feet from any existing utility line. 3. The existing reciprocal access and parking easement agreement with the adjacent property owner must be maintained in good standing (Document D220241215, Official Public Records, Tarrant County, Texas). The agreement must stipulate that spaces in the designated parking area would be available for use by tenants and visitors to Lot 8R, Block 2,Jack M Estes Subdivision. 4. For any tenant or use that requires parking for fleet vehicles, the fleet vehicles must be parked on the west side of the building. Parking of fleet vehicles is prohibited in front of the building adjacent to Flory Street. 5. Signs must designed and installed in accordance with Chapter 106 — Signs of the North Richland Hills Code of Ordinances. E. Amendments to Approved Planned Developments. An amendment or revision to the Nonresidential Planned Development (NR-PD) must be processed in the same manner as the original approval. The application for an amendment or revision must include all land described in the original ordinance that zoned the land to the NR-PD district. Decrease on-site parking requirements; 5. Reduce minimum yards or setbacks; or 6. Change traffic patterns.
