HomeMy WebLinkAboutCC 1964-06-08 Minutes MINUTES OF THE MEETING OF THE CITY COUNCIL, NORTH RICHLANÐ HILLS, TEXAS, HELÐ AT CITY HALL, 4101 MORGAN CIRCLE, JUNE 8, 1964, 7:30 P. M. CALL TO ORDER & ROLL CALL: Those Present: Mayor Hunter; Councilmen Stevens, Barnett, Roberts, Dowell and Falcone. ADMINISTRATIVE STAFF PRESENT: City Director, City Attorney, Fire Chief and City Secretary. INVOCATION: Mr. Granville Edwards. APPROVAL OF MINUTES: Mr. Barnett moved, Mr. Dowell seconded, to approve the minutes of the meeting held Mqy 25, 1964 as they now stand. Motion carried 5-0. COMMUNICATIONS: 1. Letter (hold-over) - Mr. Greer, State Highway Department - Represent- ative to Regional Transportation Study Committee. After discussion Mr. Roberts moved to name Mr. French to be City representative to this committee. Mr. Dowell seco~ded. Messrs. Dowell, Roberts, Barnett and stevens voted YES, Mr. Falcone abstaining. Motion carried 4-0. 2. Letter - Mr. Greer of Highway Ðepartment - Re: Overpass for Booth Calloway R~cd - denied at this time. REPORTS OF CmmITTEES: 1. Rufe Snow Widening: Mr. Falcone passed out drawings of several pr~;~s819 for the widening of Rufe Snow Drive, pointing out the one his committee favored and a.sked Council to adopt one for consideration. After study and discussion Mr. D~rnett moved for Council to ~dopt this program for evaluation with sketch No.1 as a basis. Hr. Roberts seconded. Mr. stevens asked for a report from Mr. French at next meeting. Motion carried 5-0. Mr. French was asked for an itemized list of costs for a first class job and also for an alternate proposal. OLD :9USINESS: 1. Summer Recreation Program: Mr. French told of talking with Mr. Stafford and stated the plan was similar to the Haltom City program but due to the late start and dead- line this program would be passed over for this year but Mr. Stafford would contact the Council in February concerning this program for next Bummer. 2. Zoning Complaint: Mr. TAft ~~cved pictures of Flory Street area showing tall grass, water over the dry weather crossing and sheet iron barn, subjects of his com- plaint. Lengthy discussion followed in which Mr. Taft stated that his main complaint was that he felt that his area had been zoned illegally. Mr. Goodnight stated that he would like to work with Mr. Taft and his Attorney, if he had one, concerning this problem. This met with approval. 3. Legal Opinion: - Re: Removal of Water Board Members: Mr. Goodnight stated he had not had time to arrive at an opinion at this time, stating that he thought he knew the answer but would like a little more time for study. This opinion to be given at next meeting. 4. Correction to Minutes of May 11, 1964 - Zoning Report: City Secretary pointed out a paperwork change only in the minutes of May 11, 1964. Minutes read "Local Retail-Bujiness" - should read "Clpss "C" Residential". NEW BUSINESS: 1. Revise ordinances; Mr. Falcone asked Mr. Goodnight to read from Statute Book on "responsi- bilities and powers of Mayor". Mr. Goodnight read Article 989 and dur- ing some discussion read other articles requested. Mr. Falcone stated, after discussion and study of Ordinance No. 31, Section 1, that he wanted to sponsor an amendment to this section because of conflict with several City ordinances where amount of fines were concerned - Rmend~ent to read $200.00 instead of $100.00. Discussion of designation of one-way streets brought on suggestion by Mr. Falcone that an ordinance be drawn concerning this matter. Mr. Falcone stated he wanted to sponsor amendments to Ordinances NO.'S 13, 30,31 and 33 ooncerning appointments - "appointments made by Mayor" deletp.d and to read "Appointments made by any one CounciJ~~n and confirmed by Council". Mr. Goodnight stated since Ordinance No. 31 did not have a Savings Clause the entire ordin~nce should be redrafted. Mr. Falcone sugbaat~a amending Ordinance No. 33 in regards to Zoning Commission members from five (5) members to nine (9). After further discussion it was requested of Mr. Goodnight to study these ordinances and draw up amendments and naw ordinances to present at next meeting. OTHER BUSINESS: 3t~temcnt for $175.00 from Mr. Goodnight for extra services connected with the preliminary hearing of the Dock Dutton case M~S presented to Council and Mr. Goodnight told of this hearing and results. Ðiscussion followed afterwhich Mr. Falcone moved to approve payment of the $175.00. Mr. Roberts seconded and motion carried 5-0. ' Mr. Falcone asked Mr. Goodnight what was the maximum tax rate a General Law City could impose and the answer was $2.50. Mr. Falcone asked Mr. Goodnight if the Mayor had acted outside his powers in asking Judge Massey to preside at Court June 4, even though the motion ~/as made and carried that the Judge's tenure of office was ended May 31st. Mr. Goodnight stated that the Mayor had not acted outside his powers according to the state Statutes. Some general discussion followed.
