APPROEAL Of MINUTES: Mrs. Reagan made a oorreotion in the thlrd
sentenoe, ~ragra~h 4, page 4, ot the mlnutes at the meeting og
Augult 24,1964, stating that the original minute. were oorrect,
but that some words were omitted from the stencilled oo~les. Ooun-
cilman Roberts made a motion to a~rove the minutes as correoted,
seooned by Oouncllman Stevenl. Motion oarried 5-0.
OOMMUNIOATIONS:
1. Letter tro. Jo~n S. Pure.ll stating that ~oliol.s requested by
the Oity tor the Northealt Wast. Oolleotors would be torthcomlng,
and that this letter was aontirœation at the polioles that would
be furnish.d the Oity al loon as they could be wrltten.
2. L.tt.r trom state Highway Engineer, ft. W. ODeok, regarding trattic
light at state Hlghways 121 and 19)8, Itattng that they did not wish
to initiate this st*dy until atter the o~ening of I. H. 820.

se~teJlber 1,1964. Motion made by Mr. lowell that the reslgnation be"
aoce.ted, seconed by Mr. Barnett. Motion carried 4-1, with Mr. ralcone
easting the dlssenting vote.
Mayor Hunter stated that he and Oouncilman stevens had met with Mr.
lawson lavl., concerning hls em~loyment as Oity Attorney. Mr. stevens
re~orted that Mr. lavis had agreed to a retainer at .200.00 .er month
for two Oounoll meetlôgs and two Oorporation Oourt sessions .er month,
but that there would be an extra charge tor lengthy ord1nances requiring
re.earoh, and tor Oourt ..,....n... in contested ca.e.. Atter di.cu.s-
ion Mr. stevens made a motion to acce~t Mayor Hunter'. reoommendation
to e..loy Mr. lavis as 01ty Attorney, seooned by Mr. Roberts. Mr.
Baraett then moved to table this motion, but h1s motion died for laok

thelr develo,.entl. Mr. Barnett sald he would sponsor an ordlnance to
that etrect, and atter dlscusslon, made a motion that the 01ty Att-
orney be lnstructed to draft such an ordinance. Mr. Roberts seconded,
and motlon carrled 5-0.

had seen so.e .treets ln the 01t1 that were so poorly built that
Johnson grass was growing in the street, and that he had .repared

affirmative, the Mayor stated that he and Mr. Adoock bad talked to Mr.

SouthWest Laboratorle., and construction of .treet. would b. stop.ed

Hr. Barnett then moved to make the follwwlng adjultment to Aocount 6,
Police lepartment: Par.l, Item (b), delete Lieutenant's salary ot
15l24.00, and add 14545.00 to Par.2, Item (t), tor a sixth patrolman'l
salary, and ~laoe the dlfterenoe of 1579.00 to Account lO. Motion was
seoonded by Mr. lowell and dlsousslon tollowed, durlng wbioh the Chiet

6. TRANSFER or SUIlPLUS MONEY TO STJŒET DEPARTMENT: Mr. raloone suggested
that all surplus money tor the current tiscal year be transferred lnto
the street Departm.nt. It was pointed out that only two weeks rema1ned
in this budget year, that this amount could not be used in that short
tille and would revert back to surplus tunds at the end of ...t.mber,
and no action was taken on this ltea.
REPO~T OF OHAR!ER OOMMISSION:
Mr. Oalvin Luper, Ohairman ot the Oharter Oomalssion, .resented a copy
ot the proposed oharter, and read a letter dated Se~teaber 9,1964,
addressed to the Mayor, re~orting on the work ot the Charter Ooaaisslon,
and requestlng that an ele ction be oalled tor Nove.ber J,1964. Mr
lowell made a motlon that the 00unc11 receive the report ot the Oharter
Ooamisslon. Jiscussion tollowed, w1th audience partioi,ation. Mayor
Hunter read Artlcle No. 1167 from Vernon's 01val statutes, regard1ng
submlssion ot the charter, and stated he thought that according to
this law, tha Ooubcil bad no alternatlve but to call the election to~
November Jrd, a. .pecltled by the Okarter Oomaisslon. Further disoussion
tollowed, and the Oorporation Oourt Judge Marlon Massey was requa.ted
to co.e forward and give his opinion ot thls law. Judge Massey commended
the Oouncll oÓ the hiring at Mr. lawson lavis as Oit7 Attorney, and then
expla1ned the ~rovisions at Artiole. 1167 and 1168, and stated that lt
was his o.lnion that the Charter Oommission had the ~rerogative ot sett-
ing the date ot the election, and the Oouncil was requ1red to call the
electlon on the date .~ecitied. Conèiderable di.cussion tollowed, with
menvers ot the Oharter Commission and other interested citlzens partlc-
i.ating. Mr. Stevens made a motion to table the aatter until an Attor-
ney has studied the charter, and Mr. Zellers, a Okarter Oommission
menber, stated that Mr. Goodnight, who was then 01ty Attor.ey, did a.~
rOTe the charter. Mr. Barnett seconed Mr. stevens motion to table, and

warned the Ooubcil that It they voted to table this matter that any
oitizen could file a wrlt of mandamus to force the. to call the eleo'tôQQ
Vote was then taken and motion carrled J-2, with M....., falcone, Stevens
and Barnett voting to table, and Oouncilmen lowell and Roberts voting
Inol. Xayor Hunter again point.d out that this .atter ·can very well
be in the hands of the Distriot Oourt ln the morning'.
