MINUTES OF THE SPECIAL MEETING OF
THE CITY COUNCIL OF NORTH RICHLAND
HILLS, TEXAS, HELD AT THE CITY HALL
4101 MORGAN~IHCLE, SEPTMEBER 24, 1964
7:30 P.M.
CALL TO ORDER AND HOLL CALL:
Those present: Mayor Hunter, Councilmen: Barnett, Dowell,
Falcone, Roberts and Stevens..
Administrative Staff Present: City Secrøtary
Mayor Hunter painted out that the reason for the meeting
was to decide what action should be taken on appealing the
case of Luper vs The City of North Hich1and Hills. The Mayor
also pointed out that he felt it was a mistake to appeal
the case and spend more of the City's money. He stated that
the City had already lost the case and it had proven that
the election should be held.
Councilman Dowell stated that the Council must abide by the
law and should consider the City's money before taking any
more votes.
Mayor Hunter stated: Contrary to what the Council thought
or what they had been informed that he had not met secretly
wi th the City Attorney. 'rhe Mayor also asked that the
Council meetings be conducted in a more business like manner
Councilman Jtevens stated that in his opinion the lawsuit
filed by ¡VJr. Luper was hasty and unjust and that the Council
was forced into taking the action that it took.
Councilman Barnett then stated: "This Council is vested with
much discretionary authority by the laws of the State of Texas,
but one exception is to perform any act contrary to the law.
Therefore we continue to be determined to abide by the law
and those rules handed down by; the courts. II
Councilman Dowell then stated that this was a waste of the
City's money and asked Barnett how much of the City's money
would have to be spent before the Council would realize that
the election should be held.
In reply Barnett then stated: "'The rights of the people can
not be equated in dollars and cents. It is a matter of record
that the plaintiff, Calvin Luper, has instituted these
proceedings against the City of North Hichland Hills, and in
such regard, it is certainly usual and reasonable that the
defendant avail himself of every legal remedy. II
Councilman Roberts stated that it was certainly unfortunate
that this had hapoened but that he had worked with the City
Attorney, Dawson Davis, on the matter and the attorney felt
that the appeal must be made. Roberts said that he felt that
the Council had to take this stand.
Mayor Hunter then stated, that in his opinion, that after
fifteen minutes of hearing, the judge forsaw that the Council
was in the wrong. Considerable discussion followed with
Councilman Barnett saying: "In order to protect the rights
of the citizens of North Rich1and Hills, I Move that we auth-
orize the City Attorney to immediately proceed with the
perfection of an appeal in the mandamus case initiated by
the plaintiff, Calvin Luper, acting as chairman of the Charter
Commission, naming the City of North Rich1and Hills and this
Council as defendants, and I further move that such funds as
necessary be immediately appropriated and approved by this
Council, including a check of the City of North Richland
Hills, Texas, drawn upon said City's accoUnts, in the amount
of fifteen hundred dollars, made payable to Mr. George Johnson,
District Clerk, to be deposited with said clerk in leiu of the
making of a supersedeas bond, said sum having been fixed by
the court as the amount of a supersedeas bond, said check to
be duly signed and executed.
Councilman Roberts stated that he would try to point out to
the people, the parts of the Charter that they should see
would hurt them.
Councilman Barnett stated: "This City will not continue to
allow the inappropriate reverse publici~y which is being
circulated by a partisan special interest group within this
City. The facts are: as a matter of record which is taped and
on file and which will reflect in the minutes of the Council
of North Richland Hills, finally accepted and approved by
this Council. The City Council by a three to two ~ote made
motion to table a motion to accept an unsigned letter from
the North Richland Hills Charter Commission, recommending the
Council accept an unsigned proposed home rule charter, until
such time as a final copy was furnished the members of this
Council, and the City Attorney had the opportunity to review
the charter. If such special interest group had wished to
act in good faith they could have prevented the immediate
circumstances by very simply taking this elementary immediate
action.
Councilman DoweL!.,; made a motion to call the election for
Movember 3, 1964. After considerable discussion it was decided
to take a vote on the case of Luper vs The City of North
Richland Hills, as whether or not the City should appeal the
case.
Motion was made by Barnett to appeal the case. Those voting
yes were: Councilmen: Falcone, Stevens, Toberts, and Barnett.
Councilman Dowell cast the dissention vote. The motion carried
4-1.
Mayor Hunter instructed the City Secretary to secure a receipt
from the person whoreceives the check from the City.
