HomeMy WebLinkAboutCC 1964-11-09 Minutes MINUTES OF THE MEETING OF THE CITY COUNCIL OF NORTH RICHLAND HILLS, TEXAS, HELD AT THE CITY HALL, 4101 MORGAN CIRCLE, NOVEMBER 9, 1964 I CALL TO ORDER AND RaLL CALL Those present: Mayor Hunter. Councilmen: Stevens, Barnett, Roberts, Dowell and Falcone. Administrative staff present: City Attorney, Chief of Police, Fire Chief and City Secretary. Also present a visiting Councilman from Wl\t8lUga, Mr. Roger Brooks. II APPROVAL OF MINUTES Mr. Roberts made a motion that the minutes be approved with the following corrections: In the second paragraph of the October 1, 1964, minutes: two of the three appeal judges that were to hear the appeal would be out of the City, therefore, the appeal could not be heard in time to have the election on November 3, 1964; also the second sentence at the bottom of the page be left in the minutes. The motion was seconded by Mr. Barnett. The motion carried with all councilmen voting yes. IIIT COMMUNICATIONS 1. Mayor Hunter read a letter from the Texas Highw~y Department in reference to the adjustment of utilities for the state right of way. The co ncil suggested that the City Attorney look into the matter further. 2. Mayor Hunter read a letter commending the quick work done on a water and street repair project in the cijy. 3. Mayor Hunter read a letter of protest from Mr. Roy L. Schapansky in reference to his name being placed on a letter that was delivered from door to door. In the letter Mr. Schapansky stated that he did not give permission for his mame to be used in this manner. 4. A letter from Mrs. P.M. Dodson was also read by Mayor Hunter. IDt was of the same nature as letter number three. IV' OLD BUS INESS Mr. Falcone stated that he would like to know who authorized payment of $542.00 to the Texas Printing and better Co. for the printing of the home rule charter. Mayor Hunter advised that section III of ordinance 122 provided for payment of th~ printing of the charter. Mr. F~lcone stated that Mr. Barnett's motion on October 12, 1964, proviåèd the provisions under which the printing would be paid. MUch discussion followed on the payment of the printing bill. The City Attorney examined ordinance #122. Mr. Davis stated that it was his off hand opinion that Mr. Barnett's motion would have priority as to the method of payment. Mr. Barnett then stated that the Mayor and th4 aity Secretary had acted contrary to the wishes of the City Council and contrarym the wishes of the citizens of North Richland Hills. Mr. Barnett also stated that he considered this payment a misappropriation of city funds. 2. Mr. Roberts made a motion that was seconded by Mr. Dowell that ordinance 31 be adopted with a change in paragraph seven to shall rather than mayor may not be. The motion passed with all councilmen voting yes. Mr. Fàlcone made a motion that ordinance 123 be adopted. Mr. Dowell seconded the motion. The motion carried with all coun- cilmen voting yes. V NEW BUSINESS 1. ~àyor Hunter read the returns of the election held on November 3, 1964. Mr. Falcone asked tosee the official returns of the election. Mr. Falcone and other councilmen examined the official returns of the election. Mr. Dowell made a motion that the council validate the election. The motion had no second. Mr. T.J. Hickman advised the council that he had something that was relative to the validation of the charter election. Mr. Hickman presented a petition to the council with the signatures of persons who had not received a copy of the charjer. All councilmen examined the petition. Mr. Dowell asked if Mr. P.M. Dodson was in the audience. Mr. Dowell asked Mr. Dodson if he had signed the petition. Mr. Dodson stated that had not and ftr. Dowell advised Mr. Dodson that his name was on the petition. Mr. Dodson examined the petitiom and advised that the signature on the petition was not his. The petition was also examined by a Mrs. R.L. Scha- pansky who stated that her name was signed on the petition and the signature was not hers. Much discussion followed. Mr. Dowell made a motion that the election be validated. Mr. Stevens seconded the motion. The City Attorney then advised the council that they could not validate the election, however, the, could officially adopt the charter. Mr. Dowell reworded his motion. The motion passed 3-1, with Councilman Dwoell, Roberts and Stevens voting yes, Councilman Barnett abstaining and Councilman Falcone voting no. 2. Mr. Falcone stated that he would like ordinance 30 cöamged to read ten years experience rather than five years for the City Attorney. Much discussion followed with Mayor Hunter pointing out that the next council could change the ordinance back to five years, if they so desired. IV OTHER BUSINESS The City Attorney advised the council that from a hurried examination of the case of Dock Duton vs the City of North Richland Hills that he could see some defects on the part of the plaintiff, and upon filing a plea and presenting the defects to a judge that the City could possibly win the case. The council a,';reed that the City should be defended in the matter. VII MOTION TO ADJOURN Mr. Dowell made the motion to adjourn. The motion was seconded by Mr. Falcone.
