MINUTES OF TqE MEETING OF
THE CITY COUNCIL OF NORTH
RICHLAND HILLS, TEXAS, HELD
AT THE CITY HALL, 4101 MORGAN
CIRCLE'. DECEMBER 28, 1964
7:30 P.M.
CALL TO ORDER AND ROLL CALL
Those present: Mayor Hunter. Councilmen: Stevens, Barnett,
Roberts, Dowell and Falcone.
Administrative Staff Present: City Attorney, City Secretary,
Fire Chief and Chief of Police.

APPROVAL OF MINUTES
Mr. Dowell made a motion, seconded by Mr. Falcone that the
minutes of the special meeting, December 21, 1964, and
minutes of the regular meeting, December 14, 1964, be approved
Mr. Barnett stated that he wanted it noted in the minutes
that the bids for the fire truck were to have been opened
at this meeting. Mr. Dowell's motion passed 5-0, with all
councilmen voting yes.
COMMUNICATIONS
Mayor Hunter read a letter from the City Attorney in reference
to his opinion on voter eligiblity in the coming election.
City Attorney, Dawson Davi$, read a letter to the State
cJrlcerning the City's positi~n on movement of utilities.
REPORTS FROM COMMITTEES
Mr. Dowell advised the Councilfuat the developer involved
in the North Hills Dr. drainage problem would deposit a
draft for $1,500.00 at Northeast National Bank if the home-
owners involved would sign a release. Mr. Dowell also advised
that Dick Knowlton is drawing up specifications for bids
on the project. Mr. Barnett made a motion, seconded by Mr.
Roberts, that the City Attorney draw up the necessary papers
for the City. The motion passed 5-0, with all councilmen voting

OLD BUSINESS
Mr. Falcone. made a motion that the paving ordinance be adopted.
The motion was seconded by Mr. Barnett. The motion passed
3-2, with Coun~ilmen Falcone, Barnett and Roberts voting ye s,
Councilmen Dowell and Stevens voting no.
Mr. Dowell made a motion that ordinance regulating speed
limit on state Highway 121 during construction be adopted.
The motion was seconded by Mr. stevens. The motion passed
5-0, with all councilmen voting yes.
The City Attorney presenteà an ordinance adopting the Southern
Standard Building Code. Mr. Dowell made a motion to table
the matter. The motion w~s seconded by Mr. stevens. The
motion did not carry. Mr. Dowell and Mr. stevens voted to
table discussion and Mr. Falcone, Barnett and Roberts voted
to continue discussion. Mr. Falcone then made a motion that
the ordinance be adopted. r1r. Johnny Sandlin then asked the
Council if he could speak to them a~out the code. Mr. Roberts
made a motion that Mr. 8~ndlin be heard. The motion was seconded
by Mr. Dowell. The motion passed 4-1, with Mr. Falcone voting
no. The motion to adopt ordinance passed 3-2, with councilmen
Stevens and Dowell voting no.
Mr. Dawson Davis advised the Council that he had talked to
Officers of the Northeast Waste Collectors and that they
had agreed to pay the City $31.05 franchise tax for the
month of November and any franchise tax that might be due
for the month of December. They also agreed to set up a
fund of $100.00 or mor4 if needed, to refund to customers
who had proof of payment and who would sign a statement
that they had not received any service. Mr. Barnett made
a motion to accept the one hundred dollars and the franchises
due. Mr. Dowell seconded the motion. The motion passed 5-0.
Mr. Davis informed the Council that he had been conta~ted
by Mr. P.S. Henry in teference to a Mr. Thomas C. Ferguson
thinking of opening a private club wiich would possibly
serve intoxication beverages in the City of North Richland
Hills. Mr. Davis advised that he was not familiar with
the law in this particular matter and that he would investigate
further. Mr. Stevens stated that he would sponsor an ordinance
to prohibit the opening of this sort of an establishment.
Mr. Roberts stated that he would co-sponsor the ordinance.
Mr. Barnett inquired about the typing of all tle ordinances
on master units. Mayor Hunter advised him that he had not been
able to locate anyone who would bring a typewriter and come
to the City Hall to do the typing. The mayor also advised
Mr. Barnett that the ordinance books could not be taken
from the ctty Hall. Mr. Barnett then stated that he would
mve someone who could type the ordinances by the end of
the week.
Mr. Falcone asked the City Attorney if an official of the
City or an employee could be on a retainer from the City
and if the party could be on a retainer for an ihterest in
conflict with the City. City Attorney advised negative.
Mr. Falcone said that he had had a number of requests for
poll watchers in the coming election. The City Attorney
advised that poll watchers could be appointed in accordance
with the election coàe.
Mr. Falcone advised that he lacked one necessary item for
his discussion of the impeachment of a City Official.
Mr. Barnett made a motion seconded by Mr. Falcone that
the balloting on zoning be secret. The motion did not pass.
Mr. 3arnett and Mr. Falcone voted y~s and Mr. Roberts, stevens,
and Dowell voted no.
Mr. Barnett made a motion that all councilmen and City officials
be given a sticker to imdicateé such for their automobiles.
The motion was seconded by Mr. Falcone. The motion passed
5-0, with all councilmen voting yes.
Mr. Barnett made a motion seconded by Mr. Falcone that
smoking be prohibited during council meetings. The motion
did not pass. Mr. Barnett and Mr. Falcone voted for the
motion. Mr. Dowell, Robe_ts and Stevens voted against the
motion.
Mr. Ealcone made a motion to adjourn. The motion was seconded
by Mr. hoberts.
Council adjourned at 10:45 P.M.
