The regular meeting of the North Richland Hills City Council waS held_
Monday October 12_ at the oivllc buildint, Pipe Line Road and Morgan
Circle and was oalled to order at 8:~5 P.M., with Counoilmen Zellers,
Kutilek_ and Grener present. Also the City Seoretary add guest.
The meeting was oalled to order by Mayor Pro Tem, Paul Kutilek. It was
determined that a majority of the voting members of the Counoil was present
and oonstituted a quorum for the transaction of business.
The minutes of the last regular meeting were read_ and as corrected were
approved. The minutes of the spec ial meet ing of the Counc il held at th e
City offices on Thursday_ Oot.S, 1959, had not been transcribed by the
City Seoretary and wen passed over to be read at the n'rl regular meeting.
The Seoretary read the audit.for the month of September. Eaoh Councilman
present challenged the payment to Mayor Perry of the sum of tlOO.OO as
expense in attending a meeting of the Texas League of Municipalities at
Dallas and also an item of $50.00 expense to Texarkana, Texas, none of
~ich expenditùres had been theretofore authorized or approved. The Secretary
was instructed to demand an it6mized statement of' actual expelUle and submit
it to the Council for its consideration.
The fact was then discussed that the Mayor had without pt10r knowledge or
approval of the Council movedlthe City Offices into new end different'
quarters at an added expense of what was said to be $25.00 per month; that
the l~or had also and without prior knowledge or authorization of the Council
employed an additional clerk to act as an assistant secretary, but no action
was taken with reference to these matters other than to point out that in
all these matters the Mayor had acted without lawful authority.
Clyde Zellers then moved the adoption of a resolution with reference to the «
water and sewer system, being the same resolution which had been oonsidered
at saveral prior meetings of the Council_ true copy of which is hereto attached
and made a part of these minutes as though set out herein in full. Said
motion was seconded by Stan Graner and after discussion was adopted, the
following Councilmen voting "yes": Clyde Zellers, Stan Graner~ and Paul Kutilek.
Voting "no", none.
Clyde Zellers then moved the adoption of an ordinance granting to Tarrant
County Water Supply Corporation, a non-profit corporation, a franchise for a
term of thirty-five years_ to operate a water system..... and a sewer system
in Notth Richland Hills. the same being the proposed franchise ordinance
theretofore distributed to all Councilmen and theretofore considered in
several past regular meetings of the Council. true copy of Which is hereto
attached and made a part of these minutes as though set out herein in full.
Said motion was seconded by Stan Graner, and after discussion was adopted,
the follewing Councilmen voting "Yes"; Clyde Zellers, Stan Grener_ and Paul
Kuti1ek. Voting "No", none.
Thereupon the Chair bwought to the attention of the Council the petition
of L.L. Caesar, Mrs. N.G. Chesser_ Tommy A. Sears and fourteen (14) other

complaining of a tather rccèI~ly established Holiness Church on Odell
Street~ ~~d requesting that the City take whatever action was available to
it to abate the nuisance as well as to require compliance with all City
Ord4iances. After some discussion;: motion was made by Stan Graner, seconded
by Clyde Zellers, and adopted that the petition be referred the City Attorney
with instructions to investigate the matter further ~ld to take such
action as in the circumstances is available to the City, including the
filing of suit i'or injunction or other remedy oi'_ in the judgment of the
City Attorney. such should be instituted.
Stan Graner moved tha.t the City buy six copies of Roberts Rules of Order
to be the propert;)' ofeha Coty and one placed in the hands of each Councilman
and the Mayor to be used by them during their term of office, and then
delivered to their successors. The motion was seconded by Clyde Zellers
and carried by unanimous vote.
Paul Kutilek then reported to the Council that the oonunittee appointed at
the special meeting of the Council held on October S, 1959. of which he
was a member_ to negotiate with the Smithfield Volunteer Fire Association.
heA met with representatives of the Aßsociation_ inspected the properties
and had made a tentative suggested offer which the representatives of the
of' the Association were going to present to the Association and report back
to the committee. No action was required at this meeting and none was taken.
Representatives of Hillvicw Addition were then recognized, who brought the
bad drainage condition through that Addition to the attendtion of the Council_
especially pointing out the damage which had occurred due to the recent
heavy rain, and requested that some action be taken by the City to remedy this
condition. It was the concensus of opinion_ both of the Council and of the
representatives_ that it was a situation which required 'ngineering advise
and that nothing could really be done wothout such advise and recommendation.
This broughh up the question of the appoi~tment of a City Engineer. It was
pointed out that appointment of a City Engineer was imperative
with Ordinance No. 54, "An ordinance regulating the platting
of landft in the City. ..
Dick inowlton_ a licensed engineer, resident of the City. had
offered to perform the service required thereunder for 90% of
in said ordinanoe. Mr. Knowlton has been of substantial assistance in the
writing of said ordinance.
After consideration of the petition of the residents of Hillview and the
nsedto appoint an engineer in connection with the subdivision ordinance_
Stan Graner moved t hat the offer of Dick Knowlton to serve in such capacity
in consideration of p~ilent to him of 90% of the fees be accepted_ and that
he_ Dick Knowlton, be appointed City Engineer. This motion was seconded by
Clyde Zellers, and was adopted by unanimous vote of those present.
The Council_ recognidng that under such appointment the City Engineer
would not be required to do the engineering &ld make recommendations relating
to the drainage situation in Hillview Addition in consideration of 90% of the
fees prescribed in the sub-division ordinance, motion was made by Stan Graner_

seconded by Clyde Zellers, that the City Attorney be directed to contact
Diok Knowlton and request that N.r. Knowlton advise the Council at its next
regular meeting of the tstimated cost of the engineering service required
in connection with the Hillview Addition Drainage problem. Motion was carried.
j Fred Ross_ then being recognized, presented to the Council the matter
of an area owned by him_ described as lying between the newly
Farm to Maltket Road No. 1938 and the Old Smithfield Road No.
completely surrounded by said roads_ containing silghtly 1es
and requested that said area be zoned commercial since ot wa
use. There are no residences nor residents within 200 feet 0
land. On motion of Clyde Zellers, !econded by Stan Graner, tb:e
voted to grant such request and to zone the desctibed area commercial as an

Mr. Jack Renfro, chairman of the Zoning Commission. presented and discussed
several zoning matters but stated that no aotion was required at this
meeting_ and none was taken.
Clyde Zellers then moved the adoption IK of certain procedural rules to
govern the conduct of the Council, being the SBme rules which had been under
discussion at the last three preceding regular meetings and distributed to
all members of the Council _ with some amendments. which amendments..-eø
were read. The motion was seconded by Stan Graner. 'rue copy of said procedural.
rules is hereto attached and made a part of these minutes as though set out
in full herein. After discussion. said procedural rules as hereto attached
were adoptedþ the following vot1.ng "yes": Stan Graner, Clyde Zellers and
Paul Kutilek. Voting "No", none.
