GENERAL ITEMS CA ZBA21-0001 PUBLIC HEARING AND CONSIDERATION OF A REQUEST FROM ENGIN CALVIN FOR A VARIANCE FROM SECTION 118-718(D) (CARPORT REGULATIONS) OF THE NORTH RICHLAND HILLS ZONING ORDINANCE AT 4704 RIDGESIDE DRIVE, BEING 0.22 ACRES DESCRIBED AS LOT 20, BLOCK 1, PARKRIDGE ESTATES. Chair Duer read the. rules and regulations of the Zoning Board of Adjustment. He stated alternate Board members Thomas Clemmons and Crystal Ndidi Ibe may participate in the discussion of the items but would not be voting on the items as there are five regular members present. Chair Duer opened the public hearing, and called for Principal Planner Clayton Husband to introduce the request. Mr. Husband introduced the request. Ashley Dilg, 474 Ridgeside Drive, North Richland Hills, representing Engin Calvin, was sworn in by Chair Duer and presented the request and distributed two letters of support for the application. Chair Duer asked how far the easternmost portion of the carport would be from the rear property line. Ms. Dilg answered ten feet. Chair Duer asked how far the carport would be from the side property line. Ms. Dilg answered two feet. Board Member Gibbs asked how the roof pitch of the carport compared to the roof pitch of house. Ms. Dilg stated the house has a 7:12 roof pitch and the carport would be a 6:12 roof pitch. Board Member Gibbs asked if the carport could be constructed with the same roof pitch as the house. Ms. Dilg answered yes. Board Member Koons asked if the roof ridge of the carport would be the same height as the house. Ms. Dilg answered the roof pitch would match but the carport would be shorter in overall height. Board Member Clemmons asked if adding masonry to the columns would increase the height of the carport. Ms. Dilg answered no and that the masonry could extend to the top of the columns. Chair Duer called for anyone wishing to speak for or against the request to come forward. There being no one else wishing to speak, Chair Duer closed the public hearing. Chair Duer called for Principal Planner Clayton Husband to present the staff report. Mr. Husband presented the staff report. Chair Duer and Mr. Husband discussed the size of the parking area under the carport and the size of the roof cover. Board Member Clemmons and Mr. Comstock discussed side yard setbacks in other October 28, 2021 Zoning Board of Adjustment Meeting Minutes Page 4 of 5 zoning districts as compared to the proposed carport. Chair Duer, Mr. Husband, and Mr. Comstock discussed masonry columns on the carport and gutters on the carport roof. A MOTION WAS MADE BY BOARD MEMBER KEMP TO APPROVE BA21-0001 AS PRESENTED. THE MOTION FAILED DUE TO LACK OF A SECOND. A MOTION WAS MADE BY CHAIR DOER, SECONDED BY VICE CHAIR KOONS TO APPROVE BA21-001, WITH THE CONDITION THAT THE COLUMNS OF THE CARPORT MUST BE CLADDED WITH A MASONRY MATERIAL, THE ROOF PITCH OF THE CARPORT MUST MATCH THE PITCH OF THE ADJACENT ROOF OF THE HOUSE OVER THE GARAGE, THE SIZE OF THE CARPORT MUST NOT EXCEED 440 SQUARE FEET IN AREA AS COVERED BY THE ROOF AREA, THE SETBACK FROM THE REAR PROPERTY LINE MUST BE AT LEAST TEN FEET AS MEASURED TO THE EDGE OF THE EAVE, THE SIDE SETBACK MUST BE AT LEAST TWO FEET AS MEASURED TO THE FACE OF THE POST, AND GUTTERS MUST BE INSTALLED ON THE SOUTH SIDE OF THE STRUCTURE. NORTH RICH'LAND- HILLS ZONING BOARD OF ADJUSTMENT MEMORANDUM FROM: Planning & Zoning Department DATE: January 27, 2022 SUBJECT: ZBA22-0002 Public hearing and consideration of a request from Tricia Bradford for a variance from Section 118-718(c) (permanent accessory building regulations) of the North Richland Hills zoning ordinance at 7554 Terry Drive, being 0.22 acres described as Lot 2, Block 18, Holiday North Addition. PRESENTER: Clayton Husband, Principal Planner SUMMARY Tricia Bradford is requesting approval of a variance to allow an existing 453-square-foot accessory building to encroach the side and rear building lines. The property is located at 7554 Terry Drive. BACKGROUND INFORMATION The property is located on the south side of Terry Drive, between Susan Lee Drive and Stone Drive. The property is zoned R-2 (Single -Family Residential) and is developed with a single-family residence constructed in 1972. The 9,882-square-foot lot is part of the Holiday North subdivision. The lot is rectangular in shape, being 90 feet wide and ranging from 106 to 114 feet deep. The property is owned and occupied by the applicant, who purchased the property in August 2012. In September 2021, the owner applied for a building permit to construct an addition to the house. During the plan review, it was discovered that a permanent accessory building, patio cover, and driveway paving had been constructed on the property, and that permits had not been issued for the construction. Discussions with the owner indicated that the construction occurred prior to her owning the property. Evaluation of aerial photographs show that the paving and accessory building were constructed between 2007 and 2008, and the patio cover between 2009 and 2011. In order to bring the property closer to compliance, the owner submitted building permit applications for these improvements. The owner submitted a building permit application for the permanent accessory building on November 12, 2021. During the permit review it was noted that the building encroaches the side and rear building setbacks. Rather than reconstruct the building to modify the size and dimensions to comply with the standards, the owner decided to seek a variance to authorize the structure to remain as constructed. The materials include a copy of the application explaining the reasoning for the variance request and other relevant documents. An analysis of the request and relevant codes is below. ANALYSIS The variance request is related to standards for permanent accessory buildings, which are contained in Section 118-718(c) of the zoning ordinance. The building is constructed in the southwest corner of the property at the rear of the driveway. The building is 453- square-feet in area, measuring 22 feet wide by 20.6 feet deep. The building satisfies all standards for permanent accessory buildings except for the side and rear setbacks. Permanent accessory buildings less than 500 square feet in size require a side setback of six (6) feet and a rear setback of ten (10) feet. The structure under consideration encroaches both the side (west) and rear (south) building setback lines, as described in the table below. In exercising it powers to grant a variance, the board of adjustment must make specific findings and show in its minutes that: a. Literal enforcement of the controls will create an unnecessary hardship or practical difficulty in the development of the affected property. b. The situation causing the hardship or difficulty is neither self-imposed nor generally affecting all or most properties in the same zoning district. c. The relief sought will not injure the permitted use of adjacent conforming property. d. The granting of the variance will be in harmony with the spirit and purposes of these regulations. OPTIONS FOR BOARD CONSIDERATION The Zoning Board of Adjustment has the following options on this application. 1. Approve the variance as presented. This action would approve variances to the side and rear building line setbacks for the structure and allow the building to remain as constructed. 2. Approve the variance with conditions. This action would approve variances to the side and rear building line setbacks for the structure, subject to the owner making modifications to its size, location, or design as directed by the Board. 3. Deny the variance. This action would require the structure to be modified to achieve compliance with the required side and rear building line setbacks. Can you please grant me an zoning variance on the 10 foot rear set back and the 6 foot side min yard set back, and a variance on a 5' U. E at rear. 2. State the grounds for the request and describe any special conditions that cause hardships that, in your opinion, justify the variance(s) being requested. Examples of special conditions are: topography, creeks, utility lines, irregular lot or tract shapes, etc. The Zoning Board of Adjustment must determine that special conditions exist before making a motion to approve a request. If it is determined that special conditions do not exist, the motion must be to deny the request. If necessary, use a separate sheet. This is a special condition because this was not a self imposed situation. I bought my house in 2012 and this building had already been constructed. Pictures of the shed were included in the listing when I saw the property for sale on-line. This was the first time for me ever buying a house and I assumed that when I bought the house everything on the property complied with city codes and setback requirements. According to satellite images either the man that sold me the property or the owner before him built the structure. I feel that approval of this variance would have no detrimental effect on my neighbors. I'm trying to improve my house and have an addition done to make it a more comfortable space for my family. I'm a single mom of three boys and this all started because I'm needing an additional bedroom. I had no idea that the shed on my property was not permitted and all I want to do now is make things right and get my property properly permitted. If necessary, use a separate sheet. This is a special condition because this was not a self imposed situation. I bought my house in 2012 and this building had already been constructed. Pictures of the shed were included in the listing when I saw the property for sale on-line. This was the first time for me ever buying a house and I assumed that when I bought the house everything on the property complied with city codes and setback requirements. According to satellite images either the man that sold me the property or the owner before him built the structure. I feel that approval of this variance would have no detrimental effect of the adjoining property Thank you in advance for all your help and consideration. SUMMARY OF THE ZONING BOARD OF ADJUSTMENT The Board of Adjustment shall have the powers and exercise the duties of a Board in accordance with Section 211.009 of the Texas Local Government Code. Board members are representatives of the City and shall have the right to inspect premises where required in the discharge of their responsibilities under the laws of the State of Texas and the ordinances of the City of North Richland Hills. The Board's jurisdiction shall extend to and include the hearing and deciding of the following topics of appeals and applications, and to that end shall have the necessary authority to ensure continuing compliance with its decision. The Board of Adjustment, in specific cases, may authorize or order the following: Interpretation. Hear and decide appeals where it is alleged there is error on any order, requirement, decision, or interpretation of the zoning regulations by the Building Official in the enforcement of this ordinance or a zoning district boundary. In reaching its decision, the Board shall establish firm guidelines for future administrative actions on like matters. Permits for nonconformity. Authorize a building permit for the reconstruction, extension, or enlargement of a building occupied by non -conforming uses, on the lot or tract occupied by such building, provided such reconstruction does not prevent the potential return of such property to a conforming use. Discontinuance of nonconformity. Require the discontinuance of non -conforming uses of land or structures under any plan whereby the full value of the structure and facilities can be amortized within a definite period of time, taking into consideration the general character of the neighborhood and the necessity of all property to conform to the regulations of the zoning ordinance. All actions to discontinue a non -conforming use of land or structure shall be taken with due regard to the property rights of the persons affected when considered in light of the public welfare and the character of the area surrounding the designated non -conforming use and the conservation and preservation of the property. Authorize upon appeal, in specific cases, such variance from the terms of the zoning ordinance that are not contrary to the public interest, and where, because of special conditions, the enforcement of the ordinance would result in an unnecessary hardship. However, the Board shall not have the power to grant variances from the terms of the zoning ordinance for a change in use not allowed in a district. In exercising it powers to grant a variance, the Board of Adjustment shall make findings and show in its minutes that: a. Literal enforcement of the controls will create an unnecessary hardship or practical difficulty in the development of the affected property. b. The situation causing the hardship or difficulty is neither self-imposed nor generally affecting all or most properties in the same zoning district. c. The relief sought will not injure the permitted use of adjacent conforming property. d. The granting of the variance will be in harmony with the spirit and purposes of the zoning regulations.
