Mayor Trevino asked the City Secretary to call on those who completed a public meeting appearance form to speak during the public hearing. There being no forms submitted, Mayor Trevino asked if there was anyone in the audience wishing to speak on the item to come forward. Kudos Korner - Chris Turner, Cory Bain and Robert Stancil in Public Works - A citizen posted her appreciation for the crew that fixed the pavement in front of her driveway, making it safer for her to navigate the area in her wheelchair. She said they came out to look at the problem the day after it was reported and they had it fixed in less than a week. "I want to thank the city for caring enough to make it safer," she said. I. PRESENTER: Clayton Comstock, Planning Director SUMMARY: On behalf of Aberfeldy Properties Inc (owner) and Younger Partners (property manager), BCC Engineering is requesting a special use permit for a quick service restaurant on 5.4 acres located at 5555 Rufe Snow Drive. GENERAL DESCRIPTION: The property under consideration is located at the northwest corner of Rufe Snow Drive and Browning Drive. The site is developed as a multi-use shopping center constructed in 1983. The applicant proposes to renovate and remodel a portion of a former dry cleaner business space on the southwest endcap of the building for a new tenant, II1�1_Y_ .._Qoffeae. attached. The area would be a self- contained loop that enters and exits from the existing parking lot. The area would be separated from the driving aisle on the west by a raised curbed median. The central island in the drive-through area would be landscaped. The pickup window would be located under the existing canopy on the south side of the building. The proposed conditions of approval for this special use permit are attached. The zoning ordinance provides that special use permits may establish reasonable conditions of approval on the operation and location of the use to reduce its effect on adjacent or surrounding properties. These conditions are based on the applicant's proposed development of the property and recommendations from the Development Review "K NOKTH KICHLAND HILLS Committee. These conditions may be modified throughout the public hearing process, but they are subject to final approval by City Council. Land use In 2015, the zoning ordinance was amended to create new land use types for restaurants. One of the land use types is "quick service restaurant," commonly referred to as a fast food restaurant. This land use requires approval of a special use permit in the C-2 (Commercial) zoning district. Drive-through standards and requirements The zoning ordinance includes design standards for restaurants that provide drive- through service. The proposed construction complies with all drive-through standards except as noted below. The applicant is requesting approval of the following modified standards as part of the special use permit. • Drive-through lanes and pickup windows are not permitted to be located between the building and a public street. The proposed site layout shows these features located between the building and Browning Drive. A drive-through lane and pickup window are already located in this area as they were constructed as part of a previous dry cleaner business that occupied the space. • The entrance to a drive-through lane must be at least 50 feet from all public streets. As proposed, the entrance to the drive-through area is immediately adjacent to a driveway into the property. Landscaping A central landscaped island would be installed in the drive-through area. Pavement would be removed to establish the approximately 1,350-square-foot landscaped island. The landscaped area must be watered by an automatic underground irrigation system. On April 12, 2021, the Landscape Review Board approved a landscape plan for the shopping center property. The plan was approved as part of a remodel of the shopping center to allow improvements to the site without conforming to landscaping and buffering standards. In general, the site provides 9.5% of the lot in a landscaped area, while the standards require a minimum of 15% of the lot area. The addition of the landscaped island will increase the landscape area to approximately 10% of the lot area. Sidewalks The Development Review Committee recommends that about 100 linear feet of four-foot sidewalk be constructed on the north side of Browning Drive adjacent to the drive-through area. The sidewalk would provide a direct pedestrian connection to the single-family and multifamily residences in the Iron Horse transit oriented development district. This recommendation is included in the attached SUP development standards. Outdoor lighting The Development Review Committee recommends that the existing lighting fixtures on the building be replaced with conforming fixtures that comply with Section 118-728 of the zoning ordinance. This revision is reflected in the attached SUP development standards. "K NOKTH KICHLAND HILLS LAND USE PLAN: This area is designated on the Land Use Plan as Retail Commercial. This designation provides sites for community and regional shopping centers, commercial establishments, and employment centers. These sites are typically located on highways and major thoroughfares at key intersections. CURRENT ZONING: The property is zoned C-2 (Commercial). This district is intended to provide for the development of retail and general business uses primarily to serve the community and region. Uses include a wide variety of business activities and may involve limited outside storage, service, or display. The C-2 district should be located away from low and medium density residential development and should be used as a buffer between retail and industrial uses. The district is also appropriate along business corridors as indicated on the land use plan. PLANNING AND ZONING COMMISSION: The Planning and Zoning Commission conducted a public hearing and considered this item at the February 17, 2022, meeting and voted 6-0 to recommend approval, specifically with the sidewalk recommendation of the Development Review Committee. As such he was more then happy to modify the existing drive through circulation to que vehicles on site without blocking Browning Drive as requested by the Development Review Committee (DRC). The landlord has granted PJ's Coffee permission to use the drive through and apply for the appropriate permit as required by the City. The changes needed to accommodate the new and improved drive through will entail the removal of two peninsulas/islands, one existing sweet gum tree, one cedar elm tree,ten parking spaces, part of the sidewalk by the building, and one fire lane on the South side of the building as shown on the proposed landscape& site removals plan uploaded to the portal. The revised drive through circulation plan has a lane width of 12'when you first enter the drive through, a 20' lane width on the west side to accommodate the turning radius of larger trucks without blocking the fire lane (Turning Radius Back-up uploaded to the portal), and a 14' lane width next to the building/under the canopy. New curb will be installed to delineate the drive through especially on the west side due to the existing fire lane. The landscape plan uploaded to the portal shows rocks and shrubs in the drive through island and any tree requirements made by the DRC will be placed elsewhere on site (tentatively near Whataburger per the property owner). The site plan has been revised to show that PJ's will be utilizing the existing dumpster located in the NW corner of the site, and that the grease trap will be in the ground between the West side of the building and the striped fire lane. PJ's Coffee is requesting a special use permit (SUP)for 5555 Rufe Snow Drive, Suite 100 with the nearest cross streets of Rufe Snow Drive and Browning Drive. Section 4: The use of the property described above shall be subject to all applicable regulations contained in the Building and Land Use Regulations and all other applicable and pertinent ordinances of the City of North Richland Hills. Exhibit B— Land Use and Development Regulations —Ordinance No. 3733— Page 1 of 2 Special Use Permit Case ZC21-0011 Lot 1R, Block 4, Industrial Park Addition 5555 Rufe Snow Drive, North Richland Hills,Texas This Special Use Permit (SUP) must adhere to all the conditions of the North Richland Hills Code of Ordinances, as amended, and the base zoning district of C-2 (Commercial). The following regulations shall be specific to this Special Use Permit. Where these regulations conflict with or overlap another ordinance, easement, covenant or deed restriction, the more stringent restriction shall prevail. A. Permitted land uses. A special use permit is authorized for a quick service restaurant on the property. B. Site development standards. Development of the property shall comply with the development standards of the C-2 (Commercial) zoning district and the standards described below. 1. The site improvements must be constructed as shown on the site plan attached as Exhibit „C .11 2. Landscaping must be installed as shown on the site plan attached as Exhibit "C" and the standards described below. a. A landscape plan for the project must be prepared by a Registered Landscape Architect and be approved by the Development Review Committee prior to the issuance of a building permit. b. If existing trees located adjacent to the drive approaches cannot be preserved, then replacement trees of an equivalent species and caliper must be planted on the property. c. All landscaped areas must be watered by an automatic underground irrigation system equipped with rain and freeze sensors. All large and ornamental trees must be on bubbler/drip irrigation on separate zones from turf grass. d. The landscaping must be installed prior to the issuance of a certificate of occupancy. 3. The drive-through components on the site must comply with Section 118-633(26) of the zoning ordinance and the standard described below. a. The drive-through lane improvements must be constructed as shown on the site plan attached as Exhibit "C," including lane widths, pavement markings, and menu board locations. b. The menu board must not be located within the visibility sight triangle of the westernmost driveway. c. The drive-through stacking lane and pickup window may be located on the south side of the building between the building and Browning Drive. 4. A four-foot wide sidewalk and curb ramps must be constructed adjacent to Browning Drive as shown on the site plan attached as Exhibit "C." A four-foot wide pedestrian access connection to the sidewalk and curb ramp must be constructed as shown on the site plan attached as Exhibit"C."The pedestrian access must include a striped crosswalk from the curb ramp across the drive-through area that connects to a curb ramp in the sidewalk in front of the building. C. Building design standards. Building design and appearance must comply with the building elevations attached as Exhibit "C" and the standards described below. 1. The existing lighting fixtures on the west facade building must be replaced with conforming fixtures that comply with Section 118-728 of the zoning ordinance. 2. Signs on the site must comply with Chapter 106 (Signs) of the Code of Ordinances. D. Amendments to Approved Special Use Permits. An amendment or revision to the special use permit will be processed in the same manner as the original approval. The application for an amendment or revision must include all land described in the original ordinance that approved the special use permit. E. Expiration. The special use permit will expire three (3) years from the effective date of this ordinance. If the quick service restaurant is still in operation at the time of expiration, the business shall be considered a legal non-conforming use and may continue operation subject to the standards described in Section 118-153 of the zoning ordinance. F. Administrative Approval of Site Plans. The development is subject to final approval of a site plan package. Site plans that comply with all development-related ordinances, and this Ordinance may be administratively approved by the Development Review Committee. The city manager or designee may approve minor amendments or revisions to the standards provided the amendment or revisions does not significantly: 1. Alter the basic relationship of the proposed uses to adjacent uses; 2. Change the uses approved; 3. Increase approved densities, height, site coverage, or floor areas; 4. Decrease on-site parking requirements; 5. Reduce minimum yards or setbacks; or 6. Change traffic patterns. The program is comprised of six types of preventive maintenance techniques ranging in scope from full-depth subgrade stabilization and resurfacing to crack sealing, and incorporates 72 different streets into the program for the 2022 year. GENERAL DESCRIPTION: The Preventive Street Maintenance Program was created to invest in proactively maintaining the City's streets to prolong their useful life. Prior to 2019, the priorities were set based on visual staff observations, and had proven successful for a number of years. Following Council approval of a Pavement Assessment project in the 2018/2019 budget, we were able to have the City's roadway network surveyed and assessed using an outside consultant. The assessment project produced a long-term plan of action that if followed, would make better use of available maintenance funds to improve overall condition rating. The six types of preventive maintenance techniques include the three that staff has utilized for several years (Crack Seal, Slurry Seal and 2" Overlay) along with three newer techniques. Two of the newer techniques are a result of staff recommending preventive maintenance on some concrete streets in addition to the asphalt streets. Including concrete streets in the program was new in the 2019/2020 programs. All six techniques are summarized below: IrLp NOKTH KICHLAN HILLS Asphalt Streets- 1. Crack Seal — This is the technique where the large cracks in the pavement are sealed in order to prevent water and debris from getting to the subgrade. This extends the longevity of the pavement. 2. Slurry Seal — This is an application of asphalt and very small aggregate that is used to seal the fine cracks in the pavement. This process covers the entire surface of the roadway and is used for less traveled streets such as residential streets. 3. Micro Surfacing — This is a newer technique. It is similar to a Slurry Seal except the asphalt application consists of material that is more durable and will hold up on more traveled roadways such as collector streets. 4. 2" Asphalt Overlay — This technique is used to apply a new 2" thick asphalt surface over the existing pavement. Concrete Streets: 5. Crack Seal — This technique serves the same purpose as the Crack Seal for asphalt streets but it is a different material and needs to be applied somewhat differently. 6. Partial Pavement Replacement—This technique involves replacing bad areas of concrete pavement. The size of the area replaced can range in size from a few square feet to a few panels. The proposed 2022 Program is a single year program, representing the fourth year of recommendations from the Pavement Assessment project. The list of streets being recommended for each of the six different techniques along with location maps is included for reference. Additionally, this program includes the rehabilitation of Onyx Drive South from Billy Faye Drive to Bonzer Street to be completed in partnership with Tarrant County Precinct #3. The City's Preventive Street Maintenance Program has utilized the Tarrant County's paving services through interlocal agreements on one or more streets per year since 2011. This partnership with Tarrant County has been successful for several years. Recent cooperative programs include streets like Meadow Road, Eden Road and Susan Lee Lane. Staff presented this year's program to the Capital Improvement Projects (CIP) Committee on Monday, February 28, 2022 and the committee recommended it's approval. Funding for this year's program is available in the FY 2021/22 Adopted Budget. PRESENTER: Boe Blankenship, Assistant Public Works Director- Operations SUMMARY: The City Council is being asked to authorize the City Manager to execute an interlocal agreement between Tarrant County and the City of North Richland Hills for road construction work on Onyx Drive South. GENERAL DESCRIPTION: Over the past few years Tarrant County Field Operations, specifically Precinct No. 3, has helped the City complete various street construction projects. Most recently county forces rehabilitated Stonybrooke Drive in 2021. This partnership allows the City to stretch maintenance dollars by taking advantage of the County's in-house capabilities. The proposed 2022 project is Onyx Drive South from Billy Faye Drive to Bonzer Street, and will include full sub-grade stabilization followed by a new asphalt surface. The terms and conditions of the agreement replicate those used in prior years. The City will pay for the materials, trucking charges and one half of the fuel used by Tarrant County for the sub-grade stabilization process as well as the placement of the asphalt in the roadway. Once the agreement is executed, staff will coordinate with the County to schedule the work which will be funded as part of the 2022 Preventive Street Maintenance program (SM2201). At this time, it is anticipated that the work will take place in October of 2022. The work is estimated to take 3 to 4 weeks to complete. RECOMMENDATION: Authorize the City Manager to execute an interlocal agreement with Tarrant County to rehabilitate and resurface Onyx Drive South from Billy Faye Drive to Bonzer Street. THE STATE OF TEXAS INTERLOCAL AGREEMENT COUNTY OF TARRANT This Interlocal Agreement is between Tarrant County, Texas ("COUNTY"), and the City of North Richland Hills ("CITY"). WHEREAS, the CITY is requesting the COUNTY's assistance to: • Rehabilitate and Resurface Onyx Drive located within the City of North Richland Hills from Billie Faye Drive to Bonzer Street (Approximately 2,060 linear feet). Collectively, hereinafter referred to as the "Project". WHEREAS, the Interlocal Cooperation Act contained in Chapter 791 of the Texas Government Code provides legal authority for the parties to enter into this Agreement; and WHEREAS, during the performance of the governmental functions and the payment for the performance of those governmental functions under this Agreement, the parties will make the performance and payment from current revenues legally available to that party; and WHEREAS, the Commissioners Court of the COUNTY and the City Council of the CITY each make the following findings: a. This Agreement serves the common interests of both parties; b. This Agreement will benefit the public; C. The division of costs fairly compensates both parties to this Agreement; and d. The CITY and the COUNTY have authorized their representative to sign this Agreement. e. Both parties acknowledge that they are each a "governmental entity" and not a "business entity" as those terms are defined in Tex. Gov't Code § 2252.908, and therefore, no disclosure of interested parties pursuant to Tex. Gov't Code Section 2252.908 is required. NOW, THEREFORE, the COUNTY and the CITY agree as follows- 1 TERMS AND CONDITIONS 1. COUNTY RESPONSIBILITY The COUNTY will furnish the labor and equipment to assist the CITY in completing the Project: • Onyx Drive: Following milling and removal of the excess materials by the CITY, the COUNTY will stabilize the exposed subgrade, regrade, shape, and prime the roadbed, place four inches of asphalt base, place two inches of asphalt surface, and clean the project jobsite 2. CITY RESPONSIBILITY 2.1 The CITY will furnish and pay for the actual cost of the materials, including any delivery or freight cost. The CITY will provide a purchase order and will be billed directly by the material supplier. The COUNTY may accumulate and bill the CITY for incidental material cost. 2.2 The CITY will pay for one-half of the COUNTY's fuel used to construct this Project. The COUNTY will invoice the CITY for the fuel consumed at the conclusion of the Project. 2.3 The CITY will be responsible for all traffic control necessary to safely construct this project. This responsibility includes all advance notices, signage, barricades, pilot vehicles, and flagmen necessary to control traffic in and around the construction site. The CITY will be responsible for and provide portable message boards to supplement traffic control as needed. 2.4 The CITY will remove the existing surface and make any necessary roadway repairs and preparations prior to the COUNTY starting work. 2.5 The CITY will adjust all utilities, manholes and valve boxes for this Project. 2.6 The CITY will provide the COUNTY with a hydrant meter and all the water necessary for construction of the Project at no cost to the COUNTY. 2.7 The CITY will provide or pay for any engineering, survey, and laboratory testing required for this Project. 2.8 The CITY will furnish a site for dumping all spoils and waste materials generated during construction of this Project. 2.9 The CITY will provide the material to backfill the pavement edges for this project. 2 2.10 If required, the CITY will be responsible for the design and development of a Storm Water Pollution Prevention Plan (SWPPP). The CITY further agrees to pay for all cost (including sub-contractor materials, labor and equipment) associated with the implementation of the plan. The COUNTY will be responsible for maintenance of the plan during the duration of the Project. Documentation and record keeping of the SWPPP will be the responsibility of the CITY. 3. PROCEDURES DURING PROJECT COUNTY retains the right to inspect and reject all materials provided for this P roj ect. If the CITY has a complaint regarding the construction of the project, the CITY must complain in writing to the COUNTY no later than 30 days of the date of project completion. 4. NO WAIVER OF IMMUNITY This Agreement does not waive COUNTY rights under a legal theory of sovereign immunity. This Agreement does not waive CITY rights under a legal theory of sovereign immunity. 5. OPTIONAL SERVICES 5.1 If requested by the CITY, the COUNTY will apply permanent striping coordinated through the Transportation Department. Application of striping by the COUNTY is limited to Project roadways. If the CITY desires permanent striping applied to any roadways or portions of roadways not covered by this Agreement, the CITY will need to enter into a separate agreement with the COUNTY for the provision of those services. 6. TIME PERIOD FOR COMPLETION The CITY will give the COUNTY notice to proceed at the appropriate time. However, the COUNTY is under no duty to commence construction at any particular time. 3 7. THIRD PARTY This contract shall not be interpreted to inure to the benefit of a third party not a party to this contract. This contract may not be interpreted to waive any statutory or common law defense, immunity, including governmental and sovereign immunity, or any limitation of liability, responsibility, or damage of any party to this contract, party's agent, or party's employee, otherwise provided by law. 8. JOINT VENTURE & AGENCY The relationship between the parties to this Agreement does not create a partnership or joint venture between the parties. This Agreement does not appoint any party as agent for the other party. 9. EFFECTIVE DATE This Agreement becomes effective when signed by the last party whose signing makes the Agreement fully executed. 10. TERMINATION This Agreement will automatically terminate on either December 31, 2022 or on the date the project is completed, whichever occurs first. Notwithstanding the foregoing, or any other language to the contrary, either party may terminate this Agreement without cause upon thirty (30) days' written notice to the other party prior to the intended date of termination. The North Richland Hills Police Department, in cooperation with law enforcement agencies across the area, supports the TAG Center in its mission to combat gang violence through the coordination of gang prevention, intervention, and suppression activities. State supplemental grant funding from the H.B.5 supplemental appropriations designated for the TAG's with a combined population of 250,000 is available through the Governor's Office to continue this project in FY2023. The Governor's Office has contacted the City of North Richland Hills to continue as the fiduciary and sponsoring agency for grant. GENERAL DESCRIPTION: The Governor's Office contacted the City of North Richland Hills to continue to serve as the fiduciary and sponsoring agency for this grant. This FY2023 grant application is a continuation of the program to cover the TAG Center's annual operations budget and additional one-time purchases to be funded from the Texas Senate H.B.5 supplemental appropriations. The investigative units participating in the TAG Center are the Texas DPS Investigative Unit, the U.S. Homeland Security Investigators Gang Squad, the ATF's Violent Crime Squad and Intelligence Unit, and the FBI's Gang Unit, as well as local municipal and county agencies. GENERAL DESCRIPTION: The City Council, at its January 24, 2022 meeting, approved Resolution No. 2022-009 that called the May 7, 2022 General Election. The 2022 General Election determines the positions of Mayor and City Council Places 2, 4, and 6. The positions are elected for a two-year term and will expire in May 2024, or until their successors are duly elected and qualified. The filing period for the 2022 General Election began January 19, 2022, and concluded on February 18, 2022. The filing deadline for a write-in candidate to declare candidacy was February 22, 2022. As the authority responsible for having the official ballot prepared, the City Secretary shall certify to the presiding officer of the governing body that candidates are unopposed for the election scheduled to be held on May 7, 2022. Following receipt of certification (Attachment A) and pursuant to Subchapter C of Chapter 2 of the Election Code, the City Council may declare each unopposed candidate elected to office.
