PRESENTER: Stefanie Martinez, Director of Neighborhood Services SUMMARY: The minutes are approved by majority vote of the Board at the Substandard Building Board meetings. GENERAL DESCRIPTION: The Neighborhood Services Department prepares action minutes for each Substandard Building Board Meeting. The minutes from each meeting are placed on a later agenda for review and approval by the Board. Upon approval of the minutes, an electronic copy is uploaded to the City's website. RECOMMENDATION: Approve Minutes of the February 8, 2022, Substandard Building Board Meeting. CALL TO ORDER Chairman Crowson called the meeting to order at 6.04 p.m. B.1 PUBLIC COMMENTS - AN OPPORTUNITY FOR CITIZENS TO ADDRESS THE SUBSTANDARD BUILDING BOARD ON MATTERS WHICH ARE SCHEDULED ON THIS AGENDA FOR CONSIDERATION BY THE BOARD, BUT NOT SCHEDULED AS A PUBLIC HEARING. C.2 ELECTION OF CHAIR AND VICE CHAIR APPROVED Chairman Crowson asked if there are any nominations for Vice Chair. In response, Mr. Michael Gist recommended that the Board keep same Vice Chairman. Mr. Wait accepted the nomination. MR. MICHAEL GIST MOVED TO NOMINATE MR. BILL WAIT AS VICE CHAIRMAN. MR. DANIEL CAULKINS SECONDED THE MOTION. MOTION TO APPROVE CARRIED 6-0. Chairman Crowson asked if there are any nominations for Chair. In response, Mr. Bill Wait recommended that the Board keep same Chairman. Chairman Crowson accepted the nomination. MR. C.3 2022 SUBSTANDARD BUILDING BOARD ANNUAL TRAINING Thomas McMillian, Assistant City Attorney, presented his 2022 Substandard Building Board Annual Training presentation. Mr. McMillian informed the Board they would be trained on the following: • Boards and Commissions • Rules applying generally and specific to SBB • Local Government Code Chapter 54, as it relates to Quasi-Judicial Enforcement. • Rules of Procedure • Public Information Act Mr. McMiliian provided an overview on the composition, terms of office, qualification for membership, attendance, meetings, removal of member process and types of Boards. Mr. McMillian informed the Board that members could not serve on any other City of North Richland Hills board or commission. Chairman Crowson asked if that was correct, as he is a Board Member for the Gas Board of Appeals. Mr. McMillian said he would look into as it could be based on the type of Board it is and he would get back with Substandard Building Board Meeting February 8, 2022 Page 2 of 4 Chairman Crowson with an answer. Mr. Wait stated he was on the Library Board and he was told he could only serve on one Board and he was removed from the Library Board. Mr. McMillian informed the Board that Chapter 54 Texas Local Government Code allows a Municipality to enact if they want to have a Substandard Building Board. Not every Municipality has a Substandard Building Board. This allows a municipality to create to the Board and enact provisions into your city code to form the Board and the Board to carry out that function. Mr. McMillian presented all the case types that could be presented to the Board and the possible outcomes including civil penalties and different types of orders that can be issued by the Board. Zoning issues sometimes come up when dealing with substandard structures but the Substandard Building Board does not have authority over zoning. Mr. McMillian asked Ms. Martinez if we have issues with agricultural animal. Ms. Martinez replied yes. We actually got a call this week about a goat in a residential neighborhood. Goats are not allowed in residential area. The resident was informed of the violation and the goat has to be removed from the property. Mr. McMillian went over the Rules of Procedures which included what the quorum is, types of action the Board can take, procedures on the hearing process, questions that come across the Board, what is required in the notices that go out and if a Board member is disqualified from voting on a matter. Mr. McMillian informed the Board that under the law, Public Information is considered any information that is written, produced, collected, assembled, or maintained under a law or ordinance or in connection with the transaction of official business by a governmental body and for a governmental body owns the information and has a right to access to the information. Public information can be a book, paper, letter, document, e-mail, Internet posting, text message, instant message, other electronic communication, printout, photograph, film, tape, microfiche, microfilm, Photostat, sound recording, map, and drawing and a voice, data, or video representation held in computer memory. Mr. McMillian advised the Board to be careful conducting Board business on personal devices as those emails/text become city property and if requested are subject to disclosure under the Public Information. Mr. Crowson stated this is why he set up a separate email address to conduct city business. It is so important to get personal emails separate. Mr. McMillian stated that was great idea as it makes everything easier. Mr. McMillian went over how public information is requested and the penalties for violations of the Public Information Act. D. SBB CASE UPDATES SBB-2021-81 — 7405 Hightower Drive • This case was brought before the Board in August 2021 for both a substandard and nuisance violation. The Board ordered the structures be demolished and the property cleaned per an agreed order with the owner within 120 days. A month after the Board order the main structure suffered a structure fire. The structures were identified as demolished and the property was cleaned in early December by the owner. SBB-2021-82 — 5600 Newman Drive • This case was brought before the Board in August 2021 due to a nuisance violation. The Board ordered that the property be cleaned in 30 days. The property was identified in compliance on September 10, 2021. SBB-2021-83 — 7220 Riviera • This case was brought before the Board in November 2021 due to a nuisance violation. The Board ordered that the property be cleaned in 30 days and assessed a $270.00 civil penalty. Although the property owner has made huge strides in cleaning the property, it is not complete. The civil penalty has not been paid. The City is currently taking quotes to have the property cleaned and lien the property. SBB-2021-84 — 1 Country Place Drive • This case was brought before the Board in November 2021 for both a substandard and nuisance violation. The Board ordered the structures be demolished within 60 days and the property be cleaned within 30 days. On January 10, 2022 the property was found to be in compliance. The structures were demolished and the property "K NOKTH KICHLAND HILLS was clear of all debris. The $2,700.00 Civil Penalty issued by the Board at the November hearing was also paid on January 6, 2022. SBB-2021-85 - 6320 Skylark Circle • This case was brought before the Board in November 2021 due to a substandard violation on the property regarding an unpermitted addition on the side of the primary residence. The Board issued an order to the owner to bring the property into compliance within 14 days. On November 29, 2021 the building official inspected the property and the structure was in compliance. STAFF RECOMENTATION No action to be taken. "K NOKTH KICHLAND HILLS SUBSTANDARD BUILDING BOARD MEMORANDUM FROM: Neighborhood Services DATE: March 8, 2022 Department SUBJECT: SBB 2022-86 Public Hearing and consideration whether the accumulation on the property located at 5600 Newman Drive, known as Block 6, Lot 21 of the Irish Meadows Addition in the City of North Richland Hills, Tarrant County, Texas is in violation of city's ordinances and issue order to abate and/or issue civil penalties. PRESENTER: Stefanie Martinez, Director of Neighborhood Services SUMMARY Neighborhood Services will present evidence to the Board for consideration as to whether conditions exist on the single family property which are in violation of the Chapter 34 of the Nuisance Ordinance. BACKGROUND INFORMATION The property is located on the northeast corner of Newman Drive and Emerald Hills Drive. The property is directly across the street from the Academy at C.F. Thomas Elementary School. The property is zoned R-3 (Single Family Residential) with a single-family residence. The 8,046 square foot property is owned and occupied by Floyd Smith. The current case was initiated in January 2022 when the property was identified to have an unlawful accumulation of household furniture, trash, debris, tires and dismantled motor parts in the driveway and side of the house. This same property was brought before the Board in August of 2021 for the same violation and lack of compliance. That case was finally resolved following the Board's order to clean within 30 days. The current case history is as follows: • January 6, 2022 - case initiated, violation confirmed. Code Compliance Officer Brian Thomas observed trash/debris, trash bags, a scale, vacuum cleaner, bucket(s), several lawn mowers and a dismantled motor scooter in driveway and on side of house. Officer Thomas did not make any contact with the homeowner and/or occupants. Officer Thomas proceeded with issuing a PCA for the ongoing code violation, to property owners' grandson, Houston Griffith. Mr. Griffith admitted to bringing the items to the property and he continues to live at the property as well. Photos were taken. • January 11, 2022 — Officer Thomas observed a large pile of florescent light fixtures and a radiator stacked on side of house. Photos were taken. "K NOKTH KICHLAND HILLS • January 13, 2022— Thomas re-inspected the property and observed several lawn mowers, miscellaneous debris, recycling cart full of debris, a tire, a dismantled motorcycle, large pile of florescent light fixtures, a radiator on top of the light fixture. • January 13, 2022 (continued) —fixtures and a full trash cart on collection day after trash was collected on street. Photos were taken; also Officer Thomas proceed with PCA delivered to courts. • January 25, 2022 - Officer Horne posted on the front door, the Notice & Order and photos were taken. • January 28, 2022- Officer Thomas and Horne re-inspected the property with Mr. Houston Griffith present at time of re-inspection. • February 1, 2022- Officer Thomas observed lawnmowers in the backyard, the cart of trash and debris, a tire in the driveway, a lawnmower in the driveway and a partially dismantled motorcycle with part(s) laying in the driveway, which Mr. Griffith stated would be gone from the property back in January. Also the garbage remained at the curb, although the garbage/recycle collection day had passed. • February 8, 2022 — Lead Code Compliance Officer Rayneice Horne observed a lawn mower, container, motorcycle all in driveway, also there were some items stored on the side of the house. • February 14, 2022 — Notice of Hearing was mailed both certified and regular to the property owner and grandson. PRESENTER: Stefanie Martinez, Director of Neighborhood Services SUMMARY Neighborhood Services will present evidence to the Board for consideration as to whether the single family structure is substandard as described in Chapter 98 of the City of North Richland Hills' Buildings Ordinance. BACKGROUND INFORMATION The property is located at 6332 Onyx Drive South. The property is zoned R-3 Residential and has a single-family residence structure. The property is located east of Fossil Creek Park on the south side of the City. The property is vacant and owned by Ibraheem Khader whom resides in Richland Hills. • March 4, 2021 — case initiated, violation confirmed. Code Compliance Officer Rayneice Horne observed a substandard structure due to a house fire. Horne tried calling the occupant listed on the water account, no answer. A notice of violation was emailed to both email addresses listed on the water account and mailed to the address listed with Tarrant Appraisal District records. Photos were taken. • March 5, 2021 — Code Compliance Officer Matthew Hall posted the notice of violation to front entry and side yard entry gate. Hall observed the property to be vacant and open at the front and rear door entries and an additional four windows were observed broken and open. He also posted a notice of violation at the front entry of the property owners home address in Richland Hills. The fire incident report was received and uploaded to the case file for record. Photos were taken. • March 5, 2021 (continued)— Officer Hall made contact with the property owner, Ibraheem Khader, he said that the home is insured and that a claim has already been submitted. He also said he had hired someone to get the house boarded up and it should be completed by the end of the weekend. • March 29, 2021 — Officer Horne observed the house to be boarded and secured. The property owner has not made any contact with Officer Horne or Officer Matthew since "K NOKTH KICHLAND HILLS March 5, 2021. Another notice of violation was mailed to the address listed with Tarrant Appraisal District records. Photos were taken. • April 13, 2021 — The property remained in violation, photos taken. Another notice of violation was mailed to the address listed with Tarrant Appraisal District records. • April 29, 2021 — The property remained in violation, photos taken. Another notice of violation was mailed to the address listed with Tarrant Appraisal District records. • May, 17, 2021 — The property remained in violation, photos taken. Another notice of violation was mailed to the address listed with Tarrant Appraisal District records. • May 28, 2021 —The notice of violation was returned back to Neighborhood Services. • June 4, 2021 - Horne sent an email to the property owner, Mr. Khader requesting a call back. The Water Department notes from March 2021 stated the house fire occurred late February 2021 and the property owner was working on the insurance claim. • June 7, 2021 — Officer Horne still has had no contact from the property owner and the property remained in violation. Horne found another property address for the property owner and mailed a final notice of violation. Later during the day Horne spoke with Mr. Khader he stated he does not have the money to rebuild the structure, and his plan is to sell two other homes within a year in hopes he could do something about the fire damage structure until then he cannot do anything to the property. • July 24, 2021 —The property remained in violation, photos taken. • August 3, 2021 —The property remained in violation, photos taken. • August 11, 2021 - Horne spoke with Mr. Khader, he stated he will be selling/closing on his moms house this week so he should have some funds available, but he still hasn't found a contractor to remodel the house. • September 21, 2021—The property remained in violation, photos taken. • October 8, 2021 - The property remained in violation, photos taken. • November 1, 2021 - The property remained in violation, photos taken. Due to the property owners lack of ability to comply with the requirements according to the City Code, a PCA was submitted to the court for citation. • December 8, 2021 —The property remained in violation, photos taken. • December 15, 2021 —The property remained in violation, photos taken. Horne had court with Mr. Khader, he stated he was in the process on signing a contract to have the house demolish. He stated the electricity has already been shut off and he has to schedule the plumbing to be capped off. • January 12, 2022 — The property remained in violation, photos taken for court hearing today. Mr. Khader did not appear for court hearing. • January 18, 2022—Horne observed a non-franchise dumpster in the rear of property along with several trash bags stored in the rear yard all viewable from the street. The property remained in violation, photos taken. Horne spoke with Mr. Khader he states that he is currently cleaning the house out, he was informed that the non-franchise dumpster is in "K NOKTH KICHLAND HILLS violation and would need to be removed along with the trash bags. He was also informed to submit an action plan with a timeline to Officer Horne. • January 21, 2022— Horne observed guys on site cleaning out house, the house has been gutted out for the most part. Photos were taken. • February 8, 2022 —The property remains in violation, although the trash/debris has been removed from the property, photos taken for court hearing that is schedule for tomorrow. Horne and the Building Inspector Gary Taylor were schedule to meet Mr. Khader at the property address today, to discuss with him the permit(s) he will need to obtain before he begins any more work to the structure, but he was a no show. • February 9, 2022 — Horne attend the court hearing and so did Mr. Khader. He stated the reason why he did not attend the meeting yesterday because he was at school, he also stated he's decided not to demolish the structure but to move forward with a remodel. • February 14, 2022 — Notice of Hearing mailed both certified and regular to the property owner. Since the inception of the case nearly a year ago, the owner has secured the exterior and cleaned out the interior of the structure. Minimal work has been accomplished in 12 months and action did not begin until Lead Officer Horne issued a citation to the owner and the threat of a court fine was upon the owner. A public hearing will be held to consider action regarding the following substandard residential building in accordance with the city's substandard building regulations, North Richland Hills Code of Ordinances, Chapter 98. Violations of city standards present at the buildings are as follows: 1. The structure sustained fire damage that has remained unrepaired more than 90 days. 2. The fire damage caused deficiencies in the electrical wiring, lighting, weatherproofing, and structure/framing. All fire damage must be repaired and corrected. 3. Exterior of structure has accumulation of trash and debris. All accumulation of trash and debris must be removed. 4. Both exterior and interior of structure must be brought to minimum code requirements, or structure must be demolished. Notifications of these violations were sent on March 4, 2021, March 29, 2021, April 14, 2021, April 29, 2021, May 17, 2021, June 7, 2021, January 21, 2022 and January 25, 2022. The board will determine whether the building complies with the standards set out in the ordinance and consider whether to uphold the Building Official and the Director of Neighborhood Services order to repair or demolish structure and remove all debris. In either case, if the ordered action is not taken within a reasonable time specified by the Board, the City may vacate, secure, remove, or demolish the building or relocate the occupants of the building and levy the cost thereof as a special assessment against the property. All interested persons may appear and be heard. Failure to appear will be deemed as waiving your right to be heard and the Substandard Building Board will make their determination based on the evidence presented. A copy of the order of the Substandard Building Board concerning your case will be mailed to you.
