DRIVE, BEING 0.22 ACRES DESCRIBED AS LOT 2, BLOCK 18, HOLIDAY
NORTH ADDITION.
Chair Duer read the rules and regulations of the Zoning Board of Adjustment. He
stated alternate Board member Crystal Ndidi Ibe may participate in the discussion of
the items but would not be voting on the items as there are five regular members
present.
Chair Duer opened the public hearing, and called for Principal Planner Clayton
Husband to introduce the request. Mr. Husband introduced the request.
Chair Duer called for the applicant to present the request and be sworn in prior to
speaking.
Tricia Bradford, 7554 Terry Drive, North Richland Hills, was sworn in by Chair Duer
and presented the request. She referenced communication with utility companies and
letters of support from neighbors.
Chair Duer called for Principal Planner Clayton Husband to present the staff report.
Mr. Husband presented the staff report. He stated letters of support were submitted
from the following people: Kyle Daniel, 7549 Terry Drive, North Richland Hills;
Matthew and Brittany Legacy, 7550 Terry Drive, North Richland Hills; Vicki and
Stanley Redding, 7601 Jean Ann Drive, North Richland Hills; and Justin and Jillian
Wilburn, 7551 Terry Drive, North Richland Hills.
Chair Duer and Mr. Husband discussed the burying of the electric service line to the
building and the title survey of the lot.
Chair Duer called for anyone wishing to speak for or against the request to come
forward. There being no one else wishing to speak, Chair Duer closed the public
hearing.

Mehndy Ali for a variance from Section 118-314 (off-street parking
standards) of the North Richland Hills zoning ordinance at 6801
Ridgetop Road, being 0.20 acres described as Lot 17, Block 5,
Foster Village Addition.

SUMMARY
Mehndy Ali is requesting approval of variance to the off-street parking standards to allow
a garage conversion to remain without providing two covered and enclosed garage
parking spaces on the property. The property is located at 6801 Ridgetop Road.
BACKGROUND INFORMATION
The property is located at the northeast corner of Crosstimbers Lane and Ridgetop Road,
between Starnes Road and Hightower Drive. The lot is 80 feet wide, 115 feet deep, and
approximately 8,720 square feet in area. The property is zoned R-3 (Single-Family
Residential). The house was constructed about 1984 and has approximately 1,474
square feet of living area.
Mehndy Ali purchased the house in August 2020. At some time prior to the sale, a
previous owner converted the two-car garage to living space without issuance of building
permits. The conversion was noted during an inspection of the property as part of the
single-family rental inspection program. When the space was converted, the garage door
was removed and an exterior entry door added to the wall. The construction has not been
inspected for compliance with building and life safety codes. Photos of the interior and
exterior of the house are attached and are available online as part of a previous real
estate listing of the property ( 'illllow,corn 6 1„Il lip.qe op_II ..).
The owner has applied for a variance from the parking standard to allow the garage
conversion to remain without converting the space back to a garage or providing covered
garage parking elsewhere on the property. The variance application and supporting
materials are attached. The materials include a copy of the application explaining the
reasoning for the variance request and other relevant documents. An analysis of the
request and relevant codes is below.

ANALYSIS
The variance request is related to standards contained in ��rie�htl:lon 11 - 14(�? of the
zoning ordinance. This section also references the general parking and loading standards
in Sir ii lI"e II II„ of the zoning ordinance. The applicable standards require that single-family
residential lots provide two covered and enclosed garage parking spaces located behind
the front building line. Due to the garage conversion, the house does not meet this zoning
standard.
Garage conversions are permitted if an alternative location for the required covered
parking is provided. At the time the house was constructed (1984), the zoning ordinance
required that four off-street parking spaces be provided on the lot, with at least two of
those spaces being covered. The lot currently has only two off-street parking spaces,
which are located in the driveway.
While a garage was not specifically required at the time the house was constructed, the
setback standards required that any garage or carport must be located behind the front
building line. (Ordinance 1080: NRH zoning ordinance of 1984).
Based on the size and layout of the property, and given that the lot is a corner lot, there
appears to be sufficient room to construct a detached garage in the rear yard. A new
driveway could be constructed on the Crosstimbers Lane side of the house to provide
access to a detached garage in the rear yard. The possible location of a detached garage
appears to satisfy side and rear yard building setbacks. If a new detached garage is
constructed, the existing driveway should be removed. The applicant has not indicated a
plan to construct a new garage. This analysis was done to determine if room was available
for a detached garage.
If the variance request is approved, the owner must apply for a building permit for the
garage conversion. Modifications to the converted area may be required to ensure that
construction complies with building and life safety codes. Waivers from or modifications
to these codes cannot be addressed through action by the Zoning Board of Adjustment.
FINDINGS FOR VARIANCE APPROVAL
Section 118-86(4) of the zoning ordinance authorizes the Zoning Board of Adjustment
"...to authorize upon appeal, in specific cases, such variance from the terms of [the
Zoning Ordinance] as will not be contrary to the public interest and where, because of
special conditions, the enforcement of the [Zoning Ordinance] would result in an
unnecessary hardship."
In exercising it powers to grant a variance, the board of adjustment must make specific
findings and show in its minutes that:
a. Literal enforcement of the controls will create an unnecessary hardship or practical
difficulty in the development of the affected property.
b. The situation causing the hardship or difficulty is neither self-imposed nor generally
affecting all or most properties in the same zoning district.

c. The relief sought will not injure the permitted use of adjacent conforming property.
d. The granting of the variance will be in harmony with the spirit and purposes of
these regulations.
OPTIONS FOR BOARD CONSIDERATION
The Zoning Board of Adjustment has the following options regarding this application.
1. Approve the variance as presented. This action would allow the garage conversion
to remain and may require certain modifications to the area in order to comply with
life safety and building code standards.
2. Approve the variance with conditions. This action would allow the garage
conversion to remain subject to the owner making modifications to its size,
location, or design as directed by the Board.
3. Deny the variance. This action would require the space be converted back to a
garage or that two covered and enclosed parking spaces be added to the property.

1. List the pertinent section(s) of the zoning ordinance and indicate the specific variances being requested. If necessary, use
a separate sheet.
This property was purchased on June 26, 2020 with a garage conversion. It was leased August
2020 and at that time a rental inspection was ordered and approved at its current condition.
This property is now being denied a rental permit because of garage conversion. We are asking for
approval of garage conversion and variance on this matter.
2. State the grounds for the request and describe any special conditions that cause hardships that, in your opinion,justify the
variance(s) being requested. Examples of special conditions are: topography, creeks, utility lines, irregular lot or tract shapes,
etc. The Zoning Board of Adjustment must determine that special conditions exist before making a motion to approve a
request. If it is determined that special conditions do not exist, the motion must be to deny the request. If necessary, use a
separate sheet.
Ground for the request is based on garage conversion that was done before the purchase. The
home was purchased with the understanding that the conversion of the garage was permitted and
resolved prior to the sale.
3. Explain any special circumstances, if applicable, not considered by the zoning ordinance. Examples: (1) if the subdivision
plat was approved prior to the current zoning ordinance requirements; or (2) the zoning ordinance was amended or a policy
change was adopted after submitting an application for a building permit or other phase of the development process. If
necessary, use a separate sheet.
The past rental inspection and permit was issued in the same condition it is today. I hope the board
will approve my application.
