D.2 SRB21-0001 PUBLIC HEARING AND CONSIDERATION OF A REQUEST FROM RACETRAC FOR A VARIANCE TO CHAPTER 106 (SIGNS) OF THE NORTH RICHLAND HILLS CODE OF ORDINANCES AT 5640 RUFE SNOW DRIVE, BEING 2.5 ACRES DESCRIBED AS LOT 3, BLOCK 35, HOLIDAY WEST ADDITION. DENIED Chair Trevino opened the public hearing and called on Director of Planning Clayton Comstock to introduce the item. Mr. Comstock informed the Board the applicant is requesting a sign variance to Chapter 106 of the Code of Ordinances on 2.5 acres located at 5640 Rufe Snow Drive. Mr. Comstock provided site photos of the property. Applicant representative for RaceTrac, Andrew Malzer, 200 Galleria Parkway SE, Suite 900, Atlanta, Georgia, informed the Board they are seeking a variance to the current sign. The applicant is proposing to remove the catwalk and ladder required to change numbers manually. They propose to utilize the existing pole and cabinet to update and replace with electronic numbers that are changed from corporate in Georgia. The new sign would also include; new logo, replace fuel grade panels, replace pricers with 61" and 32" sunshine LED pricers, paint existing pole and cabinet. Mr. Comstock stated staff shared with the applicant how they could improve the sign and use scrollers to display the numbers. RaceTrac stated that they prefer LED to preserve visibility. Mr. Comstock presented a summary of the variance request and stated it was a legal non-conforming sign at the time of installation in 1996 as it met the sign criteria in the Zoning Ordinance. The proposed variance this evening is to allow LED for 64% of the sign area. The LED display includes red and green lighting with black background. Mr. Comstock stated the options for the Board's consideration is to (1) approve variance request as presented, (2) approve the variance request subject to changes to the design, location, or size of the sign or (3) deny the request. The Board, applicant and staff discussed scrollers and current RaceTrac monument sign on Davis Boulevard and making this work on Rufe Snow. Economic Development September 13, 2021 Sign Review Board Meeting Minutes Page 2 of 3 Director Craig Hulse stated that the city has an economic development funding program for monument signs and pole removal. Mr. Malzer, applicant representative for RaceTrac, said that they will not move forward with a monument sign. Chair Trevino asked the City Secretary to call on those who completed a public meeting appearance form to speak during the public hearing. There being no forms submitted, Chair Trevino asked if there was anyone in the audience wishing to speak on the item to come forward. PRESENTER: Clayton Comstock, Planning Director SUMMARY: On behalf of Burkett Media Management LLC, Beau Burkett is requesting a permit for nonconformity to Chapter 106 (Signs) of the North Richland Hills Code of Ordinances. The applicant is requesting to convert an existing billboard sign to a digital billboard sign at 8650 Airport Freeway. GENERAL DESCRIPTION: The property is located on the south side of the Airport Freeway frontage road between Bedford Euless Road and Blackfoot Trail. The site is immediately adjacent to a convenience store with fuel sales (Exxon) and a car wash (Xpress Car Wash). The 3,183- square-foot property is zoned C-1 (Commercial) and is located in the Freeway Corridor Overlay district. Burkett Media Management LLC is requesting approval of a permit to remove the existing nonconforming billboard sign and construct a digital billboard on the property. The applicant is under contract to purchase the property from Five Star Properties. The application and supporting materials are attached. The materials include pertinent information and correspondence, a site survey, a site plan, construction drawings, color image exhibits of the proposed sign, and other relevant documents. Section 106-9 of the Signs chapter allows the Sign Review Board to authorize the reconstruction or relocation of a nonconforming billboard, including its conversion to digital technology. Digital billboards may only replace existing nonconforming off-premise billboards located on nonresidential lots that have frontage on NE Loop 820 and State Highway 121. Subsequent approval by the Texas Department of Transportation (TxDOT) is not required for the digital billboard. The City of North Richland Hills is a TxDOT Certified City since 2011, and may exercise control over commercial signs within the city limits. A permit issued by the City is acceptable instead of a permit issued by TxDOT within the certified area. "K NOKTH KICHLAND HILLS Digital billboards are subject to certain design standards required by Section 106-12(b) of the Sign chapter. The following is a summary of the primary design standards associated with the request. A complete copy of the standards is attached for reference. Sign Area Billboard signs are limited to 672 square feet in total display area. The proposed digital billboard meets this with this standard, measuring 14 feet in height and 48 feet in width. Sign Height The maximum height permitted for digital billboards is based on the grade level of the main traveled way closest to the sign. The height limit must not exceed g g an overall height of 42.5 feet from the centerline of the main traveled way. For the purposes of billboard signs, the height standard is based on the grade level of the adjacent general purpose lanes of the highway. This is consistent with prior consideration of digital billboard conversions. At the proposed location under consideration, the general purpose lanes on Airport Freeway are located below the North Tarrant Express toll lanes. The elevation of the general purpose lanes is approximately 20 feet, which could allow for a billboard with an overall height of 62.5 feet. The applicant proposes a billboard with an overall height of 85 feet, which is based on the grade level of the North Tarrant Express toll lanes. Information provided by the applicant indicates the elevation of the toll lanes as 50 feet above the grade level of the base of the sign. Additionally, the property is located in the Freeway Corridor Overlay district, which restricts all pole sign heights to 65 feet. While this height does not specifically apply to billboard signs, it does provide a standard of public expectations for the heights of signs within the freeway corridor. The allowed height of any billboard sign is subject to specific approval by the Sign Review Board. "K NOKTH KICHLAND HILLS •,,,�%//%//,%i///i�//ruiiiiiu%///%irirrim,r/rafri/�iii%/rGiarr r � � ,u„ #^7 EXISTING SIGN PROPOSED SIGN Support structure The support structure for digital billboards must be clad in a decorative material consisting of brick, stone, or other approved masonry material. The use of EIFS is not an approved finish `' material. The proposed billboard complies with this standard. The support structure would be clad in a decorative stone product, Texas gold chalk, supplied by Texas Stone Designs. An example of this material is shown at right and is consistent with the Freeway Corridor Urban Design Plan for integrating stone elements into the corridor parkways and medians. Landscaping The property is located within the Freeway Corridor Overlay district. Properties in this overlay are subject to certain landscaping standards as part of new construction, as required by Section 114-71(k) of the Vegetation chapter of the Code of Ordinances. The Sign Review Board may place conditions of approval on sign applications to provide for the maintenance of the integrity and character of the area in which the permit is granted. As alternative to the overlay standards, and consistent with prior approvals for digital billboard, the DRC recommends the following landscaping requirements be implemented as a condition of approval to soften the appearance of the sign structure at the ground level. 1. A landscape plan that includes the following features must be included with the sign permit application. The landscape plan must be prepared by registered landscape architect. a. Three (3) large deciduous oak trees of a minimum 3-inch caliper planted along the freeway property line. b. Five (5) Vitex ornamental trees planted at the southeast corner of the parcel. "K NOKTH KICHLAND HILLS c. A planting bed of at least two hundred (200) square feet installed around the base of the support column. The bed must be separated from the surrounding turf by a decorative stone border and must be kept maintained clear of high grass and weeds. Plantings must include a mixture of at least sixteen (16) shrubs selected from Dwarf Abelia, Autumn Sage, and Texas Sage. 2. All landscaped areas must be watered by an automatic underground irrigation system equipped with rain and freeze sensors. The applicant is requesting that landscaping not be required in association with this permit request. Permit for nonconformity The request is being processed as a permit for nonconformity. Approval would be associated with the sign permit for the digital conversion of the billboard, and approval does not run with the property in the same manner as a variance. If future improvements were proposed on the site, compliance with the standards would be evaluated again at that time. A public hearing is not required for consideration of a permit for nonconformity. Pendley, AICP, CBO, LEED Green Associate Chief Building Official City of North Richland Hills Re: Sign Upgrade by Burkett Media—8650 Airport Fwy, North Richland Hills, TX Dear Mr. Pendley: Our firm specializes in sign law issues from coast to coast. We are working with Burkett Media on its North Richland Hills project. As you know, Burkett Media hopes to improve an existing billboard on Texas Highway 183 (TEXpress Toll 121 / 183 Express) for the benefit of local businesses and the community. Please include this letter in the Sign Review Board/City Council packet for the March 28 meeting. Our review of the City Code shows that the Council has the authority to approve the upgraded sign. One question was the spacing from other billboards. Although the Code generally requires 1500 feet spacing: "The sign review board is authorized to grant variances to the minimum spacing requirements provided that no variance violates the Highway Beautification Act of 1965." For example, the Council approved the Clear Channel LED billboard that is 1250 feet away from this sign. The Clear Channel approval was issued in 2014, long after this billboard was in existence. Notably, the State of Texas (TXDOT) only requires 500 feet between such billboards in North Richland Hills. Thus, the spacing can and should be varied by the Council. In order to make sure this is a win-win situation, my client will voluntarily accept several conditions as shown on the attached sheet. These voluntary permit conditions include a ban on adult content and use of the sign for City messaging. Adam Webb EAW/kl Attachments (voluntary permit conditions) VOLUNTARY PERMIT CONDITIONS The following conditions on the approval of the Burkett Media billboard upgrade are voluntarily offered by Burkett Media. The City Council/Sign Review Board should approve the project with these conditions: (1) Burkett Media agrees to reject advertising that is for sexually-oriented or adult businesses and any obscene words or pictures; (2) Burkett Media agrees to comply with all applicable federal and state legal requirements; (3) Burkett Media agrees to comply with current best available digital-billboard technologies, including but not limited to,remote diagnostic and maintenance capability, "Amber Alert" capability, automatic brightness adjustment to ambient lighting conditions, UL and IEC approval, color calibration to ensure consistent image quality,remote shutdown capability, regularly scheduled onsite maintenance, internal service access for safety and improved appearance, anchoring mechanism and support system; (4) Burkett Media will provide an advertising discount to businesses within the City limits of North Richland Hills of 10% off current rate card pricing; (5) Burkett Media will provide forty (40) hours per year without charge between the hours of 6:00 am and midnight for City of North Richland Hills messages and public service announcements (display time will be "unsold space" only and only at the request of the City). The City shall provide Burkett Media with non-commercial advertising copy at least five (5) days before the proposed display date. City messages will be subject to Burkett Media's standard advertising copy rejection and removal policies. Pendley, AICP, CBO, LEED Green Associate Chief Building Official City of North Richland Hills Re: Sign Upgrade by Burkett Media(SRB22-0002 to be heard March 28, 2022) Dear Mr. Pendley: Our firm has been asked to review the comments of the Development Review Committee ("DRC") directed toward the application of Burkett Media to improve an existing billboard on Texas Highway 183. Please accept this letter and the various attachments as the applicant's response as directed by the DRC. Burkett Media looks forward to appearing on March 28 for the hearing and to gaining approval for this win-win project. In response to each of the DRC's points, Burkett Media responds as follows: Comment 4: . . .provide color image exhibits showing how the proposed billboard would appear after the installation. The exhibits should include eastbound and westbound views from the Airport Freeway frontage road as well as both the lower main lanes and upper toll lanes ofAirport Freeway. Response: Please see Exhibits A-C attached hereto. Comment S: The proposed billboard appears to be a complete replacement of the existing billboard rather than a conversion. The site plan drawing indicates the support column being relocated by approximately 8-10 feet. In the response letter to these comments, describe the specific plan for the construction, and whether that includes total removal of the existing sign. The application needs clarification on whether it is a conversion or new construction. Response: The existing sign will be fully removed and the new sign will be constructed pursuant to the engineered blueprints submitted. This is critical because the old structure does not meet current building code requirements. The proposed structure will meet all up-to-date codes, including increased wind loads. The safety and soundness of the structure is our top priority. Please note, all other sign upgrades that have been approved and completed were complete rebuilds. This is necessary to meet engineering requirements because the required masonry and two digital units add significant weight. Comment 6: . . . The response letter to these comments must include justification as to why this height is appropriate for this location and include examples of signs of similar height in the area. The upgraded sign will meet Section 106-12(b)'s sign height requirements because the code allows for the sign to be 42.5 feet above the grade of the main travelled way. The main travelled way is now the Toll Express Lanes, so the relevant roadway height has increased since the original billboard was installed. Please note, the surveyor found that the sign is 50 feet below grade, so a height of 92.5 feet is allowed. Burkett Media, however, is seeking only what is needed for visibility, a height of 35 feet above the toll lanes. Comment 7: Revise the engineered blueprint drawing to remove the catwalks from the design of the structure, as both sides of the sign are planned to be digital. Response: Please see Exhibit D attached hereto. The catwalks have been removed. Comment 8: In the response letter to these comments,provide the following: a. Provide the supplier source or manufacturer specification for the proposed Texas gold chalk stone cladding material for the pole surround. Response: Texas Stone Designs 2001 W. Indicate who will maintain the landscaping on the parcel on which the sign is located. Response: Landscaping is not required. Please see response to Comment 9 below. Comment 9: The Development Review Committee will recommend to the Sign Review Board that landscaping be installed on the property address requirements of the Freeway Corridor Overlay district and to soften the appearance at the ground level. A landscape plan that includes the following features must be included with the next submittal. a. Five (5)Desert willow ornamental trees planted on the parcel. b. A planting bed of at least seventy-five (75) square feet installed around the base of the support column. The bed must be separated from the surrounding turf by steel edging or a decorative stone border. Plantings must include at least twelve (12) shrubs selected from Dwarf Abelia, Autumn Sage, Texas Sage, Dwarf Yaupon Holly, Red Yucca, New Gold Lantana, and Gulf muhly grass. c. All landscaped areas must be watered by an automatic underground irrigation system equipped with rain and freeze sensors. Response: The relevant provision of the Freeway Corridor Overlay District regulations is Section 118-554, which states: Sec. 118-554. -General conditions. The following general conditions shall be required of all development located in the Freeway Corridor Overlay District. If not addressed in this division, the general conditions of the base district shall apply. (1) Screening and fencing standards. Article Vlll of this chapter shall apply to the Freeway Corridor Overlay District, except that required masonry screening walls adjacent to residential uses shall be a minimum of eight feet in height and shall have an element of Lueders Limestone (i.e. columns, part or all of wall). Thus, the only landscaping rules would have to come from Article VIII which is titled "Screening and Fencing Standards." Upon review of Article VIII, however, there are no landscaping requirements therein. Please note that this sign will be much more attractive to those passing near the sign base than the original billboard it is replacing. The addition of substantial and expensive stonework will provide a massive improvement. I have re-attached as Exhibit F the permit conditions that Burkett Media has voluntarily agreed to accept as an element of this approval. Please let me and Mr. Burkett know if there are any other questions or concerns. Mr. Burkett looks forward to completing this upgrade. It will truly be a win-win project. The following is an explanation of the analysis: 1. Units of Measurement. A foot-candle (or foot-candle,fc, Im/ft2, or ft-c) is a measurement of light intensity. One foot-candle is defined as enough light to saturate a one-foot square with one lumen of light. For example, where the display illuminates at 0.14 foot-candles, it has a light intensity of approximately 14%of a single wax candle as viewed from 1 foot away. 2. Assumptions:The accompanying graph depicts illumination levels in foot candles that the display will produce based on nighttime running levels measured at 85' in elevation.The measurements assume total darkness with regards to the surrounding light and an all-white content on the display. These assumptions provide for the worst-case scenario, not the more likely application. 3. Practical Application:Typical content runs at 25-35%of the brightness of all-white content,therefore, the actual levels of illumination will nearly always be markedly lower than that shown in the graph. 4. Ambient Light Effects.The presence of ambient light producing elements at night including, but not limited to, roadway and traffic lighting, commercial lighting from nearby commercial properties, the moon, etc., will further diminish the impact of the light output from the display in question. 5. Display Features The display is equipped so as not to exceed 0.3-foot candles above ambient light as measured from the appropriate distance.This standard is based on the acceptable standards for outdoor illumination from the Illuminating Engineering Society of North America, and has been implemented in the numerous states and municipalities throughout the U.S. 6. Automatic Dimming Technology.The perceived brightness of an electronic message center is dependent on a variety of factors.Ambient light conditions play the largest role in affecting the brightness of the display. An electronic message center communicates its messages by emitting light. With approval by the sign review board as described in section 106-15, existing legal nonconforming off-premise billboard signs located on lots having frontage on U.S. Interstate Highway Loop 820 and Texas State Highway 121 may be converted to digital billboards under the following conditions: (1) Each message shall be displayed for at least eight seconds and a change of message shall be accomplished within two seconds or less. (2) Transitions between the display of a message, content, and/or image shall be immediate only and shall occur simultaneously on the entire sign face. (6) The main support structure shall have a decorative finish consisting of brick, stone, or other approved masonry finish materials. The use of EIFS shall not constitute an approved finish material. (7) A minimum spacing of 1,500 shall be required between one digital billboard and any other digital or conventional billboard on the same side of the roadway facing the same direction. The sign review board is authorized to grant variances to the minimum spacing requirements provided that no variance violates the Highway Beautification Act of 1965. (8) A digital billboard shall have a default mechanism built in to either turn the display off or show "full black" on the display in the event of a malfunction. (9) The display may not display light of such intensity or brilliance to cause glare or otherwise impair the vision of the driver, or results in a nuisance to the driver. (10) A digital billboard shall be equipped with both a dimmer control and a photocell, which automatically adjusts the display's intensity according to natural ambient light conditions.The brightness of the display shall not exceed 0.3 foot-candles over ambient light measurement at a distance of 250 feet from the sign. (11) Upon notification, the sign operators agree to coordinate with city staff to display emergency information critical to the traveling public, such as AMBER ALERTS from a National Center for Missing and Exploited Children (NCMEC) authorized source, Homeland Security, and other alerts involving terrorist attacks, and natural disasters. Emergency messages are to remain in the display's rotation according to the designated issuing agency's protocols. A digital billboard shall not exceed an overall height of 42.5 feet, measured from the highest point of the sign to the grade level of the centerline of the main-traveled way closest to the sign, at a point perpendicular to the sign location. The lowest point of the sign shall have a minimum clearance of at least 20 feet above the adjacent grade. (16) In cases where a conventional billboard is converted to a digital billboard of larger size,the net area increase of the proposed digital billboard display must be physically removed from other conventional billboards located within the city and under the same ownership or control as the owner proposing the conversion. Once an inventory of all billboards within the city is submitted, the owner may choose which specific conventional billboard face(s) are to be removed in exchange forthe net area increase caused by the digital sign conversion.The square footage can be accumulated by the surrendering of smaller conventional billboard face(s) as long as the aggregate amount removed equals or exceeds the area increase caused by the conversion.
