ORDINANCE NO. 2439
AN ORDINANCE BY THE CITY OF NORTH RICHLAND HILLS, TEXAS, AMENDING
ORDINANCE NUMBER 1874, THE COMPREHENSIVE ZONING ORDINANCE, TO
ESTABLISH A NEIGHBORHOOD COMMERCIAL ZONING DISTRICT AND TO
ESTABLISH DIMENSION AND OPERATION REGULATIONS FOR THE DISTRICT;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council has determined that areas of the city are appropriate for
transition from residential to commercial use; and
WHEREAS, the City Council intends to encourage quality transition allowing low-impact
commercial uses on the fringes of residential areas; and
WHEREAS, the City Council has determined the need to allow staff to modify or expand
base district regulations by designing overlay zones in conjunction with base district
requirements; and
WHEREAS, after notice and public hearing, the Planning and Zoning Commission of
the City of North Richland Hills, Texas, has forwarded a recommendation to the City
Council for amendment of Ordinance No. 1874 by changing said Zoning Ordinance as
set forth herein; now therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND
HILLS, TEXAS:
1.
THAT, Ordinance No. 1874, the Zoning Regulations of the City of North Richland Hills,
as amended, is hereby amended to insert the Neighborhood Commercial District, by
adding as follows:
A. Add to Section 300 District Classifications, A Base Districts:
NC Neighborhood Commercial
B. Add to Section 310 Table of Permitted Uses, Non-Residential Districts:

C. Add to Section 440.A. Purpose, 5. NC Neighborhood Commercial District: The
Neighborhood Commercial District is intended for offices and neighborhood
shopping facilities predominately serving neighborhood or community needs, which
may be located within or adjacent to residential neighborhoods. It provides a buffer
between residential districts and more intense commercial districts and serves as a
transitional zone where limited residential and business uses coincide. Site
development regulations and performance standards are intended to ensure that
uses will be compatible and complimentary in scale and appearance with a
residential environment. The permanent District standards may be combined with
an overlay to utilize unique design criteria to better match the existing conditions of a
specific neighborhood.
D. Add to Section 440.C. Lot and Area Requirements, a column labeled NC as follows:

E. Add NC to Section 440.D.1, 2, 6,8.
F. Add to Section 440.D.7 Refuse Facilities ~NC District: No refuse containers shall
be located outdoors on a permanent basis. Dumpsters are not permitted.
G. Add to Section 440.E.5 NC District: No outdoor activities or other uses shall be
permitted in the NC Neighborhood Commercial District other than parking and
loading.
H. Add to Section 605.A Table 6-2 NC: Primary Structures 75%; Accessory Buildings
75%; EXCEPTION: An exception to the masonry requirement shall apply to existing
structures in the NC Neighborhood Commercial District, which do not meet the
masonry requirement. Any enlargement of an existing structure in the NC District

shall provide an amount of masonry which matches the adjacent surfaces of the
existing structure.
I. To Section 1 020.D Table of District Screening Requirements (Table 10-F), add to
Column 1 a row labeled NC with R (screening wall required) to columns 3-13 (all
residential districts).

SEVERABILITY CLAUSE. That it is hereby declared to be the intention of the City
Council that the section, paragraphs, sentences, clauses and phrases of this ordinance
are severable, and if any phrase, clause, sentence, paragraph or section of this
ordinance shall be declared invalid or unconstitutional by the valid judgment or decree
of any court of competent jurisdiction, such invalidity or unconstitutionality shall not
affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this
ordinance, since the same would have been enacted by the City Council without the
incorporation in this ordinance of any such invalid or unconstitutional phrase, clause,
sentence, paragraph or section.
3.
SAVINGS CLAUSE. That Ordinance Number 1874, the Comprehensive Zoning
Ordinance of the City of North Richland Hills, Texas, as amended, shall remain in full
force and effect, save and except as amended by this ordinance.
4.
EFFECTIVE DATE. This ordinance shall be in full force from and after its passage.
