Chair Trevino called on Planning Director Clayton Comstock to present the item.
Mr. Comstock informed the Board, the applicant is requesting a landscaping variance
and permit for nonconformity to Chapter 106 of the Code of Ordinances for a digital
billboard conversion on 0.07 acres located at 8650 Airport Freeway. Mr. Comstock
provided site photos of the property.
Applicant Beau Burkett, Austin, Texas, informed the Board Burkett Media is requesting to
replace the current sign with digital signage on both sides of the sign and increase the
height to 85 feet.
Mr. Comstock, provided a summary of the request and reviewed the Sign Code
Standards as well as proposed billboard signage, support structure, sign height
comparisons and landscaping standards. Mr. Comstock stated the Sign Review Board
approves billboard conversion or replacement. In 2011 the Texas Department of
Transportation (TxDOT) designated the City of North Richland Hills a Certified City and
the city may exercise control over commercial signs within the city limits through Chapter
106. TxDOT approval is not required.
The board, applicant and staff discussed the landscape plan, Amber alerts, sign heights
and elevations of various signs in the city, managed lanes, landscaping variances for the
site and continued the sign height discussion.

SUBJECT: SRB22-0003 Consideration of a request from Burkett Media
Management LLC for a permit for nonconformity to Chapter 106
(Signs) of the North Richland Hills Code of Ordinances to allow a
digital billboard conversion at 7702 NE Loop 820, being 0.453 acres
described as Lot 4R1A, Richland Terrace Addition.

SUMMARY:
On behalf of Burkett Media Management LLC, Beau Burkett is requesting a permit for
nonconformity to Chapter 106 (Signs) of the North Richland Hills Code of Ordinances.
The applicant is requesting to convert an existing billboard sign to a digital billboard sign
at 7702 NE Loop 820.
GENERAL DESCRIPTION:
The property is located at the southwest corner of NE Loop 820 and Boulevard 26. The
site is immediately adjacent to the parking lot for Hooters restaurant and the right turn
lane from the frontage road to Boulevard 26. The 19,745-square-foot property is zoned
C-2 (Commercial) and is located in the Freeway Corridor Overlay district.
Burkett Media Management LLC is requesting approval of a permit to remove the existing
nonconforming billboard sign and construct a digital billboard on the property. The
applicant is under contract to purchase the property from May Advertising Venture 11. The
application and supporting materials are attached. The materials include pertinent
information and correspondence, a site survey, a site plan, construction drawings, color
image exhibits of the proposed sign, and other relevant documents.
Section 106-9 of the Signs chapter of the North Richland Hills City Code of Ordinances
allows the Sign Review Board to authorize the reconstruction or relocation of a
nonconforming billboard, including its conversion to digital technology. Digital billboards
may only replace existing nonconforming off-premise billboards located on nonresidential
lots that have frontage on NE Loop 820 and State Highway 121. Subsequent approval by
the Texas Department of Transportation (TxDOT) is not required for the digital billboard.
The City of North Richland Hills is a TxDOT Certified City since 2011, and may exercise
control over commercial signs within the city limits. A permit issued by the City is
acceptable instead of a permit issued by TxDOT within the certified area.
Digital billboards are subject to certain design standards required by Section 106-12(b)
of the Sign chapter. The following is a summary of the primary design standards
associated with the request. A complete copy of the standards is attached for reference.

Sign Area
Billboard signs are limited to 672 square feet in total display area. The proposed digital
billboard meets this with this standard, measuring 14 feet in height and 48 feet in width.
Sign Height
The maximum height permitted for digital billboards is based on the grade level of the
main traveled way closest to the sign. The height limit must not exceed an overall height
of 42.5 feet from the centerline of the main traveled way.
At the proposed location under consideration, the main traveled way on NE Loop 820 is
approximately 36 feet above the grade level of the frontage road. This could allow for a
billboard with an overall height of 78.5 feet. The proposed digital billboard has an overall
height of 75 feet.

EXISTING SIGN PROPOSED SIGN
Support structure
The support structure for digital billboards must be clad in a
decorative material consisting of brick, stone, or other approved
masonry material. The use of EIFS is not an approved finish `'
material.
The proposed billboard complies with this standard. The support
structure would be clad in a decorative stone product, Texas gold
chalk, supplied by Texas Stone Designs. An example of this
material is shown at right and is consistent with the Freeway „
Corridor Urban Design Plan for integrating stone elements into
the corridor parkways and medians.

Landscaping
The property is located within the Freeway Corridor Overlay district. Properties in this
overlay are subject to certain landscaping standards as part of new construction, as
required by Section 114-71(k) of the Vegetation chapter of the Code of Ordinances.

The Sign Review Board may place conditions of approval on sign applications to provide
for the maintenance of the integrity and character of the area in which the permit is
granted. The DRC recommends the following landscaping requirements be implemented
as a condition of approval in order to implement the overlay standards and complement
the existing median landscaping at the Boulevard 26 / NE Loop 820 intersection. The
applicant has agreed to this condition.
A graphic summary of the recommended landscape features is attached. A landscape
plan, prepared by a registered landscape architect, must be included with the sign permit
application. The design must include landscape amenities and plantings that are
consistent in materials and appearance with the TxDOT Boulevard 26 median
improvements adjacent to the site.

a. Four (4) large deciduous oak trees of a minimum four-inch caliper planted
adjacent to the parking lot.
b. Three (3) ornamental trees planted behind the masonry wall adjacent to the
right-turn lane.
c. Five (5) masonry urban design monuments.
d. One (1) longer masonry knee wall adjacent to the right-turn lane.
e. Approximately fifty (50) three-gallon evergreen shrubs planted to establish a
hedgerow planted adjacent to the parking lot.
f. Landscape bed edging.
2. All landscaped areas must be watered by an automatic underground irrigation
system equipped with rain and freeze sensors.
Similar landscape improvements have been installed on restaurant, retail, and automobile
dealership sites on NE Loop 820. The attached graphic summary includes photos of some
existing improvements.
Aerial utilities
There are several aerial utilities and meters on and
around the property, and it is unclear how the sign is � Illlb��� „a h
receiving power. Consistent with other development /
proposals, the Development Review Committee �ei
recommends that the power lines that service the
property be placed underground and the power poles
removed. This includes the single wire crossing �,�����,�%��� ✓
Boulevard 26 just south of the sign. This will require
coordination with Oncor to determine the purpose and r
extent of the utility lines.

Catwalk Screen
Like many billboard signs, the proposed sign would have the two sign faces angled toward
the roadway, creating an opening on one side. This opening would expose the backsides
of each sign and the interior catwalks behind the signs. This opening would also face
south and would be very visible to northbound traffic on Boulevard 26 and from the City
Point development. The Development Review Committee recommends the use of a plain
screen of durable material and color on this opening, similar to the digital billboard sign
located on the Richland High School property.

The request is being processed as a permit for nonconformity. Approval would be
associated with the sign permit for the digital conversion of the billboard, and approval
does not run with the property in the same manner as a variance. If future improvements
were proposed on the site, compliance with the standards would be evaluated again at
that time.
A public hearing is not required for consideration of a permit for nonconformity.
RECOMMENDATION:
Approve SRB22-0003 subject to a maximum sign height of 75 feet, landscaping, utility
and screening modifications as recommended by the Development Review Committee,
and compliance with all other development standards required by Section 106-12(b) of
the Sign chapter.

Re: Lighting Analysis for Daktronics Light Direct BLD14x48

The attached lighting analysis pertains to the digital display manufactured by Daktronics, Inc., and proposed for
installation at32°49'S7.3"N 97°13'00.8"VV. The following ioan explanation of the analysis:
1. Units of Measurement. Afoot'cand|e (orfoot'cand|e,fc, |m/ft2, orft'c) ioameaourementofUght
intensity. One foot-candle is defined as enough light to saturate a one-foot square with one lumen of
light. For example, where the display illuminates at 0.17foot'cand|eo, it has a light intensity of
approximately 17%ofa single wax candle ao viewed from 1 foot away.
2. Assumptions:The accompanying graph depicts illumination levels in foot candles that the display will
produce based on nighttime running levels at a measurement height of 80 feet in elevation.The
measurements assume total darkness with regards tothe surrounding light and an all-white content on
the display. These assumptions provide for the worst-case scenario, not the more likely application.
3. Practical Application:Typica| contentrunoat2S'3S%ofthebrightne000fa||'vvhitecontent,therefore,
the actual levels of illumination will nearly always be markedly lower than that shown in the graph.
4. Ambient Light Effects.Thepreoenceofambient|ightprodudnge|ementoatnightinduding, butnot
limited to, roadway and traffic lighting, commercial lighting from nearby commercial properties,the
moon, etc.,will further diminish the impact of the light output from the display in question.
S. Display Features. The display is equipped so as not to exceed 0.3 foot candles above ambient light as
measured from the appropriate distance.This standard is based on the acceptable standards for
outdoor illumination from the Illuminating Engineering Society of North America, and has been
implemented in the numerous states and municipalities throughout the U.S.
6. Automatic Dimming Technology.The perceived brightness ofan electronic message center iodependent
on a variety of factors. Ambient light conditions play the largest role in affecting the brightness of the
display.
An electronic message center communicates its messages by emitting light. It therefore must not be too
dim, since it couldn't be distinguished in sunlight; nor should it be too bright, as the image will be
distorted and difficult to read.The sign must adjust its brightness over the course of the day.Today's
signs can dim from 100%during a bright sunny afternoon,to around 4%(depending on manufacturer
and model) during the darkest night.That means the sign is only 4%as bright at night as during the

daytime. During the course of the day,the sign will periodically adjust its brightness levels to ensure itio
operating appropriately.
This adjustment is possible because of the photocell/light sensor. All electronic message centers
manufactured by Daktronics come equipped with a light sensor, which detects the ambient light level,
and adjusts the oign'o brightness accordingly. There are upto two hundred fifty-six levels ofdimming
available.

Sec. 106-12. Electronic message boards and digital billboards.
(b) Digital billboards. With approval by the sign review board as described in section 106-15, existing
legal nonconforming off-premise billboard signs located on lots having frontage on U.S. Interstate
Highway Loop 820 and Texas State Highway 121 may be converted to digital billboards under the
following conditions:
(1) Each message shall be displayed for at least eight seconds and a change of message shall be
accomplished within two seconds or less.
(2) Transitions between the display of a message, content, and/or image shall be immediate only
and shall occur simultaneously on the entire sign face.
(3) No display shall include animation, full motion video, blinking, flashing, dissolving or fading
images, moving light, scrolling images or text, nor shall it project a static image upon a
stationary object.
(4) The display of message, content, and/or image shall be visible only from one direction of traffic
travel per sign face on the primary roadway to which the sign is designed to be read.
(5) No portion of a digital billboard shall project into a dedicated utility easement or be closer than
five feet to a federal, state, or local right-of-way at the time of initial construction.
(6) The main support structure shall have a decorative finish consisting of brick, stone, or other
approved masonry finish materials. The use of EIFS shall not constitute an approved finish
material.
(7) A minimum spacing of 1,500 shall be required between one digital billboard and any other
digital or conventional billboard on the same side of the roadway facing the same direction.
The sign review board is authorized to grant variances to the minimum spacing requirements
provided that no variance violates the Highway Beautification Act of 1965.
(8) A digital billboard shall have a default mechanism built in to either turn the display off or show
"full black" on the display in the event of a malfunction.
(9) The display may not display light of such intensity or brilliance to cause glare or otherwise
impair the vision of the driver, or results in a nuisance to the driver.
(10) A digital billboard shall be equipped with both a dimmer control and a photocell, which
automatically adjusts the display's intensity according to natural ambient light conditions.The
brightness of the display shall not exceed 0.3 foot-candles over ambient light measurement at
a distance of 250 feet from the sign.
(11) Upon notification, the sign operators agree to coordinate with city staff to display emergency
information critical to the traveling public, such as AMBER ALERTS from a National Center for
Missing and Exploited Children (NCMEC) authorized source, Homeland Security, and other
alerts involving terrorist attacks, and natural disasters. Emergency messages are to remain in
the display's rotation according to the designated issuing agency's protocols.
(12) The owner of a digital billboard shall provide contact information for a person who is available
to be contacted at any time and is able to turn off the sign promptly after malfunction occurs

or reduce the intensity of the sign within 12 hours of a request by the building official or the
Texas Department of Transportation to a level acceptable to the city and/or department.
(13) A digital billboard or its message, content and/or image shall not be configured to resemble a
warning or danger signal or cause a driver to mistake it for a warning or danger signal.
(14) A digital billboard or its message, content and/or image shall not resemble or simulate any
lights of official signage used to control traffic in accordance with the currently adopted edition
of the TXDOT manual on Uniform Traffic Control Devices.
(15) A digital billboard shall not:
a. Exceed 672 feet in total display area.
b. A digital billboard shall not exceed an overall height of 42.5 feet, measured from the
highest point of the sign to the grade level of the centerline of the main-traveled way
closest to the sign, at a point perpendicular to the sign location. The lowest point of the
sign shall have a minimum clearance of at least 20 feet above the adjacent grade.
(16) In cases where a conventional billboard is converted to a digital billboard of larger size,the net
area increase of the proposed digital billboard display must be physically removed from other
conventional billboards located within the city and under the same ownership or control as the
owner proposing the conversion. Once an inventory of all billboards within the city is
submitted, the owner may choose which specific conventional billboard face(s) are to be
removed in exchange forthe net area increase caused by the digital sign conversion.The square
footage can be accumulated by the surrendering of smaller conventional billboard face(s) as
long as the aggregate amount removed equals or exceeds the area increase caused by the
conversion.
(17) All digital and conventional billboards shall pay annual renewal fees in accordance with
Appendix A.

SUBJECT: SRB22-0002 Consideration of a request from Burkett Media
Management LLC for an amendment to the permit for nonconformity
to Chapter 106 (Signs) of the North Richland Hills Code of
Ordinances to modify the landscaping requirements at 8650 Airport
Freeway, being 0.07 acres described as Lot 3, Block B, Richland
Oaks Addition.

SUMMARY:
On behalf of Burkett Media Management LLC, Beau Burkett is requesting an amendment
to the previously-approved permit for nonconformity to Chapter 106 (Signs) of the North
Richland Hills Code of Ordinances. The applicant is requesting to convert an existing
billboard sign to a digital billboard sign at 8650 Airport Freeway.
GENERAL DESCRIPTION:
The property is located on the south side of the Airport Freeway frontage road between
Bedford Euless Road and Blackfoot Trail. The site is immediately adjacent to a
convenience store with fuel sales (Exxon) and a car wash (Xpress Car Wash). The 3,183-
square-foot property is zoned C-1 (Commercial) and is located in the Freeway Corridor
Overlay district.
On March 28, 2022, the Sign Review Board approved a request to remove the existing
nonconforming billboard sign and construct a new digital billboard on the property. A
condition of approval was to provide landscaping and irrigation on the property, including
shrubs and a planting bed of at least 200 square feet around the base of the column.
Burkett Media Management LLC has submitted an application for a second digital
billboard conversion for property located at the southwest corner of Boulevard 26 and NE
Loop 820. This application is a related item on the April 25, 2022, Sign Review Board
agenda (see SRB22-0003). During its evaluation of the new request, the Development
Review Committee (DRC) considered that landscaping improvements would be more
beneficial at the NE Loop 820 location to complement the design of the Boulevard 26
median improvements adjacent to the site. The DRC recommends that the landscaping
and irrigation requirement for the Airport Freeway site be removed so that substantial
enhancements could be made to the NE Loop 820 location.

Chair Trevino called on Planning Director Clayton Comstock to present the item.
Mr. Comstock informed the Board, the applicant is requesting a landscaping variance
and permit for nonconformity to Chapter 106 of the Code of Ordinances for a digital
billboard conversion on 0.07 acres located at 8650 Airport Freeway. Mr. Comstock
provided site photos of the property.
Applicant Beau Burkett, Austin, Texas, informed the Board Burkett Media is
requesting to replace the current sign with digital signage on both sides of the sign
and increase the height to 85 feet.
Mr. Comstock, provided a summary of the request and reviewed the Sign Code
Standards as well as proposed billboard signage, support structure, sign height
comparisons and landscaping standards. Mr. Comstock stated the Sign Review
Board approves billboard conversion or replacement. In 2011 the Texas Department
of Transportation (TxDOT) designated the City of North Richland Hills a Certified City
and the city may exercise control over commercial signs within the city limits through
Chapter 106. TxDOT approval is not required.
The board, applicant and staff discussed the landscape plan, Amber alerts, sign
heights and elevations of various signs in the city, managed lanes, landscaping
variances for the site and continued the sign height discussion.
