GENERAL DESCRIPTION:
The City Secretary's Office prepares action minutes for each City Council meeting. The
minutes for the previous meeting are placed on the consent agenda for review and
approval by the City Council, which contributes to a time efficient meeting. Upon
approval of the minutes, an electronic copy will be uploaded to the City's website.
RECOMMENDATION:

Mayor Trevino called the meeting to order at 6.02 p.m.
1. DISCUSS ITEMS FROM REGULAR CITY COUNCIL MEETING.
City Council had no questions for staff.
2. MID-YEAR FINANCIAL REPORT FOR THE PERIOD ENDING MARCH 31,
2022.
Director of Budget and Research Trudy Lewis reviewed the mid-year financial report for
the period ending March 31, 2022. Ms. Lewis reviewed the General Fund, Park

Development Fund, Crime Control District Fund and Utility Fund providing the following
year to date actuals.
General Fund
Revenue - $37,962,909 (69.97% of projected budget)
Expenditures - $24,975,956 (46.26% of projected budget)

Revenue - $5,185,856 (51.8% of projected budget)
Expenditures - $3,825,963 (38.45% of projected budget)
Crime Control District Fund
Revenue - $1,505,253 (52.05% of projected budget)

3. DISCUSSION OF THE CITY'S LOCAL OPTION HOMESTEAD EXEMPTION.
Director of Finance Mark Mills provided an overview of current property value trends and
an overview of the City's homestead exemption. The homestead exemption provides a
deduction for qualified properties, which lowers the appraised value of a residence for
the purpose of determining its taxable value. The City's current homestead exemption is
15%. Mr. Mills informed City Council that he and Director of Budget and Research
Trudy Lewis attended a meeting with the Tarrant Appraisal District for taxing entities. At
this meeting, Tarrant County's Chief Appraiser Jeff Law indicated that cities could expect
residential property values to significantly increase on average 20% across Tarrant
County. The following regional cities have a homestead exemptions Arlington (20%),
Euless (20%), Fort Worth (20%), Grapevine (20%), Hurst (20%), Keller (20%),
Southlake (20%), and Haltom City (10%). The cities of Bedford, Colleyville Richland
Hills, and Watauga do not offer homestead exemptions. Staff is seeking direction from
City Council whether to modify the local option homestead exemption. The examples
provided tonight are based on a 20% homestead exemption. The City Council may elect
to increase the exemption by 1% increments up to a maximum of 20%. If City Council
directs staff to move forward with an increase to the homestead exemption, staff will bring
forward an ordinance for approval in June. The Appraisal District and Tarrant County
must be notified prior to July 1.

litigation - In re North Richland Hills Alamo, LLC, Case No. 22-40384-elm11 , filed in the

Session began at 6.45 p.m. and concluded at 6.53 p.m.
Mayor Trevino announced at 6.53 p.m. that City Council would convene to the regular

Director of Finance Mark Mills introduced the item. Mr. Mills introduced Whitley Penn,
LLP representative Patrick Simmons who reviewed the results of the City's Fiscal Year
2021 Annual Comprehensive Financial Report ("ACFR"). Mr. Simmons shared that the
auditor's opinion of the City's financial statements is an unmodified opinion ("clean").

H.1 ANNOUNCEMENTS
Council member Mason Orr made the following announcements.
The Animal Adoption & Rescue Center will hold a Low-Cost Pet Vaccination Clinic on
Saturday, May 21 from 10.00 a.m. to noon. The clinic will provide rabies shots, booster
shots, city pet licenses and microchips. Please contact the animal shelter for pricing and
more information.
The NRH Senior Center is hosting a Health Fair on Wednesday, May 25. The event will
take place from 10.00 a.m. to 1.00 p.m. in the Grand Hall. In addition to free health
screenings, vendors will provide information on wills, trusts, estate planning, homecare,
rehabilitation centers, senior living and more. Please contact the Senior Center for more
information.
Kudos Korner - Elliott Huff, Wesley Becknal, Tristan Clarke, Brice Gardner and Jason
Davis with the Fire Department - A resident called in to let us know how proud she was of
the staff she rode out with at Fire Station 5. The professionalism and compassion they
showed to people in very difficult situations blew her away. She wanted to make sure
everyone knew what an exceptional job these employees were doing for the residents of
North Richland Hills.

SUBJECT: PLAT22-0019 Consideration of a request from Robert Nordyke for a
final plat of Lot 1, Block 1, Nordyke Estates, being 1.25 acres located
at 6613 Harmonson Road.
PRESENTER: Clayton Comstock, Planning Director
SUMMARY:
Robert Nordyke is requesting approval of a final plat of Nordyke Estates. This 1.25-acre
property is located at 6613 Harmonson Road.
GENERAL DESCRIPTION:
The property under consideration is a 1.25-acre site located on the north side of
Harmonson Road, between Rufe Snow Drive and Lochridge Court. The property is
adjacent to the Mackey Creek drainage channel. The site is developed with a single-
family residence and associated accessory buildings.
The proposed final plat is intended to create one single-family residential lot so that the
property is eligible for building permits for the construction of accessory buildings and
renovations to the house. The property is unplatted and has 90 feet of frontage on
Harmonson Road and is approximately 582 feet deep.
The property is zoned R-3 (Single-Family Residential). Part of the southeast portion of
the property is located in the floodplain and floodway of Mackey Creek. There is an
existing 18-inch sanitary sewer main line adjacent to the east property line, and a 12-inch
water main line adjacent to the west property line. An easement would be dedicated on
the plat to cover each of these utility lines.
LAND USE PLAN: This area is designated on the Land Use Plan as Low Density
Residential. This designation promotes quality neighborhoods of conventional suburban
single-family detached homes. General characteristics of these neighborhoods include a
density of two to six dwelling units per acre and houses of one- and two-stories.
CURRENT ZONING: The property is currently zoned R-3 (Single-Family Residential).
The R-3 district is intended to be a transitional zone between developments of lower and
higher densities or between lower density residential and nonresidential areas. It also
provides area for moderate density development of single-family detached dwelling units
constructed at an approximate density of 4.8 dwelling units per acre.

the conditions outlined in the Development Review Committee comments. The applicant
has revised the plat to address all conditions.
DRC REVIEW & RECOMMENDATION: The Development Review Committee (DRC)
recommends approval of the plat, which is in conformance with the subdivision
regulations and the zoning ordinance.

SUMMARY:
On behalf of Rushiti Enterprises LLC, GeoNav LLC is requesting approval of a replat of
Lots 3R1 and 3R2, Block 1, D.J. Anderson Addition. This 1.686-acre property is located
at 8517 Davis Boulevard.
GENERAL DESCRIPTION:
The site is located on the west side of Davis Boulevard just north of the intersection of
North Tarrant Parkway. The lot is developed with two commercial buildings, one of which
is occupied by Starwood Cafe. The applicant proposes to subdivide the property into two
lots.
The replat would make the following revisions to the previous plat.
1. The property would be subdivided into two lots. Lot 3R1 is 33,715 square feet in
size and developed with a commercial building. Lot 3R2 is 39,716 square feet in
size and is also developed with a commercial building (Starwood Cafe).
2. A common access easement would be added to both lots to provide circulation
through and between the properties.
The plat does not alter or remove any recorded covenants or restrictions, if any, on the
property.
As required by Section 212.015(f) of the Texas Local Government Code, written notice of
this replat will be mailed to each owner of the lots in the D.J. Anderson subdivision that
are within 200 feet of the lots being replatted. The notice is required to be sent no later
than 15 days after approval of the plat by City Council.
LAND USE PLAN: This area is designated on the Land Use Plan as Retail Commercial.
This designation provides sites for community and regional shopping centers, commercial
establishments, and employment centers. These sites are typically located on highways
and major thoroughfares at key intersections.
CURRENT ZONING: The property is currently zoned C-1 (Commercial). This district is
intended to provide for development of retail service and office uses principally serving

community and regional needs. The district should be located on the periphery of
residential neighborhoods and be confined to intersections of major arterial streets. It is

application and acceptance of allocated funds if awarded for the FY2022
Community Oriented Policing Services Hiring Program.

SUMMARY:
The Community Oriented Policing Services (COPS) has announced the FY2022 COPS Hiring
Program (CHP) application, which provides funding to law enforcement agencies to assist in the
hiring of law enforcement officers in an effort to increase community policing capacity and crime
prevention efforts. The Police Department will use the grant funds to increase the level of service
to our citizens with the addition of four uniformed patrol officers.
GENERAL DESCRIPTION:
The Police Department is seeking authorization to apply for and utilize grant funds offered through
the FY2022 COPS-CHP application to increase the level of patrol staffing by the addition of four
uniformed patrol officers. Public safety staffing levels require constant evaluation in order to
ensure sufficient personnel are available to meet the department's mission to preserve and protect
life and property and the department's vision to "provide an atmosphere where people feel safe,
secure, and acknowledged." Patrol officer staffing studies conducted in 2017 and 2022 both
stated the department's authorized staffing level was insufficient to meet projected service
demand. This request for four patrol officer FTEs will more closely align patrol staffing levels with
those recommended by the studies and provide more efficient and safer police services.
The FY2022 COPS-CHP is a three-year award program that will provide up to 75 percent funding
of the agency's entry-level police officer salary and fringe benefits. The total grant application will
be $500,000.00 and requires a 25 percent minimum local cash match and a fourth-year position
retention. Total program costs along with the cash match sharing will be phased in over the four-
year period.

The grant program will only cover the cost of a starting police officer position. However, due to
the type of work being proposed for this position it is anticipated that it will be filled by a senior
officer thereby increasing the City's portion. If approved, these positions would be available

WHEREAS, The City Council of North Richland Hills finds it is in the best interest of the
citizens of North Richland Hills to request the funds available under this
program to increase the level of service to our citizens with the addition of
four uniformed patrol officers; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
NORTH RICHLAND HILLS, TEXAS, THAT:
SECTION 1. The City Council of the City of North Richland Hills hereby finds that the
recitals set forth above are true and correct and are incorporated into this
Resolution as if written herein.
SECTION 2. The City Council of the City of North Richland Hills hereby authorizes and

Law enforcement has made significant improvements in its responses to people experiencing
mental health crises through the development of various models of crisis intervention team (CIT)
training, crisis triage centers, co-response teams, and embedded mental health and behavioral
services. The evolution of these approaches has improved the safety of law enforcement and
people in crisis. It has also resulted in the deflection of individuals with mental health needs away
from the criminal justice system and toward the services and care they need.
The Police Department is seeking authorization to apply for and utilize grant funds offered through
the FY2022 COPS-CIT application for the addition of a civilian Mental Health Coordinator position
as part of a new Crisis Intervention Team. By approaching the mental health crisis from a team
mindset, we should be able to both deliver better service to those that need it and bring together
all of the services we provide to those in our community, including ourselves,who need assistance
beyond traditional forms of guidance.
The FY2022 COPS-CIT award is two years (24 months) in duration for a maximum of $350,000
per award. There is no local match. If approved, this position would be available October 1, 2022.

of a request from Capital Real Estate Inc. to revise the PD (Planned
Development)for 8521 Davis Boulevard, being 2.09 acres described
as Lot 4, Block 1, D.J. Anderson Addition.

SUMMARY:
Capital Real Estate Inc. is requesting to revise the existing PD (Planned Development)
on 2.09 acres located at 8521 Davis Boulevard.
GENERAL DESCRIPTION:
The property under consideration is located on the west side of Davis Boulevard just north
of the North Tarrant Parkway intersection. The 92,000-square foot site is located behind
Starwood Cafe and a commercial building that front Davis Boulevard. The site is adjacent
to single-family residences in the Steeple Ridge subdivision on the north and west sides
and a City water tower on the south side.
The property is currently zoned PD (Nonresidential Planned Development). The zoning
was approved by City Council on January 14, 2013 (Ordinance 3233). The PD provides
for a base zoning district of 0-1 (Office) with an additional use allowance for a private
school with less than 100 students.
The site is currently developed with a 14,000-square-foot building occupied by E.A.
Young Academy, a private school. Other site improvements include parking areas, a
swimming pool, playground areas, and a screening wall adjacent to the residential
neighborhood. The school site does not have frontage on Davis Boulevard, but the site
has driveway access through the adjacent commercial site.
The applicant is requesting an amendment to the PD to add "child care center" as a
permitted use on the property. Although similar in use and operations, "private school"
and "day care center" are two separate uses on the City's Table of Permitted Uses. The
amendment is intended to accommodate Ili,ii„Il, ,lr, llsY, ,,,,,,,, ,q,u ,lr;y lyd as a new tenant in the
building. The lease for E.A. Young Academy is expiring and the school is relocating to
Roanoke. As part of the renovations to the property, the swimming pool and some

This designation encourages professional, medical, and administrative offices as well as

HILLS, TEXAS BY AMENDING THE PLANNED
DEVELOPMENT (PD) FOR 8521 DAVIS BOULEVARD
FOR THE PURPOSE OF ADDING CHILD CARE
CENTER AS A PERMITTED USE; PROVIDING THAT
THIS ORDINANCE SHALL BE CUMULATIVE OF ALL
ORDINANCES; PROVIDING FOR SEVERABILITY;
ESTABLISHING A PENALTY; PROVIDING FOR
SAVINGS; PROVIDING FOR PUBLICATION; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of North Richland Hills, Texas is a home-rule municipality located
in Tarrant County, Texas acting under its charter adopted by the electorate
pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of
the Local Government Code; and
WHEREAS, the Zoning Ordinance of the City of North Richland Hills regulates and
restricts the location and use of buildings, structures, and land for trade,
industry, residence, and other purposes, and provides for the establishment
of zoning districts of such number, shape, and area as may be best suited
to carry out these regulations; and
WHEREAS, the City Council has previously passed an ordinance adopting a
Comprehensive Land Use Plan Map as the primary document on which to
base all zoning, platting, and other land use decisions; and
WHEREAS, the Comprehensive Land Use Plan Map provides guidance for future
development in conformance with the adopted Comprehensive Land Use
Plan; and
WHEREAS, the City Council of the City of North Richland Hills previously approved a
nonresidential planned development for the property; and
WHEREAS, the owner of the property containing approximately 2.09 acres of land
located at 8521 Davis Boulevard (the "Property") has filed an application to
amend the planned development to add child care center as a permitted
use; and

WHEREAS, the Planning and Zoning Commission of the City of North Richland Hills,
Texas held a public hearing on May 19, 2022, and the City Council of the
City of North Richland Hills, Texas, held a public hearing on June 13, 2022,
with respect to the zoning change described herein; and
WHEREAS, the City has complied with all requirements of Chapter 211 of the Local
Government Code, the Zoning Ordinance of the City of North Richland Hills,
and all other laws dealing with notice, publication, and procedural
requirements for rezoning the Property; and
WHEREAS, upon review of the application, and after such public hearing, the City
Council finds that granting the request herein furthers the purpose of zoning
as set forth in the Zoning Ordinance of the City of North Richland Hills and
that the zoning change should be granted, subject to the conditions imposed
herein;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF NORTH RICHLAND HILLS, TEXAS:
Section 1: That the Zoning Ordinance of the City of North Richland Hills and planned
development for 8521 Davis Boulevard are hereby amended to revise the
development standards for the property, containing approximately 2.09
acres of land, as described and shown on Exhibit"A," attached hereto and
incorporated for all purposes.
Section 2: The City Council finds that the information submitted by the applicant
pursuant to the requirements of the Zoning Ordinance is sufficient to herein
approve the nonresidential planned development in accordance with the
requirements of the Planned Development (PD) District Land Use and
Development Regulations, set forth in Exhibit "B," and the Site Plan
Exhibits, set forth in Exhibit "C," both of which are attached hereto and
incorporated for all purposes.
Section 3: That the official zoning map of the City of North Richland Hills is amended
and the Planning Director is directed to revise the official zoning map to
reflect the approved PD (Planned Development) zoning, as set forth above.
Section 4: The use of the property described above shall be subject to all applicable
and pertinent ordinances of the City of North Richland Hills, all applicable
regulations contained in the Building and Land Use Regulations for the 0-
1 (Office) zoning district, and the additional zoning standards as set forth in
Exhibit "B."
Section 5: The zoning district as herein established has been made in accordance with
a comprehensive plan for the purpose of promoting the health, safety,
morals and general welfare of the community.

Section 6: This Ordinance shall be cumulative of all provisions of ordinances and of
the Code of Ordinances of the City of North Richland Hills, Texas, as
amended, except when the provisions of this Ordinance are in direct conflict
with the provisions of such ordinances and such code, in which event the
conflicting provisions of such ordinances and such code are hereby
repealed.
Section 7: It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses, and phrases of this Ordinance are
severable, and if any section, paragraph, sentence, clause, or phrase of this
Ordinance shall be declared unconstitutional by the valid judgment or
decree of any court of competent jurisdiction, such unconstitutionality shall
not affect any of the remaining sections, paragraphs, sentences, clauses,
and phrases of this Ordinance, since the same would have been enacted
by the City Council without the incorporation in this Ordinance of any such
unconstitutional section, paragraph, sentence, clause or phrase.
Section 8: Any person, firm or corporation violating any provision of the Zoning
Ordinance and the zoning map of the City of North Richland Hills as
amended hereby shall be deemed guilty of a misdemeanor and upon final
conviction thereof fined in an amount not to exceed Two Thousand Dollars
($2,000.00). Each day any such violation shall be allowed to continue shall
constitute a separate violation and punishable hereunder.
Section 9: All rights and remedies of the City of North Richland Hills are expressly
saved as to any and all violations of the provisions of any ordinances
governing zoning that have accrued at the time of the effective date of this
Ordinance; and, as to such accrued violations and all pending litigation, both
civil and criminal, whether pending in court or not, under such ordinances,
same shall not be affected by this Ordinance but may be prosecuted until
final disposition by the courts.
Section 10: The City Secretary is hereby authorized and directed to cause the
publication of the descriptive caption and penalty clause of this ordinance
two times.
Section 11: This ordinance shall be in full force and effect immediately following
publication as required by Section 10 hereof.
AND IT IS SO ORDAINED.

This Planned Development(PD) District must adhere to all the conditions of the North Richland Hills Code
of Ordinances,as amended,and adopt a base district of 0-1(Office).The following regulations are specific
to this PD district. Where these regulations conflict with or overlap another ordinance, easement,
covenant or deed restriction, the more stringent restriction will prevail.
A. Permitted Land Uses. Uses in this PD are limited to those permitted in the 0-1 (Office) zoning
district, as amended,with the addition of and subject to the following.
1. Child care center
2. Private school with less than 100 students
3. Any land use requiring a special use permit in the 0-1 (Office) zoning district, as
amended, is only allowed if a special use permit is issued for the use.
4. Any land use prohibited in the 0-1 (Office) zoning district, as amended, is also
prohibited.
B. Site development standards. Development of the property shall comply with the
development standards of the 0-1 (Office)zoning district and the standards described below.
1. The site improvements must be constructed as shown on the site plan attached as Exhibit
„C

2. Landscaping must be installed as shown on the site plan attached as Exhibit "C."
3. The following must be completed within six (6) months of the issuance of the certificate
of occupancy for the child care center.
a. The in-ground swimming pool must be demolished, filled, compacted, and
covered with natural turf.A grading permit must be issued before demolition work
is started.
b. All swimming pool accessories such as coping, ladders, diving boards, and similar
features must be removed from the property.
c. The ornamental metal fence on the northwest side of the in-ground swimming
pool area must be removed.
C. Amendments to Approved Planned Developments. An amendment or revision to the PD
district will be processed in the same manner as the original approval.The application for an
amendment or revision must include all land described in the original ordinance that
approved the PD district.
The city manager or designee may approve minor amendments or revisions to the standards
provided the amendment or revisions does not significantly:
1. Alter the basic relationship of the proposed uses to adjacent uses;
2. Change the uses approved;
3. Increase approved densities, height, site coverage, or floor areas;
4. Decrease on-site parking requirements;

Chair Welborn introduced the item, opened the public hearing, and called for
Planning Director Clayton Comstock to introduce the request. Mr. Comstock
introduced the request.
Chair Welborn called for the applicant to present the request.
Allison Morgan, Capital Real Estate Inc, 60 South Sixth Street, Minneapolis,
Minnesota, presented the request. She stated the E. A. Young Academy private
school was relocating to another city and that the Children's Courtyard child care
center would lease the building, which requires an amendment to the property
zoning. She indicated the swimming pool would be removed but no other site
improvements were planned.
Commissioner Luppy and the applicant discussed about the intended use of the
accessory building adjacent to the pool. The applicant stated the building would either
continue to use for restroom facilities or for storage for the child care center.
Chair Welborn called for Mr. Comstock to present the staff report. Mr. Comstock
presented the staff report.
Chair Welborn and Mr. Comstock discussed the proposed use and its potential
effects on alcoholic beverage sales in the area. Mr. Comstock noted that an initial
review of the alcoholic beverage code suggests that the child care center would not
affect the ability of adjacent restaurants to sell alcohol.
Commissioner Hoffa and Mr. Comstock discussed the differences between private
schools with limited enrollment and child care centers and their effects on alcoholic
beverage sales in the area.

SUMMARY:
Francisco and Melinda Zagal are requesting a zoning change from AG (Agricultural) to
R-2 (Single-Family Residential) on 0.23 acres located at 8408 Franklin Court.
GENERAL DESCRIPTION:
The property is located south of Shady Grove Road on the east side of Franklin Court.
The lot is part of the Thomas Peck Subdivision, which was platted in 1969. The lot is
currently vacant.
The applicant is requesting a zoning change to R-2 (Single-Family Residential) with the
intent to construct a new residence on the property. The 10,269-square foot lot has 81
feet of frontage on Franklin Court and is approximately 125 feet deep. While the property
is a platted lot, the owner would be responsible for installing any water and sanitary sewer
taps and associated impact fees.
While most of the lots on Franklin Court are zoned Agricultural, eight lots have been
rezoned to R-2 (Single-Family Residential). These properties were rezoned in 2002,
2011, 2014, 2019, 2020, and 2021 to accommodate the construction of new single-family
residences.
LAND USE PLAN: This area is designated on the Land Use Plan as Low Density
Residential. This designation promotes quality neighborhoods of conventional suburban
single-family detached homes. General characteristics of these neighborhoods include a
density of two to six dwelling units per acre and houses of one- and two-stories.
CURRENT ZONING: The property is currently zoned AG (Agricultural). The AG district is
intended to preserve lands best suited for agricultural use from encroachment of
incompatible uses, and to preserve in agricultural use, land suited to eventual
development into other uses pending proper timing for practical economical provisions of
utilities, major streets, schools, and other facilities so that reasonable development will
occur.

AN ORDINANCE OF THE CITY OF NORTH RICHLAND
HILLS, TEXAS AMENDING THE ZONING ORDINANCE
OF THE CITY OF NORTH RICHLAND HILLS, AND THE
ZONING MAP OF THE CITY OF NORTH RICHLAND
HILLS, TEXAS BY REZONING A 0.23-ACRE TRACT OF
LAND LOCATED AT 8408 FRANKLIN COURT FROM
AG (AGRICULTURAL) TO R-2 (SINGLE-FAMILY
RESIDENTIAL); PROVIDING THAT THIS ORDINANCE
SHALL BE CUMULATIVE OF ALL ORDINANCES;
PROVIDING FOR SEVERABILITY; ESTABLISHING A
PENALTY; PROVIDING FOR SAVINGS; PROVIDING
FOR PUBLICATION; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the City of North Richland Hills, Texas is a home-rule municipality located
in Tarrant County, Texas acting under its charter adopted by the electorate
pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of
the Local Government Code; and
WHEREAS, the Zoning Ordinance of the City of North Richland Hills regulates and
restricts the location and use of buildings, structures, and land for trade,
industry, residence, and other purposes, and provides for the establishment
of zoning districts of such number, shape, and area as may be best suited
to carry out these regulations; and
WHEREAS, the City Council has previously passed an ordinance adopting the
Vision203O Land Use Plan as the primary document on which to base all
zoning, platting, and other land use decisions; and
WHEREAS, the Vision203O Land Use Plan map provides guidance for future
development in conformance with the adopted Vision203O Land Use Plan;
and
WHEREAS, the owner of the property containing approximately 0.23 acres of land
located at 8408 Franklin Court (the "Property") has filed an application to
rezone the Property from its present classification of AG (Agricultural) to R-
2 (Single-Family Residential); and
WHEREAS, the Planning and Zoning Commission of the City of North Richland Hills,
Texas held a public hearing on May 19, 2022, and the City Council of the
City of North Richland Hills, Texas, held a public hearing on June 13, 20227
with respect to the zoning change described herein; and

WHEREAS, the City has complied with all requirements of Chapter 211 of the Local
Government Code, the Zoning Ordinance of the City of North Richland Hills,
and all other laws dealing with notice, publication, and procedural
requirements for rezoning the Property; and
WHEREAS, upon review of the application, and after such public hearing, the City
Council finds that granting the request herein furthers the purpose of zoning
as set forth in the Zoning Ordinance of the City of North Richland Hills and
that the zoning change should be granted, subject to the conditions imposed
herein;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF NORTH RICHLAND HILLS, TEXAS:
Section 1: That the Zoning Ordinance of the City of North Richland Hills is hereby
amended by rezoning from AG (Agricultural) to R-2 (Single-Family
Residential) 0.23 acres of property described as Lot 13, Thomas Peck
Subdivision, commonly referred to as 8408 Franklin Court, as described and
shown on Exhibit "A," attached hereto and incorporated for all purposes.
Section 2: That the official zoning map of the City of North Richland Hills is amended
and the Planning Director is directed to revise the official zoning map to
reflect the approved R-2 (Single-Family Residential) zoning, as set forth
above.
Section 3: The use of the property described above shall be subject to all applicable
regulations contained in the Building and Land Use Regulations and all
other applicable and pertinent ordinances of the City of North Richland Hills.
Section 4: The zoning district as herein established has been made in accordance with
a comprehensive plan for the purpose of promoting the health, safety,
morals and general welfare of the community.
Section 5: This Ordinance shall be cumulative of all provisions of ordinances and of
the Code of Ordinances of the City of North Richland Hills, Texas, as
amended, except when the provisions of this Ordinance are in direct conflict
with the provisions of such ordinances and such code, in which event the
conflicting provisions of such ordinances and such code are hereby
repealed.
Section 6: It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses, and phrases of this Ordinance are
severable, and if any section, paragraph, sentence, clause, or phrase of this
Ordinance shall be declared unconstitutional by the valid judgment or
decree of any court of competent jurisdiction, such unconstitutionality shall

not affect any of the remaining sections, paragraphs, sentences, clauses,
and phrases of this Ordinance, since the same would have been enacted
by the City Council without the incorporation in this Ordinance of any such
unconstitutional section, paragraph, sentence, clause or phrase.
Section 7: Any person, firm or corporation violating any provision of the Zoning
Ordinance and the zoning map of the City of North Richland Hills as
amended hereby shall be deemed guilty of a misdemeanor and upon final
conviction thereof fined in an amount not to exceed Two Thousand Dollars
($2,000.00). Each day any such violation shall be allowed to continue shall
constitute a separate violation and punishable hereunder.
Section 8: All rights and remedies of the City of North Richland Hills are expressly
saved as to any and all violations of the provisions of any ordinances
governing zoning that have accrued at the time of the effective date of this
Ordinance; and, as to such accrued violations and all pending litigation, both
civil and criminal, whether pending in court or not, under such ordinances,
same shall not be affected by this Ordinance but may be prosecuted until
final disposition by the courts.
Section 9: The City Secretary is hereby authorized and directed to cause the
publication of the descriptive caption and penalty clause of this ordinance
two times.
Section 10: This ordinance shall be in full force and effect immediately following
publication as required by Section 9 hereof.
AND IT IS SO ORDAINED.

SUMMARY:
Scott Wood is requesting a zoning change from R-3 (Single-Family Residential) to R-1-S
(Special Single-Family) on a 1.99-acre property located at 8104 Green Valley Drive.
GENERAL DESCRIPTION:
The property under consideration is a 1.99-acre lot located on the south side of Green
Valley Drive just west of Davis Boulevard. The site is developed with a single-family
residence. The lot is 200 feet wide and approximately 443 feet deep.
The applicant lives on the adjacent property at 8100 Green Valley Drive, which is zoned
R-1-S (Special Single-Family). He is requesting a zoning change on the property in
question with the intent to replat the property to incorporate the southern portion of the
site into his existing lot. The remaining portion of the property at 8104 Green Valley Drive
would be platted as a separate one-acre lot with the existing residence. The replat is a
related item on the June 13, 2022, agenda (see PLAT22-0018).
LAND USE PLAN: This area is designated on the Land Use Plan as Low Density
Residential. This designation promotes quality neighborhoods of conventional suburban
single-family detached homes. General characteristics of these neighborhoods include a
density of two to six dwelling units per acre and houses of one- and two-stories.
CURRENT ZONING: The property is currently zoned R-3 (Single-Family Residential).
The R-3 district is intended to be a transitional zone between developments of lower and
higher densities or between lower density residential and nonresidential areas. It also
provides area for moderate density development of single-family detached dwelling units
constructed at an approximate density of 4.8 dwelling units per acre.
PROPOSED ZONING: The proposed zoning is R-1-S (Special Single-Family). The R-1-
S zoning district is intended to provide areas for very low-density development of single-
family detached dwelling units that are constructed at an approximate density of one unit
per acre in a quasi-rural setting. The R-1-S district is specifically planned to allow for the
keeping of livestock in a residential setting.

HILLS, TEXAS BY REZONING A 1.99-ACRE TRACT OF
LAND LOCATED AT 8104 GREEN VALLEY DRIVE
FROM R-3 (SINGLE-FAMILY RESIDENTIAL) TO R-1-S
(SPECIAL SINGLE-FAMILY); PROVIDING THAT THIS
ORDINANCE SHALL BE CUMULATIVE OF ALL
ORDINANCES; PROVIDING FOR SEVERABILITY;
ESTABLISHING A PENALTY; PROVIDING FOR
SAVINGS; PROVIDING FOR PUBLICATION; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of North Richland Hills, Texas is a home-rule municipality located
in Tarrant County, Texas acting under its charter adopted by the electorate
pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of
the Local Government Code; and
WHEREAS, the Zoning Ordinance of the City of North Richland Hills regulates and
restricts the location and use of buildings, structures, and land for trade,
industry, residence, and other purposes, and provides for the establishment
of zoning districts of such number, shape, and area as may be best suited
to carry out these regulations; and
WHEREAS, the City Council has previously passed an ordinance adopting the
Vision203O Land Use Plan as the primary document on which to base all
zoning, platting, and other land use decisions; and
WHEREAS, the Vision203O Land Use Plan map provides guidance for future
development in conformance with the adopted Vision203O Land Use Plan;
and
WHEREAS, the owner of the property containing approximately 1.99 acres of land
located at 8104 Green Valley Drive (the "Property") has filed an application
to rezone the Property from its present classification of R-3 (Single-Family
Residential) to R-1-S (Special Single-Family); and
WHEREAS, the Planning and Zoning Commission of the City of North Richland Hills,
Texas held a public hearing on May 19, 2022, and the City Council of the
City of North Richland Hills, Texas, held a public hearing on June 13, 20227
with respect to the zoning change described herein; and

WHEREAS, the City has complied with all requirements of Chapter 211 of the Local
Government Code, the Zoning Ordinance of the City of North Richland Hills,
and all other laws dealing with notice, publication, and procedural
requirements for rezoning the Property; and
WHEREAS, upon review of the application, and after such public hearing, the City
Council finds that granting the request herein furthers the purpose of zoning
as set forth in the Zoning Ordinance of the City of North Richland Hills and
that the zoning change should be granted, subject to the conditions imposed
herein;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF NORTH RICHLAND HILLS, TEXAS:
Section 1: That the Zoning Ordinance of the City of North Richland Hills is hereby
amended by rezoning from R-3 (Single-Family Residential) to R-1-S
(Special Single-Family) 1.99 acres of property described as Lot 2, College
Acres Addition, commonly referred to as 8104 Green Valley Drive, as
described and shown on Exhibit "A," attached hereto and incorporated for
all purposes.
Section 2: That the official zoning map of the City of North Richland Hills is amended
and the Planning Director is directed to revise the official zoning map to
reflect the approved R-1-S (Special Single-Family) zoning, as set forth
above.
Section 3: The use of the property described above shall be subject to all applicable
regulations contained in the Building and Land Use Regulations and all
other applicable and pertinent ordinances of the City of North Richland Hills.
Section 4: The zoning district as herein established has been made in accordance with
a comprehensive plan for the purpose of promoting the health, safety,
morals and general welfare of the community.
Section 5: This Ordinance shall be cumulative of all provisions of ordinances and of
the Code of Ordinances of the City of North Richland Hills, Texas, as
amended, except when the provisions of this Ordinance are in direct conflict
with the provisions of such ordinances and such code, in which event the
conflicting provisions of such ordinances and such code are hereby
repealed.
Section 6: It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses, and phrases of this Ordinance are
severable, and if any section, paragraph, sentence, clause, or phrase of this
Ordinance shall be declared unconstitutional by the valid judgment or
Ordinance No. 3741

decree of any court of competent jurisdiction, such unconstitutionality shall
not affect any of the remaining sections, paragraphs, sentences, clauses,
and phrases of this Ordinance, since the same would have been enacted
by the City Council without the incorporation in this Ordinance of any such
unconstitutional section, paragraph, sentence, clause or phrase.
Section 7: Any person, firm or corporation violating any provision of the Zoning
Ordinance and the zoning map of the City of North Richland Hills as
amended hereby shall be deemed guilty of a misdemeanor and upon final
conviction thereof fined in an amount not to exceed Two Thousand Dollars
($2,000.00). Each day any such violation shall be allowed to continue shall
constitute a separate violation and punishable hereunder.
Section 8: All rights and remedies of the City of North Richland Hills are expressly
saved as to any and all violations of the provisions of any ordinances
governing zoning that have accrued at the time of the effective date of this
Ordinance; and, as to such accrued violations and all pending litigation, both
civil and criminal, whether pending in court or not, under such ordinances,
same shall not be affected by this Ordinance but may be prosecuted until
final disposition by the courts.
Section 9: The City Secretary is hereby authorized and directed to cause the
publication of the descriptive caption and penalty clause of this ordinance
two times.
Section 10: This ordinance shall be in full force and effect immediately following
publication as required by Section 9 hereof.
AND IT IS SO ORDAINED.

SUMMARY:
On behalf of RSST & J Real Estate LLC, Scott Wood is requesting approval of a replat of
Lots 2R and 3R, Block 1, College Acres Addition. This 4.004-acre property is located at
8100 and 8104 Green Valley Drive.
GENERAL DESCRIPTION:
The property under consideration consists of two lots located on the south side of Green
Valley Drive just west of Davis Boulevard. The lots are part of the College Acres Addition
originally platted in July 1960. Each lot is 200 feet wide and approximately 443 feet deep
and developed with a single-family residence.
The applicant intends to replat the property in order to incorporate the southern portion of
Lot 2 (8104 Green Valley Drive) into Lot 3 (8100 Green Valley Drive). The remaining
portion of Lot 3 would be platted as a separate one-acre lot with the existing residence.
Lot 3 is zoned R-1-S (Special Single-Family), but Lot 2 is zoned R-3 (Single-Family
Residential). In order to accommodate the proposed replat, the applicant is requesting a

SUBJECT: Consider Resolution 2022-023 authorizing a suspension of the
June 17, 2022 effective date of Oncor Electric Delivery's request to
increase rates
PRESENTER: Karen Manila, Assistant City Manager
SUMMARY:
Oncor Electric Delivery Company ("Oncor" or "the company") filed an application on or
about May 13, 2022 with cities retaining original jurisdiction seeking to increase system-
wide transmission and distribution rates by $251 million or approximately 4.5% over
present revenues. The company asks the city to approve an 11.2% increase in residential
rates and a 1.6% increase in street lighting rates. If approved, a residential customer
using 1300 kWh per month would see a bill increase of about $6.02 per month.
The attached resolution suspends the June 17, 2022 effective date of the company's rate
increase for the maximum period permitted by law to allow the city, working in conjunction
with the Steering Committee of Cities Served by Oncor, to evaluate the filing, determine
whether the filing complies with law, and if lawful, to determine what further strategy,
including settlement, to pursue.
GENERAL DESCRIPTION:
The City of North Richland Hills is a member of a 169-city coalition known as the Steering
Committee of Cities Served by Oncor ("Steering Committee"). The Steering Committee
has been in existence since the late 1980s. It took on a formal structure in the early 1990s
when cities served by the former TXU gave up their statutory right to rate case expense
reimbursement in exchange for higher franchise fee payments. Empowered by city
resolutions and funded by per capita assessments, the Steering Committee has been the
primary public interest advocate before the Public Utility Commission, the courts, and the
legislature on electric utility regulation matters for the last 30 years.
Although Oncor has increased rates many times over the past few years, this is the first
comprehensive base rate case for the company since March, 2017.
Resolution No. 2022-023 authorizes the city to suspend the rate change for 90 days after
the date that the rate change would otherwise be effective. The resolution refers to the
suspension period as "the maximum period allowed by law" rather than ending by a
specific date. This is because the company controls the effective date and can extend

the deadline for final city action to increase the time that the city retains jurisdiction if
necessary to reach settlement on the case.
The resolution also authorizes the Steering Committee, consistent with the city's
resolution approving membership in the Steering Committee, to act on behalf of the city
at the local level in settlement discussions, in preparation of a rate ordinance, on appeal
of the rate ordinance to the Public Utility Commission, and on appeal to the courts.
Negotiating clout and efficiency are enhanced by the city cooperating with the Steering
Committee in a common review and common purpose. Additionally, rate case expenses
are minimized when the Steering Committee hires one set of attorneys and experts who
work under the guidance and control of the Executive Committee of the Steering
Committee.
Also included in the resolution is reimbursement to the Steering Committee for its
reasonable rate case expenses. Legal counsel and consultants approved by the
Executive Committee of the Steering Committee will submit monthly invoices that will be
forwarded to Oncor for reimbursement. No individual city incurs liability for payment of
rate case expenses by adopting a suspension resolution.
Finally, the resolution cites that it was passed at a meeting that was open to the public
and that the consideration of the resolution was properly noticed, as well as provides that
both Oncor and Steering Committee counsel will be notified of the city's action by sending
a copy of the approved and signed resolution to certain designated individuals.

COMPANY AND DIRECT ANY NECESSARY LITIGATION AND
APPEALS; FINDING THAT THE MEETING AT WHICH THIS
RESOLUTION IS PASSED IS OPEN TO THE PUBLIC AS
REQUIRED BY LAW; REQUIRING NOTICE OF THIS
RESOLUTION TO THE COMPANY AND LEGAL COUNSEL FOR
THE STEERING COMMITTEE
WHEREAS, on or about May 13, 2022, Oncor Electric Delivery Company (Oncor),
pursuant to PURA §§ 33.001 and 36.001 filed with the City of North
Richland Hills a Statement of Intent to increase electric transmission and
distribution rates in all municipalities exercising original jurisdiction within
its service area effective June 17, 2022; and
WHEREAS, the City of North Richland Hills is a member of the Steering Committee of
Cities Served by Oncor ("Steering Committee") and will cooperate with the
169 similarly situated city members and other city participants in conducting
a review of the Company's application and to hire and direct legal counsel
and consultants and to prepare a common response and to negotiate with
the Company prior to getting reasonable rates and direct any necessary
litigation; and
WHEREAS, PURA § 36.108 grants local regulatory authorities the right to suspend the
effective date of proposed rate changes for ninety (90) days after the date
the rate change would otherwise be effective; and
WHEREAS, PURA § 33.023 provides that costs incurred by Cities in ratemaking
proceedings are to be reimbursed by the regulated utility.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND
HILLS, TEXAS:
SECTION 1. That the June 17, 2022 effective date of the rate request submitted by
Oncor on or about May 13, 2022, be suspended for the maximum period
allowed by law to permit adequate time to review the proposed changes
and to establish reasonable rates.

SECTION 2. As indicated in the City's resolution approving membership in the Steering
Committee, the Executive Committee of Steering Committee is authorized
to hire and direct legal counsel and consultants, negotiate with the
Company, make recommendations regarding reasonable rates, and to
intervene and direct any necessary administrative proceedings or court
litigation associated with an appeal of a rate ordinance and the rate case
filed with the City or Public Utility Commission.
SECTION 3. That the City's reasonable rate case expenses shall be reimbursed by
Oncor.
SECTION 4. That it is hereby officially found and determined that the meeting at which
this Resolution is passed is open to the public as required by law and the
public notice of the time, place, and purpose of said meeting was given as
required.

The City Council is requested to consider the nomination of Anthony Bridges to Place 6
and Jared Ross to ex-officio on the Planning and Zoning Commission and Capital
Improvement Advisory Committee.
GENERAL DESCRIPTION:
The city is in receipt of Gregory Hoffa's resignation from Place 6 on the Planning and
Zoning Commission and Capital Improvement Advisory Committee. The term for this
office expires June 30, 2022. Historically, the member serving as ex-officio is
recommended for appointment to a voting position on the Commission.
Associate Mayor Pro Tern Turnage recommends current ex-officio Anthony Bridges be
appointed to Place 6 on the Commission. The appointment of Mr. Bridges creates a
vacancy in the position of ex-officio on the Planning and Zoning Commission and Capital
Improvement Advisory Committee. Mayor Trevino recommends the appointment of Jared
Ross to ex-officio to fulfill the vacancy, term expiring June 30, 2022.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NORTH
RICHLAND HILLS; APPOINTING MEMBER(S) TO THE PLANNING
AND ZONING COMMISSION AND THE CAPITAL IMPROVEMENT
ADVISORY COMMITTEE; ESTABLISHING TERMS; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, City Council appoints members of the public to serve on various boards,
commissions, and committees; and
WHEREAS, appointed members serve a two-year term, unless appointed to fulfill an
unexpired term; and
WHEREAS, annual appointments coincide with City Council terms with Places 1, 37 57
and 7 being appointed in odd-numbered years and Places 2, 47 6, and
Mayoral appointments in even-numbered years; and
WHEREAS, each member serves until their successor has been duly appointed and
qualified; and
WHEREAS, Council desires to fulfill the vacancy in Place 6 and ex-officio on the
Planning and Zoning Commission and the Capital Improvement Advisory
Committee.
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
NORTH RICHLAND HILLS, TEXAS:
SECTION 1. The City Council hereby finds that the recitals set forth above are true and
correct and are incorporated into this Resolution as if written herein.
SECTION 2. The following members have been submitted for nomination and approved
by a majority of the City Council.

Jared Ross Ex-Officio Term expiring June 30, 2022
SECTION 3. This Resolution shall take effect and be in full force and effect from and after
the date of its adoption, and it is so resolved; and all Resolutions of the City
Council of the City in conflict herewith are hereby amended or repealed to
the extent of such conflict.

SUMMARY:
Accept public official Patrick Faram's resignation from City Council Place 5.
GENERAL DESCRIPTION:
The city is in receipt of Mr. Faram's written resignation from public office, dated June 6,
2022. Pursuant to Texas Election Code, Title 12, Chapter 201, the City Council is the
authority to act on a public official's resignation.
Section 201.023 of the Texas Election Code provides that a vacancy occurs the date the
resignation is accepted by the appropriate authority, "City Council", or on the eighth day
after the date of its receipt by the authority, whichever is earlier.
The resignation creates a vacancy on City Council that will be filled by a special election
on November 8, 2022. Staff will place an item on a future meeting to order a special
election to fulfill the vacancy for the office with a term expiring May 6, 2023, or until a
successor has been duly elected and qualified for the office.
RECOMMENDATION:
Accept public official Patrick Faram's resignation from City Council Place 5.

Kudos Korner:
Every Council Meeting, we spotlight our employees for the great things they do. Tonight
we recognize:
Jason Fitzwater and David Connor in the Facilities Department — On a recent
Friday evening, Jason and David were dispatched after hours to a water emergency at
a city facility. Water was leaking into multiple rooms and initial thoughts were a water
pipe had broken. Upon investigating, it was determined rainwater was being sucked into
the HVAC units and pushed into the facility. After determining the source of the
infiltration, Jason and David stayed to help clean up the water. Thanks to their quick
response, damage to the facility was minimized. Their actions reflect the city's core
values of responsibility, service and teamwork and are a testament to the caliber of staff
in the Facilities Department.
