ORDINANCE NO. 465
DOGS
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLA\D
HILLS, TEXAS:
SECTION 1. ANNUAL REGISTRATION ABOLISHED:
Any city ordinance to the contrary notwithstanding, there shall no
longer be any requirement to register dogs in the City of North Richland Hills,
nor to pay any registration fee. Any and all ordinances to the contrary are
hereby repealed insofar only as they require such registration or such fee,
provided however, nothing herein contained shall be deemed to affect any
requirement that dogs be vaccinated.
SECTION 2. VACCINATION:
All animals of the dog kind, more than seven (7) months old, within
the City Limits of the City are required to be immunized against rabies by
means of any approved standard vaccine for the prevention of rabies approved
by the Health Department of the City. Whosoever administers such vaccine shall
issue to the owner or person having said dog vaccinated a certificate of
vaccination stating the name of the owner, the address where the dog is kept,
description of the dog, date of the vaccination, the number of the rabies
vaccination tag and the kind of vaccine used. He shall also furnish to the
owner of such animal a metal tag on one side of which is stamped "Rabies
Vaccine Administered" or a similar phrase and the date of vaccination which
tag at all times shall be securely attached to a collar around the neck of the
animal or to a harness around the neck and body of the animal vaccinated.
SECTION 3. RUNNING AT LARGE:
It shall be unlawful for the owner or harborer of any dog to permit
such dog to run at large upon the streets, alleys, or any public place within
the City Limts unless such dog be at all times under control of said owner,
a member of said owner's iwmediate family or said owner's servant or agent,
by means of a leash or chain of sufficient strength and length to control the
actions of said dog. At all other times said dog shall be confined to the
premises of said o~!ner by substantial fence of sufficient strength and height
to prevent said dog from escaping therefrom, inside the house or secured on
said premises by leash consisting of a metal chain of sufficient strength to
prevent said dog from escaping from said premises and so arranged that said
dog will remain upon said premises when the leash is stretched to full strength.
SECTION 4. DUTY OF OFFICERS TO IMPOUND:
It shall be the duty of the Director of Public Health, the Chief of
Police, and/or any health officer or any police officer to cause to be taken
upon or impounded all animals of the dog kind loose or at large in violation
of the terms of this ordinance.

SECTION 5. RIGHT TO REDEEM:

The owner of any dog impounded under the terms of this ordinance shall
h~ve the right to redeem same, unless other\~ise provided, upon payment to the
poundmaster for each ani~al so redeemed, the sun of three do:lars ($3.00) pick
up fee, one dollar ($1.00) pound fee, and one dollar (51.CO) per day boarding
fee, and any fine. The sum so paid to the paundmaster shail be paid by him
into the City Treasury.
SECTION 6. TIME TO REDEEM:
All impounded dogs shall be redeemed within four (4) days after their
capture and impoundment and all such animals not redeemed within the said tiGe
may be given to a new owner. If no new owner be found, the dog so impounded
may be destroyed.
SECTION 7. VACCINATION OF REDEEMED DOGS:
All animals of said dog kind redeemed at the dog pound must be immedi-
ately vaccinated against rabies in accordance with the provisions of Section 2.
with the provisions of this ordinance, said owner must sign a statement giving
the name of the owner and the address where said dog shall be confined and
stating that he will have said dog vaccinated immediately in accordance with
the provisions provided for herein. Failure to have said dog vaccinated shall
be grounds for immediate return of said dog to the City Pound and said animal
may be destroyed or othen~ise disposed of and the failure to so comply with
the term shall constitute an offense under this ordinance and shall be punished
in accordance with Section 14. hereof.

SECTION 8. QUARANTINE OF DOGS EXPOSED TO RABIES:
Any animal of the dog kind that has rabies or symptoms thereof or is
suspected of having rabies or that has been exposed to rabies, in addition to
the provisions of Section 3., shall be immediately and securely confined in an
enclosed area protected from contact with other animals, both wild and domestic
and kept there under the supervision of the Department of Public Health or the
Police Department for a period of not less than fourteen (14) days.
SECTION 9. QUARANTINE OF RABID DOGS:
Any animal of the dog kind that has rabies or symptoms thereof, or
animal that bites, scratches, or otherwise attacts any person within the City
Limits, in addition to the provisions of Section 3., shall be immediately and
securely confined by the owner, or one having custody, in an enclosed area
protected from contact with other animals,both wild and domestic, for a period
of ten (10) days subject to inspection from time to time so as to be able to
determine whether said animal is affected by rabies; or said animal shall be
quarantined and held for a like time in any veterinary hospital approved by
the Health Department, or shall be held at the City Pound for ten (10) ¿~ys,
after which period of time and in the event such animal is determined to be
free from rabies, said animal may be returned to its o\vr.er, or if not claimed
thereafter may be given to another owner or .destroyed if a new owner cë~not be
found.

SECTION 10. REPORTING RABID DOGS:
It shall be the duty of the owner or harborer of the practicing
veterinarian to report to the Police Depart~ent all cases of rabies with
which he comes in contact or to which his attention has been directed. This
report shall be made immediately upon diagnosis or suspicion or such cases
of rabies.
SECTION 11. BARKING DOGS:
Any person who shall harbor or keep on his premises or in or about his
premises under his control, any dog or animal of the dog kind \r/hich by loud
or unusual barking or howling) shall cause the peace and quiet of the neighborhood
or the occupants of adjacent premises to be disturbed, shall be quilty of a
misdemeanor and upon conviction shall be fined in any sum not to exceed tviO
hundred dollars ($200.00), and a separate offense shall be deemed committed
upon each day during or on which a violation occurs or continues.
SECTION 12. RIGHT TO DESTROY UNLICENSED DOGS:
The Health Officer, the Chief of Police or any health officer or any
police officer shall have the right, but shall not be required~ to immediately
destroy or cause to be destroyed, any animal of the dog kind to which the
required vaccination tag is not attached as heretofore required, when such dog
cannot be caught for impoundment or when such animal is deemed to be dangerous
to the public.
SECTION 13. WILD ANIMALS:
(A) It shall be unlawful to keep or harbor any wild animal
within the City without a permit, excepting commercial
establishments dealing in the sale of these animals that
have proper zoning) for such a commercial enterprise
and that have proper facilities for restraint and care
of these animals.
(8) The Animal Warden and the City Manager or his assistant
may issue a permit to allow and establishing conditions
under which it would be permissible to keep or harbor
wild animals in the City.
SECTION 14. CREATING A HEALTH HAZARD:
Any person who shall harbor or keep on his premises or in or about
his premises under his control any dog or animal of the dog kind and who shall
allow his premises to become a hazard to the general health and welfare of the
community, or who shall allow his premises to give off noxious or offensive
odors due to the activity or presence of said animal (5) shall be guilty of a
misdemeanor and upon conviction shall be fined in accordance with Section 15.
hereof.

SECTION 15. PENALTY:
Any person violating the provisions of any of the foregoing Sections
pertaining to dogs shall be fined in any sum not to exceed tvlO hundred dollars
($200.00); provided that the provisions requiring pay~ent or tax shall not
apply to dogs following transients through the City.
