GENERAL ITEMS C.1 ZBA22-0004 PUBLIC HEARING AND CONSIDERATION OF A REQUEST FROM TOMMY CUNNINGHAM FOR A VARIANCE FROM SECTION 118-313 (LOT AND AREA REQUIREMENTS) OF THE NORTH RICHLAND HILLS ZONING ORDINANCE AT 1 COUNTRY PLACE DRIVE, BEING 1.26 ACRES DESCRIBED AS TRACT 7A2A, STEPHEN RICHARDSON SURVEY, ABSTRACT 1266. June 23, 2022 Zoning Board of Adjustment Meeting Minutes Page 2 of 4 Chair Duer read the rules and regulations of the Zoning Board of Adjustment. He stated since there are only four regular members present at the meeting, any action by the Board must be approved by a unanimous vote. Chair Duer opened the public hearing, and called for Principal Planner Clayton Husband to introduce the request. Mr. Husband introduced the request. Chair Duer called for the applicant to present the request and be sworn in prior to speaking. Tommy Cunningham, 2006 Nighthawk Court, Westlake, Texas, was sworn in by Chair Duer and presented the request. He described the plans for the property including rezoning, subdivision plat approval, and design of the house. He stated the lot is unusual since it has limited frontage on Country Place Drive and includes significant areas in the flood plain. He stated these factors make it difficult to situate a house on the property and he is seeking to establish a front building setback on the lot to allow for construction of the house. Chair Duer and the applicant discussed the floodplain on the property and the topographic survey of the lot. Chair Duer called for Principal Planner Clayton Husband to present the staff report. Mr. Husband presented the staff report. Chair Duer called for anyone wishing to speak for or against the request to come forward. There being no one else wishing to speak, Chair Duer closed the public hearing. A MOTION WAS MADE BY BOARD MEMBER KEMP, SECONDED BY BOARD MEMBER ELSTON, TO APPROVE BA22-0004 AND ESTABLISH A 25-FOOT FRONT BUILDING LINE AND 10-FOOT SIDE BUILDING LINES AS PRESENTED. THE MOTION CARRIED 4-0. D. PRESENTER: Clayton Comstock, Planning Director SUMMARY Norberto Saez is requesting approval of a variance to allow a swimming pool to be constructed on a corner lot in the side yard between the house and the street. The property is located at 8117 Beverly Drive. BACKGROUND INFORMATION The property is located at the northeast corner of Beverly 4 „ Drive and Grand View Drive. The lot is zoned R-2 (Single- Family Residential) and is developed with a single-family residence and detached garage constructed in 1999. The � R 12,510-square-foot lot is part of the Shady Oaks subdivision b ry which was platted in 1994. The lot is generally rectangular in { shape, with a curved west property line on Grand View Drive. The lot is 120 feet wide at the front and 75.5 feet wide at the rear, and it measures 120 feet deep at the center of the lot. The property is owned and occupied by the applicant. In August 2022, the owner applied for a building permit to construct a swimming pool in the side yard on the west side of the lot. As part of the plan review, it was noted that the pool did not comply with the location standards required by the zoning ordinance, which does not allow pools to be located in a side yard. The owner considered alternate locations for the pool in order to comply with the standards, such as the rear yard area in the northeast corner of the lot. However, the owner ultimately decided to seek a variance to allow the swimming pool to be constructed in the location as proposed. The variance application and supporting materials are attached. The materials include application information explaining the reasoning for the variance request and other relevant documents. An analysis of the request and relevant codes is below. ,VOL W IMMUMM "K NOKTH KICHLAND HILLS ANALYSIS The variance request is related to standards for swimming pools, which are contained in Section 1.1.8 7.22 (.��Jl m m I in 1s) of the zoning ordinance. ...................................................................................................................... .. . .. g ...............................................P.22.............. The lot in question is a corner lot located at the northeast corner of Beverly Drive and Grand View Drive. The pool would be constructed in the fenced side yard area on the west side of the lot between the house and Grand View Drive. While the typical corner lot in the R-2 (Single-Family Residential) zoning district is 80 feet wide and rectangular in shape, this lot is 120 feet wide due to the curve in Grand View Drive. The lot is 75 feet wide at the rear. The house was constructed on the eastern side of the lot, which left a larger than usual side yard adjacent to the street. In the rear yard is a detached garage that is connected to the house with a covered walkway. The exhibits below show the improvements on the lot and the proposed location of the swimming pool. .............. 101 01 ................ POOL LOCATION POOL DETAILS Given its proposed location on the property, the pool is does not comply with zoning ordinance requirements related to the location of swimming pools. The zoning ordinance does not permit swimming pools to be constructed in a front or side yard except on irregular and/or cul-de-sac lots. The zoning ordinance does not provide a definition or standard for determining if a lot is irregular in shape. However, an illustration in A ir.t..J..c.l..e 1I X. of the ordinance provides guidance for establishing building setbacks on odd-shaped lots, which are noted as pie-shaped, wedge-shaped, or lots with property lines that are not parallel to or not set at right angles to the front property line. Based on this guidance and a visual survey of other lots in the area, it was determined that the lot in question did not have the characteristics of an irregular-shaped lot. The situation causing the hardship or difficulty is neither self-imposed nor generally affecting all or most properties in the same zoning district. c. The relief sought will not injure the permitted use of adjacent conforming property. d. The granting of the variance will be in harmony with the spirit and purposes of these regulations. OPTIONS FOR BOARD CONSIDERATION The Zoning Board of Adjustment has the following options on this application. 1. Approve the variance as presented. This action would approve a variance to the swimming pool location standards and allow the pool to be constructed as presented. 2. Approve the variance with conditions. This action would approve a variance to the swimming pool location standards, subject to the owner making modifications to its size, location, or design as directed by the Board. 3. DESCRIPTION Position of the buildings(house and garage)on the property make installation of a pool in the backyard very difficult. Also,the curve of the street creates a very large side yard that has been fenced in and would be suitable for a pool. 1.
