The City Council of North Ri chla.nd Hills held a. regular Council meet- ing on December 12, 1960 at the City Office, 7109 Grapevine Hwy. and was called to order at 7:32 P. M. by Mayor Zellers with Councilmen Graner, Owens and Johns present, Councilmen Bell and Campbell absent. Mayor Zellers called upon Councilman Owens to give the Invocation. Mayor Zellers greeted the guests present and introduced the Council members and City employees after which, since there were no correct- ions or changes, the minuteR stood approved. Mr. R. L. Knowlton, City Engineer, brought before the Council an- other filing for the North Hills Addition and stated that as far as could be determined the contours and elevations shawn are correct and the area is above flood area. To ascertain its correctness, it would cost the City between $100.00 & $200.00 to have the area checked by Enginerrs. After discussion Mr. Johns moved that Council take no action until the Zoning Commission studies and investigates the plat and reports to Council with their recommendations. Mr. Owens second- ed and motion carried. After discussion concerning a bill supposedly for rewiring one of the fire trucks andMayor Zellers offering to write a letter to the Company concerned, Mr. Johns moved for the Mayor to write a letter to Tom Maggard Motors stating they had not lived up to their bid or agreement and that until they did Council refused to pay the invoice. Mr. Hamil- ton, Fire Chief, stated the bid was not in writing but that there were three persons who heard the terms agreed upon. Mr. Graner seconded the motion and it carried. Mr. Owens moved that all future bids taken be in wrl ting and in detail. Mr. Graner seconded and motion carried. Mayor Zellers told of two ordinances he had received from the State Highway Department and turned them over to the City Attorney for study and recommendations. After discussion concerning amending Ordinance No. 30 to include a two year term of office for the City Attorney, it was decided not to do so. Discussion concerning Ordinance No. 8 wherein the City Secretary serves as Corporation Court Clerk, Mr. Graner moved to amend Ordinance No.8 to state that the City Secretary shall appoint a deputy to serve as Court Clerk. Mr. Owens seconded and motion carrieª~JkUpon Mrs. Ray'e recommendation, Mr. Graner moved that Mrs. Dorothyfõe ~ppointed Deputy to the Court Clerk. Mr. Johns seconded and motion ca.rried. After discussion Mr. Graner moved that the City General Offices woulû be closed December 26th. and January 2nd. for the Christmas and New Years holidays. Mr. Johne seconded the motion which carried after which Mr. Graner moved to accept Judge Massey's request that Corpora- tion Court not be held December 24th. and Hr. Mr. Johns then moved to cancel the regular Council meeting of Decem- ber 26th. and Mr. Gr&ncr ceconded the motion which carried. Employee benefits as submitted by Chief Coe and Mr. French was out- lined ln part by the Mayor and since it would entail lengthy discuss- ion , it was decided to de fer unt il the end of the meet ing if t iiJie allowed. Mayor Zellers reported that Mr. Rich~ardAon would not let the City break the rental lease unless it paid all thc remaining eight months re nt B. . After discussion and explaination of penalties the City would have to pay, the Mayor recommended refunding to the City employees all monies withheld from their salaries since September 1, 1960, Mr. Graner moved to refund withholding and social security taxes withheld and as of January 1, 1961, start deductions once more. Mr. Owens second- eo and motion carried. Several petitions were presented by the Developer and citizens of ~he College Hl11s Addition concerning Pros and Cons of lowering the build- ing restrictions from l200 sq. Ft. to 1100 sq. Ft. Deed restrictions of the addition calls for 1100 Sq. Ft. At a Public Hearing in 1958 the Developer was informed changes would have to be made to conform with the City's ordinance ßnd nothing had been done. A building permit had been re- fused issuance becÐ.use of the square footege requirement. Mr. v.J. B. Campbell, Attorney representing Educator's Developers, spoke concern- ing this )::'cblem and asked Council to grant a verit-u:.ce to allow four proposed houses to be built which fall under the 1200 sq. Ft. re- quirement. Mr. Conner, Wade Banowsky, Mr. Goodnight, Mr. Bullard, Hr. Renfro and others all spoke for and e.gainst and after rather lengthy discussion, Mr. Owens moved that the question go through proper channels and a Public Hearing be ce.lled~ Mr. Gra.ner second- ed the motion which carried. Mr. Hamilton told of be.d leaks in tank of one fire truck and having to have it welded at a cost of $52.25. Mr. Owens moved for the City to paJr said bill. Mr. Graner 88conded and motion carried. Mr. Henfro rec)f.lmended further study into establishing Wards in our City. After disCDssil);:, Council felt tha.t any definate a.ction at this time would be premature but tha.t further study would not hurt. Chief Coe stated that Ordinance No. 80, Sections I & III confllct ~:ith state Laws and recommended that an amendment be drawn up. Mr. French showed Council a plat of the College Acres Addition re- platting eaid area. Mr. French recommended that as a result of a Public Hearing the. t the reque at to zone lot,'l of the revised plat as Local Retail Business and Class "B" for remaining lots. Mr. Graner moved to approve the second filing of the College Acres Addition revising ~lat with lot 1 as Local Retail Business and houses to con- form to Clasa "B" Residenta.!l or better.
