HomeMy WebLinkAboutCC 1961-04-10 Minutes Page 43 MINUTES OF THE MEETING OF THE CITY COUNCIL, NORTH RICHLAND HILLS, TEXAS, HELD AT 7:30 P. M., CITY OFFICES, MONDAY, APRIL 10, 1961. CALL TO ORDER AND ROLL CALL: Present: Mayor Zellers; Councilmen Bell, Johns, Campbell, Graner and Owens; also, Mayor-elect Hunter and·Councilmen-elect White and Terrell. Administrative Staff Present: City Attorney, City Inspector, Chief of Police, City Clerk, Electrical Inspector, Corporation CourtJudge and City Secretary. INVOCATION: Rev. Ted Spencer, Minister of the Davis Memorial Metho- dist Church. APPROVAL OF MINUTES: Mr. Johns moved to approve minutes of the last regular meeting as submitted. Mr. Owens seconded and motion carried 5-0. 1. PROSECUTION OF ILLEGAL VOTER. Mayor Zellers told of Dr. H. C. Allison voting absentee and also in person and that he would like for the City Attorney to prosecute before Judge Duvall in County Court. Mr. OWens moved that the City Attorney prosecute this case with Mr. campbell seconding and motion carried 5-0;: 2. VALIDATION OF ELECTION. Mayor Zellers read the election results as submitted by the head election judge, Mr. Frank Di Giovanni, and Mr. Bell moved election be validated and Mr. Campbell seconded and motion carried 5-0. (Proceedings taped and on file) Page 44 9. NOMINATION AND ELECTION OF V~YOR PRO TEM. Mr. Johns 'nominated Mr. Campbell as Mayor Pro Tem with Mr. Bell seconding. Mr. Terrell nominated Mr. Claude White with the Mayor seconding. The Mayor seconding brought up question of legality of the Mayor seconding or voting as a member of Council. Mr. Good- night read from Statutes No. 1007, V.A.T.S. ,and quoted Case: City of Centerville vs. Adkisson-291SWL, Page 798. and gave the legal opinion that as Mayor, the only time he could vote was to break a tie. After further discussion, Mayor Hunter ca'. led for a vote on fÄ¡" PIJ~c.f'- the nomination of Mr. Campbell. Messers. Johns.^ana. Bell voting !Qß, Messers. White and Terrell Dot voting. Motion carried. 10 TAX ADJUSTMENT, NO. 633. Mayor Hunter then read a tax adjustment sent for Council approval by Mr. James, Tax Assessor, and Mr. Bell moved to approve with Mr. Campbell seconding and motion carried 5-0. 11. ORDINANCE - RULES & REGULATIONS REGARDING AGENDA. (ORD. NO. 86) Mr. Goodnight presented an ordinance for study and approval of Council and explained reasons for approving this ordinance. Mr. Campbell stated he felt several times before in the past that such an ordinance was needed to have control over the agenda so that the members would have time for study and would als~ save much time. Mr. Terrell stated it seemed to him to be a good ordinance but want- ed time to study. Mayor Hunter said he thought it a good ordinance and Mr. Bell then moved to adopt said ordinance. Mr. Johns seconded and motion carried. Ordinance to be known as Ordinance No. 86. 12. MOTION TO ADJOURN. Mr. Campbell moved to adjourn at 9:05 P. M. Mr. White seconded and motion carried. APPROVED:
