McGinnis City Attorney CALL TO ORDER Mayor Trevino called the meeting to order at 6:00 p.m. 1. DISCUSS ITEMS FROM REGULAR CITY COUNCIL MEETING. City Council had no questions for staff. 2. WELCOME AND INTRODUCTION - PUBLIC OFFICIAL, PUBLIC EMPLOYEE, OR CITIZEN. Director of Parks and Recreation Adrien Pekurney introduced Park Planning Manager Michael Wilson. EXECUTIVE SESSION September 26, 2022 City Council Meeting Minutes Page 1 of 7 1. SECTION 551.074: PERSONNEL MATTERS TO DELIBERATE THE EMPLOYMENT, EVALUATION, AND DUTIES OF PUBLIC EMPLOYEES - MUNICIPAL COURT CLERK Mayor Trevino announced at 6:03 p.m. that the City Council would adjourn into Executive Session as authorized by Chapter 551, Texas Government Code, Section 551.074: Personnel matters to deliberate the employment, evaluation, and duties of public employees - Municipal Court Clerk. Executive Session began at 6:07 p.m. and concluded at 6:43 p.m. Mayor Trevino announced at 6:43 p.m. that City Council would convene to the regular City Council meeting. REGULAR MEETING A. McGinnis City Attorney A.1 INVOCATION Council member Wright Oujesky gave the invocation. A.2 PLEDGE Council member Wright Oujesksy led the Pledge of Allegiance to the United States and Texas flags. A.4 CITIZENS PRESENTATION Ms. Mona Harmon, 1709 Malibar Road, Fort Worth, Texas spoke on behalf of 12 people who were present to support the continued use of the Dan Enchols Center for their weekly jamboree. The following people were present Jeanette Chavez, 5640 Bogota Drive, North Richland Hills; Lou Chavez, 5640 Bogota Drive, North Richland Hills; Don Spears, 709 Kelly Terrace, Arlington; Patsy Seeton, 15 Los Colinas Court, Pantego; Linda Holllis, 5616 Marlene Drive, Haltom City; Nita Young, 3325 Willowcrest Drive, Apt 117, North Richland Hills; Vivian Jordan, 708 Sandlin Drive, Bedford; Betty Ann Murphy-Rivera, 209 Valley View Drive South, Colleyville; Donna Roland, 309 W. Pipeline Road, #232, Hurst; Shawn Smith, 1709 Malibar Road, Fort Worth; and Katherine Harmon, 1900 Savilla, Fort Worth; Kenneth Hollis, 5616 Marlene Drive, Haltom City. Mr. Paul Dillon, 6705 Hadley Drive, North Richland Hills, discussed the city's pickle ball court rules. He asked City Council to consider changing the court rules to promote open play. Mayor Trevino asked City Manager Mark Hindman and Director of Parks and Recreation Adrien Pekurney to speak with Ms. Harmon to discuss alternatives and respond to statement regarding deed restrictions. Mayor Trevino also asked Ms. Pekurney to visit with Mr. Dillon regarding rules for the pickle ball court. A.5 PUBLIC COMMENTS There were no requests to speak from the public. A.6 REMOVAL OF ITEM(S) FROM CONSENT AGENDA No items were removed from the consent agenda. B. CONSIDER APPROVAL OF CONSENT AGENDA ITEMS APPROVED A MOTION WAS MADE BY DEPUTY MAYOR PRO TEM DEUPREE, SECONDED BY COUNCIL MEMBER WRIGHT OUJESKY TO APPROVE THE CONSENT AGENDA. MOTION TO APPROVE CARRIED 5-0. B.1 APPROVE MINUTES OF THE SEPTEMBER 8, 2022 SPECIAL CITY COUNCIL MEETING. September 26, 2022 City Council Meeting Minutes Page 3of7 B.2 APPROVE MINUTES OF THE SEPTEMBER 12, 2022 REGULAR CITY COUNCIL MEETING. B.3 AUTHORIZE THE CITY MANAGER TO EXECUTE AN AMENDMENT AND RENEWAL OF THE NORTHEAST TARRANT TEEN COURT INTERLOCAL AGREEMENT WITH THE CITIES OF WATAUGA AND RICHLAND HILLS, FOR THE CONSOLIDATED TEEN COURT SERVICES PROGRAM. B.4 APPROVE AWARD OF RFP NO. 22-018 TO WHIRLIX DESIGN, INC. FOR THE REPLACEMENT OF PLAYGROUND EQUIPMENT AT CROSS TIMBERS PARK IN THE AMOUNT OF $189,480.00 AND AUTHORIZE THE CITY MANAGER TO EXECUTE THE ASSOCIATED CONSTRUCTION AGREEMENT. B.5 CONSIDER RESOLUTION NO. 2022-041, AUTHORIZING SUBMISSION OF THE GRANT APPLICATION AND ACCEPTANCE OF ALLOCATED FUNDS IF AWARDED FOR THE OFFICE OF THE GOVERNOR'S PUBLIC SAFETY OFFICE (PSO) FY2023 BULLET-RESISTANT SHIELD PROGRAM GRANT IN THE AMOUNT OF $61,974.44. B.6 AUTHORIZE THE PURCHASE OF ADDITIONAL PERSONAL PROTECTIVE EQUIPMENT (PPE) AND OTHER FIREFIGHTING EQUIPMENT USING A CITY CONTRACT WITH CASCO INDUSTRIES, INC., FOR A TOTAL INCREASED AMOUNT OF $39,041.80. PUBLIC WORKS E.1 APPROVE VOTING AND ALTERNATE MEMBERS TO THE FORT WORTH WHOLESALE CUSTOMER ADVISORY COMMITTEE FOR THE OCTOBER 1, 2022 TO THE SEPTEMBER 30, 2023 PERIOD. APPROVED Director of Public Works Caroline Waggoner presented the item. Staff is requesting City Council approve the appointment of Caroline Waggoner and Karen Manila as voting and alternate members to the Fort Worth Wholesale Customer Advisory Committee, respectively. The term of office is for a period of one year beginning October 1, 2022 September 26, 2022 City Council Meeting Minutes Page 4 of 7 through September 30, 2023. A MOTION WAS MADE BY COUNCIL MEMBER ORR, SECONDED BY COUNCIL MEMBER COMPTON TO APPROVE VOTING AND ALTERNATE MEMBERS TO THE FORT WORTH WHOLESALE CUSTOMER ADVISORY COMMITTEE FOR THE OCTOBER 1, 2022 TO THE SEPTEMBER 30,2023 PERIOD. MOTION TO APPROVE CARRIED 5-0. F. GENERAL ITEMS F.1 CONSIDER REIMBURSEMENT RESOLUTION NO. 2022-040 IN AN AMOUNT NOT TO EXCEED $14,450,000. APPROVED Director of Finance Mark Mills presented the item. Staff recommends City Council approve reimbursement Resolution No. 2022-040. The reimbursement resolution provides for payment of expenses associated with Fiscal Year 2022/2023 capital projects before the debt issuance is complete. Any interim funding required will be appropriated from existing reserves and repaid upon receipt of the bond proceeds. The reimbursement resolution is for the following projects. * street program supplemental funds - $5,000,000; * dump truck- $185,000; dump truck- $205,000; *fire engine - $985,000; * 24" transmission line - $3,075,000; and * cellular end point conversion - $4,855,000. MOTION TO APPROVE CARRIED 5-0. F.2 CONSIDER RESOLUTION NO. 2022-042, APPOINTING MEMBERS TO THE YOUTH ADVISORY COMMITTEE FOR THE 2022/2023 ACADEMIC YEAR. APPROVED Assistant to the City Manager Billy Owens presented the item. Staff is recommending the appointment of the following individuals to the Youth Advisory Committee. EXECUTIVE SESSION ITEMS - CITY COUNCIL MAY TAKE ACTION ON ANY ITEM DISCUSSED IN EXECUTIVE SESSION LISTED ON WORK SESSION AGENDA APPROVED A MOTION WAS MADE BY COUNCIL MEMBER WRIGHT OUJESKY, SECONDED BY COUNCIL MEMBER ORR TO APPROVE THE SIXTH AMENDMENT TO THE EMPLOYMENT CONTRACT WITH MUNICIPAL COURT CLERK REBECCA VINSON, AS DISCUSSED IN EXECUTIVE SESSION. MOTION TO APPROVE CARRIED 5-0. H. INFORMATION AND REPORTS H.1 ANNOUNCEMENTS Mayor Pro Tern Rodriguez made the following announcements. Keep NRH Beautiful is holding its annual Trash Bash Litter Cleanup Event on Saturday, October 1, 2022. Volunteers of all ages are encouraged to participate. Following the clean-up, there will be a volunteer luncheon with food and fun activities for both children and adults. Please visit the city's website to sign up. National Night Out is coming up on Tuesday, October 4, 2022. If you will be hosting a National Night Out block party, please register your event in advance so city officials can plan to attend. September 26, 2022 City Council Meeting Minutes Page 6 of 7 Kudos Korner - Wayne Estep and Robert Raley in Public Works - A senior citizen called to share her appreciation and praise for the city employees who assisted her. She said they were working nearby and came over to help her turn off water to her leaking irrigation system. "This is exactly what our society needs to be like--I am proud to live here," she said. I.
