EXECUTIVE SESSION
The Planning and Zoning Commission may enter into closed Executive
Session as authorized by Chapter 551, Texas Government Code. Executive
Session may be held at the end of the Regular Session or at any time during
the meeting that a need arises for the Planning and Zoning Commission to
seek advice from the city attorney (551.071) as to the posted subject matter of
this Planning and Zoning Commission meeting.
The Planning and Zoning Commission may confer privately with its attorney to
seek legal advice on any matter listed on the agenda or on any matter in
which the duty of the attorney to the governmental body under the Texas
Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly

Chair Welborn stated that for item C.1 the property owner has requested to withdraw
this case from consideration, and that action by the Commission is not required for
this item. He stated the case is brought back for action in the future, it will be
re-advertised for public hearing, which would include mailing required notices to
property owners.

C.2 ZC22-0040 PUBLIC HEARING AND CONSIDERATION OF A REQUEST

Chair Welborn stated since they are related items on the same property, items C.2,
C.3, and D.1 would be presented together, but the Commission would take action on
each one separately.

Ben Loibl, 8900 Kirk Lane, North Richland Hills, Texas, presented the request. He
stated he is requesting rezoning of the property to R-1-S in order to plat the property
and apply for building permits for an accessory building and future renovations to the
house. He stated the building would house his collector cars, recreational and sports
vehicles, woodworking equipment, and gym equipment.
Chair Welborn, Ex-Officio Ross and the applicant discussed the existing accessory
building on his adjacent property, including the use and size of the building.
Chair Welborn called for Mr. Husband to present the staff report. Mr. Husband
presented the staff report.
Commissioner Stamps and Mr. Husband discussed the plat and right-of-way width of
Kirk Lane.
Chair Welborn and Mr. Husband discussed the proposed setbacks for the building
and the exterior building materials.
Chair Welborn called for anyone wishing to speak for or against the request to come
forward.
Luke Steinbrink, 8625 Rumfield Road, North Richland Hills, Texas, spoke in favor of
the request.
Chair Welborn called for anyone wishing to speak for or against the request to come
forward. There being no one else wishing to speak, Chair Welborn closed the public
hearing.
Mr. Husband stated that two emails in opposition to the request were received
following publication of the agenda.

the property.

SUMMARY:
Abcons Corporation is requesting a revised special use permit for a hotel on 2.83 acres
located at 9020 Grand Avenue.
GENERAL DESCRIPTION:
The property is located at the east corner of Grand Avenue and Walker Boulevard, across
from Stormy Plaza and The Venue at HomeTown, and adjacent to the Northeast Crossing
shopping center. The property is currently vacant. The applicant proposes to develop a
hotel on the site.
The property is currently zoned TC (Town Center). A special use permit for a hotel was
approved by City Council on December 10, 2018 (Ordinance 3553). The special use
permit included site development and operational standards associated with a four-story
Marriot Town Place Suites hotel. The application under consideration would make the
following revisions to the special use permit standards.
1. The number of guest rooms would be increased from 120 rooms to 130 rooms.
2. The swimming pool would be relocated from indoor to an outdoor location behind
the building. This revision would also result in a modified building footprint that
eliminates a vehicle entrance on Walker Boulevard, directing traffic flow to the rear
of the property.
The proposed conditions of approval for this revised special use permit are attached.
These conditions were approved as part of Ordinance 3553, with the addition of the
revisions discussed above. Since this is a proposed amendment to the overall special
use permit, these conditions may be modified throughout the public hearing process, but
they are subject to final approval by City Council.

PREVIOUSLY APPROVED CONCEPT PLAN PROPOSED CONCEPT PLAN REVISION
LAND USE PLAN: This area is designated on the Land Use Plan as Urban Village. This
designation promotes sustainable, pedestrian-oriented, mixed-use development that
provides the opportunity for many uses to coexist within a compact area. Urban Villages
encourage an efficient, compact land use pattern; support vibrant public spaces; reduce
the reliance on private automobiles; promote a functional and attractive community using
recognized principles of urban design; allow flexibility in land use; and prescribe a high
level of detail in building design and form. Urban Villages can come in the form of vertical
mixed use, where multiple uses share a single multi-story building; or horizontal mixed
use, where a diverse set of uses are placed within close, walkable proximity.
CURRENT ZONING: The property is currently zoned TC (Town Center) and is in the
Neighborhood Core subzone. This subzone is the business, service, and institutional
center of the district. It straddles thoroughfares at the most active intersections and is
usually in walking distance of a substantial residential population. It allows for a mix of
uses, including residential and nonresidential uses in the same building.

Special Use Permit Case ZC22-0030

This Special Use Permit (SUP) shall adhere to all the conditions of the North Richland Hills Code
of Ordinances, as amended, and the base zoning district of TC (Town Center). The following
regulations shall be specific to this Special Use Permit. Where these regulations conflict with or
overlap another ordinance, easement, covenant or deed restriction, the more stringent
restriction shall prevail.
A. Permitted uses. The uses authorized by this Special Use Permit shall be limited the following:
1. Hotel
B. Site development standards. Development of the property shall comply with the
development standards of the TC Town Center zoning district and the standards described
below.
1. Building location, appearance of the building, and general lot landscaping must be as
shown on the concept plan and conceptual elevations attached as Exhibit "C."
2. The maximum number of guest rooms allowed is one hundred thirty (130) rooms.
3. The use of street fagade-or window-mounted HVAC units is not permitted.
4. The hotel must include the following amenities: pool, indoor gym, common area dining
room, and business meeting room(s).
C. Operational standards. The operation of the hotel must comply with the standards described
below.
1. This special use permit is for the TownePlace Suites by Marriott name or brand only.
Any name or brand change will require approval of a revised special use permit.
2. The hotel owner/operator must join and be a member of the Town Center Property
Owners Association.
D. Administrative Approval of Site Plans. The development is subject to final approval of a site
plan package. Site plans that comply with all development-related ordinances, Town Center
Design Guidelines, and this Ordinance may be administratively approved by the Town Center
Architect, Town Center Design Review Board, and City Development Review Committee.
The city manager or designee may approve minor amendments or revisions to the Special
Use Permit standards provided the amendment or revisions does not significantly:
1. Alter the basic relationship of the proposed uses to adjacent uses;

SUMMARY:
On behalf of Sandcap Davis-N Tarrant LLC (owner) and SimonCRE JC Agave V, LLC
(developer), Harrison French & Associates is requesting a special use permit for a quick
service restaurant on 1.001 acres located at 8376 Davis Boulevard.
GENERAL DESCRIPTION:
The property is located on the east side of Davis Boulevard and south of North Tarrant
Parkway. The site is vacant and located in front of the B&B Theatres location opening
soon. The developer proposes to develop a site for a new.Il,;?',I clh,lf;Z glh,C.offee quick service
restaurant with drive-through service.
A site plan package for the property is attached. Planned improvements to the site include
construction of a new 1,984-square-foot building with drive-through service. The zoning
ordinance requires special use permit approval for a quick service restaurant. The
ordinance also includes specific standards for the design and layout of drive-through
lanes, and the proposed project satisfies those design standards.
Landscaped areas cover 27% of the lot. These areas include a 15-foot-wide landscape
setback adjacent to Davis Boulevard, parking lot islands, landscaped areas adjacent to
the drive-through lane, and a landscape buffer between the drive-through lane and
adjacent cinema property.
The parking lot contains 20 parking spaces and vehicle stacking for 10 cars in the drive-
through lane. The site has access to Davis Boulevard and North Tarrant Parkway through
common access easements on all adjacent lots. These easements connect to existing
driveways on both roads.
The proposed conditions of approval for this special use permit are attached. Applications
for special use permits provide an opportunity to address modifications to specific site
development and building design standards for the site. These conditions are based on

the applicant's proposed development of the property. These conditions may be modified
throughout the public hearing process, but they are subject to final approval by City
Council.
LAND USE PLAN: This area is designated on the Land Use Plan as Retail Commercial.
This category provides sites for community and regional shopping centers, commercial
establishments, and employment centers.
CURRENT ZONING: The property is currently zoned C-1 (Commercial). This district is
intended to permit a variety of retail trade, personal and business services
establishments, and offices principally serving community and regional needs. The district
should be located on the periphery of residential neighborhoods and at intersections of
major arterial streets. It is also appropriate for major retail corridors.

This Special Use Permit (SUP) must adhere to all the conditions of the North Richland Hills Code
of Ordinances, as amended, and the base zoning district of C-1 (Commercial). The following
regulations shall be specific to this Special Use Permit. Where these regulations conflict with or
overlap another ordinance, easement, covenant or deed restriction, the more stringent
restriction shall prevail.
A. Permitted land uses. A special use permit is authorized for a quick service restaurant on the
property.
B. Site development standards. Development of the property must comply with the
development standards of the C-1 (Commercial) zoning district and the standards described
below.
1. The site improvements must be constructed as shown on the site plan attached as Exhibit
„C

2. Landscaping must be installed as shown on the site plan attached as Exhibit "C." All trees
planted on site must be container-grown trees.
3. The drive-through components on the site must comply with Section 118-633(26) of the
zoning ordinance.
C. Building design standards. Building design and appearance must comply with the building
elevations attached as Exhibit "C" and the standards described below.
1. The quick service restaurant must be at least one thousand nine hundred fifty (1,950)
square feet in floor area.
2. Signs on the site must comply with Chapter 106 (Signs) of the Code of Ordinances.
D. Expiration. The special use permit will expire three (3) years from the effective date of this
ordinance. If the quick service restaurant is still in operation at the time of expiration, the
business shall be considered a legal non-conforming use and may continue operation subject
to the standards described in Section 118-153 of the zoning ordinance.
E. Amendments to Approved Special Use Permits. An amendment or revision to the special use
permit will be processed in the same manner as the original approval. The application for an
amendment or revision must include all land described in the original ordinance that
approved the special use permit.
F. Administrative Approval of Site Plans. The development is subject to final approval of a site
plan package. Site plans that comply with all development-related ordinances, and this
Ordinance may be administratively approved by the Development Review Committee.
The city manager or designee may approve minor amendments or revisions to the standards
provided the amendment or revisions does not significantly:
1. Alter the basic relationship of the proposed uses to adjacent uses;
2. Change the uses approved;

SUMMARY:
Fort Worth Christian School is requesting a special use permit for outdoor recreation
areas with elevated lights on 41.07 acres located at 6200 Holiday Lane.
GENERAL DESCRIPTION:
The property is located on the south side of Holiday Lane and south of Mid-Cities
Boulevard. The 41-acre site is bounded by Holiday Lane, Bogart Drive, and College
Circle. The property is currently developed with a private school campus serving
elementary through high school students. The campus consists of multiple buildings and
athletic fields. The property is zoned U (School, Church, and Institutional).
A site plan and conceptual master plan for the campus are attached. The applicant is
seeking approval to install elevated lighting at one existing ballfield location and one new
proposed sport court on the property. Special use permit approval is required for any
outdoor recreation areas with or without elevated lighting installed.
The elevated lighting is proposed at the following locations as described and shown in
the exhibits below.
1. The existing softball field is located on the north side of the campus adjacent to the
drive entrance on Holiday Lane. Four light poles with LED luminaires are proposed
for construction. A pole would be installed at each outfield corner, with the highest
luminaires mounted at 70 feet above grade. A pole would be installed behind both
sides of the infield area, with the highest luminaires mounted at 60 feet above
grade. Overall, 25 luminaires would be installed at the softball field.
2. Tennis courts are proposed to be constructed at a future date in the northeast
corner of the campus near the intersection of Holiday Lane and College Circle.
Planned construction includes eight tennis courts divided into two court
enclosures. Eight poles with LED luminaires would be installed at the corner of

luminaires would be installed at the tennis court area.

CONCEPTUAL MASTER PLAN SOFTBALL AND TENNIS COURT AREAS
Outdoor lighting must comply with the standards contained in S.:e c,t ii „itn,,,,.......1,11, ......, , , „ of the
zoning ordinance. One of the purposes of these standards is to minimize adverse offsite
effects of lighting such as light trespass and glare. To evaluate that purpose, a
photometric plan for the proposed lighting design was submitted with the application and
is included in the attached special use permit exhibits. The plan includes the location for
the proposed lighting and a data sheet showing light emissions across the area and at
the property lines.
Since the lighting is adjacent to Holiday Lane and College Circle and close to single-family
residences, the lighting must be designed to limit light trespass on to adjacent roadways
and residential property. The lighting design indicates the illumination at the street is one
foot-candle or less, which is consistent with the outdoor lighting standards.
The proposed conditions of approval for this special use permit are attached. Applications
for special use permits provide an opportunity to address modifications to specific site
development and building design standards for the site. These conditions are based on
the applicant's proposed development of the property. These conditions may be modified
throughout the public hearing process, but they are subject to final approval by City

Services. This designation provides for nonprofit activities of an educational, religious,
governmental, or institutional nature. Schools, churches, hospitals, government buildings,
fire stations, and public utilities are examples of community service areas.

Institutional). This district is intended to permit nonprofit activities associated with

Lot 1, Block 1, Fort Worth Christian School Addition

This Special Use Permit (SUP) must adhere to all the conditions of the North Richland Hills Code
of Ordinances, as amended, and the base zoning district of U (school, Church, and Institutional).
The following regulations shall be specific to this Special Use Permit. Where these regulations
conflict with or overlap another ordinance, easement, covenant or deed restriction, the more
stringent restriction shall prevail.
A. Permitted land uses. A special use permit is authorized for elevated lights associated with the
softball field and tennis courts.
B. Site development standards. Development of the property must comply with the
development standards of the U (school, Church, and Institutional) zoning district and the
standards described below.
1. The site improvements must be constructed as shown on the site plan attached as Exhibit
„C
.11
2. The elevated lighting on the site must comply with Section 118-728 (Outdoor lighting) of
the zoning ordinance.
3. The mounting height of luminaires at the softball field must not exceed seventy (70) feet
above grade.
4. The mounting height of luminaires at the tennis courts must not exceed sixty (60) feet
above grade.
C. Expiration. The special use permit will expire three (3) years from the effective date of this
ordinance. If the elevated lighting is still in operation at the time of expiration, the use shall
be considered a legal non-conforming use and may continue operation subject to the
standards described in Section 118-153 of the zoning ordinance.
D. Amendments to Approved Special Use Permits. An amendment or revision to the special use
permit will be processed in the same manner as the original approval. The application for an
amendment or revision must include all land described in the original ordinance that
approved the special use permit.
E. Administrative Approval of Site Plans. The development is subject to final approval of a site
plan package. Site plans that comply with all development-related ordinances, and this
Ordinance may be administratively approved by the Development Review Committee.
The city manager or designee may approve minor amendments or revisions to the standards
provided the amendment or revisions does not significantly:
1. Alter the basic relationship of the proposed uses to adjacent uses;
2. Change the uses approved;
3. Increase approved densities, height, site coverage, or floor areas;
4. Decrease on-site parking requirements;
