Husband to introduce the item.
Chair Trevino abstained from the discussion of the item and left the Council Chamber at
7.41 p.m.
Acting Chair Rodriguez opened the public hearing and called on Principal Planner
Clayton Husband to introduce the item.
Mr. Husband informed the Board the applicant is requesting a variance from the size
standards for monument signs. The site is located at 7804 Mid-Cities Boulevard.
Applicant Jay Bruner Senior Pastor at Center Point Church, 7804 Mid-Cities Boulevard,
informed the Board that over time the newly planted trees have grown and in addition the
utility poles and lines has decreased the sight availability for the church sign. Although
the sign requested is larger than allowed by city ordinance, the applicant believes the
sign will complement the area.
Mr. Husband presented staff's report. The site is located at the southwest corner of
Mid-Cities Boulevard and Smithfield Road. The property has frontage on these streets as
well as Abbott Avenue on the west. The site is currently developed with a
23,570-square-foot church building and associated parking, the site has landscaping and
other site improvements, primarily on the western portion of the site.
In May 2022, the owner applied for a sign permit to construct a new monument sign at
the southwest corner of Mid-Cities Boulevard and Smithfield Road. As part of the plan
review, it was noted that the sign structure and message area were larger than permitted
by the sign regulations. The owner considered modifications to the size in order to
comply with the standards. However, the owner ultimately decided to seek a variance to

allow the sign as proposed. Mr. Husband showed comparative signs to the one being
requested.
Acting Chair Rodriguez asked the City Secretary to call on those who completed a public
meeting appearance form to speak during the public hearing. There being no forms
submitted, Acting Chair Rodriguez asked if there was anyone in the audience wishing to
speak for or against the item to come forward. There being no one wishing to speak,
Acting Chair Rodriguez closed the public hearing.

SUBJECT: SRB22-0005 Consideration of a request from Clear Channel LLC for
a permit for nonconformity to Chapter 106 (Signs) of the North
Richland Hills Code of Ordinances to allow a digital billboard
conversion at 8101 Glenview Drive and 4120 Glenview Court, being
0.844 acres described as Lot 1A, Block 2, Towne Oaks Addition, and
Tract 1, William Wallace Survey, Abstract 1606.

SUMMARY:
On behalf of Clear Channel LLC, Teresa Moore is requesting a permit for nonconformity
to Chapter 106 (Signs) of the North Richland Hills Code of Ordinances. The applicant is
requesting to convert an existing billboard sign to a digital billboard sign at 8101 Glenview
Drive.
GENERAL DESCRIPTION:
The property is located at the northwest corner of NE Loop 820 and Glenview Drive. The
billboard sign is situated near the frontage road and between the two buildings on the
property. The 38,507-square-foot property is zoned LR (Local Retail).
Clear Channel LLC is requesting approval of a permit to remove the existing
nonconforming billboard sign and construct a digital billboard on the property. The
application and supporting materials are attached. The materials include pertinent
information and correspondence, a site survey, a site plan, construction drawings, color
image exhibits of the proposed sign, and other relevant documents.
Section 106-9 of the Signs chapter of the North Richland Hills City Code of Ordinances
allows the Sign Review Board to authorize the reconstruction or relocation of a
nonconforming billboard, including its conversion to digital technology. Digital billboards
may only replace existing nonconforming off-premise billboards located on nonresidential
lots that have frontage on NE Loop 820 and State Highway 121. Subsequent approval by
the Texas Department of Transportation (TxDOT) is not required for the digital billboard.
The City of North Richland Hills is a TxDOT Certified City since 2011, and may exercise
control over commercial signs within the city limits. A permit issued by the City is
acceptable instead of a permit issued by TxDOT within the certified area.
Digital billboards are subject to certain design standards required by Section 106-12(b)
of the Sign chapter. The following is a summary of the primary design standards
associated with the request. A complete copy of the standards is attached for reference.

Sign Area
Billboard signs are limited to 672 square feet in total display area. The proposed digital
billboard meets this with this standard, measuring 14 feet in height and 48 feet in width.
Sign Height
The maximum height permitted for digital billboards is based on the grade level of the
main traveled way closest to the sign. The height limit must not exceed an overall height
of 42.5 feet from the centerline of the main traveled way.
The overall height of the billboard is proposed to remain the same. The billboard is 60
feet in height as measured from the grade of the frontage road, and approximately 35 feet
above the main traveled way on NE Loop 820.

Support structure
The support structure for digital billboards must be clad in a
decorative material consisting of brick, stone, or other

approved masonry material. The use of EIFS is not an
approved finish material. The proposed billboard complies
with this standard. An example of this material is shown at
right and is consistent with the Freeway Corridor Urban
Design Plan for integrating stone elements into the corridor
parkways and medians.
Illumination
Digital billboards must be equipped with controls that automatically adjust the intensity of
the display according to natural ambient light conditions. The brightness of the display
must not exceed 0.3 foot-candles over ambient light measurement at a distance of 250
feet from the sign.
The photometric plan indicates the brightness of the display ranges from 0.208 to 0.260
foot-candles at 250 feet from the sign. These calculations are based on the billboard
operating at nighttime with a full white display. Normal operation provides levels typically

50% of the calculated values. Since there are existing residential dwelling units located
within 150 to 250 feet from the sign in the Parkwyn Townhomes development, the
brightness would be monitored to address any effects on the dwellings. The brightness
can be adjusted remotely as necessary.
Permit for nonconformity
The request is being processed as a permit for nonconformity. Approval would be
associated with the sign permit for the digital conversion of the billboard, and approval
does not run with the property in the same manner as a variance. If future improvements
were proposed on the site, compliance with the standards would be evaluated again at
that time.
A public hearing is not required for consideration of a permit for nonconformity.
RECOMMENDATION:
Approve SRB22-0003.

Please find attached an application packet for converting our existing off-premise sign at 8101
Glenview Drive from a traditional printed/static billboard to a digital as allowed under Section 106-
12. Electronic message boards and digital billboards. in the current Building and Land Use
Regulations. Clear Channel Outdoor is the applicant as owner of the legal nonconforming off-
premise billboard situated on property owned by Constance J. Harrison and Tricia Harrison and the
existing lease agreement between Clear Channel Outdoor and the Harrisons recognizes Clear
Channel Outdoor as the permit holder. The sign is on a lot having frontage on U.S. Interstate
Highway Loop 820 and when built will comply with the specified conditions in subsection (b) (1) -
(17), as well as all applicable federal and state requirements.
In addition to meeting the requirements mentioned above, Clear Channel Outdoor agrees to reject
advertising that is for sexually-oriented or adult businesses and any obscene words or pictures. As
is the current practice with digital billboards within the City of North Richland Hills, Clear Channel
Outdoor will provide advertising space on available spots for city messaging at no cost to the city.

The Fonuetoo Digital Billboard System offers features which enable Billboard operators to
comply with variable ordinance requirements. Below are the methodologies in vvNioh the
Formetoo software can provide billboard operators the ability toadapt to the specific
requirements within their zoning market and operate within the specific guidelines that are
established within each municipality.
Valid artwork file extension types for upload to the scheduling platform include:
]PEG, PNG, BMP.TIFF and KTD
These files types prevent the sign,from displaying any content that may flash, twinkle, blink or
show any animation.
Transitions between messages are instant and seamless and occur over the entire face of the
sign.
Brightness—I liumination of the sign is closely monitored. Each sign is preset at the factory for

Sighs are tested at FULL White. A factory set configuration table limits the upper and
lower end brightness.
Each sign face has an onboard photocell that provides automatic brightness changes based on
ambient light conditions at the face. Two additional safeguards are in place to monitor the
proper brightness level of the sign. Each face has its Latitude and Longitude recorded. Upon loss
of signal from the photocell, the sign will diem based on a sunrise sunset schedule. If the control
system for the face loses framing data from the player PC, the sign goes dark based on a
configuration timer.This is typically set at 1 minute, In normal daily operation,the sign face
would transition from 100% of maximum operating levels to as low as 3% depending on light
levels monitored by the photocell.
Post installation, a technician will verify the ambient light conditions applicable to the local
ordinances,An Extech light meter is used to verify the night time ambient conditions.Typical
factory settings provide for less than a 0.3 foot candle measurement at distances appropriate
for the signs square footage. Brightness levels can be remotely adjusted as needed.
In addition to the above-mentioned software/firmware precautions that monitorthe brightness
settings, onboard diagnostics alert operators to system problems via email notification.The
system,will also be equipped with a remote controllable power control repay that enables
operators to remotely shut all power down to the face,

GAIT— Isthe brightness of the light point at the source. Standard practices set the nighttime
maximum operating level at 300 NIT.This value is based on the unit operating at with a full
white display or worse possible conditions. Normal operation would' provide levels typically 50%
of the charted values,
FootCandle—The amount of light cast from the source in each location. Foot Candle
measurements are taken by turning the unit off to see the ambient light in an area with the
meter. The unit is then turn on fully white to calculate the difference value. Values represented
in,the study are based on the sign only, existing ambient light would be,added to the value.
Ambient light comes from many existing sources in the area.
