PRESENTER: Alicia Richardson, City Secretary/Chief Governance Officer SUMMARY: City Council is required to canvass the votes of the City Council Special Election held on November 8, 2022. Resolution No. 2022-049, formally accepts the results of the election and declares the winning candidate. GENERAL DESCRIPTION: The Texas Election Code requires that the City Council meet after the Special Election to canvass the results of the election. The governing body shall canvass the election results no earlier than the third (3rd) day after the election and no later than the fourteenth (14t") day after the election. The canvassing period began November 11 and ends on November 22. The period during which the Early Voting Ballot Board shall meet is November 11-21. Tarrant County will provide the city's unofficial results no later than November 22. The above results could potentially change prior to canvass. If the ballots are returned in accordance with state law and the Early Voting Ballot Board qualifies the ballots, the "I r*4W NOLa`C`H KIC"HLAND HILLS unofficial results will be updated to reflect any changes. Should there be any changes; City Council will be provided the revised unofficial results and a revised resolution prior to the canvass. Recommendation: Approve Resolution No. 2022-049, as presented at the meeting. RESOLUTION NO. 2022-049 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, CANVASSING THE ELECTION RESULTS OF THE NOVEMBER 8, 2022 SPECIAL ELECTION FOR AN UNEXPIRED TERM ON CITY COUNCIL, PLACE 5; AND DECLARING A CANDIDATE ELECTED TO OFFICE. WHEREAS, the City of North Richland Hills, Texas ("City") is a home rule city acting under its charter adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Local Government code; and WHEREAS, the City of North Richland Hills Charter provides that city elections shall be held in accordance with laws of the State of Texas; and WHEREAS, Section 41.001(a) of the Texas Election Code, provides for authorized uniform election dates in which an election in Texas can be held; and WHEREAS, the Texas Election Code provides that the governing body of a municipality shall be the authority to order a Special Election for the purposes of electing members to the governing body to fulfill a vacancy; and WHEREAS, the City Council approved Resolution No. 2022-035, calling the Special Election of November 8, 2022 for the purpose of electing a council member to serve on the City Council in Place 5 (unexpired term); and WHEREAS, an election was duly held in the City of North Richland Hills on the 8t" day of November, 2022; and WHEREAS, the City Council has met to canvass the votes in such election and accept the tabulations provided by Tarrant County Elections Administrator (Exhibit A). Section 2: The following is, and the same is hereby declared to have been elected to the office listed below to serve until May of 2023, or until a successor has been duly elected and qualified.
