HomeMy WebLinkAboutOrdinance 0449 ORDINANCE NO. 449 AN ORDINANCE GRANTING AN EXEMPTION OF THREE THOUSAND ($3,000.00) DOLLARS OF ASSESSED VALUE, FOR AD VALOREM TAX PURPOSES TO ALL PERSONS SIXTY FIVE (65) YEARS OF AGE OR OLDER, UNDER CERTAIN CONDITIONS. WHEREAS, Article XIII, Section 1-b of the Texas Constitution as arnended and approved by the citizens of Texas by vote on Novernber 7, 1972, enables the governing body of a city, frorn and after January 1, 1973, to exernpt, by its own action, not less than Three Thousand ($3,000.00) Dollars of the assessed value of residential hornesteads of persons sixty five (65) years of age or older frorn all ad valorern taxes thereafter levied by such ci ty; and WHEREAS, the City Council of the City of North Richland Hills, Texas, has deterrnined that because of the financial burden of the aged, who for the rnost part are on fixed incornes, it would be in the best interest of the City and its citizenry to grant such exernption, NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, That there shall be exernpt frorn city ad valorern taxes for the year 1973, and all subsequent years where the City Council by resolution so provides, the surne of Three Thousand ($3,000.00) Dollars frorn the assessed value of any exclusively residence hornestead, within the city, occupied by a owner sixty five (65) years of age or older, as of January 1 of each tax year, on the following terrns and conditions: 1. To qualify for such exernption, the property rnust be clairned as (hornestead) for state and county ad valorern tax purposes. 2. A single person rnay qualify. 3. The person clairning the exernption must own at least one-half (1/2) interest (legal or equitable) in the property, or own sarne jointly or in cornrnon with a spouce, child, brother, or sister. 4. The person clairning the exernption rnust have been a resident of the City of North Richland Hills, Texas, for at least one (1) year as of January 1 of each tax year. 5. No exernption shall be allowed until all delinquent taxes, assessrnents, penalties, and interest against the property shall have been paid in full. 6. No exernption shall be allowed unless the property is used exclusively for residential purposes. 7. No exernption shall be or becorne effective unless there shall have been filed in the office of the Tax Assessor-Collector of the City of North Richland Hills, Texas, between January 1 and April 30 of the current taxed year, an affidavit clairning such exernption, on a forrn suitable to the City Tax Assessor-Collector, together with such reasonable proof of ownership and age as rnay be required, provided however such affidavit rnay be filed within one hundred twenty (120) days of the passage of this ordinance, even though such date exceeds April 30 of the tax year 1973. Any person or persons who shall willfully rnake false affidavit for the purpose of clairning the exernption herein granted, shall be guilty of a rnisderneanor and shall be liable to a fine of not rnore than Two Hundred ($200.00) Dollars, and further, shall be liable to the city for the taxes, plus ten (10%) per cent penalty and six (6%) per cent interest thereon, which would have been due and payable if the exernption would not have been allowed had the affidavit not been false. If any section, paragraph, subdivision, clause, phrase, or provision of this ordinance shall be adjudged invalid or held unconstitutional, the sarne shall not affect the validity of this ordinance as a whole or any part or provision thereof other than the part so decided to be invalid or unconstitutional. The City Secretary is hereby directed to publish the cornplete text of this ordinance at least twice, in the official newspaper of the city. This ordinance shall take effect and be in full force and effect frorn and after the date of its passage, and it is so ordained.
