Mr. Husband informed City Council the applicant is requesting a variance to Chapter 114 (vegetation) of Code of Ordinances for 1.65 acres located at 4525 City Point Drive. The current zoning is C.2 (commercial). Mr. Husband provided site photos of the property. Applicant representative Joe LaCroix, with Baird, Hampton & Brown, presented the request. Mr. LaCroix informed the Board they are combining two lots and expanding the parking by approximately 60 parking spaces to include, landscaping improvements and a screening wall. Mr. LaCroix continued that there are approximately 23 existing trees close to the common property line to existing neighbors. The applicant is trying to be a good neighbor and does not want to remove all the trees. They are requesting a screening wall about 20 feet out from the property line. The property has utility easements in this same area. Mr. LaCroix stated that in order to put in the fence, all the trees must be removed and the applicant did not feel it was necessary to remove the existing trees. He would like to keep the existing hackberry trees. Mr. LaCroix was available to answer questions from the Board. The Board, applicant and staff discussed concern about the responsibility of the landscape maintenance between the wall and the existing chain link fence; the required masonry screening wall complying with code; the addition of some trees and the applicants intent to leave it natural and preserve the existing greenscape; irrigation requirements; screening wall location as related to both properties; underground storm water; and citizen safety with the area between the wall and chain link fence. Mr. Husband presented a summary of the variance.The applicant is requesting a August 08, 2022 Landscape Review Board Meeting Minutes Page 2 of 4 variance to allow the screening wall to be constructed at a location other than the common property line. The wall would be constructed to follow the western edge of the parking lot, which is curved along the southwest portion of the lot. The distance between the common property line and the wall ranges from approximately 18 to 55 feet. The location of the wall would screen the parking lot from adjacent properties; however, it would not provide complete screening of the commercial property. The applicant is also requesting the existing tree line adjacent to the residential properties count as the required plantings for the buffer yard. There are 23 existing trees in the buffer yard area that include Hackberry (15), Elm (2), Ash (5), and Mulberry (1). All of these trees are deciduous species and would not provide screening during winter months. The landscaping regulations require that one large tree be planted for each 30linear feet of buffer yard area, with at least 40% of the trees being an evergreen species. The buffer yard is 210 feet long, which would require seven (7) trees to be planted. Most of the existing trees would need to be removed to plant the required buffer yard trees. The existing trees are not a species recommended for use in landscaping plans for commercial properties Acting Chair Rodriguez asked the City Secretary to call on those who completed a public meeting appearance form to speak during the public hearing. There being no forms submitted, Acting Chair Rodriguez asked if there was anyone in the audience wishing to speak on the item to come forward. PRESENTER: Clayton Comstock, Planning Director SUMMARY: On behalf of MG Rufe Snow LLC, Franz Architects is requesting a permit for nonconformity in conjunction with a large-scale remodel of an existing shopping center building. The permit for nonconformity would allow improvements to the site to continue without conforming to the current landscaping and buffering standards. The site is located at 5196 Rufe Snow Drive. Since the permit value of the building remodel exceeds 75 percent of the current appraised value of the existing improvements, full compliance with the landscaping standards is required. GENERAL DESCRIPTION: The property under consideration is generally located at the southeast corner of Rufe Snow Drive and Dick Lewis Drive. The subject building is 45,162 square feet in size and located between WinCo Foods and The Shoppes at Crown Point. The site was originally developed as a grocery store in 1984 and was last used as a church. The building is currently vacant. Because development of the site predates the adoption of landscaping and buffering standards, the property is considered legal non-conforming to current landscaping standards. The Landscape Review Board previously approved an alternate landscape plan for the site on November 10, 2014. The current proposed design does not align with that approval, and the applicant proposes an alternative landscape plan for consideration by the Board. Improvements on the property are appraised by the Tarrant Appraisal District (TAD) at $1.5 million. The applicant submitted a building permit to remodel the existing building to retail stores for three new tenants. The value of all work requiring building permits is $2.7 million, almost twice the value of the appraised existing improvements. Since the value of the remodel of the building is more than 75% of the existing improvements value, the general standards of the Vegetation Chapter 114, Article III, Section 114-71 (Landscaping Regulations) apply to this property. The improvements required by the code include a "K NOKTH KICHLAND HILLS minimum landscaped area on the site, landscape setbacks on Dick Lewis Drive, parking lot landscaping, and a masonry screening wall adjacent to Dick Lewis Drive. The table below details the applicable standards and describes the applicant's proposal to mitigate the deficiency. In addition, copies of detailed landscaping plan is attached. DESCRIPTION Remodel of existing building to provide three new retail tenant spaces.Site is being upgraded with new islands and striping. 1. List the pertinent section(s)of the landscaping and buffering regulations and indicate the specific interpretations, variances,or nonconforming use exceptions being requested. State the grounds for the request and describe any special conditions that cause hardships that,in your opinion, justify the variances or exceptions being requested. Explain any usual circumstances, if applicable, that are not considered by the landscaping and buffering regulations. We want to proceed with submitting for nonconforming permit. The reason for the non-conformity at the front is because it is cost prohibitive to run water for irrigation to all the landscape islands. We are adding new landscape islands with landscaping elements,adding curb stops to guide vehicular traffic circulations and improve pedestrian safety, and adding landscape to the front of the building via planters shown. The cost of running irrigation to each island is cost prohibitive and the xeriscaping we have chosen will provide for an improved aesthetic to the property that will look consistent in the future without concern for the droughts and freezes we have experienced in the region over the past several years. Regarding the screening wall, we can't do this with a masonry wall,it is cost prohibitive. PRESENTER: Clayton Husband, Principal Planner SUMMARY: On behalf of JC Pace Ltd, Triangle Engineering is requesting a variance to Chapter 114 (Vegetation) of the North Richland Hills Code of Ordinances. The site is located at 6450 Rufe Snow Drive. The applicant is requesting a variance related to the required buffer yard, masonry screening wall, and parking lot entrance islands. GENERAL DESCRIPTION: The site is located on the east side of Rufe Snow Drive just north of the Mid-Cities Boulevard intersection. The site is north of an existing shopping center and adjacent to single-family residences on Sunset Drive. The property is zoned C-2 (Commercial) and is undeveloped. As part of the review, the DRC noted that the location of the required landscape buffer yard and screening wall between the site and adjacent residential use is encumbered by a 50-foot wide pipeline easement. The applicant discussed possible landscaping and screening wall improvements with the pipeline owner, The Williams Companies, Inc. It was determined that tree plantings and a screening wall could not be constructed within the easement due to the location of the pipeline. As a result, the applicant decided to seek a variance from those standards and request approval of an alternate landscape plan for the site. ANALYSIS The landscaping and buffering standards that apply to this property are found in Article III, Landscaping and Buffering Regulations of Chapter 114 (Vegetation) of the Code of Ordinances. The Development Review Committee (DRC) reviewed the landscape plan for the property as part of the site plan application for the project. The plan meets the requirements of the landscaping and buffering regulations except for the standards described below. The Board may include appropriate conditions as part of the approval of a variance request. The affirmative vote of four Board members is required to approve a variance. A public hearing is required for consideration of a request for variance. Notice of the public hearing was published in the newspaper and mailed to all owners of real property within 200 feet of the site. OPTIONS FOR BOARD CONSIDERATION The Landscape Review Board has the following options on this application. 1. Approve the variance as presented. This action would approve variances to the screening wall, buffer yard, and entrance island standards and allow the landscaping to be constructed as presented. 2. Approve the variance with conditions. This action would approve variances to the screening wall and buffer yard standards, subject to the owner making modifications to the screening wall, buffer yard, and entrance island standards as directed by the Board. An example condition may be the replacement of the existing wood fence with a new wood fence. 3. Deny the variance. This action would require the screening wall, buffer yard, and entrance islands to be installed in compliance with landscaping standards for nonresidential properties. Significant site design modifications would be required to provide the requisite landscape area and materials as well. RECOMMENDATION: Approve LRB22-0003. DESCRIPTION We are requesting a landscaping variance for the rear portion of our property, it is between a commercial property and residential property. Due to the existing gas line in the rear and subsequent easement,we are not able to place the city required landscaping in that area.We have placed additional landscaping on the site between the building and the rear access drive to provide an additional buffer with the neighboring residential properties. In addition to the landscaping variance, we are requesting a variance to place the dumpster along the rear access drive of the property. Due to the current access on the site and the paths that must remain for the total circulation of the shopping center,we are limited to the access points for a dumpster truck on the property.The remainder of the shopping center stores have their dumpsters placed along the rear access drive that face the neighbors as well.
