PRESENTER: Clayton Comstock, Planning Director SUMMARY: At their February 13, 2023 meeting, City Council will consider an ordinance calling for a May 6, 2023 special election for the North Richland Hills voters to consider amendments to the City Charter. The City Charter is a legal document that describes the city's boundaries, form of government and general powers; establishes its administrative structure; establishes the authority for granting of franchises and other functions; and provides for controls such as initiative, referendum, and recall. The North Richland Hills City Charter was originally adopted in 1964 and was last amended in 2001. Pending Council's action on Monday, February 13, city staff may present an overview of the proposed amendments to the existing Charter of the City of North Richland Hills. February 02, 2023 Planning and Zoning Commission Meeting Minutes Page 1 of 9 2 DISCUSS ITEMS FROM THE REGULAR PLANNING AND ZONING COMMISSION MEETING Due to winter weather conditions, the staff reports for the cases were presented during the work session. Mr. Comstock presented the staff report for ZC21-0004. Chair Welborn asked if the project was being proposed as a single phase. Mr. Comstock responded that the zoning request included all lots and that the criteria was met for each lot. Commissioner Stamps asked about the impact of the north building line. Mr. Comstock responded that the adjacent lot was zoned R-7-MF, which would affect the building location on the adjacent lot. Commissioner Stamps and Mr. Comstock discussed the location of parking on the subject property and screening for this parking. Mr. Comstock presented the staff report for ZC22-0044. Chair Welborn asked about commercial occupations and vehicles on the subject property. Mr. Comstock stated that some commercial occupations are allowed on the property as customary home occupations. Commissioner Riscky and Mr. Comstock discussed the frequency of zoning violations due to existing commercial businesses on residential properties. Commissioner Riscky asked if a waiver of the driveway surface could be recommended to City Council. Mr. Comstock responded that the Commission could make these recommendations to City Council as part of their motion. Mr. Comstock presented the staff report for ZC22-0045. Chair Welborn and Mr. Comstock discussed previous City Council actions related to the property. Ex-Officio Ross stated that previous requests for the property included a concrete driveway, which was not included in this request. Ex-Officio Ross asked Mr. Frohman about options for bridging the existing drainage channel. Mr. Frohman responded that grade elevations had not yet been considered or established in the current designs. Ex-Officio Ross and Mr. Comstock discussed the special development plan for the adjacent lot and the parking standards outlined in this plan. Commissioner Stamps asked if the temporary parking area would be able to be developed once the subject lot is complete. Mr. Comstock responded that it would be available for development. PRESENTER: Clayton Husband, Principal Planner SUMMARY: Stuart Threadgold is requesting a zoning change from AG (Agricultural) to R-1 (Single- Family Residential) on 2.0 acres located at 7540 Bursey Road South. GENERAL DESCRIPTION: The property under consideration is a 2.0-acre site located on the south side of the street where Bursey Road South turns to a north-south direction. Adjacent properties include both multi-acreage residential lots and conventional single-family subdivisions (Fair Oaks Estates and Kingswood Estates). The property is developed with a single-family residence. It is unplatted and has 166 feet of frontage on Bursey Road South and is approximately 523 feet deep. The applicant is requesting a zoning change on the property with the intent to plat the property and create two single-family residential lots in a flag-shaped arrangement. The final plat of the property is a related item on the February 16, 2023, agenda (see PLAT23- 0032). LAND USE PLAN: This area is designated on the Land Use Plan as Low Density Residential. This 2.0-acre property is located at 7540 Bursey Road South. GENERAL DESCRIPTION: The property under consideration is a 2.0-acre site located on the south side of the street where Bursey Road South turns to a north-south direction. Adjacent properties include both multi-acreage residential lots and conventional single-family subdivisions (Fair Oaks Estates and Kingswood Estates). The property is developed with a single-family residence. It is unplatted and has 166 feet of frontage on Bursey Road South and is approximately 523 feet deep. During the review of the plat, the Development Review Committee (DRC) discussed the effect that the proposed lot arrangement would have on the property. General characteristics of these neighborhoods include a density of two to six dwelling units per acre and houses of one- and two-stories. The Development Review Committee reviewed this plat on January 31, 2022.The following represents the written statement of the conditions for conditional approval of the plat. 1. Informational. A zoning change application was submitted for this property in conjunction with the subdivision plat. The review of the plat was based in part on proposed zoning of R-1 (Single- Family Residential). NRH Subdivision Regulations§110-384(Conformity with zoning regulations) 2. The proposed southern lot does not conform to the minimum lot frontage standards of the proposed R-1 (Single-Family Residential) J zoning district.The width of the leg on the southern lot must be revised to 50 feet in width for the entire length of the leg in order for the lot to comply with the standards. The zoning ordinance and subdivision regulations could allow for a lot to provide only 50 feet of lot width and street frontage,and this standard has been applied in other flag-shaped lot arrangements. l The Development Review Committee (DRC) cannot support the width l of the leg on the southern lot as proposed.The DRC would support and recommend approval of a waiver of the 50-foot width for the portion of the leg to provide for a minimum six-foot building setback adjacent to the existing house, provided the remainder of the leg complies with the 50-foot width. The purpose is to ensure that the existing structures can satisfy all building setbacks from the new property lines and prevent the house from becoming nonconforming in terms of setbacks. See exhibit to right as a guide. A reduction of the width of the leg may be approved only if a waiver is granted by the Planning and Zoning Commission and City Council to this standard.
