HomeMy WebLinkAboutResolution 2022-045 RESOLUTION NO. 2022-045 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, CREATING A CHARTER REVIEW TASK FORCE AND APPOINTING MEMBERS TO THE TASK FORCE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, The City.Council desires to submit proposed City Charter amendments to the qualified voters of the City; and WHEREAS, Article XVIII Section 21 of the City Charter states that the Charter may not be amended more than once every two years; and WHEREAS, the City's Charter was last amended in 2001; and WHEREAS, The City Council desires to create a Charter Review Task Force to review potential amendments to the Charter. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, THAT: SECTION 1. The City Council hereby establishes a Charter Review Task Force to review and make recommendations to the City Council for amendments to the City's Charter. SECTION 2. The Charter Review Task Force shall be charged with considering possible revisions to the Articles and Sections of the Charter as noted below, determining which of these Articles and Sections require amendment, deletion, or addition, and presenting the Task Force's recommendations to the City Council for the purpose of calling a Charter Amendment Election. a. Article V: City Council. i. Section 1. City Officials. The Task Force is only to consider provisions in this Section related to Open Meetings. ii. Section 2. Qualifications. b. Article VI: Powers and Duties of Officers. i. Section 2. Duties of Mayor-Mayor Pro Tern ii. Section 5. Appointment and Removal of City Secretary. The Task Force is only to consider provisions in this Section related to the Assistant City Secretary. iii. Section 7. Municipal Court c. Article XIV: Planning/Building Regulations. i. Section 1. The Planning and Zoning Commission ii. Section 2. The Planning and Zoning Commission Powers and Duties d. Article XVII: City Civil Service. e. Article XVIII: General Provisions. i. Section 6. Official Newspaper ii. Section 13. Ethics Resolution No.2022-045 Page 1 of 3 f. Remove redundancies, inconsistencies and correct any typographical errors in the Charter. g. Remove or modify language that conflicts with or is preempted by other legislation. SECTION 3. The City Council may amend the charge of the Charter Review Task Force at any time. SECTION 4. The Charter Review Task Force shall consist of three (3) City Councilmembers appointed by the Mayor, and six (6) North Richland Hills citizens appointed by the remaining City Councilmembers. SECTION 5. The meetings of the Charter Review Task Force shall be open to the public and held in accordance with the Texas Open Meetings Act. SECTION 6. The City Council shall have the right to remove or replace members of the Charter Review Task Force at any time if deemed to be in the best interest of the City, without further formal action by the City Council. SECTION 7. The Charter Review Task Force shall serve as an advisory body to the City Council and the City Council may accept, reject, or modify any;all or part of the Charter Review Task Force's recommendations. SECTION 8. The Charter Review Task Force shall complete its review and provide recommendations and a report to the City Council on January 9, 2023, unless such date is modified. The Mayor shall be authorized to modify the date as necessary, without further formal action from the City Council. SECTION 9. The City Council shall make the final determination concerning whether and when to hold a City Charter Amendment election and the propositions to be submitted to the voters at the election. SECTION 10. The following members are hereby appointed to the Charter Review Task Force: SECTION 11. The Charter Review Task Force shall serve at the pleasure of the City Council and shall serve unless or until replaced by the City Council. SECTION 12. The Charter Review Task Force shall cease to exist upon the accomplishment of the purpose for which it was created unless earlier abolished by majority vote of the City Council.
