PRESENTER: Clayton Comstock, Planning Director SUMMARY: On behalf of Torino LLC, Steven Razo, and Vonnie Razo (owners), Barron-Stark Engineers is requesting approval of a final plat of Lots 4-7, Block 1, Tivoli Garden Estates. This 3.06-acre property is located in the 7500 block of Chapman Road. GENERAL DESCRIPTION: The property under consideration is a 3.06-acre site on the north side of Chapman Road at the Holiday Lane intersection. The property is located on the north side of Chapman Drive across from the intersection of Holiday Lane. The property has approximately 410 feet of frontage on Chapman Drive and is approximately 328 feet deep. The property is zoned RI-PD (Residential Infill Planned Development). The zoning was approved by City Council on December 13, 2021 (Ordinance 3719). The primary purposes of the RI-PD district were to limit the subdivision to four lots, provide appropriate setbacks for the context of the area, and restrict the number and location of driveways surrounding the intersection of Chapman Road and Holiday Lane. In keeping with the RI-PD zoning, the proposed plat includes four single-family residential lots. The lots range in size from 24,766 square feet to 33,463 square feet, with a density of 1.3 dwelling units per acre. The lots include a 25-foot front building line, a 30-foot rear building line, and a 55-foot front setback for garages. Two shared driveways are provided on Chapman Road on either side of the Holiday Lane intersection. The driveway locations are established by a 25-foot wide private cross access easements located on the common lines between Lots 4 and 5 and between Lots 6 and 7. LAND USE PLAN: This area is designated on the Vision203O Land Use Plan as Residential Estate. This designation promotes neighborhoods defined by larger single- family lots and homes at a density of less than two (2) units per acre. These neighborhoods are characterized by large lots, rural street design, estate-style fencing, "K NOKTH KICHLAND HILLS barns, and livestock. These properties address a specific market niche and add to the diverse mix of housing and lot options for the community. CURRENT ZONING: The property is zoned RI-PD (Residential Infill Planned Development). The zoning for this property was approved by City Council on December 13, 2021 (Ordinance 3719). TRANSPORTATION PLAN: The development has frontage on the following streets. A right-of-way dedication of approximately 13,988 square feet for Chapman Road is provided on the final plat. CITY COUNCIL: The City Council will consider this request at the April 24, 2023, meeting following action by the Planning and Zoning Commission. DRC REVIEW & RECOMMENDATION: The Development Review Committee (DRC) recommends approval of the plat subject to the attached DRC comments. These comments include revisions to notations and labeling on the drawing, clarification of the right-of-way dedication area, and verification of a required off-site drainage easement dedication. GENERAL DESCRIPTION: The property is located at the northwest corner of Davis Boulevard and Smithfield Road. The property is currently vacant. The applicant proposes to develop a site for a new Starbucks quick service restaurant. The property is located within the TOD Core Character Zone of the Smithfield Transit Oriented Development (TOD) District. This subzone provides the most opportunities for redevelopment and new development in the station area, with a mix of residential and non-residential uses permitted in a building scale of up to four stories in height. The site is located less than one-half mile south of the TEXRail Smithfield Station and across Davis Boulevard from the Traditional Neighborhood Development of HomeTown. A site plan package for the property is attached. Planned improvements to the site include construction of a new 2,200-square-foot building with drive-through service. The TOD district expressly prohibits drive-through facilities; therefore, City Council approval of a Special Development Plan is required. Landscaped areas cover 39% of the lot. PRESENTER: Clayton Comstock, Planning Director SUMMARY: On behalf of Rossmore Enterprises (owner) and Chick-fil-A (developer), Burger Engineering is requesting a special use permit for a quick service restaurant on 1.10 acres located at 6645 NE Loop 820. GENERAL DESCRIPTION: The property is located in the northwest quadrant of NE Loop 820 and Rufe Snow Drive. The site is presently developed with an Applebee's restaurant. The developer proposes to redevelop the site for a new Chick-fil-A quick service restaurant with drive-through service. Site Plan & Land Use A site plan package for the property is attached. Planned improvements to the site include construction of a new 5,100-square-foot building with dual-lane drive-through service. The zoning ordinance requires special use permit approval for a quick service restaurant. In addition, the ordinance includes specific standards for the design and layout of drive- through lanes. The design complies with the standards, except for the drive-through lanes being located between the building and the street (NE Loop 820). Landscaping Proposed landscaped areas cover 13.33% of the lot. This is an increase from the existing 11.37% landscape area, but is less than the minimum 15% landscape area required for all new development. The 15% threshold could be accomplished with the conversion of 3-4 proposed parking stalls to landscape area. Proposed landscape areas include a 15- foot-wide landscape setback adjacent to the NE Loop 820 frontage road, parking lot islands, landscaped areas adjacent to the drive-through lane, and a landscape buffer between the drive-through lane and adjacent parking spaces and driving aisles. Additionally, a 27-foot long, three-foot tall limestone wall would be installed as a "K NOKTH KICHLAND HILLS decorative feature in the landscape setback. This wall is provided as a required hardscape element to comply with the Freeway Corridor landscape standards. Parking, Circulation & Vehicle Access For the size building, a minimum 35 parking spaces are required. The parking lot contains 49 parking spaces and vehicle stacking for approximately 30 cars in the dual drive- through lanes. The site has access to NE Loop 820 frontage road and Rufe Snow Drive through common access easements on the adjacent lots. These easements connect to existing driveways on both roads. There is also a reciprocal parking agreement in place for this shopping center, whereby parking for Chick-fil-A employees and patrons may occur on adjacent properties. Building Signage The sign ordinance permits building signage on only two sides of a building. The applicant has requested approval of building signage on four sides as part of the Special Use Permit. A sign plan is attached. The proposed conditions of approval for this special use permit are attached. Applications for special use permits provide an opportunity to address modifications to specific site development and building design standards for the site. These conditions are based on the applicant's proposed development of the property. These conditions may be modified throughout the public hearing process, but they are subject to final approval by City Council. The SUP standards address land use, landscaping, and signage. LAND USE PLAN: This area is designated on the Land Use Plan as Retail Commercial. This category provides sites for community and regional shopping centers, commercial establishments, and employment centers. CURRENT ZONING: The property is zoned C-2 (Commercial). This district is intended to provide for the development of retail and general business uses primarily to serve the community and region. Uses include a wide variety of business activities and may involve limited outside storage, service, or display. The following regulations shall be specific to this Special Use Permit. Where these regulations conflict with or overlap another ordinance, easement, covenant or deed restriction, the more stringent restriction shall prevail. A. Permitted land uses. A special use permit is authorized for a quick service restaurant on the property. B. Site development standards. Development of the property shall comply with the development standards of the C-2 (Commercial) zoning district and the standards described below. 1. The site improvements must be constructed as shown on the site plan attached as Exhibit „C .11 2. A minimum 13% landscape area is required. Landscaping must be installed as shown on the site plan attached as Exhibit "C." All trees planted on site must be container-grown trees. 3. The drive-through components on the site must comply with Section 118-633(26) of the zoning ordinance and the standard described below. a. The drive-through lane improvements must be constructed as shown on the special use permit exhibit attached as Exhibit "C," including pickup window, lane widths, pavement markings, and menu board locations. b. The drive-through stacking lane may be located on the south side of the building between the building and NE Loop 820 frontage road. c. A solid row of evergreen shrubs must be planted between the drive-through lane and the adjacent driving aisle to screen the area from the street. The screening shrubs must be planted the entire length of the area and be maintained at a height of thirty (30) inches above the grade of the pavement. C. Building design standards. Building design and appearance must comply with the building elevations attached as Exhibit "C" and the standards described below. 1. The quick service restaurant must be at least five thousand (5,000) square feet in floor area. 2. Signs on the site must comply with Chapter 106 (Signs) of the Code of Ordinances and the standards described below. a. Wall signs are permitted on four facades of the building. C. Expiration. The special use permit will expire three (3) years from the effective date of this ordinance. D. Amendments to Approved Special Use Permits. An amendment or revision to the special use permit will be processed in the same manner as the original approval. The application for an amendment or revision must include all land described in the original ordinance that approved the special use permit. E. Administrative Approval of Site Plans. The development is subject to final approval of a site plan package. Site plans that comply with all development-related ordinances, and this Ordinance may be administratively approved by the Development Review Committee. The city manager or designee may approve minor amendments or revisions to the standards provided the amendment or revisions does not significantly: 1. Alter the basic relationship of the proposed uses to adjacent uses; 2. Change the uses approved; 3. Increase approved densities, height, site coverage, or floor areas; 4. Decrease on-site parking requirements; 5. Reduce minimum yards or setbacks; or 6. Change traffic patterns.
