ADJUSTMENT OF THE CITY OF NORTH RICHLAND HILLS, TEXAS
APRIL 22, 2004

The meeting was called to order by Acting Chairman Leslie Jauregui at 7:00 p.m.

CONSIDERATION OF MINUTES OF FEBRUARY 26,2004
APPROVED
Beth Davis, seconded by Chris Putnam, motioned to approve the minutes
of February 26, 2004. The motion was approved (3-0) with Jim Kemp
abstaining from the vote due to his absence of the February 26, 2004
meeting.
ACTING CHAIRMAN LESLIE JAUREGUI EXPLAINED THE VOTING
REQUIREMENTS OF THE ZONING BOARD OF ADJUSTMENT. ANY
REQUEST THAT GOES BEFORE THIS BOARD MUST RECEIVE A SUPER
MAJORITY (75%). THIS BOARD IS A 5 MEMBER VOTING BOARD. FOR
ANY VARIANCE TO PASS IT MUST RECEIVE 4 AFFIMATIVE VOTES.

A PUBLIC HEARING TO CONSIDER A REQUEST FROM HERITAGE CREEK
HOMES FOR A VARIANCE TO NORTH RICHLAND HILLS ZONING
ORDINANCE NO 1874: ARTICLE 6, SECTION 600. A. MASONRY
REQUIREMENT FOR RESIDENTIAL BUILDINGS. THE APPLICANT WOULD
LIKE TO CONSTRUCT ADDITIONAL LIVING SPACE TO THE BACK OF THE
EXISTING HOME. THE MINIMUM REQUIRED PERCENTAGE OF MASONRY
ON AN EXTERIOR RESIDENTIAL WALL SURFACE IS 85 PERCENT. THE
APPLICANT IS REQUESTING A VARIANCE FROM THE MASONRY
REQUIREMENTS ON THE ADDITION TO THE REAR OF THE EXISTING
HOME BY USING JAMES HARDIE PRODUCTS. THE SITE IS LOCATED AT
4320 KEN MICHAEL CT.

Acting Chairman Jauregui opened the public hearing.
Daryl Metts, Heritage Creek Homes, came forward. Mr. Metts stated that he is
representing Martha and Kent Cook who reside at 4320 Ken Michael Court in
North Richland Hills. Mr. Kent has contracted Mr. Metts to do an addition to their
home. The style of brick that is on their home has been out of production since
the 1960's. The closest material that is available is not a close match and it
would be an obvious eyesore. It would not match the size. The brick that is on
the house currently is an awkward size. It is approximately 15 % in. long x 2 in.
tall and not manufactured anymore. The other options after discussing the
circumstances with City Staff would be to go with a similar texture brick.
However, it would be different in size and again less appealing to the eye.
Currently Heritage Creek Homes are building new homes in Wise County with
James Hardie products. It is a concrete fiber material that is not flammable, it is
only 3/8 in. thick. However, it is considered a masonry product. On an addition
of a home of this age, it is a better option. Any other bricks that have been
looked at including cultured stone products are more of an obvious change. Mr.
Kent is prepared in the event that this option is not approved by the Zoning Board
to look at other options. However, a denial may turn Mr. Kent away from adding
onto the home, because Mr. Kent doesn't want something that doesn't look
similar to what he has now.
Ms. Davis asked the applicant if there would be an extended roof line and not just
a flat roof.
Mr. Metts explained that it will be a gabled roof that comes off the original house.
This house is a rectangle at the moment. On the corner of the property beyond
the deck, the structure will come straight out and will be 18 ft. x 36 ft. with a
gable roof. It will have a ridge across the top and a ridge coming straight out and
approximately a 5 ft. x 12 ft. pitch roof. It will match the house.

Acting Chairman Jauregui stated that if the addition comes within 5 ft. or closer
than 5 ft. of the pool, there will need to be some additional engineering. How far
away would the addition be from the pool?
Mr. Metts stated that it was discussed with Mr. Kent and it has been backed off
from the pool 10ft. from the edge of the water.
Beth Davis, seconded by Jim Kemp, motioned to approve BA 2004-03
based on the home being 100 percent masonry and the difficulty of
matching the exterior of the existing home. The motion was approved
unanimously (4-0).

Having no additional business to conduct, the meeting adjourned at 7:10 p.m.
